<official-title>To provide assistance for the current crisis in the Darfur region of Sudan and to facilitate a comprehensive peace in Sudan.</official-title>

<section id="H6F0CFAAC96B4456F813787ACA0D4BBB3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Comprehensive Peace in Sudan Act</quote>.</text></section> 
<section id="HB949C8BF115F4011ACB9E111F35E5379"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H64A0A10846904FBDA4C7D296BDBBC06"><enum>(1)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means the Committee on International Relations of the House of Representatives and the Committee on Foreign Relations of the Senate.</text></paragraph> 
<paragraph id="H1981B222CE3F4922B55768007D0245E3"><enum>(2)</enum><header>JEM</header><text>The term <term>JEM</term> means the Justice and Equality Movement.</text></paragraph> 
<paragraph id="H133E3307D4154932A26648934C9CD076"><enum>(3)</enum><header>SPLM</header><text>The term <term>SPLM</term> means the Sudan People’s Liberation Movement.</text></paragraph> 
<paragraph id="H86B582CD69ED422389003F6F39EB3625"><enum>(4)</enum><header>SLA</header><text>The term <term>SLA</term> means the Sudan Liberation Army.</text></paragraph> 
<paragraph id="HF4DC597906684302B6747E13865CF9E7"><enum>(5)</enum><header>Government of sudan</header><text>The term <term>Government of Sudan</term> means the National Islamic Front government in Khartoum, Sudan, or any successor government formed on or after the date of the enactment of this Act (other than the coalition government agreed upon in the Nairobi Declaration on the Final Phase of Peace in the Sudan).</text></paragraph></section> 
<section id="H8CC8089936424193B296BB36FDB43C73"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> 
<paragraph id="H120BEEE5E319494EB5CAF42EAF91D175"><enum>(1)</enum><text>Since seizing power through a military coup in 1989, the Government of Sudan has repeatedly attacked and dislocated civilian populations in southern Sudan in a coordinated policy of ethnic cleansing that cost the lives of over 2,000,000 people and displaced more than 4,000,000 people.</text></paragraph> 
<paragraph id="H159A1F688669457F820856E1BCDDF673"><enum>(2)</enum><text display-inline="yes-display-inline">The Governments of the United States, the United Kingdom, and Norway have each committed significant resources to promote an internationally supported peace process between the Government of Sudan and the Sudan People’s Liberation Movement (SPLM), under the auspices of the Inter-Governmental Authority on Development.</text></paragraph> 
<paragraph id="H7A4A32772250453BB42B84A574E1AC74"><enum>(3)</enum><text>Following the signing of the Machakos Agreement in July 2002, the Government of Sudan and the SPLM reached a number of important agreements on issues such as self-determination, security arrangements, and wealth and power sharing, culminating in the final framework agreement, the Nairobi Declaration on the Final Phase of Peace in the Sudan, signed on June 6, 2004.</text></paragraph> 
<paragraph id="HAADE1F6F08C945D0A150EA8382DF2284"><enum>(4)</enum><text>Despite efforts to negotiate a settlement between the Government of Sudan and the SPLM, a conflict between forces of the Government of Sudan, including militia forces backed by the Government, and rebel forces (the Sudan Liberation Army (SLA) and the Justice and Equality Movement (JEM)) in the impoverished Darfur region of western Sudan, began in early 2003 and has resulted in attacks by ground and air forces of the Government of Sudan against innocent civilians and undefended villages in the region.</text></paragraph> 
<paragraph id="H9245300988B84002A0DD2CB382FAC2F3"><enum>(5)</enum><text>The United Nations estimates that 2,200,000 people are conflict-affected in the Darfur region and neighboring Chad, 1,200,000 people have been internally displaced, 200,000 people have fled into Chad, and 50,000 people have been killed.</text></paragraph> 
<paragraph id="H863A7D38352E40269275B8870948C325"><enum>(6)</enum><text display-inline="yes-display-inline">The United States Agency for International Development projects that the violence and the obstruction of the delivery of food, shelter, and medical care to people of Darfur will result in the death of an estimated 320,000 people between April 1, 2004, and December 31, 2004.</text></paragraph> 
<paragraph id="H52195C344DE140D888C122A8AF7990F3"><enum>(7)</enum><text>Sudanese Government forces and government supported militia forces have also engaged in the use of rape as a weapon of war, the abduction of children, the destruction of food and water sources, and the deliberate and systematic manipulation and denial of humanitarian assistance for the people of the Darfur region.</text></paragraph> 
<paragraph id="H4C55877839B74411B3E3E448A22B243D"><enum>(8)</enum><text>The United Nations High Commissioner for Human Rights identified <quote>massive human rights violations in Darfur perpetrated by the Government of Sudan and the Janjaweed, which may constitute war crimes and/or crimes against humanity</quote>.</text></paragraph> 
<paragraph id="H05717CB707E5496CBF757B08BFED53F"><enum>(9)</enum><text>The United Nations Special Rapporteur on Extrajudicial, Summary or Arbitrary Executions stated in a recent report to the United Nations Sub-Commission on Human Rights that <quote>[i]t is beyond doubt that the [G]overnment of Sudan is responsible for extrajudicial and summary executions of large numbers of people over the last several months in the Darfur region</quote>, and that <quote>[t]he current humanitarian disaster unfolding in Darfur, for which the government is largely responsible, has put millions of civilians at risk</quote>.</text></paragraph> 
<paragraph id="H4630733682094135815B8DD0342FEB84"><enum>(10)</enum><text>The Department of State, in a press briefing on June 24, 2004, stated, as of the time of the briefing: <quote>301 villages in Darfur have been destroyed and 76 have been damaged. There have been crops burned, killed or stolen cattle, and destroyed irrigation systems.</quote>.</text></paragraph> 
<paragraph id="HE316DBC1CBA044E7B9BC8937DB07F60"><enum>(11)</enum><text>Attacks on civilians in the Darfur region continue despite an April 8, 2004, temporary cease-fire agreement reached between the Government of Sudan and the JEM and SLA rebel groups in N’Djamena, Chad.</text></paragraph> 
<paragraph id="H24FA88C11DF0440C9276022EBBB38D01"><enum>(12)</enum><text>On July 22, 2004, the United States House of Representatives and Senate both declared that the atrocities unfolding in Darfur, Sudan are genocide.</text></paragraph> 
<paragraph id="HD07635E1BA8B4F78B78045FF3994BC04"><enum>(13)</enum><text>On September 9, 2004, Secretary of State Colin L. Powell stated before the Senate Committee on Foreign Relations: <quote>When we reviewed the evidence compiled by our team, along with other information available to the State Department, we concluded that genocide has been committed in Darfur and that the Government of Sudan and the jinjaweid bear responsibility—and genocide may still be occurring.</quote> </text></paragraph> 
<paragraph id="H7ACD74D8B9324721B4AB92899E041C77"><enum>(14)</enum><text>On July 30, 2004, the United Nations Security Council passed Resolution 1556, calling upon the Government of Sudan to disarm the Janjaweed militias, apprehend and bring to justice Janjaweed leaders and their associates who have incited and carried out violations of human rights and international humanitarian law, as well as other atrocities in the Darfur region.</text></paragraph> 
<paragraph id="H6C7945BA42004190AB6B31BB4779DB5F"><enum>(15)</enum><text>The cooperation and mediation of the SPLM is critical to bringing about a political settlement between the Government of Sudan, the SLA, and the JEM.</text></paragraph> 
<paragraph id="H4A776D360FCF4EE4AE68967600D40778"><enum>(16)</enum><text>Practical implementation of a comprehensive peace agreement for Sudan, as envisioned in the Sudan Peace Act (50 <external-xref legal-doc="usc" parsable-cite="usc/12/1701">12 U.S.C. 1701</external-xref> note), and in the Machakos Protocol of 2002, is hampered by the ongoing violence in the Darfur region and by the Government of Sudan’s complicity in the violence.</text></paragraph> 
<paragraph id="H0031ADEE0A314E48AC1E9CE47D309018"><enum>(17)</enum><text display-inline="yes-display-inline">The final framework peace agreement between the Government of Sudan and the SPLM is at great risk of collapse. Since the signing of the Nairobi Declaration on the Final Phase of Peace in the Sudan, the Government of Sudan has frustrated the process of the Inter-Governmental Authority on Development by pursuing delay tactics and raising new issues in the negotiations.</text></paragraph> 
<paragraph id="H30E6D1A21402450283BEA1F7E979069"><enum>(18)</enum><text>Moreover, the Government of Sudan’s complicity in the atrocities in the Darfur region raises fundamental questions about the Government of Sudan’s commitment to peace and stability in Sudan.</text></paragraph></section> 
<section id="H609688B782EB466B86A31586E4738B14"><enum>4.</enum><header>Sense of Congress regarding genocide and the conflict in Darfur, Sudan</header> 
<subsection id="H97FA9A79BC6A4FBDBDE2BD9AB7C513D"><enum>(a)</enum><header>Sudan Peace Act</header><text>It is the sense of Congress that the Sudan Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) remains relevant and should be extended to include the Darfur region of Sudan.</text></subsection> 
<subsection id="HE44501464E8342BE9257428C146E521D"><enum>(b)</enum><header>Actions to address genocide and the conflict in darfur</header><text>It is the sense of Congress that—</text> 
<paragraph id="HBAA17FAC02AC438690AA1CF0099CF6C9"><enum>(1)</enum><text>the atrocities unfolding in the Darfur region of Sudan are genocide;</text></paragraph> 
<paragraph id="HB30DD5ADB71F4A29AD7CF3A85864DE48"><enum>(2)</enum><text>the Government of Sudan has violated the Convention on the Prevention and Punishment of the Crime of Genocide, signed at Paris on December 9, 1948, to which it is a contracting party, as a result of its complicity in the violence in the Darfur region; </text></paragraph> 
<paragraph id="HA0DDFF9D2CC84E518200434C87278300"><enum>(3)</enum><text display-inline="yes-display-inline">a legitimate countrywide peace in Sudan will only be possible if the principles enumerated in the 1948 Universal Declaration of Human Rights, the Machakos Protocol of 2002, and the Nairobi Declaration on the Final Phase of Peace in the Sudan are applied to all of Sudan, including the Darfur region;</text></paragraph> 
<paragraph id="H74327EA47B564641B7A612C05E1900A9"><enum>(4)</enum><text display-inline="yes-display-inline">the parties to the Humanitarian Ceasefire on the Conflict in Darfur (the Government of Sudan, the SLA, and the JEM), signed in N'Djamena, Chad, on April 8, 2004, must meet their obligations under that agreement, including—</text> 
<subparagraph id="H895D8FC3739B4FCF878512FD744AF80"><enum>(A)</enum><text>to give up the use of force as a means of settling the conflict in the Darfur region;</text></subparagraph> 
<subparagraph id="H2BB23C116B8844BB8B54FFFEEAC99D5B"><enum>(B)</enum><text>to allow safe and immediate access of all humanitarian assistance throughout the Darfur region; </text></subparagraph> 
<subparagraph id="HD1027C9F7EA44D42A8434EBAAF857EDB"><enum>(C)</enum><text>to allow the deployment of and cooperate with international monitors and security forces; and </text></subparagraph> 
<subparagraph id="HCC1F1D76BDC54224AC8999954605A7F1"><enum>(D)</enum><text>to expedite the conclusion of a political agreement to end the conflict in the Darfur region;</text></subparagraph></paragraph> 
<paragraph id="HE33CCEFAFD4847C88228D838DFE62E1F"><enum>(5)</enum><text display-inline="yes-display-inline">the President should impose targeted sanctions on the assets and activities of those Sudanese Government officials and other individuals who are determined to be involved in carrying out or otherwise involved in the policy of genocide in the Darfur region, as well as on the assets and activities of businesses controlled by the Government of Sudan and the National Congress Party; </text></paragraph> 
<paragraph id="H7684BE99ED5E4B20B791632DB61E50E1"><enum>(6)</enum><text>the United States Government should not normalize relations with Sudan, including through the lifting of any sanctions, until the Government of Sudan agrees to and implements a comprehensive peace agreement for all areas of Sudan, including the Darfur region;</text></paragraph> 
<paragraph id="HF149B7A969AE46A9953D47C0CC9D91E0"><enum>(7)</enum><text display-inline="yes-display-inline">the United States and the international community should use all necessary means to assist international monitors and security forces in the Darfur region, particularly the African Union monitoring team, in order to ensure an appropriate international humanitarian response to, and the protection of human life and human rights in, the Darfur region;</text></paragraph> 
<paragraph id="H36EC655156E64868008FC6AEAA5A551"><enum>(8)</enum><text>the United States should continue to provide humanitarian assistance to the areas of Sudan to which the United States has access;</text></paragraph> 
<paragraph id="H43FC38C20B624C33B100A2C8205118D0"><enum>(9)</enum><text>the member states of the United Nations, particularly the member states from the African Union, the Arab League, and the Organization of the Islamic Conference, should undertake measures to prevent the genocide in the Darfur region from escalating further, including the imposition of targeted sanctions against those responsible for the atrocities;</text></paragraph> 
<paragraph id="HCCB5A2C663F94B24AB647DE546D57C37"><enum>(10)</enum><text>in the areas of Sudan to which humanitarian access by the United States is obstructed or denied, the United States should provide humanitarian assistance through nongovernmental organizations, regardless of opposition to such assistance by the Government of Sudan; and</text></paragraph> 
<paragraph id="H1FEA2B737AD54176A3104937CE861001"><enum>(11)</enum><text>the international community, including African, Arab, and Muslim nations, should immediately provide logistical, financial, in-kind, and personnel resources necessary to save the lives of hundreds of thousands of individuals in the Darfur crisis; </text></paragraph> </subsection></section> 
<section id="HD60B483C537041B2BEC3ECF14F96D89D"><enum>5.</enum><header>Disclosure of business activities in Sudan</header> 
<subsection id="H9238785EA0FD4202B53E9C55B3D9C1D6"><enum>(a)</enum><header>Annual report to Congress</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall, not later than 6 months after the date of the enactment of this Act, and not later than the end of each 1-year period thereafter, submit to the Congress a report that includes—</text> 
<paragraph id="H35B708A8B95D45D7A30067F6FA62006E"><enum>(1)</enum><text>the identity of all entities that are engaged in commercial activity in Sudan;</text></paragraph> 
<paragraph id="H80EBF7EC8DD3486881C9D8FFA711D7D1"><enum>(2)</enum><text>the nature and extent of that commercial activity in Sudan, including any plans for expansion or diversification;</text></paragraph> 
<paragraph id="H40851A1113E146DE912900015C79AB6E"><enum>(3)</enum><text>the identity of all agencies of the Sudanese Government with which any such entity is doing business; and</text></paragraph> 
<paragraph id="HD5139138866C4CDDB9E587B09E02381E"><enum>(4)</enum><text>the relationship of the commercial activity to any violations of religious freedom and other human rights in Sudan.</text></paragraph> </subsection> 
<subsection id="HFEB715000A4D4CAD8FE26168A39248E3"><enum>(b)</enum><header>Disclosure to the public</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall publish or otherwise make available to the public each report submitted under subsection (a).</text></subsection> </section> 
<section id="H0405594667374176A316C9444000B5A"><enum>6.</enum><header>Prohibition on trading in United States capital markets</header> 
<subsection id="H2516D35F89C8412783BC3646187E157D"><enum>(a)</enum><header>Prohibition</header><text>The President shall exercise the authorities he has under the International Emergency Economic Powers Act (without regard to the requirements set forth in section 202 of that Act) to prohibit any entity engaged in any commercial activity in Sudan—</text> 
<paragraph id="H822C2A0101394AAE82815E2CA5780226"><enum>(1)</enum><text>from raising capital in the United States; or</text></paragraph> 
<paragraph id="H0EC87A9610CE4A359FB1CDF3D5C047FA"><enum>(2)</enum><text>from trading its securities (or depository receipts with respect to its securities) in any capital market in the United States.</text></paragraph></subsection> 
<subsection id="HB15142135A204A08B435D53509BDBE03"><enum>(b)</enum><header>Penalties</header><text display-inline="yes-display-inline">The penalties under section 206 of the International Emergency Economic Powers Act shall apply to violations under subsection (a) to the same extent as such penalties apply to violations under that Act.</text></subsection></section> 
<section id="H72C3544C326846228F5B99DBE9F731C7"><enum>7.</enum><header>Sanctions in support of peace in Darfur</header> 
<subsection id="H72D8B57A6DB2433F972DDE6DDE1E7940"><enum>(a)</enum><header>Sanctions</header> 
<paragraph id="H78583C1136DB4701B5E69D1DFED325A0"><enum>(1)</enum><header>Sudan peace act</header><text display-inline="yes-display-inline">Beginning on the date of the enactment of this Act, the President shall, notwithstanding paragraph (1) of section 6(b) of the Sudan Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note), implement the measures set forth in subparagraphs (A) through (D) of paragraph (2) of such section.</text></paragraph> 
<paragraph id="H8B6F3D340F884250A82910A33C280348"><enum>(2)</enum><header>Homeland security act of 2002</header><text display-inline="yes-display-inline">Beginning on the date of the enactment of this Act, the Secretary of State shall, notwithstanding section 428(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/236">6 U.S.C. 236(b)</external-xref>), prohibit the granting of a visa to—</text> 
<subparagraph id="HCCC01D28F4AC45779EE65B77E9E3682C"><enum>(A)</enum><text>a senior member of the Government of Sudan;</text></subparagraph> 
<subparagraph id="H97260FF2C45145CEAEE6A73B00BA99D8"><enum>(B)</enum><text>a senior official of the military of Sudan; or</text></subparagraph> 
<subparagraph id="H93F0A241643D49D8A0A1AC6DD9665E77"><enum>(C)</enum><text>a family member of an individual described in subparagraph (A) or (B).</text></subparagraph></paragraph></subsection> 
<subsection id="HD02EFFB88E1B43AE84250962436BF993"><enum>(b)</enum><header>Suspension of sanctions</header><text display-inline="yes-display-inline">The President may suspend the application of paragraph (1) or (2) of subsection (a), or both, if the President determines and certifies to the appropriate congressional committees that the Government of Sudan has—</text> 
<paragraph id="H4F462F42AB4E466485F018198F842551"><enum>(1)</enum><text>taken demonstrable steps to ensure that the armed forces and the militias, known as the Janjaweed, are not attacking civilians;</text></paragraph> 
<paragraph id="H4CED4E4BB5E24ACFA95938C4EDAFF625"><enum>(2)</enum><text>taken significant demonstrable and verifiable steps to demobilize and disarm the Janjaweed in the Darfur region;</text></paragraph> 
<paragraph id="H0A5B1EBD9A8743DE931563C820F0FDAF"><enum>(3)</enum><text>ceased harassment of aid workers, including those who report human rights abuses, and allowed unfettered humanitarian access to the Darfur region;</text></paragraph> 
<paragraph id="H7B471C97DBB94AB4B7FEB6C4D4FE876F"><enum>(4)</enum><text>fully cooperated with the deployment and operation of international monitors and security forces, particularly the African Union monitoring team, for the Darfur region;</text></paragraph> 
<paragraph id="H822F05E9722D4FDCAF19D3B750B866F8"><enum>(5)</enum><text>is taking demonstrable steps to ensure the safe return of displaced persons and refugees to their homes, and rebuilding the communities destroyed in the violence;</text></paragraph> 
<paragraph id="H2A61CCC0065C4DF8B28D72C077C8DE8F"><enum>(6)</enum><text>implemented the Nairobi Declaration on the Final Phase of Peace in the Sudan; and</text></paragraph> 
<paragraph id="H6D88091B04AC4317A03EF1E38C3670C2"><enum>(7)</enum><text>installed a new coalition government based on the agreements reached in the Nairobi Declaration on the Final Phase of Peace in the Sudan and is otherwise accommodating the new coalition government formed as a result of the agreement.</text></paragraph> </subsection> 
<subsection id="H5233C6E9191643698CB69900A9858911"><enum>(c)</enum><header>Reinstatement of Sanctions</header><text display-inline="yes-display-inline">The President shall reinstate the sanctions listed in paragraph (1) or (2) of subsection (a), or both, that have been suspended under subsection (b) (as the case may be) if at any time the President determines that the Government of Sudan is no longer in compliance with any of the criteria listed in paragraphs (1) through (8) of such subsection.</text></subsection> 
<subsection id="H2679026DFED84EA8B9A44403DC71003D"><enum>(d)</enum><header>Waiver</header><text>The President may waive the application of paragraph (1) or (2) of subsection (a), or both, if the President determines and certifies to the appropriate congressional committees that exceptional circumstances in support of peace in Sudan necessitate such a waiver.</text></subsection></section> 
<section id="H876A6080069F47A2B2A025FB2B5791F2"><enum>8.</enum><header>Multilateral efforts</header> <text display-inline="no-display-inline">The Secretary of State should direct the United States Permanent Representative to the United Nations to—</text> 
<paragraph id="H56A870C53BAE444295EE83E9684CE14"><enum>(1)</enum><text>press the United Nations Security Council to pursue accountability for those who are found responsible for orchestrating and carrying out the atrocities in the Darfur region, which shall include advocating for an ad hoc international criminal tribunal for the prosecution of war crimes, crimes against humanity, and genocide;</text></paragraph> 
<paragraph id="HEAB1B6A1D89E44EC92BCFA93073754F9"><enum>(2)</enum><text>encourage member states of the United Nations to—</text> 
<subparagraph id="HCE8EF8C29B6F4CD6B48F9713A82CE93B"><enum>(A)</enum><text>freeze the assets of senior members of the Government of Sudan and their families held in each such member state;</text></subparagraph> 
<subparagraph id="HA18FF210B5A445CA9379DC580033FB7D"><enum>(B)</enum><text>cease to import Sudanese oil;</text></subparagraph> 
<subparagraph id="HE20F645D732648878DC7400A7E88901"><enum>(C)</enum><text>restrict the entry or transit of senior members of the Government of Sudan and their families through each such member; and</text></subparagraph> 
<subparagraph id="HE58C99555F274EB6AD275297749F401E"><enum>(D)</enum><text>deny permission for any aircraft registered in Sudan to take off from, land in, or overfly each such member state; and</text></subparagraph></paragraph> 
<paragraph id="H73A59C7A9DE2436B9CD9BF46227FC3E2"><enum>(3)</enum><text>urge member states of the United Nations to cease selling arms to the Government of Sudan, including by—</text> 
<subparagraph id="H037C03E73DCA4D64BB62E39CA1B332D0"><enum>(A)</enum><text>taking the necessary measures to prevent the sale or supply, to the Government of Sudan and its mercenaries, including the Janjaweed and the Popular Defense Forces, operating in the states of North Darfur, South Darfur and West Darfur, by the nationals of such member states, from the territories of such member states, or through the use of flag vessels or aircraft of such member states, of arms and related materiel of all types, including weapons and ammunition, military vehicles and equipment, paramilitary equipment, and spare parts for the Government of Sudan and its mercenaries, as well as technical training or assistance related to the provision, manufacture, maintenance or use of such items, whether or not originating in the territories of such member states; and</text></subparagraph> 
<subparagraph id="HF9DFE7B463A44073B4D3301F00CDB600"><enum>(B)</enum><text>ensuring that the measures imposed in subparagraph (A) shall not apply to—</text> 
<clause id="HA7CE92BCB40C4F969FD8BAD2EC22623"><enum>(i)</enum><text>supplies and related technical training and assistance to monitoring, verification or peace support operations, including such operations led by regional organizations, that are authorized by the United Nations or are operating with the consent of the relevant parties;</text></clause> 
<clause id="H56DB3947C15740C38F00431BBCF2754"><enum>(ii)</enum><text>supplies of non-lethal military equipment intended solely for humanitarian, human rights monitoring or protective use, and related technical training and assistance; and</text></clause> 
<clause id="H4BE8A3123A594EEDB97F8200664B6DE4"><enum>(iii)</enum><text>supplies of protective clothing, including flak jackets and military helmets, for the personal use of United Nations personnel, human rights monitors, representatives of the media and humanitarian and development workers and associated personnel.</text></clause></subparagraph></paragraph></section> 
<section id="H60899EAD89BB4D9085EAEB52D8A35FBB"><enum>9.</enum><header>Amendments to the Sudan Peace Act</header> 
<subsection id="H5DF03444F73945C4BEA3F46F870011BD"><enum>(a)</enum><header>Assistance for the crisis in Darfur and for comprehensive peace in Sudan</header> 
<paragraph id="HF481C06924424A08A6C22BD221D00032"><enum>(1)</enum><header>In general</header><text>The Sudan Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended by adding at the end the following new section:</text>

<section id="H179CCCA41A764793A4F9BACB8723EFFE"><enum>12.</enum><header>Assistance for the crisis in Darfur and for comprehensive peace in Sudan</header> 
<subsection id="H02C4FA723D414FCE0068D2D401B2F54"><enum>(a)</enum><header>Assistance to support a comprehensive final peace agreement in Sudan and to respond to the humanitarian crisis in Darfur</header> 
<paragraph id="H3EBAB7CBD76C48FCB2159D2ED2B280FB"><enum>(1)</enum><header>Authority</header><text>Subject to the requirements of this section, the President is authorized to provide assistance for Sudan to support the implementation of a comprehensive peace agreement that applies to all regions of Sudan, including the Darfur region, and to address the humanitarian and human rights crisis in the Darfur region and its impact on eastern Chad.</text></paragraph> 
<paragraph id="H2DDFFCE61CF740028E74E5D3D929005C"><enum>(2)</enum><header>Requirement for certification</header><text>Notwithstanding section 501(a) of the Assistance for International Malaria Control Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/570">Public Law 106–570</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note), assistance authorized under this section may be provided to the Government of Sudan only if the President submits the certification described in paragraph (3).</text></paragraph> 
<paragraph id="H23FF325C04444B929BE367765F4EF085"><enum>(3)</enum><header>Certification for the Government of Sudan</header><text>The certification referred to in paragraph (2) is a certification submitted by the President to the appropriate congressional committees that the Government of Sudan has taken demonstrable steps to—</text> 
<subparagraph id="H599669E4BB6D46DCB06194F25177DB35"><enum>(A)</enum><text>ensure that the armed forces of Sudan and any associated militias are not committing atrocities or obstructing human rights monitors or the provision of humanitarian assistance or human rights monitors;</text></subparagraph> 
<subparagraph id="H0ED4BFCDB4AC4B37867B4E9400447F5D"><enum>(B)</enum><text>demobilize and disarm militias supported or created by the Government of Sudan;</text></subparagraph> 
<subparagraph id="HEA3A85E5845B416ABA82AEF34C25D7A4"><enum>(C)</enum><text>allow full and unfettered humanitarian assistance to all regions of Sudan, including Darfur;</text></subparagraph> 
<subparagraph id="HD4901FF939394BC28C0075F3F5003BDC"><enum>(D)</enum><text>allow an international commission of inquiry to conduct its investigation of atrocities in the Darfur region and Khartoum, preserve evidence of atrocities and prosecute those responsible for war crimes, crimes against humanity, and genocide;</text></subparagraph> 
<subparagraph id="H45F327AA07634DCABD00DD3343A63F82"><enum>(E)</enum><text>cooperate fully with the African Union and all other observer and monitoring missions mandated to operate in Sudan;</text></subparagraph> 
<subparagraph id="HEF169AE33D2F443EBC9D4413A13E142D"><enum>(F)</enum><text>implement the Nairobi Declaration on the Final Phase of Peace in the Sudan;</text></subparagraph> 
<subparagraph id="H01D447A444AD47A68CAFE64F36FD5D9"><enum>(G)</enum><text>install a new coalition government based on the agreements reached in the Nairobi Declaration on the Final Phase of Peace in the Sudan; and</text></subparagraph> 
<subparagraph id="H278C3BDEF36A42738E79CE00CDAF81CE"><enum>(H)</enum><text>ensure that the parties to the agreements reached in the Nairobi Declaration on the Final Phase of Peace in the Sudan accept the new coalition government formed as a result of the agreement.</text></subparagraph></paragraph> 
<paragraph id="H0E2AFCAC090243F9B8B6F7DAA3556FD0"><enum>(4)</enum><header>Suspension of assistance</header><text>If, on a date after the President submits the certification described in paragraph (3), the President determines that the Government of Sudan has ceased taking the actions described in such paragraph, the President shall immediately suspend the provision of any assistance to such Government until the date on which the President certifies that the Government of Sudan has resumed taking such actions.</text></paragraph> 
<paragraph id="H67392B6B4AB7410F98F27E163DDC2891"><enum>(5)</enum><header>Authorization of appropriations</header> 
<subparagraph id="HE9C9D1B32BA24C1FAC62E8DC6DED32E0"><enum>(A)</enum><header>In general</header><text>There is authorized to be appropriated to the President to provide the assistance described in paragraph (1), $450,000,000 for fiscal year 2005, in addition to any other funds otherwise available for such purpose. Of such amount, $150,000,000 may be made available both for humanitarian assistance in the Darfur region of Sudan and eastern Chad in response to the ongoing crisis, notwithstanding any provision of law other than the provisions of this section.</text></subparagraph> 
<subparagraph id="H95FE69CA852340348FDA43F1D7200000"><enum>(B)</enum><header>Availability</header><text>Amounts appropriated pursuant to the authorization of appropriations under subparagraph (A) are authorized to remain available until expended.</text></subparagraph></paragraph></subsection> 
<subsection id="H723161B9347546E7BD20FB134FF409DA"><enum>(b)</enum><header>Government of Sudan Defined</header><text display-inline="yes-display-inline">In this section, the term <quote>Government of Sudan</quote> means the National Islamic Front government in Khartoum, Sudan, or any successor government formed on or after the date of the enactment of this Act (other than the coalition government agreed upon in the Nairobi Declaration on the Final Phase of Peace in the Sudan).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HFD25BE945A8344578E36FD8C6304FE68"><enum>(2)</enum><header>Conforming amendment</header><text>Section 3(2) of such Act is amended by striking <quote>The</quote> and inserting <quote>Except as provided in section 12, the</quote>.</text></paragraph></subsection> 
<subsection id="H8D05991655204AC09E23D000787D0042"><enum>(b)</enum><header>Reporting requirement</header><text>Section 8 of the Sudan Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended in the first sentence by striking <quote>Sudan.</quote> and inserting <quote>Sudan, including the conflict in the Darfur region.</quote>.</text></subsection></section> 
<section id="HC580358B21D54E4E97ED4FC44536D4A4"><enum>10.</enum><header>Report on United States response to a comprehensive peace agreement for Sudan</header> 
<subsection id="H417A37A6C49E4A19B67EA505D76654C8"><enum>(a)</enum><header>Report</header><text>Not later than 60 days after the date of enactment of this Act, the President shall submit to the appropriate congressional committees a report on the planned United States response to a comprehensive peace agreement for Sudan.</text></subsection> 
<subsection id="H70FCFE40A5104375BBD646D1BFF52C00"><enum>(b)</enum><header>Content</header><text>The report required by subsection (a) shall include—</text> 
<paragraph id="H2DE69C27B7EC405597AA04BB588C4401"><enum>(1)</enum><text>a description of the planned United States response to a modified peace process between the Government of Sudan and the SPLM that would account for the implementation of a peace in all regions of Sudan, in particular Darfur;</text></paragraph> 
<paragraph id="H02D5C83430D84DB0B312A6C97350558F"><enum>(2)</enum><text>a contingency plan for extraordinary humanitarian assistance should the Government of Sudan continue to obstruct or delay the international humanitarian response to the crisis in Darfur, Sudan;</text></paragraph> 
<paragraph id="HDC53DB7B734346A8845077E059E1BC00"><enum>(3)</enum><text>a notification and explanation of the President's intent, or lack thereof, to impose targeted sanctions on the assets and activities of those Sudanese government officials and other individuals that are involved in carrying out the policy of genocide in the Darfur region, as well as on the assets and activities of businesses controlled by the Government of Sudan and the National Congress Party; and</text></paragraph> 
<paragraph id="HE0D98A1EB06740EB00EFD075362B844C"><enum>(4)</enum><text>a notification and explanation of the Government of the United States' intent, or lack thereof, to normalize relations with Sudan, including through the lifting of any sanctions, until the Government of Sudan agrees to and implements a comprehensive peace agreement for all areas of Sudan, including Darfur.</text></paragraph></subsection> 
<subsection id="H8486A210CF294D388169424F88DB35D7"><enum>(c)</enum><header>Form of report</header><text>The report required by subsection (a) may be submitted in classified form.</text></subsection></section> 
<section id="H03D248791E7448A29695FBEAE2B08951"><enum>11.</enum><header>Additional authorities; exception to export prohibitions</header> 
<subsection id="HB89F2B0DFC2945E5AD34FD499F42A2E8"><enum>(a)</enum><header>Additional Authorities</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the President is authorized to undertake appropriate programs using Federal agencies, grants or contractual arrangements, or direct support of indigenous groups, agencies, or organizations in areas outside of control of the Government of Sudan in an effort to provide emergency relief, promote economic self-sufficiency, build civil authority, provide education, enhance rule of law and the development of judicial and legal frameworks, support people-to-people reconciliation efforts, or implement any program in support of any viable peace agreement at the local, regional, or national level in Sudan.</text></subsection> 
<subsection id="H83A23D303D0C4D109CA9C17874F8F6F0"><enum>(b)</enum><header>Exception to Export Prohibitions</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the prohibitions set forth with respect to Sudan in Executive Order No. 13067 of November 3, 1997 (62 Fed. Reg. 59989) shall not apply to any export from an area in Sudan outside of control of the Government of Sudan, or to any necessary transaction directly related to that export, if the President determines that the export or related transaction, as the case may be, would directly benefit the economic development of that area and its people. </text></subsection></section>
