<section id="HC8F4C1BD18CD448EB6C22C713D77E181" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Invest in American Workers Act of 2004</short-title></quote>.</text> </section> 
<section id="H471FC58BB97243BB9C748025E342364D" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Extension of trade adjustment assistance to services sector</header> 
<subsection id="HF22463F13B9440CBADA82D00B6DD12A1"><enum>(a)</enum><header>Adjustment assistance for workers</header><text/> 
<paragraph id="HE19641E25C9D458F8F002288F93035B2"><enum>(1)</enum><header>Eligibility</header><text>Section 221(a)(1)(A) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19 U.S.C. 2271(a)(1)(A)</external-xref>) is amended by striking <quote>firm)</quote> and inserting <quote>firm, and workers in a service sector firm or subdivision of a service sector firm</quote>.</text></paragraph> 
<paragraph id="H3E4438F6AC004425AFE100D39052319F"><enum>(2)</enum><header>Group eligibility requirements</header><text>Section 222 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272</external-xref>) is amended—</text> 
<subparagraph id="H7B699D80134B42B6A166D7FEECBF72A9"><enum>(A)</enum><text>in subsection (a)—</text> 
<clause id="HA29BB7AA537048C68088DA867B4D20"><enum>(i)</enum><text>in the matter preceding paragraph (1), by striking <quote>agricultural firm)</quote> and inserting <quote>agricultural firm, and workers in a service sector firm or subdivision of a service sector firm)</quote>;</text></clause> 
<clause id="H60D5563659B84A4C85C4E9F2C6F1E59"><enum>(ii)</enum><text>in paragraph (2)—</text> 
<subclause id="HE97ECFB59096470892EBA5FC6EA9EA"><enum>(I)</enum><text>in subparagraph (A)(ii), by striking <quote>like or directly competitive with articles produced</quote> and inserting <quote>or services like or directly competitive with articles produced or services provided</quote>; and</text></subclause>

<clause id="H65F8FE70BE914F399D00BBC7F7572BB9" indent="up1"><enum>(ii)</enum><text>such workers’ firm or subdivision has obtained or is likely to obtain services described in clause (i) from a foreign country</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause></subparagraph> 
<subparagraph id="H449E3B0A2AAA41A49BEFBD52B9005F3F"><enum>(B)</enum><text>in subsection (b), in the matter preceding paragraph (1), by striking <quote>agricultural firm)</quote> and inserting <quote>agricultural firm, and workers in a service sector firm or subdivision of a service sector firm)</quote>; and</text></subparagraph> 
<subparagraph id="H9CBE55D8F0CE405C85AEB4DA4EDDE6C4"><enum>(C)</enum><text>in subsection (c)(3)—</text>

<paragraph id="HADA62AFD383B412BA1E2ABF93BBB4199"><enum>(3)</enum><header>Definitions</header><text>Section 247 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2319">19 U.S.C. 2319</external-xref>) is amended by inserting after paragraph (6) the following:</text>

<paragraph id="H8BD8EC2D921247EB9F06A703E639F92C"><enum>(7) </enum><text>The term <quote>service sector firm</quote> means an entity engaged in the business of providing information technology or other high technology services.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H13A6F9474399464581E65F06885B61A4"><enum>(b)</enum><header>Trade adjustment assistance for firms and industries</header> 
<paragraph id="HB81F49B2588648F2A990FAEE549CD430"><enum>(1)</enum><header>Firms</header> 
<subparagraph id="HB80311057CF043C3ADA5876B19C9059E"><enum>(A)</enum><header>Assistance</header><text>Section 251 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2341">19 U.S.C. 2341</external-xref>) is amended—</text> 
<clause id="HA72452AA25634028A0D8D50082420086"><enum>(i)</enum><text>in subsection (a), by inserting <quote>or service sector firm</quote> after <quote>(including any agricultural firm</quote>; and</text></clause> 
<clause id="H74A883BEAF15481AB601B9C036F97213"><enum>(ii)</enum><text>in subsection (c)(1)—</text> 
<subclause id="HA396473F17724E35003273B861427EB2"><enum>(I)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>or service sector firm</quote> after <quote>any agricultural firm</quote>;</text></subclause>

<paragraph id="H3989A4174F65487BBD00037364AE5F8B"><enum>(2)</enum><header>Industries</header><text>Section 265(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2355">19 U.S.C. 2355(a)</external-xref>) is amended by inserting <quote>or service</quote> after <quote>new product</quote>. </text></paragraph></subsection></section> 
<section id="H8C225A45418E19E32269AE8268F26F2"><enum>3.</enum><header>Trade Adjustment Assistance for communities</header> 
<subsection id="H0C7831F0B47F4961861177761FDC4E2E"><enum>(a)</enum><header>In General</header><text>Chapter 4 of title II of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2371">19 U.S.C. 2371 et seq.</external-xref>) is amended to read as follows:</text>

<chapter id="HC244CC9645F657765B8C5E8611EE6AA"><enum>4</enum><header>Trade Adjustment Assistance for communities</header> 
<section id="H70FB4FD0410D32B746FA05B525E6F83"><enum>271.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text> 
<paragraph id="H8050E6844A1B0DCADCA3BC91E17E840"><enum>(1)</enum><header>Affected domestic producer</header><text>The term <term>affected domestic producer</term> means any manufacturer, producer, farmer, rancher, fisherman or worker representative (including associations of such persons) that was affected by a finding under the Antidumping Act of 1921, or by an antidumping or countervailing duty order issued under title VII of the <act-name parsable-cite="TA30">Tariff Act of 1930</act-name>.</text></paragraph> 
<paragraph id="HCF9919AB43F12CAAC6B9CD85D4B51F0"><enum>(2)</enum><header>Agricultural commodity producer</header><text>The term <term>agricultural commodity producer</term> has the same meaning as the term <term>person</term> as prescribed by regulations promulgated under section 1001(5) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/7/1308">7 U.S.C. 1308(5)</external-xref>).</text></paragraph> 
<paragraph id="H9AA98BBD42DF3B5A02ADDAB1A3C78A0"><enum>(3)</enum><header>Community</header><text>The term <term>community</term> means a city, county, or other political subdivision of a State or a consortium of political subdivisions of a State that the Secretary certifies as being negatively impacted by trade.</text></paragraph> 
<paragraph id="HCB7269B24A97F11A0F6CAEB454F77EB"><enum>(4)</enum><header>Community negatively impacted by trade</header><text>A community negatively impacted by trade means a community with respect to which a determination has been made under section 273.</text></paragraph> 
<paragraph id="H655B84E94361AD711D4F9C92B9023BF"><enum>(5)</enum><header>Eligible community</header><text>The term <term>eligible community</term> means a community certified under section 273 for assistance under this chapter.</text></paragraph> 
<paragraph id="H9086B2B14C4B960A75D7C3A6D3FCB50"><enum>(6)</enum><header>Fisherman</header> 
<subparagraph id="H02A4504A436634F23A755480B369839"><enum>(A)</enum><header>In general</header><text>The term <term>fisherman</term> means any person who—</text> 
<clause id="H7170E4D64BBCFC46CF218E92A17CEB3"><enum>(i)</enum><text>is engaged in commercial fishing; or</text></clause> 
<clause id="HA13BA6484D4B4F9DBD753A9C00C6B9D"><enum>(ii)</enum><text>is a United States fish processor.</text></clause></subparagraph> 
<subparagraph id="H2C9DA5184D4AE71148D26F97BF1DCE0"><enum>(B)</enum><header>Commercial fishing, fish, fishery, fishing, fishing vessel, person, and United States fish processor</header><text>The terms <term>commercial fishing</term>, <term>fish</term>, <term>fishery</term>, <term>fishing</term>, <term>fishing vessel</term>, <term>person</term>, and <term>United States fish processor</term> have the same meanings as such terms have in the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1802">16 U.S.C. 1802</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="H357632D74E122A7C74510A92CA0F270"><enum>(7)</enum><header>Job loss</header><text>The term <term>job loss</term> means the total or partial separation of an individual, as those terms are defined in section 247.</text></paragraph> 
<paragraph id="HE7F8A635427818DF640F8C89D57C58F"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph></section> 
<section id="H595E21644A75B33F499E0BB1F7172E3"><enum>272.</enum><header>Community Trade Adjustment Assistance Program</header> 
<subsection id="HA7F7BBF0493A4F4B7A343E866F0091A"><enum>(a)</enum><header>Establishment</header><text>Within 6 months after the date of enactment of the <short-title>Invest in American Workers Act of 2004</short-title>, the Secretary shall establish a Trade Adjustment Assistance for Communities Program at the Department of Commerce.</text></subsection> 
<subsection id="HF4256F294CE4F96D920A5584DB2305D"><enum>(b)</enum><header>Personnel</header><text>The Secretary shall designate such staff as may be necessary to carry out the responsibilities described in this chapter.</text></subsection> 
<subsection id="H23B7824E4785127CD3F31183AEBCCC0"><enum>(c)</enum><header>Coordination of Federal response</header><text>The Secretary shall—</text> 
<paragraph id="HD23980BE416AAA5ED9C2D0B097473DA"><enum>(1)</enum><text>provide leadership, support, and coordination for a comprehensive management program to address economic dislocation in eligible communities;</text></paragraph> 
<paragraph id="HC31B117F4E4DD6558EE00889F2141FD"><enum>(2)</enum><text>coordinate the Federal response to an eligible community—</text> 
<subparagraph id="H21E5ADD74D35387477BE66B7D60152B"><enum>(A)</enum><text>by identifying all Federal, State, and local resources that are available to assist the eligible community in recovering from economic distress;</text></subparagraph> 
<subparagraph id="H6BA26B1345DF71277E2D9580D38DB9C"><enum>(B)</enum><text>by ensuring that all Federal agencies offering assistance to an eligible community do so in a targeted, integrated manner that ensures that an eligible community has access to all available Federal assistance;</text></subparagraph> 
<subparagraph id="HAD9C08544D3496FAA1838C91EF8C5C8"><enum>(C)</enum><text>by assuring timely consultation and cooperation between Federal, State, and regional officials concerning economic adjustment for an eligible community; and</text></subparagraph> 
<subparagraph id="H67958D3D4DF42C6EF6880E8CAE02B63"><enum>(D)</enum><text>by identifying and strengthening existing agency mechanisms designed to assist eligible communities in their efforts to achieve economic adjustment and workforce reemployment;</text></subparagraph></paragraph> 
<paragraph id="H97AF9759444B94DF0510699AFABBD14"><enum>(3)</enum><text>provide comprehensive technical assistance to any eligible community in the efforts of that community to—</text> 
<subparagraph id="H0478ABC64912B1E28435868FECC39BD"><enum>(A)</enum><text>identify serious economic problems in the community that are the result of negative impacts from trade;</text></subparagraph> 
<subparagraph id="H52001AAF4046F62B452951B56CE8D30"><enum>(B)</enum><text>integrate the major groups and organizations significantly affected by the economic adjustment;</text></subparagraph> 
<subparagraph id="H7A488DB94177FE4381F6A88A2EA35FB"><enum>(C)</enum><text>access Federal, State, and local resources designed to assist in economic development and trade adjustment assistance;</text></subparagraph> 
<subparagraph id="HA3931FFE43273AEA8C961A88D0B901E"><enum>(D)</enum><text>diversify and strengthen the community economy; and</text></subparagraph> 
<subparagraph id="H140A4E9B4F67B7FE3CC43D830053BC1"><enum>(E)</enum><text>develop a community-based strategic plan to address economic development and workforce dislocation, including unemployment among agricultural commodity producers, and fishermen;</text></subparagraph></paragraph> 
<paragraph id="H5573A8734F81190C707341AC6BD1B0F"><enum>(4)</enum><text>establish specific criteria for submission and evaluation of a strategic plan submitted under section 274(d);</text></paragraph> 
<paragraph id="HF2B7A0A64647CB0239F7DD9C0080C2D"><enum>(5)</enum><text>establish specific criteria for submitting and evaluating applications for grants under section 275;</text></paragraph> 
<paragraph id="H0F2CA4004F607D31FEDB50823DE3FD4"><enum>(6)</enum><text>administer the grant programs established under sections 274 and 275; and</text></paragraph> 
<paragraph id="H4DD5E0B7492770804F951D86B4A38E9"><enum>(7)</enum><text>establish an interagency Trade Adjustment Assistance for Communities Working Group, consisting of the representatives of any Federal department or agency with responsibility for economic adjustment assistance, including the Department of Agriculture, the Department of Education, the Department of Labor, the Department of Housing and Urban Development, the Department of Health and Human Services, the Small Business Administration, the Department of the Treasury, the Department of Commerce, and any other Federal, State, or regional department or agency the Secretary determines necessary or appropriate.</text></paragraph></subsection></section> 
<section id="HF979D69F41D575397DC473B125D1EAE"><enum>273.</enum><header>Certification and notification</header> 
<subsection id="HE82C080C4977053FF089D8A608A7D96"><enum>(a)</enum><header>Certification</header><text>Not later than 45 days after an event described in subsection (c)(1), the Secretary of Commerce shall determine if a community described in subsection (b)(1) is negatively impacted by trade, and if a positive determination is made, shall certify the community for assistance under this chapter.</text></subsection> 
<subsection id="H01B2FB79435B28932D48E390B54965C"><enum>(b)</enum><header>Determination that community is eligible</header> 
<paragraph id="H379957F641A7123A57E3AEBAF3FB81F"><enum>(1)</enum><header>Community described</header><text>A community described in this paragraph means a community with respect to which on or after October 1, 2004—</text> 
<subparagraph id="HB924C5C94F294EA20B843ABCE006937"><enum>(A)</enum><text>the Secretary of Labor certifies a group of workers (or their authorized representative) in the community as eligible for assistance pursuant to section 223;</text></subparagraph> 
<subparagraph id="H59D8A4D944C7013D71203FABEEEF00F"><enum>(B)</enum><text>the Secretary of Commerce certifies a firm located in the community as eligible for adjustment assistance under section 251;</text></subparagraph> 
<subparagraph id="H2BB134034FAB0EDA972AD29D7CE0568"><enum>(C)</enum><text>the Secretary of Agriculture certifies a group of agricultural commodity producers (or their authorized representative) in the community as eligible for adjustment assistance under section 293;</text></subparagraph> 
<subparagraph id="HFAC4D14F4148402F6D771AA2E6D2ECC"><enum>(D)</enum><text>an affected domestic producer is located in the community; or</text></subparagraph> 
<subparagraph id="H2572B8EC4BEF2441F9CF30ADA650023"><enum>(E)</enum><text>the Secretary determines that a significant number of fishermen in the community is negatively impacted by trade.</text></subparagraph></paragraph> 
<paragraph id="H029ECF304A4B009C21543DB014FAD36"><enum>(2)</enum><header>Negatively impacted by trade</header><text>The Secretary shall determine that a community is negatively impacted by trade, after taking into consideration—</text> 
<subparagraph id="HC477E7ED47AD9CC5D183A6B6A3A0D22"><enum>(A)</enum><text>the number of jobs affected compared to the size of workforce in the community;</text></subparagraph> 
<subparagraph id="H635E1DC1417C5EFCF1E61D8BA1589FF"><enum>(B)</enum><text>the severity of the rates of unemployment in the community and the duration of the unemployment in the community;</text></subparagraph> 
<subparagraph id="H6FAAF4374E2C7B463D4830B6AE62EBA"><enum>(C)</enum><text>the income levels and the extent of underemployment in the community;</text></subparagraph> 
<subparagraph id="H08F32241489EFAD839E22094C391E3B"><enum>(D)</enum><text>the outmigration of population from the community and the extent to which the outmigration is causing economic injury in the community; and</text></subparagraph> 
<subparagraph id="HE607DD324AE2876033D726953CB9E45"><enum>(E)</enum><text>the unique problems and needs of the community.</text></subparagraph></paragraph></subsection> 
<subsection id="H2C6C87E34A7E24ECA91FE7AEF9DD868"><enum>(c)</enum><header>Definition and special rules</header> 
<paragraph id="HF5244DEC4E0ED882AA0A33BFA1A5BD1"><enum>(1)</enum><header>Event described</header><text>An event described in this paragraph means one of the following:</text> 
<subparagraph id="H1A1C24B84EA1E0BAD56B67B164E6B57"><enum>(A)</enum><text>A notification described in paragraph (2).</text></subparagraph> 
<subparagraph id="H0A47F7214ED553CE1BF25D91E2EEC9F"><enum>(B)</enum><text>A certification of a firm under section 251.</text></subparagraph> 
<subparagraph id="H9653BAEE4D2CFE2CA43FD5BDE2610B9"><enum>(C)</enum><text>A finding under the Antidumping Act of 1921, or an antidumping or countervailing duty order issued under title VII of the <act-name parsable-cite="TA30">Tariff Act of 1930</act-name>.</text></subparagraph> 
<subparagraph id="H36BB0B2140FF5A85ECCDE28BE677E63"><enum>(D)</enum><text>A determination by the Secretary that a significant number of fishermen in a community have been negatively impacted by trade.</text></subparagraph></paragraph> 
<paragraph id="H8A6A10314B3A6A5CDBA91C8F58D9DC9"><enum>(2)</enum><header>Notification</header><text>The Secretary of Labor, immediately upon making a determination that a group of workers is eligible for trade adjustment assistance under section 223, (or the Secretary of Agriculture, immediately upon making a determination that a group of agricultural commodity producers is eligible for adjustment assistance under section 293, as the case may be) shall notify the Secretary of Commerce of the determination.</text></paragraph> 
<paragraph id="H8B3077E84ADBA06057FAF89F781FA3D"><enum>(3)</enum><header>Look back</header><text>In any case in which an event described in paragraph (1) occurred on or after January 1, 1998, and before the effective date of this chapter, the Secretary shall, not later than 45 days after such effective date, determine whether the community is negatively impacted by trade, and if a positive determination is made, shall certify the community for assistance under this chapter.</text></paragraph></subsection> 
<subsection id="H34B585A34A2E1E7DEC2EE091A96D800"><enum>(d)</enum><header>Notification to eligible communities</header><text>Immediately upon certification by the Secretary of Commerce that a community is eligible for assistance under subsection (b), the Secretary shall notify the community—</text> 
<paragraph id="H591BE8944B1E75F438C2FB82ACE64DE"><enum>(1)</enum><text>of the determination under subsection (b);</text></paragraph> 
<paragraph id="H3B914F90479B6DCBA2D89DB2FEB94A6"><enum>(2)</enum><text>of the provisions of this chapter;</text></paragraph> 
<paragraph id="HB826333E41202A411FBA20912F4C1FB"><enum>(3)</enum><text>how to access the clearinghouse established by the Department of Commerce regarding available economic assistance;</text></paragraph> 
<paragraph id="H17E4A7804CDFECE3EE7AB98875E2F7E"><enum>(4)</enum><text>how to obtain technical assistance provided under section 272(c)(3); and</text></paragraph> 
<paragraph id="HA5AAE0EF41156A3CD815E7939DA77AE"><enum>(5)</enum><text>how to obtain grants, tax credits, low income loans, and other appropriate economic assistance.</text></paragraph></subsection></section> 
<section id="H04B5071B4E3B6FDA560750A2BF0F537"><enum>274.</enum><header>Strategic plans</header> 
<subsection id="H343FCD694AC51669693425A112CB412"><enum>(a)</enum><header>In general</header><text>An eligible community may develop a strategic plan for community economic adjustment and diversification.</text></subsection> 
<subsection id="HB4539A4A4C534B64F1F7CCA41601E29"><enum>(b)</enum><header>Requirements for strategic plan</header><text>A strategic plan shall contain, at a minimum, the following:</text> 
<paragraph id="HF46B53294466E0D484DF479B62AEE95"><enum>(1)</enum><text>A description and justification of the capacity for economic adjustment, including the method of financing to be used.</text></paragraph> 
<paragraph id="HE9E724DA485361AF78CCCE97156EA66"><enum>(2)</enum><text>A description of the commitment of the community to the strategic plan over the long term and the participation and input of groups affected by economic dislocation.</text></paragraph> 
<paragraph id="HA070139E4C327E8D7E9E31927FB8387"><enum>(3)</enum><text>A description of the projects to be undertaken by the eligible community.</text></paragraph> 
<paragraph id="H272270D440C32AD6579149A005E7BE7"><enum>(4)</enum><text>A description of how the plan and the projects to be undertaken by the eligible community will lead to job creation and job retention in the community.</text></paragraph> 
<paragraph id="H8BE7767A46FB0DAEFCB63AA0C6FE7E3"><enum>(5)</enum><text>A description of how the plan will achieve economic adjustment and diversification.</text></paragraph> 
<paragraph id="HE74661864C1B0C120005A697C7CDFBE"><enum>(6)</enum><text>A description of how the plan and the projects will contribute to establishing or maintaining a level of public services necessary to attract and retain economic investment.</text></paragraph> 
<paragraph id="HC6122C324B005B805942248EEF6792B"><enum>(7)</enum><text>A description and justification for the cost and timing of proposed basic and advanced infrastructure improvements in the eligible community.</text></paragraph> 
<paragraph id="HC17A58324196256995669A9AE58AF10"><enum>(8)</enum><text>A description of how the plan will address the occupational and workforce conditions in the eligible community.</text></paragraph> 
<paragraph id="H0B970DB34C9F4064DF0147817E75E00"><enum>(9)</enum><text>A description of the educational programs available for workforce training and future employment needs.</text></paragraph> 
<paragraph id="HC7218DBE4EF7057EC8437AA3C2DFF80"><enum>(10)</enum><text>A description of how the plan will adapt to changing markets and business cycles.</text></paragraph> 
<paragraph id="H4322947E44834087EE968CBB7DD3B56"><enum>(11)</enum><text>A description and justification for the cost and timing of the total funds required by the community for economic assistance.</text></paragraph> 
<paragraph id="HE137BA9B42DEE81DDDEC94A6B79ED00"><enum>(12)</enum><text>A graduation strategy through which the eligible community demonstrates that the community will terminate the need for Federal assistance.</text></paragraph></subsection> 
<subsection id="H13F57DE74C65A54A94462584FA7B4BC"><enum>(c)</enum><header>Grants to develop strategic plans</header><text>The Secretary, upon receipt of an application from an eligible community, may award a grant to that community to be used to develop the strategic plan.</text></subsection> 
<subsection id="H67897E244CA9ED2F7F6E3A853F254DC"><enum>(d)</enum><header>Submission of plan</header><text>A strategic plan developed under subsection (a) shall be submitted to the Secretary for evaluation and approval.</text></subsection></section> 
<section id="H66B882EE467EBF96A80E138B31DBEE0"><enum>275.</enum><header>Grants for economic development</header> 
<subsection id="HAEF6E0434F32E45BD6FD2AAB3134BCD"><enum>(a)</enum><header>In general</header><text>The Secretary, upon approval of a strategic plan from an eligible community, may award a grant to that community to carry out any project or program that is certified by the Secretary to be included in the strategic plan approved under section 274(d), or consistent with that plan.</text></subsection> 
<subsection id="H936A2B8340D34EFD48CA5A99EA225FB"><enum>(b)</enum><header>Additional grants</header> 
<paragraph id="H9A0717D044944B89689060A747F4C93"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), in order to assist eligible communities to obtain funds under Federal grant programs, other than the grants provided for in section 274(c) or subsection (a), the Secretary may, on the application of an eligible community, make a supplemental grant to the community if—</text> 
<subparagraph id="HFE354E1A4497C4E9CC8C6C9385DF18A"><enum>(A)</enum><text>the purpose of the grant program from which the grant is made is to provide technical or other assistance for planning, constructing, or equipping public works facilities or to provide assistance for public service projects; and</text></subparagraph> 
<subparagraph id="H53189C1346AA6BFF770E80B7B995D00"><enum>(B)</enum><text>the grant is 1 for which the community is eligible except for the community’s inability to meet the non-Federal share requirements of the grant program.</text></subparagraph></paragraph> 
<paragraph id="H7BFF720946942FB7613FF2A5AAFFF6E"><enum>(2)</enum><header>Use as non-federal share</header><text>A supplemental grant made under this subsection may be used to provide the non-Federal share of a project, unless the total Federal contribution to the project for which the grant is being made exceeds 80 percent and that excess is not permitted by law.</text></paragraph></subsection> 
<subsection id="H8E5AF455478DC3B48E91D090FC20600"><enum>(c)</enum><header>Rural community preference</header><text>The Secretary shall develop guidelines to ensure that rural communities receive preference in the allocation of resources.</text></subsection></section> 
<section id="H4AF9967749FD0B86B7ADE3A4C3BB2A0"><enum>276.</enum><header>General provisions</header> 
<subsection id="H89D1B9A24D84840D6C471C80C67D15C"><enum>(a)</enum><header>Regulations</header><text>The Secretary shall prescribe such regulations as are necessary to carry out the provisions of this chapter. Before implementing any regulation or guideline proposed by the Secretary with respect to this chapter, the Secretary shall submit the regulation or guideline to the Committee on Finance of the Senate and the Committee on Ways and Means of the House of Representatives for approval.</text></subsection> 
<subsection id="H69893B304EE5EA8B484B67B0EE60D39"><enum>(b)</enum><header>Supplement not supplant</header><text>Funds appropriated under this chapter shall be used to supplement and not supplant other Federal, State, and local public funds expended to provide economic development assistance for communities.</text></subsection> 
<subsection id="HA60E10214077A5F4A802E9822C09E25"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary $350,000,000 for each of fiscal years 2005 through 2008, to carry out this chapter. Amounts appropriated pursuant to this subsection shall remain available until expended.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1756C8E043EB4DB2240A68963F52FA6"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="HFE0B765249264F7114AB27B0F22CB01"><enum>(1)</enum><header>Termination</header><text>Section 285(b) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19 U.S.C. 2271</external-xref> note) is amended by adding at the end the following new paragraph:</text>

<subparagraph id="H824DFE77C4FF4CB8B3F1FA5F6FCFDFB4"><enum>(B)</enum><text>who, on the last day of such 10-year period, had remaining entitlement to educational assistance under this chapter; and</text></subparagraph> 
<subparagraph id="HBA77621813B842828067FDDD777A430"><enum>(C)</enum><text>who demonstrates to the Secretary that the individual has filed a claim for benefits under a State unemployment compensation law on or after the date of the enactment of this subsection.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H5F0B66BABE2F4798BD551F3F00724100"><enum>(3)</enum><text>A qualified individual may only use entitlement to educational assistance for programs of education pursued on or after the date the individual files an application referred to in paragraph (2)(C).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<subsection id="H4CE62F7972FC470289A52DE0486BEBD0"><enum>(b)</enum><header>Conforming amendment</header><text>The heading for subparagraph (D) of section 72(t)(2) of such Code is amended in the heading by striking <header-in-text level="paragraph"><quote><header-in-text level="subparagraph">for health insurance premiums</header-in-text></quote></header-in-text>. </text></subsection>
