<section id="H298664B26F4E4D6F97BC68B4B8739B2B"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H3E30911C1318404EB451773DB63C93A1"><enum>(1)</enum><header>National intelligence program</header><text>The term <term>national intelligence program</term> means a program of foreign, military, and domestic intelligence related to the national security under the oversight of the Director of National Intelligence.</text></paragraph> 
<paragraph id="H8D5513C58EF74BDFA0BDBD18006063EE"><enum>(2)</enum><header>National intelligence center</header><text>The term <term>national intelligence center</term> means a center established by the Director of National Intelligence to provide all-source analysis and plan intelligence operations for the Federal Government on specific subjects of interest, such as counterterrorism, counterproliferation, counternarcotics, and counterintelligence.</text></paragraph> 
<paragraph id="H0A98189107164DEB894B7B800077A9F8"><enum>(3)</enum><header>National intelligence agency</header><text>The term <term>national intelligence agency</term> means an agency of the United States that contributes to the national intelligence program, including the elements of the intelligence community.</text></paragraph> 
<paragraph id="H5792FA2C83D74CE69EA771625B269113"><enum>(4)</enum><header>Intelligence community</header><text>The term <quote>intelligence community</quote> has the meaning given such term in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>).</text></paragraph></section> 
<title id="H14AEF6E29E3E45959B613FD6A593720"><enum>I</enum><header>Establishment of Director of National Intelligence</header> 
<section id="H2AE68E8E46C949ABA7AFD54EE1EB1E60"><enum>101.</enum><header>Establishment of the Director of National Intelligence</header> 
<subsection id="H2B4D7E53CD9849DCBD14EDC71376DF65"><enum>(a)</enum><header>Establishment</header><text>There is in the Executive Office of the President a Director of National Intelligence.</text></subsection> 
<subsection id="H6080D8C4536F45FF961982B8008CEE18"><enum>(b)</enum><header>Oversight of national intelligence program</header><text display-inline="yes-display-inline">The Director of National Intelligence shall act as the principal adviser to the President for intelligence matters related to the national security and shall oversee budget, operations, and personnel of the national intelligence program.</text></subsection> 
<subsection id="HF27C92F3237646080032752637D3FB4E"><enum>(c)</enum><header>Appointment</header><text>The Director of National Intelligence shall be appointed by the President, by and with the advice and consent of the Senate.</text></subsection> 
<subsection id="H07795C5878EB42D0A1AA2146ED872F61"><enum>(d)</enum><header>Executive Schedule I Compensation Rate</header><text>The Director of National Intelligence shall be compensated at the rate of pay applicable under <external-xref legal-doc="usc" parsable-cite="usc/5/5312">section 5312</external-xref> of title 5, United States Code.</text></subsection> 
<subsection id="H35A4D02D38124B7BB84F66F3522E83FE"><enum>(e)</enum><header>Prohibition on policymaking</header><text>The Director of National Intelligence shall not serve as a policymaker.</text></subsection></section> 
<section id="HA4B1E4728A7F41F2A8034CB9BAF95C2C"><enum>102.</enum><header>Duties of the Director of National Intelligence</header><text display-inline="no-display-inline">The Director of National Intelligence shall carry out the following duties:</text> 
<paragraph id="H0E080192374F408C8F831E386EDF1343"><enum>(1)</enum><text display-inline="yes-display-inline">Manage the national intelligence program, including oversight of the budget, operations, and personnel of the intelligence community.</text></paragraph> 
<paragraph id="H1233E40F1AFC40D5AF36CDD4821F1EAA"><enum>(2)</enum><text display-inline="yes-display-inline">Reorganize the intelligence services around specific threats, such as terrorism, weapons of mass destruction, and hostile countries.</text></paragraph> 
<paragraph id="H5CC8361AEAD34F66934DC0D690BE493E"><enum>(3)</enum><text>Oversee national intelligence centers.</text></paragraph> 
<paragraph id="H6106EB5E2071496C8599B5ADBA1CA2B"><enum>(4)</enum><text>Oversee the national intelligence agencies.</text></paragraph> 
<paragraph id="H38C637CFF04248BB82E78549A850491B"><enum>(5)</enum><text display-inline="yes-display-inline">Advise the President regarding the most relevant and reliable intelligence information.</text></paragraph> 
<paragraph id="HB9E60194AD9542BE9124839214BD8DB1"><enum>(6)</enum><text display-inline="yes-display-inline">Identify national security threats and determining which secrets are most important to protect.</text></paragraph> 
<paragraph id="HE6C89FD32C2F4ED69400E6087ED81400"><enum>(7)</enum><text display-inline="yes-display-inline">Advise the President regarding the coordinate efforts of the Department of Homeland Security.</text></paragraph> 
<paragraph id="H4DC53FF2994F4BBD9EB1E9598800933B"><enum>(8)</enum><text display-inline="yes-display-inline">Work closely with the Director of the Federal Bureau of Investigation and the Director of Central Intelligence.</text></paragraph> 
<paragraph id="H44F233EF843A4F0ABE8118F53BDBFAB9"><enum>(9)</enum><text>Support the President, and the heads of departments and agencies of the executive branch, the Chairman of the Joint Chiefs of Staff, and senior military commanders.</text></paragraph> 
<paragraph id="HCDEC513AF6174DD6BE1999A352177000"><enum>(10)</enum><text>Establish information sharing and information technology policies to maximize data sharing, as well as policies to protect the security of information.</text></paragraph> 
<paragraph id="HC9935260A1C743598528035B91F16C6F"><enum>(11)</enum><text>Perform such other duties as the President may prescribe.</text></paragraph></section> 
<section id="H23F932C872CE4120AEB55804DB399659"><enum>103.</enum><header>Management of the national intelligence program</header> 
<subsection id="HC0B303F6404745BE8D5CAD89CAE122F7"><enum>(a)</enum><header>In general</header><text>The following officials shall assist the Director of National Intelligence in carrying out the duty to manage the national intelligence program:</text> 
<paragraph id="HCAF7E074CBBC4595873235CBD5EB1793"><enum>(1)</enum><text display-inline="yes-display-inline">The Director of Central Intelligence, who shall also serve as the Deputy Director of National Intelligence for Foreign Intelligence, shall carry out duties with respect to foreign intelligence.</text></paragraph> 
<paragraph id="HAB71D057F0F14E689E3B705945440039"><enum>(2)</enum><text display-inline="yes-display-inline">The Under Secretary of Defense for Intelligence, who shall also serve as the Deputy Director of National Intelligence for Military Intelligence, shall carry out duties with respect to military intelligence.</text></paragraph> 
<paragraph id="H5FAB255DBA0943FD9F9D556F1DDC8EF7"><enum>(3)</enum><text display-inline="yes-display-inline">The Under Secretary of Homeland Security for Information Analysis and Infrastructure Protection, who shall also serve as the Deputy Director of National Intelligence for Domestic Intelligence, shall carry out duties with respect to domestic intelligence.</text></paragraph></subsection> 
<subsection id="H5C5813E46C8E49D4ACA514206485D13"><enum>(b)</enum><header>Duties with respect to national intelligence center operations</header><text>Each official specified in subsection (a), within the respective area of intelligence, shall acquire systems and train personnel to execute the operations assigned to the official by a director of a national intelligence center.</text></subsection> 
<subsection id="H104ED9F05D6842D4BC00FFEE9B185F84"><enum>(c)</enum><header>Coordination of agencies of the intelligence community</header><text>The head of each national intelligence agency shall coordinate functions of that agency with the appropriate area of intelligence specified in subsection (a).</text></subsection> 
<subsection id="HF2883218E8DB41E3ACFC61339B048CFA"><enum>(d)</enum><header>Construction</header><text>Nothing in this Act shall be construed as modifying the authority or duty of the Secretary of Defense to carry out the Joint Military Intelligence Program and the Tactical Intelligence and Related Activities Program.</text></subsection></section></title> 
<title id="HB4F3209F4793448FAE72A08F7D1337AD"><enum>II</enum><header>Authorities of the Director of National Intelligence</header> 
<section id="H531A614FD7F64B0A9E65B29146DB2200"><enum>201.</enum><header>Authority of the Director of National Intelligence over matters relating to budget</header><text display-inline="no-display-inline">The Director of National Intelligence shall have the following duties and authorities over matters relating to the budget of the national intelligence program:</text> 
<paragraph id="H9190E4BF61E54516B08F69E8508B871D"><enum>(1)</enum><header>Development of unified budget</header><text>The Director of National Intelligence shall prepare annual unified budgets for the national intelligence program for inclusion in the budget submission of the President under title 31, United States Code, that reflect—</text> 
<subparagraph id="H16F1E169779448CF8BB7256146C8CF4"><enum>(A)</enum><text>priorities of the National Security Council, and</text></subparagraph> 
<subparagraph id="H3962516868A94284B9861864D1000084"><enum>(B)</enum><text>an appropriate balance among the varieties of technical and human intelligence collection methods and analysis.</text></subparagraph></paragraph> 
<paragraph id="H9630640A58CE4ED7942BDC16572E21F6"><enum>(2)</enum><header>Appropriations</header><text>Amounts appropriated for the national intelligence program for a year shall be made to the Director of National Intelligence. The Director of National Intelligence shall allocate such appropriations among the national intelligence agencies.</text></paragraph> 
<paragraph id="H98C3DCB08DB14D2DBD5DB9ECA1AD6BD8"><enum>(3)</enum><header>Reprogramming</header><text>The Director of National Intelligence may reprogram funds appropriated for the national intelligence program to meet any unforeseen priority.</text></paragraph></section> 
<section id="H9DC0636DB54E485CAD4932C943384768"><enum>202.</enum><header>Authority of the Director of National Intelligence over matters relating to personnel</header><text display-inline="no-display-inline">The Director of National Intelligence shall have the following duties and authorities over matters relating to the personnel of national intelligence agencies.</text> 
<paragraph id="HCF7C9750B1304E2499D6D9BD9F035703"><enum>(1)</enum><header>Personnel policies</header><text>The Director of National Intelligence shall put into effect personnel policies to establish standards for education and training of officers and employees of national intelligence agencies and to facilitate assignments of those officers and employees at national intelligence centers and across national intelligence agencies.</text></paragraph> 
<paragraph id="HC618FB46E06D4F5A814D0435A3CAAED5"><enum>(2)</enum><header>Employment and termination authority</header><text>The Director of National Intelligence may employ such individuals in positions within the national intelligence program as the Director determines to be appropriate. The Director of National Intelligence may terminate the employment of any officer or employee of a national intelligence agency whenever the Director deems such termination necessary or advisable in the interests of the United States.</text></paragraph> 
<paragraph id="H26068A519E414DB7BD6FE6228700F17E"><enum>(3)</enum><header>Appointment of officials responsible for intelligence-related activities</header> 
<subparagraph display-inline="yes-display-inline" id="H4FF7A6F169834DE4AA01E3A200864086"><enum>(A)</enum><text>In the event of a vacancy in a position referred to in subparagraph (B), the head of the department or agency involved shall obtain the concurrence of the Director of National Intelligence before recommending to the President an individual for appointment to the position.</text></subparagraph> 
<subparagraph indent="up1" id="H942397324F1A468299C8ED8E00C697B1"><enum>(B)</enum><text>Subparagraph (A) applies to the following positions:</text> 
<clause id="H83A0B8BCB152413C955E1778B1ADF68B"><enum>(i)</enum><text>The Director of Central Intelligence.</text></clause> 
<clause id="H4CA8AFD1D11C4CC887A9DAC718F3A36F"><enum>(ii)</enum><text>The Director of the Defense Intelligence Agency.</text></clause> 
<clause id="H15C5122A54614456BB3BE474401FC15F"><enum>(iii)</enum><text>The Director of the National Security Agency.</text></clause> 
<clause id="H9B9FA6DE9FE5443C8EFE4EDD165FC754"><enum>(iv)</enum><text>The Director of the National Reconnaissance Office.</text></clause> 
<clause id="HEB00965E3AF6465DA6C741C8EE263924"><enum>(v)</enum><text>The Director of the National Geospatial-Intelligence Agency.</text></clause> 
<clause id="HD018DFFDA77C428D85EF9EF8BFA7E001"><enum>(vi)</enum><text>The Under Secretary for Information Analysis and Infrastructure Protection of the Department of Homeland Security.</text></clause> 
<clause id="HBDEC304D42AF4A379133C55E56F886D7"><enum>(vii)</enum><text>The Executive Assistant Director for Intelligence of the Federal Bureau of Investigation.</text></clause> 
<clause id="HBEE9C6FAB5424784BF844F5FF8F9E1B6"><enum>(viii)</enum><text>The Assistant Secretary of State for Intelligence and Research.</text></clause> 
<clause id="H9CB25AF0EF3E438D9C8292C68C6E26E2"><enum>(ix)</enum><text>The Director of the Office of Intelligence of the Department of Energy.</text></clause> 
<clause id="HC34F22ECE7254205B73B4F042F4CCB00"><enum>(x)</enum><text>The Director of the Office of Counterintelligence of the Department of Energy.</text></clause> 
<clause id="H87C7708DD6E242EEBDCC5D97CD9FE3C0"><enum>(xi)</enum><text>The Assistant Secretary for Intelligence and Analysis of the Department of the Treasury.</text></clause> 
<clause id="H2C27E36BEA764933B43F17003E099D77"><enum>(xii)</enum><text>The head of any other agency with national intelligence functions.</text></clause></subparagraph></paragraph></section></title> 
<title id="H5CAACBD1C84E44B39F52CB98CF534005"><enum>III</enum><header>Additional provisions</header> 
<section id="H24DA62B1ABDB4F3C98285F30AF3EAE95"><enum>301.</enum><header>Resolution of agency priority differences</header> 
<subsection id="H2E8DDB8D4A5F44DE00C20062732C9D69"><enum>(a)</enum><header>Establishment of NSC executive committee</header><text>There is established in the National Security Council an executive committee for the resolution of differences in priorities among national intelligence agencies. Insofar as the executive committee is unable to resolve a priority difference, the President shall resolve the priority difference.</text></subsection> 
<subsection id="H98F8086C285A43878300FA6FD0003D10"><enum>(b)</enum><header>Inclusion of the Director of National Intelligence</header><text>The Director of National Intelligence shall be a member of the executive committee established under subsection (a).</text></subsection></section> 
<section id="HF72A45A0B82845C3BB6F30B0734BCA14"><enum>302.</enum><header>Duty of heads of national intelligence centers to report to the Director of National Intelligence</header><text display-inline="no-display-inline">Directors of national intelligence centers shall report directly to the Director of National Intelligence.</text></section></title>
