<official-title>To strengthen and enhance the prevention and prosecution of crimes using weapons of mass destruction, and for other purposes.</official-title>

<section section-type="section-one" id="H7A3ED559A5274E8FBF07324C535D06D7" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Weapons of Mass Destruction Prohibition Improvement Act of 2004</short-title></quote>.</text></section> 
<section id="HE5F713E55A264C35BBB027A9ADF4ADC9"><enum>2.</enum><header>Weapons of mass destruction</header> 
<subsection id="HA3CE9E9D2FCC49BB996E4D45EDB16533"><enum>(a)</enum><header>Expansion of jurisdictional bases and scope</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2332a">Section 2332a</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H25D94086D0614CB3BA32FB92422FC257"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="HE2B5829FCC6F4AC294D5D8811B3447DC"><enum>(A)</enum><text>by striking paragraph (2) and inserting the following:</text> 
<quoted-block id="H4B75EE11C07C4B4CB7373CBA272C41E7"> 
<paragraph id="HDAEB8E52AC8D4D35A3FDC001CC93BA7"><enum>(2)</enum> 
<subparagraph display-inline="yes-display-inline" id="H180C8542894B41219F41FF8B7264B7D5"><enum>(A)</enum><text>against any person or property within the United States, and—</text></subparagraph> 
<subparagraph indent="up1" id="H4D55F1DAD4FA4D2398EC8F141C9BB0EA"><enum>(B)</enum> 
<clause display-inline="yes-display-inline" id="H962BFE36FDB64CF88F9571D99400009C"><enum>(i)</enum><text>the mail or any facility of interstate or foreign commerce is used in furtherance of the offense;</text></clause> 
<clause indent="up1" id="H0E3D7B43EE614B8281B728A82CAF58CC"><enum>(ii)</enum><text>such property is used in interstate or foreign commerce or in an activity that affects interstate or foreign commerce;</text></clause> 
<clause indent="up1" id="HB1A4C3EF8AFF4BFF85FA4E2C13891919"><enum>(iii)</enum><text>any perpetrator travels in or causes another to travel in interstate or foreign commerce in furtherance of the offense; or</text></clause> 
<clause indent="up1" id="HB9D61CCD6C8E42B684282C30CE032184"><enum>(iv)</enum><text>the offense, or the results of the offense, affect interstate or foreign commerce, or, in the case of a threat, attempt, or conspiracy, would have affected interstate or foreign commerce;</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H5198D2A96BE94D83AAF48971FCE9141C"><enum>(B)</enum><text>in paragraph (3), by striking the comma at the end and inserting <quote>; or</quote>; and</text></subparagraph> 
<subparagraph id="H6F1A2650E78B44F8861F59BE48DF24E"><enum>(C)</enum><text>by adding at the end the following:</text>

<subparagraph id="HB200B6D021934F2C8900E8BD3E5D8901"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph>

<subsection id="H03A0E72FA3DD47FE9354924400DE49A7"><enum>(b)</enum><header>Restoration of the coverage of chemical weapons</header> 
<paragraph id="HF98BBE78689F403E96BE7D7FFA1A770"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2332a">Section 2332a</external-xref> of title 18, United States Code, as amended by this Act, is further amended by—</text> 
<subparagraph id="H87E2AA3E91444DB6B73977AC5226B470"><enum>(A)</enum><text>in the section heading, by striking <quote><header-in-text>certain</header-in-text></quote>;</text></subparagraph> 
<subparagraph id="H0904F8C919614C4484AD00EC495E2783"><enum>(B)</enum><text>in subsection (a), by striking <quote>(other than a chemical weapon as that term is defined in section 229F)</quote>; and</text></subparagraph> 
<subparagraph id="H04939C025F8F4021A2A0EA7200D27715"><enum>(C)</enum><text>in subsection (b), by striking <quote>(other than a chemical weapon (as that term is defined in section 229F))</quote>.</text></subparagraph></paragraph> 
<paragraph id="H5311D395B29D4E71A72C63F102E4E27F"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">chapter 113B</external-xref> of title 18, United States Code, is amended in the matter relating to section 2332a by striking <quote>certain</quote>.</text></paragraph></subsection> 
<subsection id="H80062AD187474F96B3D12254ACC879F"><enum>(c)</enum><header>Expansion of categories of restricted persons subject to prohibitions relating to select agents</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/175b">Section 175b(d)(2)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="HA2640454570D44E6AA418C7173B0003B"><enum>(1)</enum><text>in subparagraph (G)—</text> 
<subparagraph id="HB350B741EA384E1DAA05DC3B95E07E87"><enum>(A)</enum><text>by inserting <quote>(i)</quote> after <quote>(G)</quote>;</text></subparagraph> 
<subparagraph id="H5B7BB33BAAD94E588346F2A02310983C"><enum>(B)</enum><text>by striking <quote>or</quote> after the semicolon; and</text></subparagraph>

<subsection id="HE962C462CB6C4CADA9B8558EAE72FA7E"><enum>(d)</enum><header>Conforming amendment to regulations</header> 
<paragraph id="H1CAB5572E71F45629931A7DDC9E78CB"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/175b">Section 175b(a)(1)</external-xref> of title 18, United States Code, is amended by striking <quote>as a select agent in Appendix A</quote> and all that follows through the period and inserting <quote>as a non-overlap or overlap select biological agent or toxin in sections <external-xref legal-doc="usc" parsable-cite="usc/42/73">73.4</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/42/73">73.5</external-xref> of title 42, Code of Federal Regulations, pursuant to section 351A of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name>, and is not excluded under sections 73.4 and 73.5 or exempted under <external-xref legal-doc="cfr" parsable-cite="cfr/42/73.6">section 73.6</external-xref> of title 42, Code of Federal Regulations.</quote>.</text></paragraph> 
<paragraph id="HCACAD0C78FD3402A86CCCBB500435153"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect on the date that sections 73.4, 73.5, and 73.6 of title 42, Code of Federal Regulations, become effective.</text></paragraph></subsection></section> 
<section id="H030D2D704CF74DCC00A0E738DC1F25FA"><enum>3.</enum><header>Participation in nuclear and weapons of mass destruction threats to the United States</header> 
<subsection id="H0556C9ECF2B34224BFF36BB9C5C73D0"><enum>(a)</enum><header>Atomic energy Act</header><text>Section 57(b) of the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/2077">42 U.S.C. 2077(b)</external-xref>) is amended by striking <quote>in the production of any special nuclear material</quote> and inserting <quote>or participate in the development or production of any special nuclear material or atomic weapon</quote>.</text></subsection> 
<subsection id="H1F64C8B834D141A59007BBD8A38FFAE"><enum>(b)</enum><header>Nuclear weapon and WMD threats</header> 
<paragraph id="H03B02652700D4321BF4CB9BBF6172B2"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/39">Chapter 39</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<section id="H490511F4657C4F378C01D4651D6C8840"><enum>838.</enum><header>Participation in nuclear and weapons of mass destruction threats to the United States</header> 
<subsection id="H4C74994486AF48C3A2D046E060B6A0CB"><enum>(a)</enum><header>In general</header><text>Whoever, within the United States, or subject to the jurisdiction of the United States, willfully participates in or provides material support or resources (as that term is defined under section 2339A) to a nuclear weapons program, or other weapons of mass destruction program of a foreign terrorist power, or attempts or conspires to do so, shall be imprisoned for not more than 20 years.</text></subsection> 
<subsection id="H75AEC952A96D4D1CAFBED1EA1B26D783"><enum>(b)</enum><header>Jurisdiction</header><text>There is extraterritorial Federal jurisdiction over an offense under this section.</text></subsection> 
<subsection id="H55B7920D714149D1ABA2CF53D0021B41"><enum>(c)</enum><header>Definitions</header><text>As used in this section—</text> 
<paragraph id="H38AFE9A8D3C44B79815862D0A21D5151"><enum>(1)</enum><header>Foreign terrorist power</header><text>The term <term>foreign terrorist power</term> means a terrorist organization designated under section 219 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>), or a state sponsor of terrorism designated under section 6(j) of the <act-name parsable-cite="EAA79">Export Administration Act of 1979</act-name> (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2405">50 U.S.C. App. 2405</external-xref>), or section 620A of the <act-name parsable-cite="FAA61">Foreign Assistance Act of 1961</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>).</text></paragraph> 
<paragraph id="H7D199AADA7454ECEAC545CE70062E8E1"><enum>(2)</enum><header>Nuclear weapon</header><text>The term <term>nuclear weapon</term> means any weapon that contains or uses nuclear material (as that term is defined under section 831(f)(1)).</text></paragraph> 
<paragraph id="HB181A7ADC90044608F62DFF83DB22394"><enum>(3)</enum><header>Nuclear weapons program</header><text>The term <term>nuclear weapons program</term> means a program or plan for the development, acquisition, or production of any nuclear weapon or weapons.</text></paragraph> 
<paragraph id="H29EE8B24FC6F4CA7A1A8F744297400AC"><enum>(4)</enum><header>Weapons of mass destruction program</header><text>The term <term>weapons of mass destruction program</term> means a program or plan for the development, acquisition, or production of any weapon or weapons of mass destruction (as that term is defined in section 2332a(c)).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H730B5F46675644A0A9E1C8703B432C6F"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/39">chapter 39</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>
