<official-title>To impose sanctions on foreign entities that engage in certain nuclear proliferation activities, and for other purposes.</official-title>

<section id="H8B9E1245A44C490AB196760064FB397B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nuclear Black-Market Elimination Act</short-title></quote>.</text> </section> 
<title id="H8CA4D484561147B5BBC96DB027C88483"><enum>I</enum><header>Sanctions for nuclear enrichment and reprocessing transfers by foreign persons</header> 
<section id="H2BD5B27DF5E64055809B32647274C500"><enum>101.</enum><header>Authority to impose sanctions</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the President is authorized to prohibit, for a period of not less than three years, any transaction or dealing by a United States person or within the United States with any foreign person or entity that the President determines sells, transfers, brokers, finances, assists, delivers or otherwise provides or receives, on or after the date of the enactment of this Act—</text> 
<paragraph id="H1EF6109E4542433F8BF8A2828E872582"><enum>(1)</enum><text>nuclear enrichment or reprocessing equipment, materials, or technology to—</text> 
<subparagraph id="H39403402F23A40F4B44810955BBE6619"><enum>(A)</enum><text>any country for which an additional protocol with the International Atomic Energy Agency for the application of safeguards (as derived from IAEA document INFCIRC/540 and related corrections and additions) is not in force; or</text></subparagraph> 
<subparagraph id="H7412F683AD9E4059BC62FD7D73E617E8"><enum>(B)</enum><text>to any country that the President determines is developing, constructing, manufacturing, or acquiring a nuclear explosive device; or</text></subparagraph></paragraph> 
<paragraph id="H486D7EC8872D4090A111ED3E7C07EF7E"><enum>(2)</enum><text>designs, equipment, or specific information to assist in the development, construction, manufacture, or acquisition of a nuclear explosive device by a non-nuclear weapon state.</text></paragraph></section> 
<section id="HEF3CFE9AF1704C86B0AE9F31A7E45F00"><enum>102.</enum><header>Presidential determination</header> 
<subsection id="HCBABA9166B8842E9B262CBDE34C9CD32"><enum>(a)</enum><header>Determination</header><text>If the President receives credible information or evidence regarding any activity described in section 101(a) by a foreign person or entity, the President shall promptly make a determination as to whether, in his judgment, such activity occurred.</text></subsection> 
<subsection id="H71B15888DDF74800BACFBD7E3367F6A0"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">If the President makes an affirmative determination under subsection (a), the President shall, within 5 days after making the determination, report the fact and substance of the determination to the appropriate congressional committees.</text></subsection> 
<subsection id="HAD79EFC93C104B7DB152DB9DACE72C36"><enum>(c)</enum><header>Publication of determination</header><text display-inline="yes-display-inline">If the President makes an affirmative determination under subsection (a), the President shall publish in the Federal Register, not later than 15 days after reporting such determination to the Committees under subsection (b), the identity of each foreign person or entity that is subject to that determination and on whom sanctions have been imposed under section 101(a), the reasons for the sanctions, and period during which the sanctions will be in effect.</text></subsection></section> 
<section id="H87586E01575542D2863F5E747DAD7C29"><enum>103.</enum><header>Additional reports</header> 
<subsection id="H0B363D556CA646B9A47215F806B7F4E4"><enum>(a)</enum><header>Possible activity</header><text>The President shall submit to the appropriate congressional committees, not later than January 30th of each year, a report containing all credible information regarding the activities described in section 101(a), regardless of whether the President determines that such activities did in his judgment occur.</text></subsection> 
<subsection id="H1311F7EC292845BBAC19148B3D90C0A6"><enum>(b)</enum><header>Transactions by foreign persons</header><text>The President shall submit to the appropriate congressional committees, not later than June 30th of each year, a report that identifies any foreign person or entity that engages in transactions or dealings with foreign persons or entities on whom sanctions are in effect under section 101(a) that—</text> 
<paragraph id="HE8E9511A55B7494EB40027675892413C"><enum>(1)</enum><text>would be prohibited transactions or dealings subject to sanctions under section 101(a) if those transactions or dealings had been conducted by United States persons or within the United States; and</text></paragraph> 
<paragraph id="H6C09FE815BE04856B7BAC912AC7EB541"><enum>(2)</enum><text>could make material contributions to a nuclear enrichment, reprocessing, or nuclear weapon development program. </text></paragraph><continuation-text continuation-text-level="subsection">The report under this subsection shall be unclassified to the maximum extent feasible, but may also include a classified annex.</continuation-text></subsection></section></title> 
<title id="HD25CF7CBC8DB4FF49B2D5614CF6C3199"><enum>II</enum><header>Incentives for proliferation interdiction cooperation</header> 
<section id="H9DBE37E3D0C84361B124E9DF9300EC33"><enum>201.</enum><header>Authority to provide assistance</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the President is authorized to provide, on such terms as he deems appropriate, assistance under section 202 to any country that cooperates with the United States and with other countries allied with the United States to prevent the transport and transshipment of items of proliferation concern in its national territory or airspace or in vessels under its control or registry.</text></section> 
<section id="HC8F620AB4300428B92BBA81137D459CE"><enum>202.</enum><header>Types of assistance</header><text display-inline="no-display-inline">The assistance authorized under section 201 is the following:</text> 
<paragraph id="HEDB5646F4E8941A8B0A3F699164733C"><enum>(1)</enum><text>Assistance under section 23 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2763">22 U.S.C. 2763</external-xref>).</text></paragraph> 
<paragraph id="HA3A9AFE32F3142E88472CF334D93D236"><enum>(2)</enum><text>Assistance under chapter 4 of part II of the Foreign Assistance Act of 1961, notwithstanding section 531(e) or 660(a) of that Act.</text></paragraph> 
<paragraph id="HEE84052CF20B4C94AB68550006A6D505"><enum>(3)</enum><text>Drawdown of defense equipment and services under section 516 of the Foreign Assistance Act of 1961.</text></paragraph></section> 
<section id="H50326114935E403C0041BC88D96EF74F"><enum>203.</enum><header>Congressional notification</header><text display-inline="no-display-inline">Assistance authorized under this title may not be provided until at least 30 days after the date on which the President has provided notice thereof to the appropriate congressional committees, in accordance with the procedures applicable to reprogramming notifications under section 634A(a) of the Foreign Assistance Act of 1961.</text></section> 
<section id="H76B22DD437474B4EA2C004B2C4572B31"><enum>204.</enum><header>Limitation</header><text display-inline="no-display-inline">Assistance may be provided to a country under section 201 in no more than 3 fiscal years.</text></section> 
<section id="HD8B009196C034BBBAB4E6D46A8833DA5"><enum>205.</enum><header>Use of assistance</header><text display-inline="no-display-inline"> To the extent practicable, assistance provided under this title shall be used to enhance the capability of the recipient country to prevent the transport and transshipment of items of proliferation concern in its national territory or airspace, or in vessels under its control or registry, including through the development of a legal framework in that country to enhance such capability.</text></section> 
<section id="H109CFF0D7F2D4E0CB9737E80655E63E0"><enum>206.</enum><header>Authorization of appropriations</header> 
<subsection id="H98C808E4D54E484A84A98C755B10E238"><enum>(a)</enum><header>Appropriations</header><text>There is authorized to be appropriated $250,000,000 to carry out this title.</text></subsection> 
<subsection id="HDE42EB012A9D48E68F42B02D00FF846E"><enum>(b)</enum><header>Availability</header><text>Amounts appropriated pursuant to subsection (a) are authorized to remain available until expended.</text></subsection></section> 
<section id="HE98BDE54A49C4ABAA45E7DD928E3C54F"><enum>207.</enum><header>Limitation on ship transfers</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the United States may not transfer any excess defense article that is a vessel to a country that has not provided written assurances to the United States that it will support and assist efforts by the United States to interdict items of proliferation concern.</text></section> 
<section id="HB547749F780F4F279802AB7F13857753"><enum>208.</enum><header>Limitation on aircraft transfers</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the United States may not transfer any excess defense article that is an aircraft to any country that has not provided written assurances to the United States that it will support and assist efforts by the United States to interdict items of proliferation concern.</text></section></title> 
<title id="HE7BE466596844BE0975F47E40867A7AE"><enum>III</enum><header>Rollback of khan nuclear proliferation network</header> 
<section id="H9550355CB7DE4F668B85A08E03557F2"><enum>301.</enum><header>Cooperation of Pakistan</header> 
<subsection id="HFE90CDA059804B4500D2ED34DFA83C4"><enum>(a)</enum><header>Limitation</header><text>Notwithstanding any other provision of law, the President may not provide, in any fiscal year, more than 75 percent of United States assistance to Pakistan unless the President determines and certifies to the appropriate congressional committees that Pakistan—</text> 
<paragraph id="H21546DAA02E147A5949ED51B756093E7"><enum>(1)</enum><text>has verifiably halted any cooperation with any state in the development of nuclear or missile technology, material, or equipment, or any other technology, material, or equipment that is useful for the development of weapons of mass destruction, including exports of such technology, material, or equipment; and</text></paragraph> 
<paragraph id="H26E6D87AB060422EA2F4F9BC8F1E542D"><enum>(2)</enum><text>is fully sharing with the United States all information relevant to the A.Q. Khan proliferation network, and has provided full access to A.Q. Khan and his associates and any documentation, declarations, affidavits, or other material that bears upon their proliferation network activities and contacts.</text></paragraph></subsection> 
<subsection id="HB396B43C10C944389E8093D6467DB700"><enum>(b)</enum><header>Waiver</header> 
<paragraph id="H0DB0120D07D54C6900744E399FF62F00"><enum>(1)</enum><header>Authority</header><text>The President may waive the requirements of subsection (a) in a fiscal year if—</text> 
<subparagraph id="HB5379AE396824CA1A2C0AD200000E600"><enum>(A)</enum><text>the President has certified to the appropriate congressional committees that—</text> 
<clause id="HA5CFCCFC9F32405982B1E69BA718038"><enum>(i)</enum><text>the waiver is in the vital interest of the national security of the United States;</text></clause> 
<clause id="H97054F390A0D4B8A921400A09E8EABB"><enum>(ii)</enum><text>the waiver will promote Pakistan’s cooperation in achieving the conditions set forth in paragraphs (1) and (2) of subsection (a); and</text></clause> 
<clause id="H984226CA7F934493942FA4001902CD00"><enum>(iii)</enum><text>Pakistan’s lack of cooperation is not significantly hindering efforts of the United States to investigate and eliminate the Khan proliferation network and any successor networks; and</text></clause></subparagraph> 
<subparagraph id="H773C2EE5B25D4F9BB273CC9B7832869C"><enum>(B)</enum><text>30 days have elapsed since making the certification under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="HF94659059A8F4DE8B2330092C9CE0736"><enum>(2)</enum><header>Briefing</header><text display-inline="yes-display-inline">Within 5 days after making a certification under paragraph (1), the Secretary of State shall brief the appropriate congressional committees on the degree to which Pakistan has or has not satisfied the conditions set forth in paragraphs (1) and (2) of subsection (a)(1).</text></paragraph> 
<paragraph id="HB0FC342BA58C47CF9E03A32CB41900DB"><enum>(3)</enum><header>Limitation</header><text>The waiver authority under paragraph (1) may not be exercised in two successive fiscal years.</text></paragraph></subsection></section> 
<section id="HE13CBA418848457BBEBB005D0306A864"><enum>302.</enum><header>Identification of proliferation network host countries</header><text></text> 
<subsection id="H0B26D597A8604EF38FCC47C99E787755"><enum>(a)</enum><header>Report</header><text>Not later than 30 days after the date of the enactment of this Act, the President shall submit a report to the appropriate congressional committees that identifies any country in which manufacturing, brokering, shipment, transshipment, or other significant activity occurs that is related to the transactions carried out by the various elements and entities of the A.Q. Khan nuclear proliferation network.</text></subsection> 
<subsection id="HCFF4A47E9A404E2F86B270B3E9DCC24F"><enum>(b)</enum><header>Additional information</header><text display-inline="yes-display-inline">After the report is submitted under subsection (a), the President shall submit to the appropriate congressional committees any additional information described in subsection (a) with respect to any country, as such information becomes available.</text></subsection></section> 
<section id="HF0156D1131DE4D538437DA12BE006C27"><enum>303.</enum><header>Suspension of arms sales licenses and deliveries to proliferation network host countries</header> 
<subsection id="HD21A28A1F52142AFA12706455EDA641D"><enum>(a)</enum><header>Suspension</header><text display-inline="yes-display-inline">Upon submission of the report and any additional information under section 302 to the appropriate congressional committees, the President shall suspend all licenses issued under the Arms Export Control Act, and shall prohibit any licenses to be issued under that Act, to any country identified in the report or additional information, until such time as the President certifies to the appropriate congressional committees that such country—</text> 
<paragraph id="H179FFFC3381649AF9528F6971B181658"><enum>(1)</enum><text>has—</text> 
<subparagraph id="HD0537413D6B246DEB87E4FF1BC87C797"><enum>(A)</enum><text>fully investigated the activities of any person or entity within its territory that has participated in the Khan nuclear proliferation network; and</text></subparagraph> 
<subparagraph id="HCFE4C469B43B468C89871633B246D4FC"><enum>(B)</enum><text>taken effective steps to permanently halt all such activities;</text></subparagraph></paragraph> 
<paragraph id="H25575D2D103746BD95E629BDF0CCC98E"><enum>(2)</enum><text>is fully cooperating with the United States in investigating and eliminating the Khan nuclear proliferation network and any successor networks operating within its territory; and</text></paragraph> 
<paragraph id="HD95C570B4929461CB0AC62F44F88D161"><enum>(3)</enum><text>has enacted new laws, promulgated decrees or regulations, or established practices designed to prevent future such activities from occurring within its territory.</text></paragraph></subsection> 
<subsection id="H66CA793F97CE4CBBA098B76F08981D67"><enum>(b)</enum><header>Waiver</header><text>The President may waive the requirements of subsection (a) in a fiscal year if—</text> 
<paragraph id="H531B34C22C9F49E7A89F085588A4F2B7"><enum>(1)</enum><text>the President has certified to the appropriate congressional committees that the waiver is in the vital interest of the national security of the United States; and</text> </paragraph> 
<paragraph id="H7848BC627B3D45489192943696BBCDEE"><enum>(2)</enum><text>5 days have elapsed since making the certification under paragraph (1).</text></paragraph> </subsection></section> </title> 
<title id="H5993862BA80E4CD59DE497349C9FE765"><enum>IV</enum><header>General provisions</header> 
<section id="H1BBF806F6DEA4BEC9B5FAED621686DE1"><enum>401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H323D73C940A24464A057A544F97F7F5E"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means the Committee on International Relations of the House of Representatives and the Committee on Foreign Relations of the Senate.</text></paragraph> 
<paragraph id="HD5555B1014C94014B0648EA2D9430093"><enum>(2)</enum><header>Excess defense article</header><text>The term <quote>excess defense article</quote> has the meaning given that term in section 644(g) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2403">22 U.S.C. 2403(g)</external-xref>).</text></paragraph> 
<paragraph id="HA65A6B21D23C4800B020051D5CAE012"><enum>(3)</enum><header>Foreign person</header><text>The term <quote>foreign person</quote> means a person other than a United States person. </text></paragraph> 
<paragraph id="H33A5954AB4E54116B5E6009B0046F4C8"><enum>(4)</enum><header>Items of proliferation concern</header><text>The term <quote>items of proliferation concern</quote> means any equipment, materials, or technology that could materially support the research, development, manufacturing, or acquisition by any means of a nuclear explosive device, a chemical or biological weapon, or missile with a payload of 500 kilograms or greater and with a range of 300 kilometers or greater.</text></paragraph> 
<paragraph id="H7D921A8AD9774AF08DABBD0053E67B8"><enum>(5)</enum><header>Non-nuclear weapon state</header><text>The term <quote>non-nuclear weapon state</quote> means any state other than the United States, the United Kingdom, France, the Russian Federation, or the People’s Republic of China.</text></paragraph> 
<paragraph id="HE1D2367BC6EF47B2949C5E932F797FE5"><enum>(6)</enum><header>Person</header><text>The term <quote>person</quote>—</text> 
<subparagraph id="H0F72D7D9C9CB466ABE5262EA2B1D0580"><enum>(A)</enum><text>means a natural person as well as a corporation, business association, partnership, society, trust, any other nongovernmental entity, organization, or group, and any governmental entity, or subsidiary, subunit, or parent entity thereof, and any successor of any such entity; and</text></subparagraph> 
<subparagraph id="H7888BDBA7F4C49D480FAFF2625011292"><enum>(B)</enum><text>in the case of a country where it may be impossible to identify a specific governmental entity referred to in subparagraph (A), means all activities of that government relating to the development or production of any nuclear equipment or technology.</text></subparagraph></paragraph> 
<paragraph id="HD6FB7BD7EEF642E188B4D1C132402F6B"><enum>(7)</enum><header>United states assistance</header><text display-inline="yes-display-inline">The term <quote>United States assistance</quote> means assistance under the foreign operations, export financing, and related programs appropriations Act for a fiscal year, and assistance under the Foreign Assistance Act of 1961.</text></paragraph> 
<paragraph id="H20D24BC5E95742769890DC7B33D4D323"><enum>(8)</enum><header>United states person</header><text>The term <quote>United States person</quote> has the meaning given that term in section 14 of the Iran and Libya Sanctions Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/22/1701">22 U.S.C. 1701</external-xref> note).</text></paragraph></section></title>
