<section id="H5EBF20271AD04CA0BD777B6E608BCEE5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Internet Privacy Protection Act of 2004</short-title></quote>.</text></section> 
<section id="HE3F0C967813A4428A100DBB6B488BBE8"><enum>2.</enum><header>Stored electronic communications</header> 
<subsection id="HC527A42102C645D9831B152E532483A4"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/121">Chapter 121</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<section id="H4758E71D936744758EF653B1D2B55B69"><enum>2713.</enum><header>Improper access by service provider</header> 
<subsection id="HFF823A2687DD431385DA75CEAF2C8DD7"><enum>(a)</enum><header>Offense</header><text>Except as provided in subsection (b), whoever, being a provider of electronic communication service, intentionally accesses the contents of a stored electronic communication while held in electronic storage by that provider shall be fined not more than $5,000.</text></subsection> 
<subsection id="HDE9AB7A30E8141F2BBC9EBC223059D09"><enum>(b)</enum><header>Exceptions</header><text>It is not an offense under subsection (a) if the access is a necessary incident to the rendition of the electronic communication service or compliance with section 2702.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H63AB26EE39024122974746D594C1EB06"><enum>(b)</enum><header>Clerical Amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/121">chapter 121</external-xref> of title 18, United States Code, is amended by adding at the end the following new item:</text>
