<legis-type>A BILL</legis-type> 
<official-title>To require the Secretary of the Treasury to mint coins in commemoration of the tragic loss of lives at the Pentagon on September 11, 2001, and to support construction of the Pentagon 9/11 Memorial in Arlington, Virginia.</official-title>

<section id="H545CC31E65D642449943280030F820BB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Pentagon 9/11 Memorial Commemorative Coin Act of 2004</quote>.</text></section> 
<section id="HEE2B1B60675B4F1A87506C55FB00DABD"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text> 
<paragraph id="HAA095D6D2CA141C08B771F3D0003C300"><enum>(1)</enum><text>Construction of the Pentagon was completed in the midst of World War II on January 15, 1943.</text></paragraph> 
<paragraph id="HA7415C97579A499E918238B620F6AACF"><enum>(2)</enum><text>September 11, 2001, marks a tragic day in the history of the United States and the Pentagon Building located in Arlington, Virginia.</text></paragraph> 
<paragraph id="HE4690F1E937047CBA06942395FA14144"><enum>(3)</enum><text>184 individuals ages 3 to 71 lost their lives through the horrific event that unfolded at the Pentagon on September 11, 2001.</text></paragraph> 
<paragraph id="HD593FED0A410489A9E04C7A627C1DF30"><enum>(4)</enum><text>An appropriate memorial reminding us of the brave men, women, and children who perished has been designed and is to be built on 1.93 acres located on the western side of the Pentagon Building.</text></paragraph> 
<paragraph id="H66F7A9139812425DB7FE5670622E0FE"><enum>(5)</enum><text>The target completion date for the construction of the Pentagon Memorial park is late fall 2006.</text></paragraph> 
<paragraph id="H75723C2A217F4E30AC488CD02F58B668"><enum>(6)</enum><text>Almost $30,000,000 will need to be raised from the private sector in order to begin construction of the memorial and to maintain it upon completion.</text></paragraph> 
<paragraph id="H86303C2937E5491BB8DD02D0D5FB00FB"><enum>(7)</enum><text>The surcharge proceeds from the sale of a commemorative coin, which would have no net cost to the taxpayers, would raise valuable funding for the construction and maintenance of the Pentagon Memorial in remembrance of those who lost their lives at the Pentagon on September 11, 2001.</text></paragraph></section> 
<section id="H15CE48E2B367465B00AEE3AD13D07CA9"><enum>3.</enum><header>Coin specifications</header> 
<subsection id="HAA19D10D14BB4A9FAAE218DC69FBA488"><enum>(a)</enum><header>Denominations</header><text>The Secretary of the Treasury (hereafter in this Act referred to as the <quote>Secretary</quote>) shall mint and issue the following coins:</text> 
<paragraph id="HCC3C7619090F4B86BF437121F6910335"><enum>(1)</enum><header>$50 gold coins</header><text>$50 coins, in the number determined under subsection (b), which shall—</text> 
<subparagraph id="H2EB23F954CF54B41941D8D3EA7030718"><enum>(A)</enum><text>weigh 1 ounce;</text></subparagraph> 
<subparagraph id="H23E486381ACB4FB500B4D6881D6E32F2"><enum>(B)</enum><text>have a diameter of 1.287 inches; and</text></subparagraph> 
<subparagraph id="HB75C63F15783481A936486D37E679BF8"><enum>(C)</enum><text>contain 91.67 percent gold and 8.33 percent alloy.</text></subparagraph></paragraph> 
<paragraph id="HB3C7B97F04044A0FAEAAD7005B34582E"><enum>(2)</enum><header>$1 silver coins</header><text>Such number of $1 coins as the Secretary determines appropriate to meet demand, which shall—</text> 
<subparagraph id="H8EEB086944A34EA7A59DDE34C4537BB9"><enum>(A)</enum><text>weigh 26.73 grams;</text></subparagraph> 
<subparagraph id="H7A0A6F8B38344ACAA0FD4996C2014CBA"><enum>(B)</enum><text>have a diameter of 1.500 inches; and</text></subparagraph> 
<subparagraph id="HDF6231EE19FA4458B5379470ACE34068"><enum>(C)</enum><text>contain 90 percent silver and 10 percent copper.</text></subparagraph></paragraph> 
<paragraph id="H712595153EE0471E9029E0FDA518121"><enum>(3)</enum><header>Half dollar clad coins</header><text>Such number of half dollar coins as the Secretary determines appropriate to meet demand, which shall—</text> 
<subparagraph id="H3E20FDB4EB464F17880321169FF3FE08"><enum>(A)</enum><text>weigh 11.34 grams;</text></subparagraph> 
<subparagraph id="H4D84A5D9AE7746E286AD002E7E9D0649"><enum>(B)</enum><text>have a diameter of 1.205 inches; and</text></subparagraph> 
<subparagraph id="HCE2101E5D92C4579989FA73196BA62F6"><enum>(C)</enum><text>be minted to the specifications for half dollar coins contained in <external-xref legal-doc="usc" parsable-cite="usc/31/5112">section 5112(b)</external-xref> of title 31, United States Code.</text></subparagraph></paragraph></subsection>
<subsection id="H6B47DBF48092467B8BBE2245A545757B"><enum>(b)</enum><header>Number of gold coins</header>
<paragraph id="HDEB0C8A1942740C2A4005C3912C981D0"><enum>(1)</enum><header>In general</header><text>The number of gold coins minted and issued under this Act shall equal the sum of 10,000 and the number determined under paragraph (2).</text></paragraph>
<paragraph id="H9EDCCFF40DE44F0FBDC0BEF3A5DA279F"><enum>(2)</enum><header>Determination of number</header><text>The Secretary, in consultation with the Attorney General of the United States, the Secretary of Defense, and the Governor of Virginia shall determine the number of innocent individuals confirmed or presumed to have been killed as a result of the terrorist attack against the Pentagon that occurred on September 11, 2001, and shall identify such individuals.</text></paragraph></subsection> 
<subsection id="HF872FD5638A14D4D00E093D700C11400"><enum>(c)</enum><header>Legal tender</header><text>The coins minted under this Act shall be legal tender, as provided in <external-xref legal-doc="usc" parsable-cite="usc/31/5103">section 5103</external-xref> of title 31, United States Code.</text></subsection> 
<subsection id="HC86371FDB1684261B6599C3088E37669"><enum>(d)</enum><header>Numismatic items</header><text>For purposes of <external-xref legal-doc="usc" parsable-cite="usc/31/5136">section 5136</external-xref> of title 31, United States Code, all coins minted under this Act shall be considered to be numismatic items.</text></subsection> 
<subsection id="H33BE93C6ED0C4EE3A73E4F11CF4FE700"><enum>(e)</enum><header>Sources of bullion</header><text>For the purpose of minting coins under this Act, the Secretary may only use metals that are from natural deposits in the United States or any territory or possession of the United States.</text></subsection> 
<subsection id="HEF86610C101847A5A5A078C200892F33"><enum>(f)</enum><header>Special treatment under exigent circumstances</header> 
<paragraph id="H96FDAA274BF942B29400D9B23AC96FC"><enum>(1)</enum><header>Findings</header><text>The Congress finds as follows:</text> 
<subparagraph id="HDBF260FCF0CF4E58005F0478E12E1767"><enum>(A)</enum><text>The limitations contained in paragraphs (1) and (2)(A) of <external-xref legal-doc="usc" parsable-cite="usc/31/5112">section 5112(m)</external-xref> of title 31, United States Code, and section 5134(f)(1)(B) of such title have well served, and continue to serve, their purpose of bringing greater stability to the markets for commemorative coins, maximizing demand and participation in such programs, and ensuring that such programs have a broad base of private support and are not used as the primary means of fundraising by organizations that are the recipients of surcharges.</text></subparagraph> 
<subparagraph id="H38902B56468247D0908997B570766F56"><enum>(B)</enum><text>The shocking circumstances of September 11, 2001, the broad base of public interest in remembering those innocent individuals who lost their lives at the Pentagon on September 11, 2001, and participating in the raising of funds for the Pentagon Memorial Fund, and the importance of implementing this coin program as quickly as possible, notwithstanding the limitations contained in such paragraphs, justify exempting the coins produced under this Act from such limitations.</text></subparagraph></paragraph> 
<paragraph id="H14AA0B5C0B454A4590F07C8B08250014"><enum>(2)</enum><header>Exemption</header><text>Paragraphs (1) and (2) of <external-xref legal-doc="usc" parsable-cite="usc/31/5112">section 5112(m)</external-xref> of title 31, United States Code, and section 5134(f)(1)(B) of such title shall not apply to coins authorized under this Act.</text></paragraph></subsection></section> 
<section id="H9736B383708E4DF2B002F91F042D449C"><enum>4.</enum><header>Design of coins</header> 
<subsection id="H572B37A88B1340D1B8994EAA21B329A3"><enum>(a)</enum><header>Design requirements</header> 
<paragraph id="H14F2ED9DF73F4A00844C54D2D5FF08A5"><enum>(1)</enum><header>In general</header><text>The design of the coins minted under this Act shall be emblematic of the spirit and bravery of the civilians, servicemen and women that work at the Pentagon and were aboard Flight 77 on September 11, 2001.</text></paragraph> 
<paragraph id="HF1FC1FC048C1479C8300EC2EE658BA9C"><enum>(2)</enum><header>Designation and inscriptions</header><text>On each coin minted under this Act, there shall be—</text> 
<subparagraph id="H2E58A7767F134CDF8BBD04DC765DFBF1"><enum>(A)</enum><text>a designation of the value of the coin;</text></subparagraph> 
<subparagraph id="HDBF1882D10F242B88C007F88D4E4B819"><enum>(B)</enum><text>an inscription of the year <quote>2001</quote>; and</text></subparagraph> 
<subparagraph id="H84EBD8EDE12B4831871F002B1FA96BA0"><enum>(C)</enum><text>inscriptions of the words <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United States of America</quote>, and <quote>E Pluribus Unum</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H637D1C38AEC44170B1DD1228313D3385"><enum>(b)</enum><header>Selection</header><text>The design for the coins minted under this Act shall be—</text> 
<paragraph id="H74E6C1DCB57A4BAFA1B1006000F7643C"><enum>(1)</enum><text display-inline="yes-display-inline">selected by the Secretary, after consultation with the Secretary of Defense, the Executive Committee of the Pentagon Memorial Fund, and the Commission of Fine Arts; and</text></paragraph> 
<paragraph id="H76CC179500F846B79FBCB5808858A4BE"><enum>(2)</enum><text>reviewed by the Citizens Coinage Advisory Committee.</text></paragraph></subsection></section> 
<section id="HB321C737EDD54383AEF49B88AEDF632F"><enum>5.</enum><header>Issuance of coins</header> 
<subsection id="H58EE02A6399640849923843B9D49F413"><enum>(a)</enum><header>Quality of coins</header> 
<paragraph id="HBDFA58D0E2794B83BB9CFBFC9040B084"><enum>(1)</enum><header>In general</header><text>Except as provided under paragraph (2), coins minted under this Act shall be issued in uncirculated quality.</text></paragraph> 
<paragraph id="H9A3FBF73D30C43049B6B543D8E7FF876"><enum>(2)</enum><header>Gold coins</header><text>$50 coins minted under section 3(a)(1) shall be issued only in proof quality.</text></paragraph></subsection> 
<subsection id="H63BAA8F00D60474E9F2DD2FF771F8293"><enum>(b)</enum><header>Mint facility</header> 
<paragraph id="H1A6D599C868A4895BE26A4E8A147A585"><enum>(1)</enum><header>In general</header><text>Except as provided under paragraph (2), only 1 facility of the United States Mint may be used to strike any particular quality of the coins minted under this Act.</text></paragraph> 
<paragraph id="HC275F46908E74CE88F94A8878EB2B293"><enum>(2)</enum><header>Clad coins</header><text>Any number of facilities of the United States Mint may be used to strike the half dollar coins minted under section 3(a)(3).</text></paragraph></subsection> 
<subsection id="H2D6B98D956CE4066A9BF0CD48E8536F"><enum>(c)</enum><header>Period for issuance</header><text>The Secretary—</text> 
<paragraph id="H2C3C889B2987483B9EAE00F754209EAD"><enum>(1)</enum><text>shall commence issuing coins minted under this Act as soon as possible after the date of the enactment of this Act; and</text></paragraph> 
<paragraph id="H6CEBD1FA76424111BEA33B7CAEB00334"><enum>(2)</enum><text>shall not issue any coins after the end of the 1-year period beginning on the date such coins are first issued.</text></paragraph></subsection></section> 
<section id="HF0B3E7D8DB4542B698A8FE0104F4DEA7"><enum>6.</enum><header>Sale of coins</header> 
<subsection id="H2C279B1BF7954D50A783CF8635F868C5"><enum>(a)</enum><header>Sale price</header><text>The coins issued under section 3(a) (other than the $50 gold coins referred to in subsection (d)) shall be sold by the Secretary at a price equal to the sum of—</text> 
<paragraph id="HABCFA72A3A17470184E1C164B1DCD4ED"><enum>(1)</enum><text>the face value of the coins;</text></paragraph> 
<paragraph id="H27A7C1B815E6473F8F8673B5C9561553"><enum>(2)</enum><text>the surcharges required by section 7(a) with respect to such coins; and</text></paragraph> 
<paragraph id="H0D82875BA8E8483698C2A7213CFC9EA3"><enum>(3)</enum><text>the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping), including the cost of the coins presented under subsection (d).</text></paragraph></subsection> 
<subsection id="HBEDABDF22B584BE58005B5030056E891"><enum>(b)</enum><header>Bulk sales</header><text>The Secretary shall make bulk sales of the coins issued under section 3(a) at a reasonable discount.</text></subsection> 
<subsection id="H832BF34CF097479E8DEB48DB77D861E9"><enum>(c)</enum><header>Prepaid orders</header>
<paragraph id="H7E9869B4661146B9BD7CDC438B567EBE"><enum>(1)</enum><header>In general</header><text>The Secretary shall accept prepaid orders received before the issuance of the coins minted under section 3(a).</text></paragraph>
<paragraph id="H3FCDF1A251FA47EBAC04FACEEC1EEDEF"><enum>(2)</enum><header>Reasonable discount</header><text>The sale prices with respect to such prepaid orders shall be at a reasonable discount.</text></paragraph></subsection> 
<subsection id="HE04A8DE8B96943BDAB2CE806EF3F05B1"><enum>(d)</enum><header>Gold coins</header><text>Notwithstanding section 5(c)(2), the Secretary shall issue a $50 coin minted under section 3(a)(1) for presentation free of charge to the next of kin or personal representative of each individual identified under section 3(b)(2). The Speaker of the House of Representatives and the President Pro Tempore of the Senate shall make appropriate arrangements for the presentation, on behalf of the Congress, of such gold coins.</text></subsection></section> 
<section id="H0B48B0E9F2EB432BAA7053BF99C39725"><enum>7.</enum><header>Surcharges on sale of coins</header> 
<subsection id="HCC703578AB644795B3D8BA17673BB639"><enum>(a)</enum><header>In general</header><text>Any sale by the Secretary of a coin minted under this Act shall include a surcharge of—</text> 
<paragraph id="H89DD32DDB01E4560BAA520DEE3C5854C"><enum>(1)</enum><text>$100 per coin for the $50 gold coins;</text></paragraph> 
<paragraph id="HAC2D373DD585473E847C55E3535BB6BD"><enum>(2)</enum><text>$10 per coin for the $1 coin; and</text></paragraph> 
<paragraph id="H273922B6ACC0483CBC3C1B55521061F7"><enum>(3)</enum><text>$5 per coin for the half dollar coin.</text></paragraph></subsection> 
<subsection id="H7C22BB461C524122A7CDAF00E317D33E"><enum>(b)</enum><header>Distribution</header><text>Subject to <external-xref legal-doc="usc" parsable-cite="usc/31/5134">section 5134(f)</external-xref> of title 31, United States Code, all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary to the Pentagon Memorial Fund for the purposes of construction of a memorial at the Pentagon, Arlington, Virginia.</text></subsection> 
<subsection id="HC4EF6C28AF8B4A699B081D48404BEFF"><enum>(c)</enum><header>Audit</header><text>The Pentagon Memorial Fund shall be subject to the audit requirements of <external-xref legal-doc="usc" parsable-cite="usc/31/5134">section 5134(f)(2)</external-xref> of title 31, United States Code, with regard to the amounts received under subsection (a).</text></subsection></section>
