<section section-type="section-one" id="H4DDB91424D9C44B9B5A7FE4B4BF400D4" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Minimum Wage Indexation Act of 2004</quote>.</text></section> 
<section id="H04CF474B7AD24B069D9F431EAFDB4C7C"><enum>2.</enum><header>Minimum wage indexation</header> 
<subsection id="H9F817D33DF9A4DC98654A66E005816E7"><enum>(a)</enum><header>In general</header><text>Section 6(a)(1) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)(1)</external-xref>) is amended to read as follows:</text>

<paragraph id="HBCB7BFFEB1BB4750A04C00F1A7A1DBF0"><enum>(1)</enum><text>except as otherwise provided in this section, not less than the following—</text> 
<subparagraph id="H2896CC30216B46FAA2C30706BCFF811F"><enum>(A)</enum><text display-inline="yes-display-inline">beginning on the date that is the 60th day after the date of enactment of the Minimum Wage Indexation Act of 2004, $5.85 an hour;</text></subparagraph> 
<subparagraph id="HBCA7E9D4FAC14E13A8978156DE6B7BCB"><enum>(B)</enum><text display-inline="yes-display-inline">beginning on the date that is 365 days after that 60th day, $6.45 an hour; </text></subparagraph> 
<subparagraph id="H401628B0470949A38C001B7E1C284204"><enum>(C)</enum><text display-inline="yes-display-inline">beginning on the date that is 365 days after the date set forth in subparagraph (B), $7.00 an hour; and</text></subparagraph> 
<subparagraph id="HD1D8B2D9679B4F2CAFF7DB66D4594FD0"><enum>(D) </enum><text display-inline="yes-display-inline">beginning on the first day of each successive 365-day period commencing after the date set forth in subparagraph (C), $7.00 an hour plus an increase determined by the Secretary to be in proportion to the increase in the Consumer Price Index for all urban consumers for the period between the date referred to in subparagraph (C) and the first day of each such 365-day period;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HBE1C52AD2FDF40F38F33A73620FFF85F"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect 60 days after the date of enactment of this Act.</text></subsection></section>
