<official-title>To amend title 18, United States Code, to provide penalties for accessing certain electronic communications in a manner that violates consumer privacy, and for other purposes.</official-title>

<section id="H5F3378A66A80486AB43CC37C2F71902C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>E-mail Privacy Act of 2004</short-title></quote>.</text></section> 
<section id="H40A7E04E62BF4F5FA041615885F57179"><enum>2.</enum><header>Interceptions</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2510">Section 2510(4)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph display-inline="no-display-inline" id="H853CA9573C5E4F18B8217C6652D58F88"><enum>(1)</enum><text>by striking the period at the end; and</text></paragraph> 
<paragraph id="H76624CC374C147669FBABEAFF56BBFC9"><enum>(2)</enum><text>by inserting <quote>, and, with respect to an electronic communication, includes the acquisition of the contents of the communication through the use of any electronic, mechanical, or other device, at any point between the point of origin and the point when it is made available to the recipient </quote> after <quote>device</quote>.</text></paragraph></section> 
<section id="H235F2C21147544AC9E8CB19D5C6CFE"><enum>3.</enum><header>Limitation of service provider exception</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2701">Section 2701(c)(1)</external-xref> of title 18, United States Code, is amended by inserting <quote>to the extent the access is a necessary incident to the rendition of the service, the protection of the rights or property of the provider of that service, or compliance with section 2702</quote> after <quote>service</quote>. </text> </section>
