<section section-type="section-one" id="H003D5FA617BA4B59003C6FD103FAD9AD" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keeping Our Education Promise to America's Children Act of 2004</short-title></quote>.</text></section> 
<section id="H3566580B08FA45108F7674DFA1657BC8"><enum>2.</enum><header>Deferral of Federal mandates if Federal government fails to make minimum appropriations</header> 
<subsection id="HAE4677CAAA4547DB8814205F4D65851F"><enum>(a)</enum><header>Deferral of certain requirements</header><text>Section 1116 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6316">20 U.S.C. 6316</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Elementary and Secondary Education Act of 1965" id="HA1356CF6FDAF4ACDAAF19B4B0084C4CC"> 
<subsection id="H7AC22790FC5F4641835571228668EF05"><enum>(i)</enum><header>Deferral</header><text>No school or local educational agency may be identified for or subject to the requirements of school improvement, corrective action, or restructuring under this section for any school year for which the amounts appropriated for the corresponding fiscal year for the purpose of carrying out this part are less than 97 percent of the following:</text> 
<paragraph id="H4CE1898CD1294C59B3150053F5E09BB2"><enum>(1)</enum><text>$20,500,000,000 for fiscal year 2005.</text></paragraph> 
<paragraph id="H035EC1FE3F094BB387AE83005F230021"><enum>(2)</enum><text>$22,750,000,000 for fiscal year 2006.</text></paragraph> 
<paragraph id="HA329D834225A4FA3B17CFB5EE777C754"><enum>(3)</enum><text>$25,000,000,000 for fiscal year 2007.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2D958220DAE74556B8D267506A905FE"><enum>(b)</enum><header>Deferral of requirements for teachers and paraprofessionals</header><text>Section 1119 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6319">20 U.S.C. 6319</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H4D67B899800644AE85D28426AACA1889"><enum>(m)</enum><header>Deferral</header><text>A State educational agency may defer the commencement, suspend the implementation, or modify but not cease the development, of the requirements of this section (for the State educational agency and local educational agencies within the State) for 1 school year for each fiscal year for which the amounts appropriated to carry out subparts 1 through 4 of part A of title II are less than 97 percent of the following:</text>
