<section id="H059B39B39C7642DCAA4C2B12DD002EAF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Coral Reef Conservation and Protection Act of 2004</quote>.</text></section> 
<section id="HE3A43B328D2D4465B842F774D1D66129"><enum>2.</enum><header>Findings and purpose</header> 
<subsection id="H73537785EDC44E05AE25B6CB800D0A2"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="HE4FAF915245347F38679F47235B1366B"><enum>(1)</enum><text>Coral reefs and coral reef ecosystems are the marine equivalent of tropical rain forests, containing some of the richest biological diversity, habitats, and systems on Earth and supporting thousands of fish, invertebrates, algae, plankton, sea grasses, and other species.</text></paragraph> 
<paragraph id="H7D50F37FCC204F42A56845B6CA39B3BD"><enum>(2)</enum><text>Coral reefs and coral reef ecosystems have great commercial, recreational, cultural, and aesthetic value to human communities as shoreline protection, areas of natural beauty, and sources of food, jobs, and pharmaceuticals, and are the focus of a wide variety of activities, including education, research, recreation, tourism, and fishing.</text></paragraph> 
<paragraph id="H163176E416294EADB09FB464B344887"><enum>(3)</enum><text>Studies indicate that coral reef ecosystems in the United States and around the world are being degraded and severely threatened by human activities including land-based pollution, overfishing, destructive fishing practices, coastal development, vessel groundings, and climate change.</text></paragraph> 
<paragraph id="H820DE9897E2B47DDBA77AA457340F931"><enum>(4)</enum><text>Executive Order 13089 created the United States Coral Reef Task Force, which is chaired by the Secretary of the Interior and the Secretary of Commerce, to develop measures necessary to reduce and mitigate coral reef ecosystem degradation and to restore damaged coral reefs, assess the United States’ role in international trade and protection of coral reef species, and implement appropriate strategies and actions to promote conservation and sustainable use of coral reef resources.</text></paragraph> 
<paragraph id="HA569E928F74840B88DC1000079D515E3"><enum>(5)</enum><text>International trade in coral, other reef invertebrates, reef fish, live rock, and other coral products contributes to the decline and degradation of reefs, primarily through the use of destructive collection practices, overexploitation of resources, loss of reef habitat, and introduction of non-indigenous species, invasive species, and pathogens.</text></paragraph> 
<paragraph id="H522E91ECE3264E86927EBA70D0F0C9E1"><enum>(6)</enum><text>The United States is the largest importer of live coral, live rock, and marine fish for the aquarium trade and of coral skeletons and precious corals for souvenirs and jewelry.</text></paragraph> 
<paragraph id="H75EE5B3AFC5447F5BFEC2E6153ECBF79"><enum>(7)</enum><text>The harvest of live coral and wild live rock is of special concern because it removes essential components of reef habitats, increases erosion, and damages critical fisheries habitats.</text></paragraph> 
<paragraph id="H0F84DCA15B2E412500721505155BF296"><enum>(8)</enum><text>More than half of the fish imported into the United States for the marine aquarium market are estimated to be captured with the use of cyanide and other poisons which kill other coral reef species and the corals that form the reef framework, and these destructive fishing practices are becoming increasingly common in other countries to meet the growing worldwide demand for ornamental fish and live food fish.</text></paragraph> 
<paragraph id="HAFED8698247742F1B194AA70828E631C"><enum>(9)</enum><text>As many as <fraction>1/3</fraction> to <fraction>1/2</fraction> of the aquarium fish imported from Southeast Asia die shortly after arriving in the United States due to stress associated with handling and transport and the use of cyanide during capture, and such high mortality rates lead to continued pressure for extraction from the wild to maintain public and private collections.</text></paragraph> 
<paragraph id="HB2949B0D590D416080559DCE8E847E6C"><enum>(10)</enum><text>The United States, as the world’s largest importer of coral reef species and products and as a party to the Convention on the International Trade in Endangered Species of Wild Fauna and Flora (CITES), should play a substantial role in conserving and restoring coral reef ecosystems, including assisting other countries in developing and implementing coral reef conservation programs and ensuring that the market in the United States for coral reef species and products does not contribute to the detriment of the survival of the species in the wild or to the detriment of coral reef ecosystems.</text></paragraph> 
<paragraph id="HDF9726CFEE1F4145B2D492509BDAC6A"><enum>(11)</enum><text>The United States should also exercise leadership in moving from a species-based sustainable management approach to an ecosystem-based approach.</text></paragraph> </subsection> 
<subsection id="H5C1333AB6F3444028442F97D56F15BC"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to provide a series of nondiscriminatory measures which are necessary for the conservation of coral reef species and further the obligations of the United States under CITES.</text></subsection></section> 
<section id="H8A5F5FE70078479CBC4F75AC00EDDC4"><enum>3.</enum><header>Prohibition on taking, importing, exporting, and transporting certain coral reef species</header> 
<subsection id="H1C8B919F147046438DEC49005C567BEF"><enum>(a)</enum><header>In general</header><text>Subject to section 4, it is unlawful for any person to—</text> 
<paragraph id="HFBC73E4EDCC24F0288E32576AC2DDE3"><enum>(1)</enum><text>take any covered coral reef species within waters under the jurisdiction of the United States;</text></paragraph> 
<paragraph id="H76E1D9E341174E33BE7F25744DCAFB2F"><enum>(2)</enum><text>import into or export from the United States any covered coral reef species;</text></paragraph> 
<paragraph id="H20402530FD2E4699976C2309C82079B8"><enum>(3)</enum><text>possess, sell, purchase, deliver, carry, transport, or receive in interstate or foreign commerce any covered coral reef species taken or imported in violation of paragraphs (1) or (2); or</text></paragraph> 
<paragraph id="H34CBFBBE27544F5EAF5200C3B0198BDA"><enum>(4)</enum><text>attempt to commit any act described in paragraphs (1) through (3).</text></paragraph></subsection> 
<subsection id="H20BA6E01E589456A89C52536D21198EF"><enum>(b)</enum><header>Covered coral reef species</header> 
<paragraph id="H91482679E036448789C3C21E26BC3500"><enum>(1)</enum><header>In general</header><text>For the purposes of this Act, the term <quote>covered coral reef species</quote> means— </text> 
<subparagraph id="HE423649719B8451D94E52235A08F0320"><enum>(A)</enum><text>any species of coral or ornamental reef fish;</text></subparagraph> 
<subparagraph id="H75989074D9664BD3881788CDC11CFB04"><enum>(B)</enum><text>any coral reef species listed in Appendix II of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) as of the effective date of this Act;</text></subparagraph> 
<subparagraph id="HCF99C5563A914255AC524800DA02DC9"><enum>(C)</enum><text>any coral reef species added to Appendix II of CITES after the effective date of this Act, unless the Secretary of the Interior, in consultation with the Secretary of Commerce, finds before the expiration of the 90-day period which begins on the effective date of the inclusion of such species in Appendix II that the take, import, and export of such species do not represent a substantial risk of harm to the sustainability of such species and its coral reef ecosystem; or</text></subparagraph> 
<subparagraph id="H6F5333CE814D48C38262B856CD259D3C"><enum>(D)</enum><text>any other coral reef species (excluding any finfish, mollusk, crustacean, or other animal or plant species taken for human consumption) the take, import, or export of which the Secretary of the Interior and the Secretary of Commerce have determined, after notice and opportunity for public comment—</text> 
<clause id="H468F12A383264A9DBA328C465659B56"><enum>(i)</enum><text>presents a substantial risk of harm to the sustainability of such species or of its coral reef ecosystem; or</text></clause> 
<clause id="HA83377B34BC248F09B11B873FE97F57F"><enum>(ii)</enum><text>results in high mortality rates for individuals of that species due to poor survivorship in transport or captivity.</text></clause></subparagraph></paragraph> 
<paragraph id="HB359D5C0B16F433BA8295471B3A57369"><enum>(2)</enum><header>Removal of a species from definition</header> 
<subparagraph id="HFBAD36DBBD984C63A917EE63F5AEBDDB"><enum>(A)</enum><header>In general</header><text>A species may be removed from the definition of covered coral reef species under paragraphs (1)(B) through (D), if the Secretary of the Interior determines that the take, import, and export of such species do not represent a substantial risk of harm to the sustainability of that species and of its coral reef ecosystem.</text></subparagraph> 
<subparagraph id="H9EE05880F8504A338821CDDF2DE01297"><enum>(B)</enum><header>Role of Secretary of Commerce</header><text>In carrying out subparagraph (A), the Secretary of the Interior shall consult with the Secretary of the Commerce with respect to a covered coral reef species under paragraph (1)(B) or (1)(C), and act jointly with the Secretary of the Interior with respect to a covered coral reef species under paragraph (1)(D).</text> </subparagraph></paragraph></subsection> 
<subsection id="H3A1CC27D02144A55989349E4853FF055"><enum>(c)</enum><header>Effective date</header><text>This section shall take effect upon the expiration of the 1-year period which begins on the date of the enactment of this Act.</text></subsection> </section> 
<section id="HFBD2EE5C650B49AFB95229108C350804"><enum>4.</enum><header>Exceptions</header> 
<subsection id="H7CDB4AF1C6CD499885BEA4900E9F7DF"><enum>(a)</enum><header>In general</header> 
<paragraph id="H31622957C61140978BD0007C8226121E"><enum>(1)</enum><header>Scientifically-based management plans</header> 
<subparagraph id="H2DD9C1AF99094C3F9ED9101B38E5386B"><enum>(A)</enum><header>Exception</header><text>Section 3 shall not apply with respect to a covered coral reef species if such species was taken in accordance with a qualified scientifically-based management plan.</text></subparagraph> 
<subparagraph id="H176B5B732B1A423591F8004838BB85F6"><enum>(B)</enum><header>Qualification of plan</header><text display-inline="yes-display-inline">For purposes of this subsection, a scientifically-based management plan is qualified if the appropriate Secretary determines that the plan—</text> 
<clause id="HBB56C3550D1448EC845DC39564DDCDA7"><enum>(i)</enum><text>provides for the conservation of a covered coral reef species and its habitat;</text></clause> 
<clause id="HA5F9C6797EC4427DB2887F7FECF0742B"><enum>(ii)</enum><text>provides that a covered coral reef species is taken in such a manner and in such quantities so as not to threaten the biological sustainability of that species or its role in the ecosystem and so as to minimize the adverse impact of the take on the coral reef;</text></clause> 
<clause id="H8BDDC3DB3E9F432590BF006211C4CC0"><enum>(iii)</enum><text>addresses factors relevant to the conservation of a covered coral reef species, which may include illegal trade, domestic trade, subsistence use, disease, habitat loss, and cumulative effects of the take on the coral reef species; and</text></clause> 
<clause id="H4EBD46CE0EBD426B94492FC3EF8619C4"><enum>(iv)</enum><text>prohibits the use of the destructive collection practices described in subsection (b)(2).</text></clause></subparagraph> 
<subparagraph id="H613C7B21A0224D348F4027DAFC5F1CC2"><enum>(C)</enum><header>Appropriate Secretary</header><text>For purposes of this paragraph, the term <quote>appropriate Secretary</quote> means—</text> 
<clause id="HB149D3078432449291FBD85568404D2"><enum>(i)</enum><text>the Secretary of Commerce with respect to domestic plans;</text></clause> 
<clause id="HD0E1E05BF2D8431ABC44D575314399C4"><enum>(ii)</enum><text>the Secretary of Commerce and the Secretary of the Interior with respect to foreign plans; or</text></clause> 
<clause id="HB385BB839FC94B8300CA00195F36751F"><enum>(iii)</enum><text>the Secretary with jurisdiction over the waters in which the plan is located with respect to plans located in waters within the Exclusive Economic Zone (as defined under section (3) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1802">16 U.S.C. 1802</external-xref>)).</text></clause></subparagraph> </paragraph> 
<paragraph id="HF55A4ABA154042D59F87C89C6332CEA7"><enum>(2)</enum><header>Cooperative breeding programs</header> 
<subparagraph id="H1CAD8933B2084F66BCA19134FB6C3711"><enum>(A)</enum><header>Exception</header><text>Section 3 shall not apply with respect to a covered coral reef species if such species is a product of a qualified cooperative breeding program.</text></subparagraph> 
<subparagraph id="HBB22807339844AFDB542E1BC49B4CB5"><enum>(B)</enum><header>Qualification of program</header><text>For purposes of this subsection, a cooperative breeding program is qualified if the Secretary of Commerce, in the case of domestic programs, or the Secretary of Commerce and the Secretary of the Interior, in the case of foreign programs, determines that the program is—</text> 
<clause id="HC952C01E30A54C81B22B439BB215DFCB"><enum>(i)</enum><text>designed to promote the conservation of covered coral reef species and maintain such species in the wild by enhancing the propagation and survival of such species; and</text></clause> 
<clause id="H8F287E142EF34B2EA5B91F23C7D06657"><enum>(ii)</enum><text>developed and administered by, or in conjunction with, an aquarium, conservation, or zoological organization which meets standards established by the appropriate Secretary.</text></clause></subparagraph></paragraph> 
<paragraph id="H7C11B0B7EF464BCF913C8FBAB7E3BCAC"><enum>(3)</enum><header>Aquaculture and mariculture facilities</header><text></text> 
<subparagraph id="H953AA3230C1A4EE1B19170FEFF004CBC"><enum>(A)</enum><header>Exception</header><text>Section 3 shall not apply with respect to a covered coral reef species if such species is a product of a qualified aquaculture or mariculture facility.</text></subparagraph> 
<subparagraph id="HA14304589B944AC0A36360DC7DC7C19F"><enum>(B)</enum><header>Qualification of facility</header><text>For purposes of this subsection, an aquaculture or mariculture facility is qualified if the Secretary of Commerce, in the case of domestic facilities, or the Secretary of Commerce and the Secretary of the Interior, in the case of foreign facilities, determines that the facility—</text> 
<clause id="H56E05A89CDD841D9BA7BF8CD2F324EAF"><enum>(i)</enum><text>demonstrates the capability to produce sufficient captive covered coral reef species in the numbers to be traded from that facility;</text></clause> 
<clause id="HC4B88291D1B94A69AA32D9F3A4D451D"><enum>(ii)</enum><text>operates in a manner which is not detrimental to the conservation of the species in the wild;</text></clause> 
<clause id="H6836D715FCE14E9FB3562B7CB071A661"><enum>(iii)</enum><text>operates in a manner which does not harm existing ecosystems, such as by introducing non-indigenous species or pathogens; and</text></clause> 
<clause id="HFB7B7082DE6442EDB7C4D4C7E8C34D6"><enum>(iv)</enum><text>operates with sufficient safeguards so as to prevent the escape of captive species and their eggs, larvae, young, fragments, and other organs of propagation.</text></clause></subparagraph></paragraph> 
<paragraph id="H9A356371C4A84E2BA0A9C8D44DCBCFC"><enum>(4)</enum><header>Scientific, museum, or zoological purposes</header><text>Section 3 shall not apply with respect to a covered coral reef species taken pursuant to authorization by the Secretary of Commerce, or imported or exported pursuant to authorization by the Secretary of the Interior for scientific purposes, museum purposes, or zoological breeding or display.</text></paragraph> 
<paragraph id="H5C9FEF62D725463B87CFD00011432242"><enum>(5)</enum><header>Incidental takes</header><text>Section 3 shall not apply with respect to a covered coral reef species taken incidentally, if such incidental takes are exempted by the Secretary of the Interior and the Secretary of Commerce by regulation.</text></paragraph> 
<paragraph id="H424DE0B4FA85474ABBCD36CF8EA60051"><enum>(6)</enum><header>Subsistence</header><text>Section 3 shall not apply with respect to a covered coral reef species taken for personal consumption by an individual, if the taking is customary, traditional, or necessary for the subsistence of the individual or the individual’s family.</text></paragraph></subsection> 
<subsection id="H593952D1222645EB8ECA8FE05D251E6B"><enum>(b)</enum><header>No exception for species taken using destructive collection practices</header> 
<paragraph id="H8E9D6AEA906446A6BBF9CDCBB650F342"><enum>(1)</enum><header>In general</header><text>No exception shall be allowed under subsection (a) with respect to a covered coral reef species that was—</text> 
<subparagraph id="H3C612EDA6E0C4496A7EFDC8C4511513C"><enum>(A)</enum><text>taken in waters under the jurisdiction of the United States using any destructive collection practice; or</text></subparagraph> 
<subparagraph id="HCC234D272FA34C58BAC796B500969375"><enum>(B)</enum><text>imported or exported without a certification by the importer or exporter that the covered coral reef species to be imported or exported was not taken through the use of any destructive collection practice.</text></subparagraph></paragraph> 
<paragraph id="H2B37194F8C3E439FA398215B97250034"><enum>(2)</enum><header>Destructive collection practices</header><text>For the purposes of this Act, <quote>destructive collection practice</quote> means any practice used in the take of coral reef species which includes any of the following:</text> 
<subparagraph id="H425B4605636545E3959B2481B580FC39"><enum>(A)</enum><text>Reef-dredging.</text></subparagraph> 
<subparagraph id="H6105E327B9D9495C830662D6D17774C"><enum>(B)</enum><text>Explosives.</text></subparagraph> 
<subparagraph id="HB82DF39FF3344A979B81B266FD34CD0"><enum>(C)</enum><text>Poisons.</text></subparagraph> 
<subparagraph id="H66020AEA8637430CB900D7CADCBDAC41"><enum>(D)</enum><text>Any other destructive collection practice identified by the Secretary of Commerce by regulation, in consultation with the Secretary of the Interior and the advisory group described in section 6(b).</text></subparagraph></paragraph> 
<paragraph id="HD2F6B91589E4496789095EA6007CD2BF"><enum>(3)</enum><header>Presence of poisons</header><text>For the purposes of this Act, the presence of cyanide, any other poison, or any metabolite associated with any such poison in a coral reef species shall constitute evidence that poison was used in the take of the coral reef species. </text></paragraph> </subsection> </section> 
<section id="HE7B0607976F54B0AAF27C9DF5F28DFA9"><enum>5.</enum><header>Consultation regarding protection of coral reef species</header><text display-inline="no-display-inline">The Secretary of State, in consultation with the Administrator of the United States Agency for International Development, the Secretary of the Interior, and the Secretary of Commerce, may initiate consultations with foreign governments which are engaged in, or whose citizens include persons engaged in, commercial operations which take coral reef species, for the purpose of—</text> 
<paragraph id="HA758C5653235464E81116DC6C7FA9160"><enum>(1)</enum><text>encouraging the protection of coral reef species through building consensus on standards for, and implementation of, sustainable management plans; and</text></paragraph> 
<paragraph id="H54D81BB5F6BE421498F8882BA6D2B9FE"><enum>(2)</enum><text>taking steps to eliminate of the use of the destructive collection practices described in section 4(b)(2).</text></paragraph></section> 
<section id="H991668E4CEF347B98F6E1D08B613861F"><enum>6.</enum><header>Coordination regarding conservation of coral reef ecosystems</header> 
<subsection id="H110B0E9CB03A441CADEC6FE72364DB17"><enum>(a)</enum><header>Coral Reef Task Force</header><text>In carrying out this Act, the Secretary of the Interior and the Secretary of Commerce shall coordinate with members of the Coral Reef Task Force for the conservation and sustainable management of coral reef ecosystems.</text></subsection> 
<subsection id="HF80A102E016F4AB9BFE945E889E5B7DC"><enum>(b)</enum><header>Advisory group</header> 
<paragraph id="H1615760556B0417AAC961D9E76F9008B"><enum>(1)</enum><header>In general</header><text>The Secretary of the Interior and the Secretary of Commerce shall convene an advisory group consisting of individuals representing public and private organizations affected by this Act, including persons involved in the conservation of coral reef ecosystems, the harvest and trade of coral reef species, and the operation of cooperative breeding programs and aquaculture and mariculture facilities for the propagation of coral reef species, and representatives of Federal agencies, states, and territories, which are represented on the Coral Reef Task Force.</text></paragraph> 
<paragraph id="HF73D8138E4EA4A60A7E7C1149CF10050"><enum>(2)</enum><header>Development of guidelines, strategy, and criteria</header><text>Before the expiration of the 1-year period which begins on the date of the enactment of this Act, the Secretary of the Interior and the Secretary of Commerce, in consultation with the advisory group, shall develop—</text> 
<subparagraph id="H245897513A35471097D70028815776AF"><enum>(A)</enum><text>criteria and indicators for the conservation and sustainable management of coral reef ecosystems;</text></subparagraph> 
<subparagraph id="H6F87C555F6784EFCBCE15CA3A832BB06"><enum>(B)</enum><text>a coordinated national strategy for conservation and sustainable management of coral reef species and ecosystems based on the criteria and indicators developed under subparagraph (A); and</text></subparagraph> 
<subparagraph id="HFC41CBBD100B471082128E6C23CBF515"><enum>(C)</enum><text>guidelines for the capture, commercial transport, and handling of coral reef species which would improve their rates of survival.</text></subparagraph></paragraph></subsection> 
<subsection id="HD04629A9EC9541408BF6CC91082DD482"><enum>(c)</enum><header>International cooperation</header><text> The Secretary of State and the Administrator of the United States Agency for International Development, in coordination with the heads of other appropriate departments and agencies, shall utilize their authorities to further the purposes of this Act by encouraging policies and implementing programs to promote the conservation and sustainable management of coral reef ecosystems in other parts of the world, by such means as multilateral negotiations, participation in various international fora, bilateral assistance, and capacity building.</text></subsection></section> 
<section id="H0F04BFF0DE9245439F7C1220D23048C5"><enum>7.</enum><header>Enforcement</header> 
<subsection id="HD4AA89B721494792AA50071CE88051DF"><enum>(a)</enum><header>Civil money penalties</header> 
<paragraph id="H135233A959D84DF1AFABCC1E5C05A7D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Interior or the Secretary of Commerce, upon finding a violation of section 3, may require the person responsible for such violation to pay a civil money penalty in an amount determined under a schedule of penalties which is established and published by the Secretary, but which does not exceed $25,000 for each violation, and which takes into account—</text> 
<subparagraph id="H6295195BB74A478DBFF84CC9823E8D00"><enum>(A)</enum><text>the nature of the violation involved;</text></subparagraph> 
<subparagraph id="HA8D2A32A743C4B96AD2200EFEAD7E42E"><enum>(B)</enum><text>the revenues of the person;</text></subparagraph> 
<subparagraph id="HCC335BCFFB0C492880087E90007D05D5"><enum>(C)</enum><text>previous violations of section 3 by the person; and</text></subparagraph> 
<subparagraph id="HE52021F555524E6096CFA118B538E64E"><enum>(D)</enum><text>such other factors as the Secretary considers appropriate.</text></subparagraph></paragraph> 
<paragraph id="HA99381183BBD4F2AB34940986C88B55E"><enum>(2)</enum><header>Notice and opportunity for hearing</header><text display-inline="yes-display-inline">The Secretary of the Interior or the Secretary of Commerce may not make any determination adverse to a person under subsection (a) until such person has been given written notice and an opportunity to be heard before the Secretary or designee.</text></paragraph> </subsection> 
<subsection id="HA2A5E2669F094EDC865BE31A826D08E"><enum>(b)</enum><header>Declaratory or injunctive relief</header><text display-inline="yes-display-inline">The Attorney General may bring a civil action in an appropriate United States district court seeking declaratory or injunctive relief for any alleged violation of sections 3.</text></subsection> 
<subsection id="HDDAE9934127E4D0799D5FED372FDE114"><enum>(c)</enum><header>Criminal penalties</header> 
<paragraph id="H0606CF50BD7D4F6B91EBE5DECAF96B00"><enum>(1)</enum><header>In general</header><text>Any person who knowingly violates section 3 shall be fined in accordance with title 18, United States Code, imprisoned for not more than 6 months, or both.</text></paragraph> 
<paragraph id="H6815EEEBE1E740F6830087AD2F354E16"><enum>(2)</enum><header>Persons engaged in business</header><text>Any person engaged in business as an importer or exporter of coral reef species who knowingly violates section 3 shall be fined in accordance with title 18, United States Code, or imprisoned for not more than 2 years, or both.</text></paragraph> 
<paragraph id="HEA0A7D478A0A4845B7CE494309FF5488"><enum>(3)</enum><header>False statements in certifications</header><text>Any person who knowingly makes, causes to be made, or submits any false material statement or representation in a certification under section 4(b)(1)(B) shall be fined in accordance with title 18, United States Code, or imprisoned for not more than 2 years, or both, and may also be prohibited from importing or exporting any coral reef species.</text></paragraph></subsection> 
<subsection id="H59700D9A5C7847BD92422418A3242763"><enum>(d)</enum><header>Rewards and incidental expenses</header> 
<paragraph id="H7A570A0AC3314909BD1C419B088C35AF"><enum>(1)</enum><header>In general</header><text>The Secretary of the Interior or the Secretary of Commerce may pay, from sums received as penalties, fines, or forfeitures of property for violations of section 3—</text> 
<subparagraph id="H7A4699AB28534716BCAB9C1B378EFF90"><enum>(A)</enum><text>a reward to any person who furnishes information which leads to an arrest, criminal conviction, civil penalty assessment, or forfeiture of property for any violation of section 3; and</text></subparagraph> 
<subparagraph id="HF3CC14AC705C41C5B0413D910136D2FE"><enum>(B)</enum><text>the reasonable and necessary costs incurred by any person in providing temporary care for any coral reef species pending the disposition of any civil or criminal proceeding alleging a violation of section 3.</text></subparagraph></paragraph> 
<paragraph id="H2730AA6ECFAD4F3BBBDBF548ADAF31D5"><enum>(2)</enum><header>Amount of reward</header><text>The amount of a reward paid under this subsection shall be designated by the Secretary of the Interior or the Secretary of Commerce.</text></paragraph> 
<paragraph id="HB428BA51F78A40E5A6BAF0DD48A79E1E"><enum>(3)</enum><header>Ineligibility of government officials</header><text>Any officer or employee of the United States or any State or local government who furnishes information or renders service in the performance of his official duties is ineligible to receive a reward under this subsection.</text></paragraph></subsection> 
<subsection id="HC93A098935ED41F0937FA9B9B8E08B50"><enum>(e)</enum><header>Executive branch enforcement</header> 
<paragraph id="H8AF49A0AA713496C00A190E62D5EC0CB"><enum>(1)</enum><header>Searches and seizures</header> 
<subparagraph id="H7E01D01FB1A04B96913EA210DCAFD4DF"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Any person authorized by the Secretary of the Interior, the Secretary of Commerce, the Secretary of the Treasury, or the Secretary of the Department in which the Coast Guard is operating may search and seize any coral reef species taken, imported, exported, possessed, sold, delivered, carried, transported, or received in violation of section 3, with or without a warrant, as authorized by law.</text></subparagraph> 
<subparagraph id="H90B46E60B0524D9BB7B27FB9B4E85F30"><enum>(B)</enum><header>Seized coral reef species</header><text>Any coral reef species seized under subparagraph (A) shall be held by any person so authorized pending disposition of civil or criminal proceedings, or the institution of an action in rem for forfeiture of such coral reef species pursuant to paragraph (3), except that the appropriate Secretary may, in lieu of holding such species, permit the owner or consignee to post a bond or other surety satisfactory to the Secretary, but upon forfeiture of any such property to the United States, or the abandonment or waiver of any claim to any such property, it shall be disposed of (other than by sale to the general public) by the Secretary in such a manner, consistent with the purposes of this Act, as the Secretary shall by regulation prescribe.</text></subparagraph></paragraph> 
<paragraph id="HB910173D76504BA281994B87A5F04187"><enum>(2)</enum><header>Citations</header><text>If any officer authorized to enforce the provisions of this Act finds that a person has violated section 3, such officer may, in accordance with regulations issued by the Secretary of Commerce, Secretary of the Interior, and the Secretary of the department in which the Coast Guard is operating, issue a citation to the violator.</text></paragraph> 
<paragraph id="HF7A049D12C034294A622776190B6B2B4"><enum>(3)</enum><header>Forfeiture</header> 
<subparagraph id="H825230CA683040EC91CD0096D5B1BC36"><enum>(A)</enum><header>Coral reef species</header><text>All coral reef species taken, imported, exported, possessed, sold, delivered, carried, transported, or received in violation of section 3 shall be subject to forfeiture to the United States.</text></subparagraph> 
<subparagraph id="HC394BF29D9D845A2B7DA017263CADE4D"><enum>(B)</enum><header>Equipment used in unlawful practices</header><text>All guns, traps, nets, and other equipment, vessels, vehicles, aircraft, and other means of transportation used to aid the take, importing, exporting, possessing, selling, purchasing, delivering, carrying, transporting, or receiving of any coral reef species in violation of section 3, shall be subject to forfeiture to the United States upon conviction of a criminal violation pursuant to subsections (b)(1) or (b)(2).</text></subparagraph></paragraph> 
<paragraph id="HB23557012E1849F49E071E336064D1E5"><enum>(4)</enum><header>Other provisions of law</header><text>Any provision of law relating to the seizure, forfeiture, and condemnation of a vessel for violation a customs law, the disposition of such vessel or the proceeds from the sale thereof, and the remission or mitigation of such forfeiture, shall apply to any seizure or forfeiture incurred or allegedly incurred under this Act, insofar as such provision of law is applicable and not inconsistent with the provisions of this Act, except that all powers, rights, and duties conferred or imposed by the customs laws upon any officer or employee of the Department of the Treasury shall, for the purposes of this Act, be exercised or performed by the Secretary of Commerce or by such persons as the Secretary may designate.</text></paragraph></subsection> 
<subsection id="HE1760F4C3B6A402FA18D02A51944A0C1"><enum>(f)</enum><header>Citizen actions</header><text></text> 
<paragraph id="HC98614B9E76F458C8E22C0DB81B40099"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), any person may commence a civil action to enjoin any person, including the United States and any other governmental instrumentality or agency (to the extent permitted by the 11th Amendment to the Constitution), who is alleged to be in violation of section 3.</text></paragraph> 
<paragraph id="H0269085BD9F045699CDF4470181FDCEA"><enum>(2)</enum><header>Jurisdiction of district courts</header><text>The United States District Court for the judicial district in which the alleged violation occurs shall have jurisdiction in all actions brought under this subsection, without regard for the amount in controversy or the citizenship of the parties.</text></paragraph> 
<paragraph id="H975575A8B5794C11A61453BFFD8EF7E1"><enum>(3)</enum><header>Intervention by Attorney General</header><text>In any such action under this subsection in which the United States is not a party, the Attorney General may intervene on behalf of the United States as a matter of right.</text></paragraph> 
<paragraph id="H3C08666C2D4847CDB315DEA93D802FE6"><enum>(4)</enum><header>Exceptions</header><text>No action may be commenced under this subsection—</text> 
<subparagraph id="H5CB997D583E74D5A9B75DE179EAFF0C4"><enum>(A)</enum><text>prior to 60 days after written notice of the violation has been given to the Secretary of the Interior and the Secretary of Commerce, and to any alleged violator of any such provision or regulation; or</text></subparagraph> 
<subparagraph id="H630EA36E70184B58B4AB0471FE618061"><enum>(B)</enum><text>if the Secretary of the Interior, the Secretary of Commerce, or the Attorney General has initiated an enforcement action under this section.</text></subparagraph> </paragraph> 
<paragraph id="HEB876388AEC845C788F34D1CD031AD4C"><enum>(5)</enum><header>Recovery of court costs</header><text>In any action brought pursuant to paragraph (1), the court may award costs of litigation (including reasonable attorney and expert witness fees) to any party, whenever the court determines such award is appropriate.</text></paragraph> 
<paragraph id="HD02EF6D11E9E48FE87F6BE2C001849E8"><enum>(6)</enum><header>Relief under other laws</header><text>The injunctive relief provided by this subsection shall not restrict any right which any person may have under any statute or common law to seek enforcement of any standard or limitation or to seek any other relief.</text></paragraph></subsection> 
<subsection id="HBEEAD95A12444DD6B8D41C3DA4121674"><enum>(g)</enum><header>American Samoa</header><text>For the purposes of any action brought under this Act, American Samoa shall be included within the judicial district of the United States District Court for the District of Hawaii.</text></subsection> </section> 
<section id="H6B38B511D0114C5B00212F96C75FAFFA"><enum>8.</enum><header>Regulations</header> 
<subsection id="H07F5F33B5C5B4D5D88766DF400C5A900"><enum>(a)</enum><header>In general</header><text>Before the expiration of the 1-year period beginning on the date of the enactment of this Act, the Secretary of the Interior and the Secretary of Commerce shall promulgate such regulations as they deem necessary and appropriate to carry out the purposes of this Act.</text></subsection> 
<subsection id="HCFF9B280210043D58DD0BE9DB58D7CB5"><enum>(b)</enum><header>Enforcement regulations</header><text>The Secretary of the Interior, the Secretary of Commerce, the Secretary of the Treasury, and the Secretary of the Department in which the Coast Guard is operating, are authorized to promulgate such regulations as may be appropriate to enforce this Act, and charge reasonable fees for expenses connected with reviewing certificates authorized by this Act, including processing applications and reasonable inspections, and with the transfer, board, handling, or storage of coral reef species and evidentiary items seized and forfeited under this Act. Any such fees collected pursuant to this subsection shall be deposited in the Treasury to the credit of the appropriation which is current and chargeable for the cost of furnishing the services. Appropriated funds may be expended pending reimbursement from parties in interest.</text></subsection></section> 
<section id="HE50BAC917B4C44FA96A2C9B6E52BEBD"><enum>9.</enum><header>Relationship to State laws</header><text display-inline="no-display-inline">Nothing in this Act shall be construed or interpreted as preempting any State from imposing any more restrictive requirement regarding any coral reef species, so long as such requirement is consistent with the international obligations of the United States and this Act.</text></section> 
<section id="H1AF84AFBB36B4BD8A47815655576E3F2"><enum>10.</enum><header>Relationship to Federal fishery management plans</header><text display-inline="no-display-inline">Nothing in this Act shall be construed or interpreted as preempting any fishery management plan developed under the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801 et seq.</external-xref>) that contains management measures more restrictive than those required by this Act.</text></section> 
<section id="H7090E738DD3343C1A88B71B03CE4DD12"><enum>11.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions apply:</text> 
<paragraph id="H70FFD01C04EA494A899762AE65FCECE4"><enum>(1)</enum><text>The term <quote>coral</quote> means any living or dead specimens, parts or derivatives, or any product containing specimens, parts or derivatives of any species of the phylum Cnidaria, including—</text> 
<subparagraph id="HBEF3BE44D7094470803859577DD9D4A6"><enum>(A)</enum><text>all species of black corals (Antipatharia), stony corals (Scleractinia), soft corals (Alcyonacea), horny corals (Gorgonacea), organ pipe corals (Stolonifera), blue corals (Coenothecalia), anemones (Actiniaria), coralliomorphs (Coralliomorpharia), and zooanthids (Zoanthidea) of the class Anthozoa; and</text></subparagraph> 
<subparagraph id="H29F0B8C33BB544C3B4DBAD8AC97BB36"><enum>(B)</enum><text>all species of the fire corals (Milleporina) and lace corals (Stylasterina) of the class Hydrozoa.</text></subparagraph></paragraph> 
<paragraph id="H5904AAF1931A48A583E51D1B331F00B7"><enum>(2)</enum><text>The term <quote>coral reef</quote> means any reef, shoal, or other natural feature composed in part of the solid skeletal structures in which corals are major framework constituents.</text></paragraph> 
<paragraph id="H97333DF4151F4B71B4CCD57EC009300"><enum>(3)</enum><text>The term <quote>coral reef ecosystem</quote> means the interacting complex of species (including reef plants of the phyla Chlorophyta, Phaeophyta, and Rhodophyta) and nonliving variables associated with coral reefs and their habitats which function as an ecological unit in nature and which are mutually dependent on this function to survive.</text></paragraph> 
<paragraph id="H4026802B2CC04CFBA657DE3EE11768EC"><enum>(4)</enum><text>The term <quote>coral reef species</quote> means—</text> 
<subparagraph id="H8AF67FFF20484D4F997787F1CA612ECD"><enum>(A)</enum><text>any species of plant or animal, including algae, seagrasses, invertebrates and vertebrates that live in, on, or near coral reefs and are directly dependent on the coral reef ecosystem for feeding, reproduction or growth, but does not include mammals, reptiles, or birds; and</text></subparagraph> 
<subparagraph id="H2381FDE1DD2A4AC58165B4359F75B76"><enum>(B)</enum><text>products derived from coral, such as live rock, coral substrate, and coral rock.</text></subparagraph></paragraph> 
<paragraph id="H4EDB3DE6E0954EBBA7DF038130D53756"><enum>(5)</enum><text>The term <quote>foreign commerce</quote> includes any transaction between persons within one foreign country, between persons in 2 or more foreign countries, between a person within the United States and a person in a foreign country, or between persons within the United States, where the coral reef species in question is moving in any country or countries outside the United States.</text></paragraph> 
<paragraph id="H6FC9EE07FA79454F00D645B1BAA73177"><enum>(6)</enum><text>The term <quote>import</quote> means to land on, bring into, or introduce into, or attempt to land on, bring into, or introduce into, any place subject to the jurisdiction of the United States, whether or not such landing, bringing, or introduction constitutes an importation within the meaning of the custom laws of the United States.</text></paragraph> 
<paragraph id="H715E9D11BD34487280D6E4C33701CD0"><enum>(7)</enum><text>The term <quote>live rock</quote> means any hard substrate derived from coral which is grown in the wild and which is attached to and supporting any species covered under paragraph (4)(A), and includes coral rock and coral substrate.</text></paragraph> 
<paragraph id="H14D6CF74B916441BB8621411612926AB"><enum>(8)</enum><text>The term <quote>ornamental reef fish</quote> means any finfish collected commercially for the aquarium and curio trade, but does not include any fish taken for human consumption.</text></paragraph> 
<paragraph id="H32617FB423A8460782937EA78F3B402"><enum>(9)</enum><text>The term <quote>State</quote> means a State, the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, the Virgin Islands, Guam, the Commonwealth of the Northern Mariana Islands, and any other commonwealth, territory, or possession of the United States.</text></paragraph> 
<paragraph id="H246CFB134AE6497AA931533DF3459905"><enum>(10)</enum><text>The term <quote>take</quote> means to capture, catch, collect or harvest coral reef species by any means.</text></paragraph> 
<paragraph id="H0AE67E4138D64254A853F758BAA2932"><enum>(11)</enum><text>The term <quote>United States</quote> includes the several States, the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, the Virgin Islands, Guam, the Commonwealth of the Northern Mariana Islands, and any other commonwealth, territory or possession of the United States that contains coral within its jurisdiction.</text></paragraph> 
<paragraph id="H314944DB2EB0402D8073BC04620406B7"><enum>(12)</enum><text>The term <quote>waters under the jurisdiction of the United States</quote> means the belt of seas extending to a distance of 200 nautical miles measured from the baseline from which the breadth of the territorial sea of the United States is measured, except where that distance is modified by maritime boundary agreements to which the United States is a party.</text></paragraph></section> 
<section id="H44B358D0F4F04081A609005CD96C084F"><enum>12.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out the provisions of this Act, for each of fiscal years 2006 through 2010—</text> 
<paragraph id="HAACA2D28833D4F57A03079C700DDAF12"><enum>(1)</enum><text>for the Secretary of the Interior, $5,000,000;</text></paragraph> 
<paragraph id="H2523451604504A45A94FFB26961607CE"><enum>(2)</enum><text>for the Secretary of Commerce, $3,000,000; and</text></paragraph> 
<paragraph id="HCA567A362C254521866907AFEB000044"><enum>(3)</enum><text>for the Secretary of State, $500,000.</text> </paragraph></section>
