<section id="H164AF4923D504DA3A8C6ABB24BD3F300" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Material Support to Terrorism Prohibition Enhancement Act of 2004</short-title></quote>.</text> </section> 
<section id="HD34D404481CB4CE3AD623506A0E0FDC"><enum>2.</enum><header>Receiving military-type training from a foreign terrorist organization</header> 
<subsection id="H78E83F17C5BE445891DA2C4CC6FCFBED"><enum>(a)</enum><header>Prohibition as to citizens and residents</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">Chapter 113B</external-xref> of title 18, United States Code, is amended by adding after section 2339C the following new section:</text> 
<quoted-block id="HA80011AA8DBA441B98E1CA1645C8A963" style="USC"> 
<section id="HA667C41B96E249368B6E1BDA5E935017"><enum>2339D.</enum><header>Receiving military-type training from a foreign terrorist organization</header> 
<subsection id="H9CEE956D179A416D9701BBC205DCA6E"><enum>(a)</enum><header>Offense</header><text>Whoever knowingly receives military-type training from or on behalf of any organization designated at the time of the training by the Secretary of State under section 219(a)(1) of the Immigration and Nationality Act as a foreign terrorist organization shall be fined under this title or imprisoned for ten years, or both. To violate this subsection, a person must have knowledge that the organization is a designated terrorist organization (as defined in subsection (c)(4)), that the organization has engaged or engages in terrorist activity (as defined in section 212 of the Immigration and Nationality Act), or that the organization has engaged or engages in terrorism (as defined in section 140(d)(2) of the Foreign Relations Authorization Act, Fiscal Years 1988 and 1989).</text></subsection> 
<subsection id="HC7F51242091049928BFE7221A0A2C88"><enum>(b)</enum><header>Extraterritorial jurisdiction</header><text>There is extraterritorial Federal jurisdiction over an offense under this section. There is jurisdiction over an offense under subsection (a) if—</text> 
<paragraph id="H89BF4A7DE5E6485C9EA6B3CFA4B54FEC"><enum>(1)</enum><text>an offender is a national of the United States (as defined in 101(a)(22) of the Immigration and Nationality Act) or an alien lawfully admitted for permanent residence in the United States (as defined in section 101(a)(20) of the Immigration and Nationality Act);</text></paragraph> 
<paragraph id="HA170AF3EC3FC49F68C5B8BF2250132D8"><enum>(2)</enum><text>an offender is a stateless person whose habitual residence is in the United States;</text></paragraph> 
<paragraph id="H54332052843546EC8854EF9B05556400"><enum>(3)</enum><text>after the conduct required for the offense occurs an offender is brought into or found in the United States, even if the conduct required for the offense occurs outside the United States;</text></paragraph> 
<paragraph id="H712981F35B94483FA47DCB933500B952"><enum>(4)</enum><text>the offense occurs in whole or in part within the United States;</text></paragraph> 
<paragraph id="H862BC53BCB134EA88319F3D2001C8E77"><enum>(5)</enum><text>the offense occurs in or affects interstate or foreign commerce;</text></paragraph> 
<paragraph id="H7915FC1A1B454AC78C6D583C03824ED6"><enum>(6)</enum><text>an offender aids or abets any person over whom jurisdiction exists under this paragraph in committing an offense under subsection (a) or conspires with any person over whom jurisdiction exists under this paragraph to commit an offense under subsection (a).</text></paragraph></subsection> 
<subsection id="HB3BEC9ACEF3B4956A23ECDC2055D8C79"><enum>(c)</enum><header>Definitions</header><text>As used in this section—</text> 
<paragraph id="H9E5A5F61BB4D4F49B667E46CF01CF22D"><enum>(1)</enum><text>the term <quote>military-type training</quote> includes training in means or methods that can cause death or serious bodily injury, destroy or damage property, or disrupt services to critical infrastructure, or training on the use, storage, production, or assembly of any explosive, firearm or other weapon, including any weapon of mass destruction (as defined in section 2232a(c)(2));</text></paragraph> 
<paragraph id="H995D0D8D827D4ED58D03D00CCC48581"><enum>(2)</enum><text>the term <quote>serious bodily injury</quote> has the meaning given that term in section 1365(h)(3);</text></paragraph> 
<paragraph id="H115A5A5CEE5344EF9603C263203CED18"><enum>(3)</enum><text>the term <quote>critical infrastructure</quote> means systems and assets vital to national defense, national security, economic security, public health or safety including both regional and national infrastructure. Critical infrastructure may be publicly or privately owned; examples of critical infrastructure include gas and oil production, storage, or delivery systems, water supply systems, telecommunications networks, electrical power generation or delivery systems, financing and banking systems, emergency services (including medical, police, fire, and rescue services), and transportation systems and services (including highways, mass transit, airlines, and airports); and</text></paragraph> 
<paragraph id="H9FD16551C8254C59B175E3341447DBB2"><enum>(4)</enum><text>the term <quote>foreign terrorist organization</quote> means an organization designated as a terrorist organization under section 219(a)(1) of the Immigration and Nationality Act.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7BEEFAFF9EEC40BC85006BCA460270C0"><enum>(b)</enum><header>Inadmissibility of aliens who have received military-type training from terrorist organizations</header><text>Section 212(a)(3)(B)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(B)(i)</external-xref>) is amended—</text> 
<paragraph id="H00EA6D08AC7140F68B234713BFE82FF3"><enum>(1)</enum><text>in subclauses (V) and (VI), by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="H840B7D6F7B304E6889D6C23F1E25F7CE"><enum>(2)</enum><text>in subclause (VII), by adding <quote>or</quote> at the end; and</text></paragraph> 
<paragraph id="HC2F6752FE8C2487E9122277FB6708E47"><enum>(3)</enum><text>by inserting after subclause (VII) the following:</text> 
<quoted-block style="OLC" id="HE2F38CBB92DA4F54A1486E994ED0C6BA" display-inline="no-display-inline"> 
<subclause id="H6BEBA6B05F8F4B19AF007D34FAE0D8E0"><enum>(VIII)</enum><text>has received military-type training (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2339D">section 2339D(c)(1)</external-xref> of title 18, United States Code) from or on behalf of any organization that, at the time the training was received, was a terrorist organization under section 212(a)(3)(B)(vi);</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> </subsection> 
<subsection id="HE53782E0C69748D98403003749149FD6"><enum>(c)</enum><header>Inadmissibility of representatives and members of terrorist organizations</header><text>Section 212(a)(3)(B)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(B)(i)</external-xref>) is amended—</text> 
<paragraph id="H8B436E27D9ED4AD3B600ECDFF7BEF8C5"><enum>(1)</enum><text>in subclause (IV), by amending item (aa) to read as follows:</text> 
<quoted-block style="OLC" id="H56507AB9B0824952A7A60165F0A8C42D" display-inline="no-display-inline"> 
<item id="HD109538E666749C499C2C824AA5405E5"><enum>(aa)</enum><text>a terrorist organization, as defined in clause (vi), or</text></item><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HB802FFF3F8C241749876FC3C48055393"><enum>(2)</enum><text>by amending subclause (V) to read as follows:</text> 
<quoted-block style="OLC" id="H7FCF08304E0D4E48819CA3A274FF95D4" display-inline="no-display-inline"> 
<subclause id="H7B655E15FC3C487E8539A58FAD60B628"><enum>(V)</enum><text>is a member of a terrorist organization, as defined in subclause (I) or (II) of clause (vi), or of an organization which the alien knows or should have known is a terrorist organization,</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H98C31EA2E99A4209895073A0B3ABE692"><enum>(d)</enum><header>Deportation of aliens who have received military-type training from terrorist organizations</header><text>Section 237(a)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(4)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="H170F0E15342F4B9695D7EB7F3B28807E" style="OLC"> 
<subparagraph id="H3D6A3BA8AA55406388E9EAE4E9A469D4"><enum>(E)</enum><header>Recipient of military-type training</header><text>Any alien who has received military-type training (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2339d">section 2339d(c)(1)</external-xref> of title 18, United States Code) from or on behalf of any organization that, at the time the training was received, was a terrorist organization, as defined in section 212(a)(3)(b)(vi), is deportable.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HAAEB9ACCA0E2483200A2275F924EFD45"><enum>(e)</enum><header>Retroactive application</header><text>The amendments made by subsections (b), (c), and (d) shall apply to the receipt of military training occurring before, on, or after the date of the enactment of this Act.</text></subsection></section> 
<section id="H8B4AE068A1E545BD83A56EC06F522100"><enum>3.</enum><header>Providing material support to terrorism</header> 
<subsection id="H8C2058BC2A56485490A17F273D9FDD12"><enum>(a)</enum><header>Additions to offense of providing material support to terrorists</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2339A">Section 2339A(a)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H1EA768C092E448E1B5FEA0E69C00ABC9"><enum>(1)</enum><text>by designating the first sentence as paragraph (1);</text></paragraph> 
<paragraph id="HCB45DEAE82964027A1136817006E07AD"><enum>(2)</enum><text>by designating the second sentence as paragraph (3);</text></paragraph> 
<paragraph id="H675B5F6F43804C60BE3D82302BE5EFD4"><enum>(3)</enum><text>by inserting after paragraph (1) as so designated by this subsection the following:</text> 
<quoted-block id="H72778B7297744D84A1DD125FBCA5F1E" style="OLC"> 
<paragraph id="HC4023A69B50542A58DF6F3D29705B6B"><enum>(2)</enum> 
<subparagraph id="H6D4D70C5A01F4234AA8D83AEB1F8B41" display-inline="yes-display-inline"><enum>(A)</enum><text>Whoever in a circumstance described in subparagraph (B) provides material support or resources or conceals or disguises the nature, location, source, or ownership of material support or resources, knowing or intending that they are to be used in preparation for, or in carrying out, an act of international or domestic terrorism (as defined in section 2331), or in preparation for, or in carrying out, the concealment or escape from the commission of any such act, or attempts or conspires to do so, shall be punished as provided under paragraph (1) for an offense under that paragraph.</text></subparagraph> 
<subparagraph id="H749A94238A364D9BB253AA9D59EA9B03" indent="up1"><enum>(B)</enum><text>The circumstances referred to in subparagraph (A) are any of the following:</text> 
<clause id="H1517461878674C5B85007EDA80B5A425"><enum>(i)</enum><text>The offense occurs in or affects interstate or foreign commerce.</text></clause> 
<clause id="H11443AFF609C4853A144169DC5A0492"><enum>(ii)</enum><text>The act of terrorism is an act of international or domestic terrorism that violates the criminal law of the United States.</text></clause> 
<clause id="H0749A7A9CC1E4A4EAE16D2A4606EA099"><enum>(iii)</enum><text>The act of terrorism is an act of domestic terrorism that appears to be intended to influence the policy, or affect the conduct, of the Government of the United States or a foreign government.</text></clause> 
<clause id="H44124BFAB900402091C81F1B07B23C7"><enum>(iv)</enum><text>An offender, acting within the United States or outside the territorial jurisdiction of the United States, is a national of the United States (as defined in section 101(a)(22) of the Immigration and Nationality Act, an alien lawfully admitted for permanent residence in the United States (as defined in section 101(a)(20) of the Immigration and Nationality Act , or a stateless person whose habitual residence is in the United States, and the act of terrorism is an act of international terrorism that appears to be intended to influence the policy, or affect the conduct, of the Government of the United States or a foreign government.</text></clause> 
<clause id="HBFBDD8AEE1EA4C42BE0993D19374666D"><enum>(v)</enum><text>An offender, acting within the United States, is an alien, and the act of terrorism is an act of international terrorism that appears to be intended to influence the policy, or affect the conduct, of the Government of the United States or a foreign government.</text></clause> 
<clause id="HAD189CEA97A54CC1AE82A87C00A00EA"><enum>(vi)</enum><text>An offender, acting outside the territorial jurisdiction of the United States, is an alien and the act of terrorism is an act of international terrorism that appears to be intended to influence the policy of, or affect the conduct of, the Government of the United States.</text></clause> 
<clause id="H22710A41F33041D59F4B26DAA7987FD"><enum>(vii)</enum><text>An offender aids or abets any person over whom jurisdiction exists under this paragraph in committing an offense under this paragraph or conspires with any person over whom jurisdiction exists under this paragraph to commit an offense under this paragraph.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H6F748D0B0D4E4ED6A59BB0D37762AAA7"><enum>(4)</enum><text>by inserting <quote>act or</quote> after <quote>underlying</quote>.</text></paragraph></subsection> 
<subsection id="H0E1E6ECFFD0D4BF8B205189D00E600B0"><enum>(b)</enum><header>Definitions</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2339A">Section 2339A(b)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="HF3889A199FB347BCA980A0905765BB18"><enum>(1)</enum><text>by striking <quote>In this</quote> and inserting <quote>(1) In this</quote>; </text></paragraph> 
<paragraph id="HF04F70D5030940C9951BE722DADD946"><enum>(2)</enum><text>by inserting <quote>any property, tangible or intangible, or service, including</quote> after <quote>means</quote>;</text></paragraph> 
<paragraph id="HC16387ED34724BFC83C8A903715B3304"><enum>(3)</enum><text>by inserting <quote>(one or more individuals who may be or include oneself)</quote> after <quote>personnel</quote>;</text></paragraph> 
<paragraph id="H6B1AF49E6871432AA49D6E809668E6B"><enum>(4)</enum><text>by inserting <quote>and</quote> before <quote>transportation</quote>; </text></paragraph> 
<paragraph id="H1B7CC25D3D4A46D400427000C564C3C"><enum>(5)</enum><text>by striking <quote>and other physical assets</quote>; and</text></paragraph> 
<paragraph id="HC67406B443B9454C829276743091FDBD"><enum>(6)</enum><text>by adding at the end the following: </text> 
<quoted-block style="OLC" id="HAFB46FACDE504A8F92A4F7121FE1B66" display-inline="no-display-inline"> 
<paragraph id="H63C364A080364AD8B0D494FE8297FD8C" indent="up1"><enum>(2)</enum><text>As used in this subsection, the term <quote>training</quote> means instruction or teaching designed to impart a specific skill, as opposed to general knowledge, and the term <quote>expert advice or assistance</quote> means advice or assistance derived from scientific, technical or other specialized knowledge.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD20431889D5B4055A72358FDF20259E7"><enum>(c)</enum><header>Addition to offense of providing material support to terrorist organizations</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2339B">Section 2339B(a)(1)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H1A9A6898C49E443496114E7CB8375F97"><enum>(1)</enum><text>by striking <quote>, within the United States or subject to the jurisdiction of the United States,</quote> and inserting <quote>in a circumstance described in paragraph (2)</quote> ; and</text></paragraph> 
<paragraph id="HD1F898626F15414FBA333D49011F66E9"><enum>(2)</enum><text>by adding at the end the following: <quote>To violate this paragraph, a person must have knowledge that the organization is a designated terrorist organization (as defined in subsection (g)(6)), that the organization has engaged or engages in terrorist activity (as defined in section 212(a)(3)(B) of the Immigration and Nationality Act, or that the organization has engaged or engages in terrorism (as defined in section 140(d)(2) of the Foreign Relations Authorization Act, Fiscal Years 1988 and 1989.</quote>.</text></paragraph></subsection> 
<subsection id="HA2AEAABD05D045188BCE610356FE5DB0"><enum>(d)</enum><header>Federal authority</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2339B">Section 2339B(d)</external-xref> of title 18 is amended—</text> 
<paragraph id="HF82131BFD0C44CB58CBB8590FF3BA7BD"><enum>(1)</enum><text>by inserting <quote>(1)</quote> before <quote>There</quote>; and</text></paragraph> 
<paragraph id="H17026B0BB0B94E51A31FFDECA927F8FA"><enum>(2)</enum><text>by adding at the end the following: </text> 
<quoted-block style="OLC" id="H7E04FD4706BC4F81817338E432CB00C0" display-inline="no-display-inline"> 
<paragraph id="H859A32025A0043B3898C1C002B1B094D" indent="up1"><enum>(2)</enum><text>The circumstances referred to in paragraph (1) are any of the following:</text> 
<subparagraph id="HF2B4C236049745849227C83C61BDFE00"><enum>(A)</enum><text>An offender is a national of the United States (as defined in section 101(a)(22) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(22)</external-xref>) or an alien lawfully admitted for permanent residence in the United States (as defined in section 101(a)(20) of the Immigration and Nationality Act.</text></subparagraph> 
<subparagraph id="HF1F24D19747A43079F68005DB54939A5"><enum>(B)</enum><text>An offender is a stateless person whose habitual residence is in the United States.</text></subparagraph> 
<subparagraph id="H0D44B695BE994A3087AA58BC9B9E04D1"><enum>(C)</enum><text>After the conduct required for the offense occurs an offender is brought into or found in the United States, even if the conduct required for the offense occurs outside the United States.</text></subparagraph> 
<subparagraph id="HDB7936F08B454FFAB51D00DD911023D6"><enum>(D)</enum><text>The offense occurs in whole or in part within the United States.</text></subparagraph> 
<subparagraph id="H04869E0976E74AC08876EC61AF3549A9"><enum>(E)</enum><text>The offense occurs in or affects interstate or foreign commerce.</text></subparagraph> 
<subparagraph id="H8B8073D9061149B89ED4ED19BD4E1CC4"><enum>(F)</enum><text>An offender aids or abets any person over whom jurisdiction exists under this paragraph in committing an offense under subsection (a) or conspires with any person over whom jurisdiction exists under this paragraph to commit an offense under subsection (a).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H76D200BA0F05417A94E7F789A1FB287F"><enum>(e)</enum><header>Definition</header><text>Paragraph (4) of <external-xref legal-doc="usc" parsable-cite="usc/18/2339B">section 2339B(g)</external-xref> of title 18, United States Code, is amended to read as follows:</text> 
<quoted-block id="H363104F07142466C85E70131B6DA5D0" style="OLC"> 
<paragraph id="H07FB27EACFC040CF93A043E5E52578C9"><enum>(4)</enum><text>the term <quote>material support or resources</quote> has the same meaning given that term in section 2339A;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H699B903A28F24BCC8EA644F58962F9D0"><enum>(f)</enum><header>Additional provisions</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2339B">Section 2339B</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="H7900DD3D32C94B5094754F6743AF72CC" style="OLC"> 
<subsection id="H461EC569D5944DCFA9AA6576D2BD336E"><enum>(h)</enum><header>Provision of personnel</header><text>No person may be prosecuted under this section in connection with the term <quote>personnel</quote> unless that person has knowingly provided, attempted to provide, or conspired to provide a foreign terrorist organization with one or more individuals (who may be or include himself) to work under that terrorist organization’s direction or control or to organize, manage, supervise, or otherwise direct the operation of that organization. Individuals who act entirely independently of the foreign terrorist organization to advance its goals or objectives shall not be considered to be working under the foreign terrorist organization’s direction and control.</text></subsection> 
<subsection id="H7AB8B323520945E5B129039086D3F34D"><enum>(i)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed or applied so as to abridge the exercise of rights guaranteed under the First Amendment to the Constitution of the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H4837594E897B45BDB5577400005FA27D"><enum>4.</enum><header>Financing of terrorism</header> 
<subsection id="H0BD9B57FD5044075B1EDDF2F557CC353"><enum>(a)</enum><header>Financing terrorism</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2339c">Section 2339c(c)(2)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H5F91DCCC55A64057A9D77BCE909DD46C"><enum>(1)</enum><text>by striking <quote>, resources, or funds</quote> and inserting <quote>or resources, or any funds or proceeds of such funds</quote>;</text></paragraph> 
<paragraph id="HA8118A3104F140FEA1301B5BB44F1EAC"><enum>(2)</enum><text>in subparagraph (A), by striking <quote>were provided</quote> and inserting <quote>are to be provided, or knowing that the support or resources were provided,</quote>; and</text></paragraph> 
<paragraph id="HE1E1A288121349B3952931BA01513F65"><enum>(3)</enum><text>in subparagraph (B)—</text> 
<subparagraph id="H44F898F4D53442E39DBD8EECA934728"><enum>(A)</enum><text>by striking <quote>or any proceeds of such funds</quote>; and</text></subparagraph> 
<subparagraph id="H473A2589D8E44B06A9DDC5719713E757"><enum>(B)</enum><text>by striking <quote>were provided or collected</quote> and inserting <quote>are to be provided or collected, or knowing that the funds were provided or collected,</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H1633B0A53B1C458680A83192DCDD94E3"><enum>(b)</enum><header>Definitions</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2339c">Section 2339c(e)</external-xref> of title 18, United States Code, is amended—</text>
