<official-title>To require an annual Department of State report on information relating to the promotion of religious freedom, democracy, and human rights in foreign countries by individuals, nongovernmental organizations, and the media in those countries, and for other purposes.</official-title>

<section id="H187B9C98DF2A4E41992197558DE2CC06" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Liberty List Act</quote>.</text></section> 
<section id="H1A89330A4B244EE594869F66FD024F80"><enum>2.</enum><header>Statement of purpose</header><text display-inline="no-display-inline">The purpose of this Act is to—</text> 
<paragraph id="H7FA23199A39E4B89B300BC9F95DB0084"><enum>(1)</enum><text>highlight the work and accomplishments of individuals, nongovernmental organizations, and the media that promote respect for religious freedom, democracy, and human rights in foreign countries;</text></paragraph> 
<paragraph id="H84FA552F828841B697F568560211C1EF"><enum>(2)</enum><text>draw attention to the conditions in such countries in which these individuals, nongovernmental organizations, and media struggle;</text></paragraph> 
<paragraph id="H54DAAE36DA114A729B5439B05BB1FD46"><enum>(3)</enum><text>offer protection for these individuals, nongovernmental organizations, and media by identifying them to the international community; and</text></paragraph> 
<paragraph id="H6E1B926FFF1D49CE9E9DFC0796C8B051"><enum>(4)</enum><text>emphasize the special significance of respect for religious freedom, democracy, and human rights in United States foreign policy.</text></paragraph></section> 
<section id="HCB526E7428A94F689167B3C7A9005FCB" section-type="subsequent-section"><enum>3.</enum><header>Annual report on promotion of religious freedom, democracy, and human rights in foreign countries by individuals, nongovernmental organizations, and the media in those countries</header> 
<subsection id="H26CEBCB66AA04889852F2B791811A151"><enum>(a)</enum><header>Annual report</header><text>The Foreign Assistance Act of 1961 is amended by adding after section 116 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n</external-xref>) the following new section:</text>

<section id="H00A42902F93643249C89502441481737"><enum>116A.</enum><header>Annual report on promotion of religious freedom, democracy, and human rights in foreign countries</header> 
<subsection id="H3027AA7336544A70AE4E237C1DC5C1F0"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">The Secretary of State shall annually submit to Congress a full and complete report regarding the promotion of religious freedom, democracy, and internationally recognized human rights in foreign countries by individuals, nongovernmental organizations, and media groups and organizations in those countries. The report shall be entitled the <quote>Annual Report on the Promotion of Religious Freedom, Democracy, and Human Rights in Foreign Countries by Individuals, Nongovernmental Organizations, and Media Groups and Organizations</quote>.</text></subsection> 
<subsection id="H4B449A9F0216466A8E4BA18D8C660086"><enum>(b)</enum><header>Preparation</header><text display-inline="yes-display-inline">The Secretary shall prepare the Annual Report with the assistance of the Assistant Secretary of State for Democracy, Human Rights, and Labor and the Ambassador at Large for International Religious Freedom.</text></subsection> 
<subsection id="HCDAEBCD8E3A546F4A3CF28DE8BF67039"><enum>(c)</enum><header>Contents</header><text>The Annual Report shall contain, with respect to a foreign country, the following information:</text> 
<paragraph id="HD7731FEB99524F118000D3E5DB238C99"><enum>(1)</enum><text>An identification of individuals in the country who have made significant efforts to promote religious freedom, democracy, or internationally recognized human rights in that country, together with a description of the nature and extent of those efforts and an assessment of progress made as a result of those efforts.</text></paragraph> 
<paragraph id="H73DA2896423247FBBE91E2F600546FEF"><enum>(2)</enum><text display-inline="yes-display-inline">An identification of nongovernmental organizations in the country that have made significant efforts to promote religious freedom, democracy, or internationally recognized human rights in that country, together with a description of the nature and extent of those efforts and an assessment of progress made as a result of those efforts.</text></paragraph> 
<paragraph id="HF89125F6E5504758B744E3A265AA609D"><enum>(3)</enum><text display-inline="yes-display-inline">An identification of media groups and organizations in the country that have made significant efforts to promote religious freedom, democracy, or internationally recognized human rights in that country, together with a description of the nature and extent of those efforts and an assessment of progress made as a result of those efforts.</text></paragraph></subsection> 
<subsection id="HFDAAB93BCCC345DF9F6860C8CF23465B"><enum>(d)</enum><header>Organization</header><text>The Annual Report shall be organized in three parts, as follows:</text> 
<paragraph id="HDF16A822E23C49249EDC512B187EF5B3"><enum>(1)</enum><text>Part I shall consist of the identification of individuals (and the associated assessment of their efforts) under subsection (b)(1).</text></paragraph> 
<paragraph id="H9FCD1D16AAEB43ECA15870366173C6BD"><enum>(2)</enum><text>Part II shall consist of the identification of nongovernmental organizations (and the associated assessment of their efforts) under subsection (b)(2).</text></paragraph> 
<paragraph id="H205AB6CB824244B8B214B268E66BC7EA"><enum>(3)</enum><text>Part III shall consist of the identification of media groups and organizations (and the associated assessment of their efforts) under subsection (b)(3).</text></paragraph></subsection> 
<subsection id="H8EEDF1520A314BF0A1B0DD8368372740"><enum>(e)</enum><header>Time for submission</header><text display-inline="yes-display-inline">The Secretary shall submit the Annual Report together with, but not as part of, the presentation materials for security assistance programs proposed for each fiscal year.</text></subsection> 
<subsection id="H13C57DC2B95F47848E2356A0B71EDCB9"><enum>(f)</enum><header>Classification</header> 
<paragraph id="H8593B9804A0B47128F7CB107B4BCC8D8"><enum>(1)</enum><header>Unclassified form</header><text>Except as provided in paragraph (2), the Annual Report shall be submitted in unclassified form.</text></paragraph> 
<paragraph id="H94DC42219E474EB8A533CEE269057DEE"><enum>(2)</enum><header>Classified annex</header><text>The Secretary may withhold the identification of an individual, nongovernmental organization, or media group or organization (including the associated assessment) if the Secretary determines that disclosure would endanger or harm such individual, nongovernmental organization, or media group or organization. If the Secretary makes such a determination, the Secretary shall disclose such identification (and associated assessment) in a classified annex.</text></paragraph></subsection> 
<subsection id="HFAA97CC1FE1C4D35BCEC12545D3C8F8C"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H08FE30807E224F47A89B978576067E71"><enum>(1)</enum><header>Annual Report</header><text display-inline="yes-display-inline">The term <quote>Annual Report</quote> means the Annual Report on the Promotion of Religious Freedom, Democracy, and Human Rights in Foreign Countries by Individuals, Nongovernmental Organizations, and Media Groups and Organizations required under subsection (a).</text></paragraph> 
<paragraph id="H77FBEBE345A44E1BB0D298A0F26150F2"><enum>(2)</enum><header>Internationally recognized human rights</header><text>The term <quote>internationally recognized human rights</quote> has the meaning ascribed to it in section 116(a).</text></paragraph> 
<paragraph id="H6B54FF1997A742D79EB63F7E2EE5120"><enum>(3)</enum><header>Media group or organization</header><text display-inline="yes-display-inline">The term <quote>media group or organization</quote> means a group or organization that gathers and disseminates news and information to the public (through any medium of mass communication) in a foreign country in which the group or organization is located, except that the term does not include a group or organization that is primarily an agency or instrumentality of the government of the foreign country. The term includes an individual who is an agent or employee of the media group or organization who acts within the scope of such agency or employment.</text></paragraph> 
<paragraph id="HBEAECF42CD594BB480718813003C8E7B"><enum>(4)</enum><header>Nongovernmental organization</header><text display-inline="yes-display-inline">The term <quote>nongovernmental organization</quote> means an organization that works at the local level to promote religious freedom, democracy, or human rights in a foreign country in which the organization is located, except that the term does not include an organization that is primarily an agency or instrumentality of the government of the foreign country. The term includes an individual who is an agent or employee of the nongovernmental organization who acts within the scope such agency or employment.</text></paragraph> 
<paragraph id="H82FBBD90BD884F00A56213BB54A6098D"><enum>(5)</enum><header>Religious freedom</header><text>The term <quote>religious freedom</quote> means the internationally recognized right to freedom of religion and religious belief and practice, as set forth in the international instruments referred to in paragraph (2) of section 2(a) of the International Religious Freedom Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/22/6401">22 U.S.C. 6401(a)</external-xref>) and as described in paragraph (3) of such section.</text></paragraph> 
<paragraph id="H4EB8C2FA189F4490AD5C46894BE7CB53"><enum>(6)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of State.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4467265B469244B59DC5177B8DFC9DF3"><enum>(b)</enum><header>Effective date</header><text>Section 116A of the Foreign Assistance Act of 1961, as added by subsection (a), shall apply to reports submitted more than one year after such date.</text></subsection></section>
