<section id="HDDCACCED013A499CBF1F9979B0160268"><enum>2.</enum><header>Importation</header> 
<subsection id="H6415253FB2974F6CB99E1E112394D0A8"><enum>(a)</enum><header>In general</header><text>Chapter VIII of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381 et seq.</external-xref>) is amended—</text> 
<paragraph id="HAE9A7F7B42A2415FB851637B048176C4"><enum>(1)</enum><text>by inserting after the chapter heading the following:</text>

<subchapter id="HBFAE7E1AAC6B4D9DAA109E79A2B4B124"><enum>B</enum><header>Importation of prescription drugs</header> 
<section id="H740063F5526F4589975C2265C0CF2258"><enum>811.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text> 
<paragraph id="H0B4565336C324CD6B4B73DC0DDE7175D"><enum>(1)</enum><header>Drug importation facility</header><text>The term <term>drug importation facility</term> means a person, other than an individual importing a prescription drug under section 812, located outside the United States (other than a transporter) that engages in the distribution or dispensing of a prescription drug that is imported or offered for importation into the United States.</text></paragraph> 
<paragraph id="HC013629D21164D2985D4FA97F70269C0"><enum>(2)</enum><header>Internet pharmacy</header><text>The term <term>Internet pharmacy</term> means a person, other than an individual importing a prescription drug under section 812, that offers to dispense in the United States a prescription drug through an Internet website in interstate commerce, regardless of whether the physical location of the principal place of business of the Internet pharmacy is in the United States or in another country.</text></paragraph> 
<paragraph id="HDD45E8B4832C43CEBC77C3DEA7D88C5E"><enum>(3)</enum><header>Pharmacy</header><text>The term <term>pharmacy</term> means a person, other than an individual importing a prescription drug under section 812, licensed by a State to dispense prescription drugs or to provide pharmaceutical care.</text></paragraph> 
<paragraph id="H2BD26547433D4949A981518502FEFD8D"><enum>(4)</enum><header>Permitted country</header> 
<subparagraph id="HF2A98565C6294517B8963C719B22649F"><enum>(A)</enum><header>In general</header><text>The term <term>permitted country</term> means a country that—</text> 
<clause id="HADD6F8C9DC334AAB83EA1EA4B5B79FC3"><enum>(i)</enum><text>was a member of the European Union as of December 31, 2003; and</text></clause> 
<clause id="HF8713FC005EF4AE70067159164C51100"><enum>(ii)</enum><text>is designated by the Secretary as a permitted country under subparagraph (B).</text></clause></subparagraph> 
<subparagraph id="H98A7E07081F24D888E5BD60813AB70FA"><enum>(B)</enum><header>Report</header><text>Three years after the date of enactment of this subchapter, the Secretary shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and to the Committee on Energy and Commerce of the House of Representatives a report that includes—</text> 
<clause id="H2C564F1D106749F2A7B9C63B571F23EB"><enum>(i)</enum><text>a list of countries under subparagraph (A)(i) designated by the Secretary from which a prescription drug shall be permitted to be imported into the United States under this subchapter, and the basis for the Secretary’s determination that the importation of a prescription drug from such countries would not present an increased risk to the public health;</text></clause> 
<clause id="HE8471F4D0A6543B8BB6CDD9508F5005B"><enum>(ii)</enum><text>a list of countries under subparagraph (A)(i) from which a prescription drug shall not be permitted to be imported into the United States under this subchapter, and the basis for Secretary’s determination that the importation of a prescription drug from such countries would present an increased risk to the public health;</text></clause> 
<clause id="HF0DCEC297ACD49418ED7C1DD5F42200"><enum>(iii)</enum><text>for countries identified in clause (i), any additional measures that could be taken to ensure that there will be no increased risk to the public health; and</text></clause> 
<clause id="H784B5581F9ED495498AF14AEDBD0BAC2"><enum>(iv)</enum><text>for countries identified in clause (ii), any additional measures that could be taken to avoid, reduce, or mitigate such increased risk to the public health.</text></clause></subparagraph> 
<subparagraph id="HE2F5CDA38D37445B90F2FDA5875DF5E"><enum>(C)</enum><header>Determination</header><text>The Secretary may determine whether to designate a permitted country at any time after submission of the report under subparagraph (B).</text></subparagraph></paragraph> 
<paragraph id="HD663F8A9C5E04C1A93F2E94DD59ECDAF"><enum>(5)</enum><header>Prescription drug</header> 
<subparagraph id="H5C6A483E42B64721B58BBFCBD02533D4"><enum>(A)</enum><header>In general</header><text>The term <term>prescription drug</term> means a drug described in section 503(b) that is approved by the Secretary under section 505.</text></subparagraph> 
<subparagraph id="HBD6FB1C0BEFB4AA4AC8DF61ECAC37F14"><enum>(B)</enum><header>Exclusions</header><text>The term <term>prescription drug</term> does not include—</text> 
<clause id="HBA166EA0129F4402006639E84EEDB21C"><enum>(i)</enum><text>a controlled substance (as defined in section 102 of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>));</text></clause> 
<clause id="H5F7F9CBCC90C44359BD305C71C1374AD"><enum>(ii)</enum><text>a biological product (as defined in section 351 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>));</text></clause> 
<clause id="H9CF37B0697DC4682B18B8853CB98907C"><enum>(iii)</enum><text>an infused drug (including a peritoneal dialysis solution);</text></clause> 
<clause id="HAEEE60F5A2C5452380C53CC43F6F548B"><enum>(iv)</enum><text>an intravenously injected drug;</text></clause> 
<clause id="H99391E6DC1BD4DE5B33434AD3ED22F6F"><enum>(v)</enum><text>a drug that is inhaled during surgery;</text></clause> 
<clause id="HF83DEE2CBFE34D46899100C924FFC8DB"><enum>(vi)</enum><text>a parenteral drug;</text></clause> 
<clause id="H480A0AB1EE5E4CAC887C8F848D541303"><enum>(vii)</enum><text>a drug manufactured through 1 or more biotechnology processes, including—</text> 
<subclause id="H40472C8DAB194D209F48A6F71BDE2C5C"><enum>(I)</enum><text>a therapeutic DNA plasmid product;</text></subclause> 
<subclause id="HECC4A7BA613042718346298619B037DE"><enum>(II)</enum><text>a therapeutic synthetic peptide product of not more than 40 amino acids;</text></subclause> 
<subclause id="H2B36A1F0E5F545F697C5395C00A5E570"><enum>(III)</enum><text>a monoclonal antibody product for in vivo use; and</text></subclause> 
<subclause id="H107CB0D4060F471D9B9C59B478C1BF9E"><enum>(IV)</enum><text>a therapeutic recombinant DNA-derived product;</text></subclause></clause> 
<clause id="H63AB55FDB91E4073BA81F3191E46141C"><enum>(viii)</enum><text>a drug required to be refrigerated at any time during manufacturing, packing, processing, or holding; or</text></clause> 
<clause id="H316D6432C8A442B990B218C643BF0D5"><enum>(ix)</enum><text>a photoreactive drug.</text></clause></subparagraph></paragraph> 
<paragraph id="HD907D5EB12F7480D00972B0975604EF8"><enum>(6)</enum><header>Treating provider</header><text>The term <term>treating provider</term> means a licensed health care provider that—</text> 
<subparagraph id="H387DC71570C3468CB9E33677A6618D88"><enum>(A)</enum> 
<clause display-inline="yes-display-inline" id="H419BB157789F4FFD9B00BC39D2947BE3"><enum>(i)</enum><text>performs a documented patient evaluation (including a patient history and physical examination) of an individual to establish the diagnosis for which a prescription drug is prescribed;</text></clause> 
<clause indent="up1" id="H5E53315D71604766972F5E00256E174B"><enum>(ii)</enum><text>discusses with the individual the treatment options of the individual and the risks and benefits of treatment; and</text></clause> 
<clause indent="up1" id="HBA1C901BDC0F48F4B36706496309A2EE"><enum>(iii)</enum><text>maintains contemporaneous medical records concerning the individual; or</text></clause></subparagraph> 
<subparagraph id="H6254146030BA45B395A261DE038E253F"><enum>(B)</enum><text>provides care to an individual as part of an on-call or cross-coverage arrangement with a health care provider described in subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H45C9DC1BE6BF45318272AF241603D151"><enum>(7)</enum><header>Wholesaler</header> 
<subparagraph id="H7CBE76EE80FC4595A0109CCEE03465"><enum>(A)</enum><header>In general</header><text>The term <term>wholesaler</term> means a person licensed as a wholesaler or distributor of prescription drugs in the United States as described in section 503(e)(2).</text></subparagraph> 
<subparagraph id="HFB267DB56C534AE3A500832D08321328"><enum>(B)</enum><header>Exclusion</header><text>The term <term>wholesaler</term> does not include—</text> 
<clause id="H0DA5B4B91A804137ACF38613D80777AF"><enum>(i)</enum><text>a person authorized to import drugs under section 801(d)(1); or</text></clause> 
<clause id="HAE39097F35E14F5C8E72BEF8FFBCE5D"><enum>(ii)</enum><text>an individual importing a prescription drug under section 812.</text></clause></subparagraph></paragraph></section> 
<section id="H4CDC92873C444D9B866B7B3C7CA18801"><enum>812.</enum><header>Personal importation</header> 
<subsection id="H8A2AD2614A41468CBCFC9B854B8FE0D6"><enum>(a)</enum><header>In general</header><text>An individual may import a prescription drug from Canada or a permitted country into the United States for personal use (not for resale), subject to subsections (b) and (c).</text></subsection> 
<subsection id="HEC3493FC4842455E9C5407B49349374B"><enum>(b)</enum><header>Importation</header><text>An individual may import a prescription drug if—</text> 
<paragraph id="H2386AB8DE9034F3BADF3002607356F34"><enum>(1)</enum><text>the prescription drug is purchased from a licensed pharmacy in Canada or a licensed pharmacy in a permitted country and dispensed in compliance with the applicable laws of Canada or the permitted country regarding the practice of pharmacy;</text></paragraph> 
<paragraph id="H4F2E68D44C9044C0B6846244C3B40038"><enum>(2)</enum><text>the prescription drug is imported for personal use (not for resale) by the individual;</text></paragraph> 
<paragraph id="H7B786960750E497AABA3DCAB37E707A9"><enum>(3)</enum><text>the prescription drug is imported from Canada or a permitted country into the United States;</text></paragraph> 
<paragraph id="H1A799764DFD64CF283869BA05353A527"><enum>(4)</enum><text>the prescription drug is imported by the individual on the person of the individual;</text></paragraph> 
<paragraph id="H8B923233BDD744E3003C002F644E32F6"><enum>(5)</enum><text>the quantity of the prescription drug imported does not exceed a 90-day supply during any 90-day period; and</text></paragraph> 
<paragraph id="HCA6B42BA654E44D6BF99E4369C8FDFE3"><enum>(6)</enum><text>the prescription drug is accompanied by—</text> 
<subparagraph id="H086617CE086F4B38A53298666D1EE5FF"><enum>(A)</enum><text>a copy of a prescription valid in a State and cosigned by a prescribing physician in Canada or the permitted country; or</text></subparagraph> 
<subparagraph id="H64D0D338A11548538F00B6AE4ED025D4"><enum>(B)</enum><text>if the prescription drug is available in Canada or the permitted country without a prescription, a copy of the valid prescription signed by a pharmacist licensed in Canada or the permitted country.</text></subparagraph></paragraph></subsection> 
<subsection id="HB85025AAD6D641E798562015E8F24308"><enum>(c)</enum><header>Compassionate use</header><text>The Secretary may permit an individual to import an up to a 90-day supply of a drug that is not approved by the Secretary under section 505 if the importation is for continuation of personal use by the individual for treatment, begun in a foreign country, of a serious medical condition.</text></subsection></section> 
<section id="H979C492F41AE4AB89B05BAC2BBA44DF9"><enum>813.</enum><header>Pharmacy and wholesaler importation of prescription drugs</header> 
<subsection id="H87960CCF427D49F79D34E77FFAC4E1FA"><enum>(a)</enum><header>In general</header> 
<paragraph id="HA6F8D1DC5B5A42AFB4B334C3402BC389"><enum>(1)</enum><header>Importation</header><text>A drug importation facility, pharmacy, Internet pharmacy, or wholesaler may import a prescription drug from Canada or a permitted country into the United States for dispensing in the United States in accordance with this subchapter.</text></paragraph> 
<paragraph id="H04983576FB524E619917D856FB545E27"><enum>(2)</enum><header>Limitation to certain ports</header><text>The Secretary may limit the ports of entry in the United States through which a prescription drug may be imported under this section to a reasonable number of ports designated by the Secretary.</text></paragraph></subsection> 
<subsection id="HC39A02117D2B40FDB900EE028DC6756C"><enum>(b)</enum><header>Requirements</header><text>Each prescription drug imported under this subchapter shall—</text> 
<paragraph id="HE1CACCAF8D504E10BBA4EF922352949B"><enum>(1)</enum><text>be approved under section 505;</text></paragraph> 
<paragraph id="H46810F0CBFA84E1B8DAD3D5FF41ECE35"><enum>(2)</enum><text>comply with sections 501 and 502;</text></paragraph> 
<paragraph id="H78158276F7F54B01B2ED50AB931D3B0"><enum>(3)</enum><text>be in a container that bears a label stating, in prominent and conspicuous type—</text> 
<subparagraph id="H944354B3D8A748F9800064D305003900"><enum>(A)</enum><text>the lot number of the prescription drug;</text></subparagraph> 
<subparagraph id="H37020B72D1184FD49DDE1109D6248DA2"><enum>(B)</enum><text>the name, address and phone number of the drug importation facility;</text></subparagraph> 
<subparagraph id="HA3F50588FE1F48D68F933032E104E802"><enum>(C)</enum><text>the following: <quote>This drug has been imported from _____.</quote>, with the name of the permitted country from which the prescription drug is imported in the blank space; and</text></subparagraph> 
<subparagraph id="H9AB4EDE52E074AF5A372DB5F397006DA"><enum>(D)</enum><text>a unique identifier code provided by the Secretary that modifies the national drug code of the prescription drug to indicate that the drug has been imported; and</text></subparagraph></paragraph> 
<paragraph id="H00B5239AA1F346D397D4F0E85C0F5EB"><enum>(4)</enum><text>comply with any other applicable requirement of this Act.</text></paragraph></subsection> 
<subsection id="HC1E8AA1DD79643B995005C66E5AC54B9"><enum>(c)</enum><header>Approved labeling</header> 
<paragraph id="H2E45C0CAECCC4E6C89830196A6628DAC"><enum>(1)</enum><header>In general</header><text>A drug importation facility that offers for importation a prescription drug under this subchapter shall submit to the Secretary an application for approval that demonstrates that the labeling of the prescription drug to be imported into the United States complies with the requirements of sections 502 and 503.</text></paragraph> 
<paragraph id="H71D515A1C36F425F923DE00583EA3E58"><enum>(2)</enum><header>Procedure</header><text>Not later than 60 days after receipt of a completed application under paragraph (1), the Secretary shall—</text> 
<subparagraph id="HC961F7BD5A40453BADD0217B6C5146EF"><enum>(A)</enum><text>approve or deny the application consistent with the requirements of sections 502 and 503; and</text></subparagraph> 
<subparagraph id="H40FF09322C034EDBB3467042488C0216"><enum>(B)</enum><text>notify the applicant of the decision of the Secretary and, if the application is denied, the reason for the denial.</text></subparagraph></paragraph> 
<paragraph id="H599A8C05406642D4A9C745FEDABCB5C4"><enum>(3)</enum><header>Lists</header> 
<subparagraph id="H7547BABDF374487383B1CA1EC40500E6"><enum>(A)</enum><header>Applications</header><text>The Secretary shall maintain an updated list of applications pending, applications approved, and applications denied under this subsection.</text></subparagraph> 
<subparagraph id="H39132973F6084F9B8300D2DA3B35BB9B"><enum>(B)</enum><header>Ports</header><text>The Secretary shall maintain an updated list of ports through which a prescription drug may be imported under this section and make the list available to the public on an Internet website.</text></subparagraph></paragraph></subsection> 
<subsection id="H8D0CC578E41D4B1BB2FBBF248CEB00B3"><enum>(d)</enum><header>Prohibition of importation of a prescription drug that enters other countries</header> 
<paragraph id="HB1332948D41F43D1AB60DD7CFE44ECD"><enum>(1)</enum><header>In general</header><text>A drug importation facility, pharmacy, Internet pharmacy, or wholesaler shall not import a prescription drug if, during any period in which the prescription drug was not in the control of the manufacturer, the prescription drug entered a country other than—</text> 
<subparagraph id="H418508061FB7434DAD704100BC28E47C"><enum>(A)</enum><text>Canada; or</text></subparagraph> 
<subparagraph id="HFB0FA04C9AF8497DA5FFC0674001E00"><enum>(B)</enum><text>subject to paragraph (2), a country that was a member of the European Union as of December 31, 2003.</text></subparagraph></paragraph> 
<paragraph id="H7A31ECA270D44DD39E21E6D3BD2386EC"><enum>(2)</enum><header>Limitation</header><text>The Secretary may exclude 1 or more of the countries under subparagraph (B) of paragraph (1) from the application of that subparagraph if the Secretary determines that allowing a prescription drug to be imported into the United States after having entered that country outside control of a manufacturer would present a risk to the public health.</text></paragraph></subsection> 
<subsection id="H8967FD23787F4EF1AD5E002324A4E600"><enum>(e)</enum><header>Prohibition of commingling</header> 
<paragraph id="HCF5931DCD54344FFAFC3974FF92FB9EF"><enum>(1)</enum><header>In general</header><text>A drug importation facility, pharmacy, Internet pharmacy, or wholesaler shall not commingle a prescription drug imported into the United States under this subchapter with a prescription drug that is not imported from Canada or a permitted country.</text></paragraph> 
<paragraph id="H19099EAC40AF493E94A10B5C9F61F28"><enum>(2)</enum><header>Label</header><text>A pharmacy or Internet pharmacy that dispenses a prescription drug imported from Canada or a permitted country shall affix on each dispensed container of the prescription drug the label required under subsection (b)(3) unless such a label is already affixed to the container.</text></paragraph></subsection> 
<subsection id="H1F777FCACC244E03AE6BF74700DFD7BD"><enum>(f)</enum><header>Drug recalls</header><text>On receipt of notification from the manufacturer of a prescription drug imported from Canada or a permitted country under this section that the prescription drug has been recalled or withdrawn from the market in Canada or a permitted country, a drug importation facility shall promptly provide the Secretary and any person to whom the prescription drug was distributed a notice that the drug has been recalled or withdrawn from the market and that includes—</text> 
<paragraph id="H0BAD660DA91C4C999D170934979516E"><enum>(1)</enum><text>information (including the lot number) that identifies the prescription drug; and</text></paragraph> 
<paragraph id="HBECB0CD5D7EC42C1B27336A4EB2F13E6"><enum>(2)</enum><text>a statement of the reason for the recall or withdrawal.</text></paragraph></subsection> 
<subsection id="HE18B97F86A494A89AAA7FB6ED0E18DFF"><enum>(g)</enum><header>Charitable contributions</header><text>Notwithstanding any other provision of this section, section 801(d)(1) continues to apply to a prescription drug that is donated or otherwise supplied at no charge or a nominal charge by the manufacturer of the prescription drug to a charitable or humanitarian organization (including the United Nations and affiliates) or to a government of a foreign country.</text></subsection> 
<subsection id="H0106DEACB7D846F597EA45EB07A71D8B"><enum>(h)</enum><header>Jurisdiction</header><text>The district courts of the United States shall have jurisdiction in an action brought by the United States against a person importing or offering for importation a prescription drug in violation of the requirements of this section.</text></subsection>

<subparagraph id="H8FE74ADF3E8942D19100FD320016B99C"><enum>(A)</enum><header>In general</header><text>The Secretary of Health and Human Services may promulgate regulations to carry out section 812 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (as added by this section).</text></subparagraph> 
<subparagraph id="HC4AFFAB24B9442CF90481267CB7910A3"><enum>(B)</enum><header>Effective date</header><text>Section 812 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> shall take effect on the date of enactment of this Act, without regard to whether the Secretary of Health and Human Services has promulgated regulations under paragraph (1).</text></subparagraph></paragraph> 
<paragraph id="H6C077570CD51422EA0295DBD2992B91E"><enum>(2)</enum><header>Pharmacy and wholesaler importation of prescription drugs</header> 
<subparagraph id="H1CBB9E7146CE45DDB5007CCCCE63DD"><enum>(A)</enum><header>In general</header><text>The Secretary of Health and Human Services shall promulgate interim final regulations to carry out section 813 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (as added by this section).</text></subparagraph> 
<subparagraph id="HFFFF6A76153C45EE98961EDFDA1E01"><enum>(B)</enum><header>Effective date</header><text>Section 813 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> shall take effect on the date that is 1 year after the date of enactment of this Act, without regard to whether the Secretary of Health and Human Services has promulgated regulations under paragraph (1).</text></subparagraph></paragraph></subsection> 
<subsection id="H290CFF9ED1A948C19BF4A8421F1E79DC"><enum>(c)</enum><header>Prohibited Act</header><text>Section 301 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) is amended by adding at the end the following:</text>

<section id="HE42E2912CE43406BB43EEF3F20EAD765"><enum>4.</enum><header>Internet pharmacies</header> 
<subsection id="H1162C9B6073E437A8300CF6816D69D8"><enum>(a)</enum><header>Internet pharmacies</header><text>Chapter V of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/351">21 U.S.C. 351 et seq.</external-xref>) is amended by inserting after section 510 the following:</text>

<section id="H7CC53B57B9A04E6094CDF722EBA3CDC1"><enum>511.</enum><header>Internet pharmacies</header> 
<subsection id="HB0803C6727B0437391090582F115A9DF"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HF5423A714B654C94B6897098911E33B1"><enum>(1)</enum><header>Advertising service provider</header><text>The term <term>advertising service provider</term> means an advertising company that contracts with a provider of an interactive computer service (as defined in section 230(f) of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>) to provide advertising on the Internet.</text></paragraph> 
<paragraph id="H7F76CE98B1A941869782F174EB581F00"><enum>(2)</enum><header>Designated payment system</header> 
<subparagraph id="H57F19347996D43D5ABEDF15DFA0097BB"><enum>(A)</enum><header>In general</header><text>The term <term>designated payment system</term> means a system used by a person to effect a credit transaction, electronic transfer, or money transmitting service described in subparagraph (B) that the Federal functional regulators determine, by regulation or order, could be used in connection with, or to facilitate, a restricted transaction.</text></subparagraph> 
<subparagraph id="HB3CCEAF1A1FB4F3B94BF6988497C6F01"><enum>(B)</enum><header>Persons described</header><text>A person referred to in subparagraph (A) is—</text> 
<clause id="HE224B0ABE59B4E9DB94D7EF2B6568312"><enum>(i)</enum><text>a creditor;</text></clause> 
<clause id="H212A1A9FC01641B4892CC88DEBE07B"><enum>(ii)</enum><text>a credit card issuer;</text></clause> 
<clause id="HEF359E5F8F2F48A9952026B941348395"><enum>(iii)</enum><text>a financial institution;</text></clause> 
<clause id="H1C824E747CE0410FB313B61329104EAF"><enum>(iv)</enum><text>an operator of a terminal at which an electronic fund transfer may be initiated;</text></clause> 
<clause id="H91EAFD00838F40AF95FFAFEDF5922D08"><enum>(v)</enum><text>a money transmitting business; or</text></clause> 
<clause id="H4A81632847094914AB50EA719178AE05"><enum>(vi)</enum> 
<subclause display-inline="yes-display-inline" id="HBB8F7AEC75A94E35A066D3EB50C3FD8B"><enum>(I)</enum><text>an international, national, regional, or local network used to effect a credit transaction, electronic fund transfer, or money transmitting service; or</text></subclause> 
<subclause indent="up1" id="H7045671AE78248A78944059B689C897D"><enum>(II)</enum><text>any participant in a network described in subclause (I).</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H109936EA8F57499C9F06A638AFBC2EAD"><enum>(3)</enum><header>Federal functional regulator</header><text>The term <term>Federal functional regulator</term> has the meaning given the term in section 509 of the Gramm-Leach-Bliley Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6809">15 U.S.C. 6809</external-xref>).</text></paragraph> 
<paragraph id="HF0847F9C21FA487F8D16E4AC343C9DD7"><enum>(4)</enum><header>Prescription drug</header><text>The term <term>prescription drug</term> means a drug described in section 503(b) that is approved by the Secretary under section 505.</text></paragraph> 
<paragraph id="H6462824C80E242D4A82E99D3C2C6938"><enum>(5)</enum><header>Internet pharmacy</header><text>The term <term>Internet pharmacy</term> means a person that dispenses or offers to dispense a prescription drug through an Internet website in interstate commerce in the United States regardless of whether the physical location of the principal place of business of the Internet pharmacy is in the United States or in another country.</text></paragraph> 
<paragraph id="H2B747DBFD09941C7B59338D0A14ECF46"><enum>(6)</enum><header>Restricted transaction</header><text>The term <term>restricted transaction</term> means a transaction or transmittal, on behalf of a individual who places an unlawful Internet pharmacy request to any person engaged in the operation of an unlicensed Internet pharmacy, of—</text> 
<subparagraph id="H1BFAC2ADE63C447BA52DABAA94E4A523"><enum>(A)</enum><text>credit, or the proceeds of credit, extended to or on behalf of the individual who placed the unlawful Internet request (including credit extended through the use of a credit card);</text></subparagraph> 
<subparagraph id="H1C41072B08BE4DC38B44E5CABA64DA9C"><enum>(B)</enum><text>an electronic fund transfer or funds transmitted by or through a money transmitting business, or the proceeds of an electronic fund transfer or money transmitting service, from or on behalf of the individual who placed the unlawful Internet request;</text></subparagraph> 
<subparagraph id="HC1C1CE58B2564840877E00EF91F55D7"><enum>(C)</enum><text>a check, draft, or similar instrument which is drawn by or on behalf of the individual who placed the unlawful Internet request and is drawn on or payable at or through any financial institution; or</text></subparagraph> 
<subparagraph id="H8825F3BDA7FA483F86C0756BA370368"><enum>(D)</enum><text>the proceeds of any other form of financial transaction (identified by the Federal functional regulators by regulation) that involves a financial institution as a payor or financial intermediary on behalf of or for the benefit of the individual who placed the unlawful Internet request.</text></subparagraph></paragraph> 
<paragraph id="HF12D3A7E964D40FEAD79089374214E78"><enum>(7)</enum><header>Unlawful Internet pharmacy request</header><text>The term <term>unlawful Internet pharmacy request</term> means the request, or transmittal of a request, made to an unlicensed Internet pharmacy for a prescription drug by mail (including a private carrier), facsimile, phone, or electronic mail, or by a means that involves the use, in whole or in part, of the Internet.</text></paragraph> 
<paragraph id="H366B208CAF57455DA2197FA12900CC53"><enum>(8)</enum><header>Other definitions</header> 
<subparagraph id="H342B0257107147DA8EF297C0F342F4D"><enum>(A)</enum><header>Credit; creditor; credit card</header><text>The terms <term>credit</term>, <term>creditor</term>, and <quote>credit card</quote> have the meanings given the terms in section 103 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1602">15 U.S.C. 1602</external-xref>).</text></subparagraph> 
<subparagraph id="H357D7378E3B14BABBB448FD27300408F"><enum>(B)</enum><header>Electronic fund transfer</header><text>The term <term>electronic fund transfer</term>—</text> 
<clause id="HEED240981B98486BA166604D13C800F4"><enum>(i)</enum><text>has the meaning given the term in section 903 of the <act-name parsable-cite="EFTA">Electronic Fund Transfer Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/1693a">15 U.S.C. 1693a</external-xref>); and</text></clause> 
<clause id="H0A9A6875240144DE90C0B2E3C2082234"><enum>(ii)</enum><text>includes any fund transfer covered under Article 4A of the Uniform Commercial Code, as in effect in any State.</text></clause></subparagraph> 
<subparagraph id="HE82F2C1151C84AADBD9BDD999E00B6D7"><enum>(C)</enum><header>Financial institution</header><text>The term <term>financial institution</term>—</text> 
<clause id="HE35B9FA1E00D4EB993E16D066524496F"><enum>(i)</enum><text>has the meaning given the term in section 903 of the Electronic Transfer Fund Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1693a">15 U.S.C. 1693a</external-xref>); and</text></clause> 
<clause id="H1E749129B159427EACBF96E6CAD05E23"><enum>(ii)</enum><text>includes a financial institution (as defined in section 509 of the Gramm-Leach-Bliley Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6809">15 U.S.C. 6809</external-xref>)).</text></clause></subparagraph> 
<subparagraph id="HAAB2069D732E48FDA981389506489215"><enum>(D)</enum><header>Money transmitting business; money transmitting service</header><text>The terms <term>money transmitting business</term> and <term>money transmitting service</term> have the meaning given the terms in <external-xref legal-doc="usc" parsable-cite="usc/31/5330">section 5330(d)</external-xref> of title 31, United States Code.</text></subparagraph></paragraph></subsection> 
<subsection id="H5D63911826C54765BF3FB1A580651252"><enum>(b)</enum><header>In general</header><text>An Internet pharmacy may only dispense or offer to dispense a prescription drug to a person in the United States in accordance with this section.</text></subsection> 
<subsection id="H1BAEED8D89074E8B91D763A749C5B331"><enum>(c)</enum><header>Licensing of Internet pharmacies</header> 
<paragraph id="H83D52E03EFDB4A5D8756516DEA0579C3"><enum>(1)</enum><header>In general</header><text>To be licensed under this section an Internet pharmacy shall—</text> 
<subparagraph id="H8C06E57C9458426C80EF2E54C9404320"><enum>(A)</enum><text>have its principal place of business in the United States, Canada, or a permitted country; and</text></subparagraph> 
<subparagraph id="H85D6647C1CD841ADA22E437E69C8F9A1"><enum>(B)</enum><text>be licensed by the Secretary in accordance with this section prior to dispensing a prescription drug to an individual.</text></subparagraph></paragraph> 
<paragraph id="H54C699679ABE480D8B6CE5E55B7D39A5"><enum>(2)</enum><header>Conditions for licensing</header> 
<subparagraph id="H48D3D4B211A3486BBA42006625C5BB1"><enum>(A)</enum><header>Application requirements</header><text>An Internet pharmacy shall submit to the Secretary an application that includes—</text> 
<clause id="HD906018E390442F19B930839DAB9A839"><enum>(i)</enum> 
<subclause display-inline="yes-display-inline" id="H6527492D7107484BB4588D9D5400CCED"><enum>(I)</enum><text>in the case of an Internet pharmacy located in the United States, verification that, in each State in which the Internet pharmacy engages in dispensing or offering to dispense prescription drugs, the Internet pharmacy, and all employees and agents of the Internet pharmacy, is in compliance with applicable Federal and State laws regarding—</text> 
<item indent="up1" id="H8E5207BE8805413FB2B932FA00BD951F"><enum>(aa)</enum><text>the practice of pharmacy, including licensing laws and inspection requirements; and</text></item> 
<item indent="up1" id="H0870360A178548CA93B3C6EE8335AFC7"><enum>(bb)</enum><text>the manufacturing and distribution of controlled substances, including with respect to mailing or shipping controlled substances to consumers; or</text></item></subclause> 
<subclause indent="up1" id="H7EA8FF6585844BE286F126D9CDC7D00"><enum>(II)</enum><text>in the case of an Internet pharmacy located in Canada or a permitted country, verification that—</text> 
<item id="H3A4ED7266D1141DC950620DA7E0096E"><enum>(aa)</enum><text>all employees and agents of the Internet pharmacy are in compliance with applicable laws of Canada or the permitted country regarding the practice of pharmacy, including licensing laws and inspection requirements; and</text></item> 
<item id="H2B43F3B8D2E64C238E39780072D5E45"><enum>(bb)</enum><text>the Internet pharmacy is in compliance with applicable Federal and State laws regarding the practice of pharmacy, including licensing laws and inspection requirements;</text></item></subclause></clause> 
<clause id="HC45450ADD48D4A49BBF1B9645BE4002C"><enum>(ii)</enum><text>verification that the person that owns the Internet pharmacy has not had a license for an Internet pharmacy terminated by the Secretary, and that no other Internet pharmacy owned by the person has had a license under this subsection that has been terminated by the Secretary;</text></clause> 
<clause id="H0F815AD8C79649DC980430E6F2415E15"><enum>(iii)</enum><text>verification from the person that owns the Internet pharmacy that the person will permit inspection of the facilities and business practices of the Internet pharmacy by the Secretary to the extent necessary to determine whether the Internet pharmacy is in compliance with this subsection; and</text></clause> 
<clause id="H46E2C79B0EE24F849EBC9C089DAAA2D9"><enum>(iv)</enum><text>in the case of an agreement between a patient and an Internet pharmacy that releases the Internet pharmacy, and any employee or agent of the Internet pharmacy, from liability for damages arising out of the negligence of the Internet pharmacy, an assurance that such a limitation of liability shall be null and void.</text></clause></subparagraph> 
<subparagraph id="H99F72B2164D942C496C5001F58AED2A9"><enum>(B)</enum><header>Identification requirements</header><text>An Internet pharmacy shall provide to any person that accesses the Internet pharmacy website, on each page of the website of the Internet pharmacy or by a link to a separate page, the following information:</text> 
<clause id="H9D8B61980CF549119E2B0718ED82EC8D"><enum>(i)</enum><text>The street address, city, ZIP Code or comparable mail code, State (or comparable entity), country, and telephone number of—</text> 
<subclause id="HFF580C7624B546BCB0D200007FA60070"><enum>(I)</enum><text>each place of business of the Internet pharmacy; and</text></subclause> 
<subclause id="H3E928BB1C0B2402792D92D365B624962"><enum>(II)</enum><text>the name of the supervising pharmacist of the Internet pharmacy and each individual who serves as a pharmacist for purposes of the Internet pharmacy website.</text></subclause></clause> 
<clause id="H614951FD7EE44474AF21FF992FC5D48C"><enum>(ii)</enum><text>The names of all States or countries, as appropriate, in which the Internet pharmacy and the pharmacists employed by the Internet pharmacy are licensed or otherwise authorized to dispense prescription drugs.</text></clause> 
<clause id="H4A89BAAC1ECA46B297CF0186F667EDE8"><enum>(iii)</enum><text>If the Internet pharmacy makes referrals to, or solicits on behalf of, a health care practitioner or group of practitioners in the United States for prescription services—</text> 
<subclause id="HA1730281D86D4629A1C1BE08DEFBC5C"><enum>(I)</enum><text>the name, street address, city, ZIP Code or comparable mail code, State, and telephone number of the practitioner or group; and</text></subclause> 
<subclause id="H1E07C3BEB5A64F5C9F720698D7A1487D"><enum>(II)</enum><text>the name of each State in which each practitioner is licensed or otherwise authorized to prescribe drugs.</text></subclause></clause> 
<clause id="H9964B892ED7E46F38F60F430716240F0"><enum>(iv)</enum><text>A statement that the Internet pharmacy will dispense prescription drugs only after receipt of a valid prescription.</text></clause></subparagraph> 
<subparagraph id="HECA19A99A35E4644964D6604392CCEF"><enum>(C)</enum><header>Professional services requirements</header><text>An Internet pharmacy shall carry out the following:</text> 
<clause id="HF0F75F287F624AC792825E09D19F8B78"><enum>(i)</enum><text>Maintain patient medication profiles and other related data in a readily accessible format organized to facilitate consultation with treating providers, caregivers, and patients.</text></clause> 
<clause id="HBB30DE0E33FC44F78977B05839A277DC"><enum>(ii)</enum><text>Conduct prospective drug use reviews before dispensing medications or medical devices.</text></clause> 
<clause id="HDB9350938550470AB850ADA5D0A6842E"><enum>(iii)</enum><text>Ensure patient confidentiality and the protection of patient identity and patient-specific information, in accordance with the regulations promulgated under section 264(c) of the <act-name parsable-cite="HIPAA">Health Insurance Portability and Accountability Act of 1996</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1320d-2">42 U.S.C. 1320d–2</external-xref> note).</text></clause> 
<clause id="HDC02587C3FDC4449BBE060CCD1B9CFA5"><enum>(iv)</enum><text>Offer interactive and meaningful consultation by a licensed pharmacist to the caregiver or patient prior to and subsequent to the time at which the Internet pharmacy dispenses the drug.</text></clause> 
<clause id="H3E2FAE92E6CE4C8D00BF943E9331A821"><enum>(v)</enum> 
<subclause display-inline="yes-display-inline" id="HB754A4CABB6B4A149FD52C2516ECDE01"><enum>(I)</enum><text>Establish a mechanism for patients to report errors and suspected adverse drug reactions.</text></subclause> 
<subclause indent="up1" id="H7F561E4FA97747DE96D9006D4878AAE8"><enum>(II)</enum><text>Document in the reporting mechanism the response of the Internet pharmacy to those reports.</text></subclause></clause> 
<clause id="HFFFFA8FB28D4429396FBEA4B002326B1"><enum>(vi)</enum><text>Develop a system to inform caregivers and patients about drug recalls.</text></clause> 
<clause id="HFF8F99BC4F19438594A59EA158B7F920"><enum>(vii)</enum><text>Educate caregivers and patients about the appropriate means of disposing of expired, damaged, or unusable medications.</text></clause> 
<clause id="H5A61109A42AC4CEAB6924803D5312E3B"><enum>(viii)</enum><text>Assure that the sale of a prescription drug is in accordance with a prescription from the treating provider of the individual.</text></clause> 
<clause id="H6ADCD2C85C74429284067C3EDC890522"><enum>(ix)</enum> 
<subclause display-inline="yes-display-inline" id="HE2A529538B844773ABC56CA4DFAD8F6C"><enum>(I)</enum><text>Verify the validity of the prescription of an individual by using 1 of the following methods:</text> 
<item indent="up1" id="H7DF6549BED6D49368EC44E0058E596B7"><enum>(aa)</enum><text>Receiving from the individual or treating provider of the individual the prescription of the individual by mail (including a private carrier), or receiving from the treating provider of the individual the prescription of the individual by electronic mail.</text></item> 
<item indent="up1" id="H778574BC7969464CA57723B363E62F47"><enum>(bb)</enum><text>If the prescription is for a controlled substance (as defined in section 102 of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>)), confirming with the treating provider the information in subclause (II).</text></item></subclause> 
<subclause indent="up1" id="HAC96D01BDF61442D88EDFF36E0FF1E46"><enum>(II)</enum><text>When seeking verification of a prescription of an individual under subclause (I)(bb), an Internet pharmacy shall provide to the treating provider the following information:</text> 
<item id="HFF24B799F70E459691DEC430F17D3CBF"><enum>(aa)</enum><text>The full name and address of the individual.</text></item> 
<item id="H663D738851C44FF28E9CAE333722E78"><enum>(bb)</enum><text>Identification of the prescription drug.</text></item> 
<item id="H252605C695D64814BA67C0DB90457722"><enum>(cc)</enum><text>The quantity of the prescription drug to be dispensed.</text></item> 
<item id="H51A08CBF89414F5696BF073684514B4C"><enum>(dd)</enum><text>The date on which the individual presented the prescription to the Internet pharmacy.</text></item> 
<item id="H4A3ED440BA534A72B5E83C98EA282C7"><enum>(ee)</enum><text>The date and time of the verification request.</text></item> 
<item id="HEEEBAED2B8564166A673A73DB51C3400"><enum>(ff)</enum><text>The name of a contact person at the Internet pharmacy, including a voice telephone number, electronic mail address, and facsimile telephone number.</text></item></subclause> 
<subclause indent="up1" id="H7F891462BB4043D09DFF4FE6A38C441"><enum>(III)</enum><text>A prescription is verified under subclause (I)(bb) only if 1 of the following occurs:</text> 
<item id="H12039439A0D74B85B797E51E5000875D"><enum>(aa)</enum><text>The treating provider confirms, by direct communication with the Internet pharmacy, that the prescription is accurate.</text></item> 
<item id="HEE038BD08744476FAA7BD123975F70A1"><enum>(bb)</enum><text>The treating provider informs the Internet pharmacy that the prescription is inaccurate and provides the accurate prescription.</text></item></subclause> 
<subclause indent="up1" id="H2144373E982D43DDA386C6635C4367B7"><enum>(IV)</enum><text>An Internet pharmacy shall not fill a prescription if—</text> 
<item id="H4EC923B82F8D4664AA00ECB62F22D9AF"><enum>(aa)</enum><text>a treating provider informs the Internet pharmacy within 72 hours after receipt of a communication under subclause (I)(bb) that the prescription is inaccurate or expired; or</text></item> 
<item id="H9E6ACA9883B04429BBC291E37BA900F7"><enum>(bb)</enum><text>the treating provider does not respond within that time.</text></item></subclause></clause> 
<clause id="H0825BC6A0F844E718FA9BF37C3F0A8B2"><enum>(x)</enum><text>Maintain, for such period of time as the Secretary shall prescribe by regulation, a record of all direct communications with a treating provider regarding the dispensing of a prescription drug, including verification of the prescription.</text></clause></subparagraph></paragraph> 
<paragraph id="HBCB7CBF3B4D3401D93245402289CF1EB"><enum>(3)</enum><header>Licensure procedure</header> 
<subparagraph id="H63EA0D51C371487DB1B700D7B365C4B2"><enum>(A)</enum><header>Action by Secretary</header><text>On receipt of a completed licensing application under paragraph (3), the Secretary shall—</text> 
<clause id="H8E9B577FCCE74B8F84DE3DD0B83DD802"><enum>(i)</enum><text>assign an identification number to each Internet pharmacy;</text></clause> 
<clause id="H59D7F3841AB1492FBFF6266966DC9329"><enum>(ii)</enum><text>notify the applicant of the receipt of the licensure application; and</text></clause> 
<clause id="H996822979088463CB0F8FD955400D0E9"><enum>(iii)</enum><text>not later than 60 days after receipt of the licensure application, issue a license if the Internet pharmacy is in compliance with conditions under paragraph (3).</text></clause></subparagraph> 
<subparagraph id="H9008C76254B5438F9FB700469883ED2C"><enum>(B)</enum><header>Electronic filing</header> 
<clause id="H7469AB5795064DF19BBFC918FDA2DEF7"><enum>(i)</enum><header>In general</header><text>For the purpose of reducing paperwork and reporting burdens, the Secretary shall require the use of electronic methods of submitting to the Secretary a licensure application required under this section and provide for electronic methods of receiving the applications.</text></clause> 
<clause id="HB022116DD9E84E7C8E6097C4D2E975F1"><enum>(ii)</enum><header>Authentication</header><text>In providing for the electronic submission of such licensure applications under this section, the Secretary shall ensure that adequate authentication protocols are used to allow identification of the Internet pharmacy and validation of the data as appropriate.</text></clause></subparagraph></paragraph> 
<paragraph id="H239B1608E2E14C79BF85D9DA49428F36"><enum>(4)</enum><header>List</header> 
<subparagraph id="HE36A5950DAC3489D9CDCBCC33FCF8"><enum>(A)</enum><header>In general</header><text>The Secretary shall compile, maintain, and periodically update a list of licensees.</text></subparagraph> 
<subparagraph id="H90B96BB245304A53AAB3D5B58B9C4177"><enum>(B)</enum><header>Availability</header><text>The Secretary shall make the list described under subparagraph (A) and information submitted by the licensee under paragraph (2)(B) available to the public on an Internet website and through a toll-free telephone number.</text></subparagraph></paragraph> 
<paragraph id="H18B8C4844C5A47AF8E4599EB1C749843"><enum>(5)</enum><header>Licensing fee</header><text>The Secretary shall establish a licensing fee that an Internet pharmacy licensed by the Secretary under this section shall be required to pay to the Secretary.</text> 
<subparagraph id="HF9DECB7EA23E4C5E88A779F86524BF56"><enum>(A)</enum><header>Collection</header> 
<clause id="H5B7189E2EF194752999B02FECDAA63E"><enum>(i)</enum><header>Collection of initial year licensing fee</header><text>A licensing fee of $5,000 shall be payable for the fiscal year in which the Internet pharmacy first submits a licensing application under this section.</text></clause> 
<clause id="H8BE4FDE44A7B41748DAE0066C5C0095"><enum>(ii)</enum><header>Collection in subsequent years</header><text>After the licensing fee is paid for the first fiscal year, the fee, as modified under subparagraph (B), shall be payable on or before October 1 of each year.</text></clause> 
<clause id="HA0B0FDF2CFCF4E9693EB81AA61D893F1"><enum>(iii)</enum><header>One fee per Internet pharmacy</header><text>The licensing fee shall be paid only once for each Internet pharmacy for a fiscal year in which the fee is payable.</text></clause></subparagraph> 
<subparagraph id="H037F2ABC5866462EAA9E715177108861"><enum>(B)</enum><header>Fee amount</header><text>The amount of the licensing fee shall be determined each year by the Secretary based on the anticipated costs to the Secretary of enforcing the requirements of this section in the subsequent fiscal year.</text></subparagraph> 
<subparagraph id="H3C1CFA43B4C647C9A2FF4E8D377809DD"><enum>(C)</enum><header>Annual fee determination</header> 
<clause id="H28780008E74D4AE5BAC4D3008968F371"><enum>(i)</enum><header>In general</header><text>Not later than 60 days before the beginning of each fiscal year beginning after September 30, 2004, the Secretary shall determine the licensing fee for that fiscal year.</text></clause> 
<clause id="H7DF8D981DA9148E791D07106B0C619B1"><enum>(ii)</enum><header>Publication of fee amount</header><text>Not later than 60 days before each fiscal year, the Secretary shall publish the licensing fee under this section for that fiscal year and provide for a period of 30 days for the public to provide written comments on the fee.</text></clause></subparagraph> 
<subparagraph id="HE56F187BFC3B4850A9CA732200332858"><enum>(D)</enum><header>Use of fees</header><text>The licensing fees collected under this section shall be used, without further appropriation, to carry out this section.</text></subparagraph> 
<subparagraph id="H3460143809AA476C83F19B70A947BF64"><enum>(E)</enum><header>Failure to pay fee</header> 
<clause id="H4C8EC4548EBD4EAB86FC16BA77DD1C6B"><enum>(i)</enum><header>Due date</header><text>A licensing fee payable under this section shall be paid by the date that is 30 days after the date on which the fee is due.</text></clause> 
<clause id="H957316BFD7DC4186A6090727F3755D93"><enum>(ii)</enum><header>Failure to pay</header><text>If an Internet pharmacy subject to a fee under this section fails to pay the fee by the date specified under clause (i), the Secretary shall not permit the Internet pharmacy to engage in the dispensing of drugs as described under this section until all such fees owed by the Internet pharmacy are paid.</text></clause></subparagraph> 
<subparagraph id="HD2DF418AEDD04D36AFA31760A5E16356"><enum>(F)</enum><header>Reports</header><text>Beginning with fiscal year 2005, not later than 60 days after the end of each fiscal year during which licensing fees are collected under this section, the Secretary shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that describes—</text> 
<clause id="HAE27D0BAF48541ECB2FDA85519617AC"><enum>(i)</enum><text>implementation of the licensing fee authority during the fiscal year; and</text></clause> 
<clause id="H66981FF3619E46C0B9154ECC8693506C"><enum>(ii)</enum><text>the use by the Secretary of the licensing fees collected during the fiscal year for which the report is made.</text></clause></subparagraph></paragraph> 
<paragraph id="HD6B3FF75F5324EC5A300ED97F7FF309"><enum>(6)</enum><header>Termination of license</header><text>The Secretary, upon the initiative of the Secretary, may terminate a license issued under subsection (c), after notice to the Internet pharmacy and an opportunity for a hearing, and if the Secretary determines that an Internet pharmacy—</text> 
<subparagraph id="H3AD9768B13BA411EB41ED130DE55556C"><enum>(A)</enum><text>has demonstrated a pattern of noncompliance with this section;</text></subparagraph> 
<subparagraph id="H96492E4F1EDC4123B57937E3B99D249E"><enum>(B)</enum><text>has made an untrue statement of material fact in its license application; or</text></subparagraph> 
<subparagraph id="H38DD8B8EC4D24B0BA9B9924D0060C7CC"><enum>(C)</enum><text>is in violation of any applicable Federal or State law relating to the dispensing of a prescription drug.</text></subparagraph></paragraph> 
<paragraph id="HF72C8C1A9268422EB933891B7300317B"><enum>(7)</enum><header>Renewal evaluation</header> 
<subparagraph id="HA7B964878AC14EC39C992DDF5EE643D6"><enum>(A)</enum><header>In general</header><text>Before renewing a license of an Internet pharmacy under this subsection pursuant to the submission of a renewal application, the Secretary shall conduct an evaluation to determine whether the Internet pharmacy is in compliance with this section.</text></subparagraph> 
<subparagraph id="H28AE827EC954438F856938932B1089A4"><enum>(B)</enum><header>Evaluation</header><text>At the discretion of the Secretary and as applicable, an evaluation under subparagraph (A) may include testing of the Internet pharmacy website or other systems through which the Internet pharmacy communicates with consumers, and a physical inspection of the records and premises of the pharmacy.</text></subparagraph></paragraph> 
<paragraph id="H58B945A24F704064BD02D1CFCB2DA35F"><enum>(8)</enum><header>Contract for operation of program</header> 
<subparagraph id="HA15040E7D78140619189E700C1C400FF"><enum>(A)</enum><header>In general</header><text>The Secretary may award a contract under this subsection for the operation of the licensing program.</text></subparagraph> 
<subparagraph id="HEBFD03B4A2AD46CAAD3E84615174922C"><enum>(B)</enum><header>Term</header><text>The duration of a contract under subparagraph (A) shall not exceed 5 years and may be renewable.</text></subparagraph> 
<subparagraph id="H39CD314BCD7041B3B1010097B4AAC3EE"><enum>(C)</enum><header>Performance review</header><text>The Secretary shall annually review performance under a contract under subparagraph (A).</text></subparagraph></paragraph></subsection> 
<subsection id="HC773DE1A5C784D21A62EBFABEEB5F85B"><enum>(d)</enum><header>Providers of interactive computer services or advertising services</header><text>A provider of interactive computer services (as defined in section 230(f) of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>)) or an advertising service provider shall be liable under this section for dispensing or selling prescription drugs in violation of this section on account of another person’s selling or dispensing of a prescription drug if the provider of the service—</text> 
<paragraph id="HF2EF7E642FF74A2D80877F03FAF4F356"><enum>(1)</enum><text>accepts advertising for a prescription drug from an unlicensed Internet pharmacy; or</text></paragraph> 
<paragraph id="H48F28151BD9C42F5A3CC390477DF5C07"><enum>(2)</enum><text>accepts advertising stating that an individual does not need a physician’s prescription to obtain a prescription drug.</text></paragraph></subsection> 
<subsection id="H4C1C69DE6726416A9CF16C0959033616"><enum>(e)</enum><header>Policies and procedures required to prevent payments for unlawful Internet pharmacy requests</header> 
<paragraph id="H63C298005E21426AA3FC99112BA4EDB8"><enum>(1)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this section, the Federal functional regulators shall promulgate regulations requiring a person described in subsection (a)(2) to prevent restricted transactions by establishing policies and procedures that—</text> 
<subparagraph id="HE491391CB2B94C0E8C6F2279DF7322B7"><enum>(A)</enum> 
<clause display-inline="yes-display-inline" id="H0C8B4FAA886B4D38BF879BAD0788F1E5"><enum>(i)</enum><text>are reasonably designed to allow the payment system and any person involved in the payment system to identify restricted transactions by means of codes in authorization messages or by other means; and</text></clause> 
<clause indent="up1" id="H03AA71C768E64BD39624665F9B91D808"><enum>(ii)</enum><text>are reasonably designed to block restricted transactions identified as a result of the policies and procedures developed under clause (i); or</text></clause></subparagraph> 
<subparagraph id="H2D2F46CE138244EF9596A7B9B7193361"><enum>(B)</enum><text>prevent the acceptance of the products or services of the payment system in connection with a restricted transaction.</text></subparagraph></paragraph> 
<paragraph id="H90323F6B5EA24CADAA983F4BE44E1720"><enum>(2)</enum><header>Requirements for policies and procedures</header><text>In promulgating regulations under paragraph (1), the Federal functional regulators shall—</text> 
<subparagraph id="HAD6DDA7A91004D2BB040E7A613268D46"><enum>(A)</enum><text>identify types of policies and procedures, including nonexclusive examples, that shall be considered to be reasonably designed to identify and reasonably designed to block or to prevent the acceptance of the products or services in connection with each type of restricted transaction, including—</text> 
<clause id="H80B9572F663145538F1B25A83381C6EE"><enum>(i)</enum><text>identifying transactions by a code or codes in the authorization message; and</text></clause> 
<clause id="H018DA8E4CA7F4E848CBC1EE2BEF94874"><enum>(ii)</enum><text>denying authorization of a credit card transaction in response to an authorization message; and</text></clause></subparagraph> 
<subparagraph id="H3C84CC9A882C4ED8A46C3EBF1B9C3D5E"><enum>(B)</enum><text>to the extent practicable, permit any participant in a designated payment system to choose among alternative means of identifying and blocking, or otherwise preventing the acceptance of the products or services of the designated payment system or participant in connection with, restricted transactions.</text></subparagraph></paragraph> 
<paragraph id="HDDD086E1E72346809EA3C3C4FDB74035"><enum>(3)</enum><header>Compliance with payment system policies and procedures</header><text>A person described in subsection (a)(2)(B) meets the requirement of paragraph (1) if—</text> 
<subparagraph id="HF96A5ECDB9C049E7A6162997233EA669"><enum>(A)</enum><text>the person relies on and complies with the policies and procedures of a designated payment system of which the person is a member or in which the person is a participant, to—</text> 
<clause id="H6C5DB3F379534464A1EE5F42F896DE03"><enum>(i)</enum><text>identify and block restricted transactions; or</text></clause> 
<clause id="H36B165FD4A5040059D09A8D1BE8BB8AF"><enum>(ii)</enum><text>otherwise prevent the acceptance of the products or services of the payment system, member, or participant in connection with restricted transactions; and</text></clause></subparagraph> 
<subparagraph id="H8B1CEC4A1C27442EBF33509F54B814A7"><enum>(B)</enum><text>such policies and procedures of the designated payment system comply with the requirements of regulations promulgated under paragraph (1).</text></subparagraph></paragraph> 
<paragraph id="HA6D247E3192A4DF18900D60859007D29"><enum>(4)</enum><header>No liability for blocking or refusing to honor restricted transaction</header><text>A person that is subject to a regulation or an order issued under this section and blocks or otherwise refuses to honor a restricted transaction (or a transaction that such person reasonably believes to be a restricted transaction) or as a member of a designated payment system, relies on the policies and procedures of the payment system in an effort to comply with regulations promulgated under this section, shall not be liable to any party for such action.</text></paragraph> 
<paragraph id="HDB32B217D0CC430393ADE1FEAA86428F"><enum>(5)</enum><header>Enforcement</header> 
<subparagraph id="H51FB2CF14ABE4D94B02C68CCF6E0ABC1"><enum>(A)</enum><header>In general</header><text>This section shall be enforced by the Federal functional regulators and the Federal Trade Commission under applicable law in the manner provided in section 505(a) of the Gramm-Leach-Bliley Act (<external-xref legal-doc="usc" parsable-cite="usc/21/6805">21 U.S.C. 6805(a)</external-xref>).</text></subparagraph> 
<subparagraph id="H78F7387E68B84BC98E00AF067D5353B"><enum>(B)</enum><header>Factors to be considered</header><text>In considering any enforcement action under this subsection against a payment system or person described in subsection (a)(2)(B), the Federal functional regulators and the Federal Trade Commission shall consider the following factors:</text> 
<clause id="H6A874EFB4CED4AF680A83917DAF03864"><enum>(i)</enum><text>The extent to which the person is extending credit or transmitting funds knowing the transaction is in connection with an unlawful Internet pharmacy request.</text></clause> 
<clause id="H33566F1A218447A0ACFA9565B7BB8044"><enum>(ii)</enum><text>The history of the person in extending credit or transmitting funds knowing the transaction is in connection with an unlawful Internet pharmacy request.</text></clause> 
<clause id="HAF99DEBB81D6477F9BD06DE973892BF8"><enum>(iii)</enum><text>The extent to which the person has established and is maintaining policies and procedures in compliance with regulations prescribed under this subsection.</text></clause> 
<clause id="HD2C937AE38D2498489FB1DCECB66596"><enum>(iv)</enum><text>The feasibility that any specific remedy prescribed can be implemented by the person without substantial deviation from normal business practice.</text></clause> 
<clause id="H236BF75ADE0044BE90D92DF532BBD79"><enum>(v)</enum><text>The costs and burdens the specific remedy will have on the person.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H73CE8783CD784084814C15608F2CF7B9"><enum>(f)</enum><header>Reports regarding internet-related violations of Federal and State laws on dispensing of drugs</header><text>The Secretary shall, pursuant to the submission of an application meeting criteria prescribed by the Secretary, make an award of a grant or contract to an entity with experience in developing and maintaining systems for the purpose of—</text> 
<paragraph id="H9FD415FBC513436F91AE2F319C33FEE2"><enum>(1)</enum><text>identifying Internet pharmacy websites that are not licensed or that appear to be operating in violation of Federal or State laws concerning the dispensing of drugs;</text></paragraph> 
<paragraph id="H9B7A08D41D244344A4B1FF0073CD4B3C"><enum>(2)</enum><text>reporting such Internet pharmacy websites to State medical licensing boards and State pharmacy licensing boards, and to the Attorney General and the Secretary, for further investigation; and</text></paragraph> 
<paragraph id="H7D21D06AE03A4194A345FEBA8B1908B4"><enum>(3)</enum><text>submitting, for each fiscal year for which the award under this subsection is made, a report to the Secretary describing investigations undertaken with respect to violations described in paragraph (1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H91367BA49020437FB682479B13B02C8C"><enum>(b)</enum><header>Prohibited Act</header><text>Section 301 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) (as amended by section 2(b)) is amended by adding at the end the following:</text> 
<quoted-block act-name="Federal Food, Drug, and Cosmetic Act" id="H9CA62126E08E43F89F7D818B632F5B3F"> 
<subsection id="HB83F796064D94DF2A4AEE90FC39B3AE"><enum>(ii)</enum><text>The sale of a prescription drug, or the ownership or operation of an Internet pharmacy, in violation of section 511.</text></subsection> 
<subsection id="HD273F3624859414CB88D3655D65E32E3"><enum>(jj)</enum><text>The representation by advertisement, sales presentation, direct communication (including telephone, facsimile, or electronic mail), or otherwise by an Internet pharmacy, that a prescription drug may be obtained from the Internet pharmacy without a prescription, in violation of section 511.</text></subsection> 
<subsection id="H7375E37F5B824D43A439F00442100690"><enum>(kk)</enum><text>The acceptance of an advertisement from an Internet pharmacy by the provider of an interactive computer service, unless the provider has on file a copy of the license issued to the Internet pharmacy under section 511.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H890F364BD8714F09B9FA19F02F58BD3"><enum>(c)</enum><header>Links to illegal Internet pharmacies</header><text>Section 302 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/332">21 U.S.C. 332</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Federal Food, Drug, and Cosmetic Act" id="H47E09562BB214511BF3EC378EAA6CF97"> 
<subsection id="HB0B29DEEC20649899FC9FAA986BE27F"><enum>(c)</enum> 
<paragraph display-inline="yes-display-inline" id="HAE6FFCE1CF5A423BA74143ACA80024"><enum>(1)</enum><text>In the case of a violation of section 511 relating to an illegal Internet pharmacy, the district courts of the United States and the United States courts of the territories shall have jurisdiction to order a provider of an interactive computer service to remove, or disable access to, a website violating that section that resides on a computer server that the provider controls or operates.</text></paragraph> 
<paragraph indent="up1" id="H7A245339EB134F89B414591CF05C3895"><enum>(2)</enum><text>Relief under paragraph (1)—</text> 
<subparagraph id="HCBDFD617320F48CBAE8CE86233FA1841"><enum>(A)</enum><text>shall be available only after provision to the provider of notice and an opportunity to appear;</text></subparagraph> 
<subparagraph id="HF222CE573D6C45208E10D9E91EADDB23"><enum>(B)</enum><text>shall not impose any obligation on the provider to monitor its service or to affirmatively seek facts indicating activity violating section 511; and</text></subparagraph> 
<subparagraph id="H7E5F16BF986F4692BEF9E3E48874F9C"><enum>(C)</enum><text>shall specify the provider to which the relief applies.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0D0442F25AB44FB98414EE5CEF192945"><enum>(d)</enum><header>Regulations</header> 
<paragraph id="H58698486A4BC4D91BF9751ACBBDEAF5C"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services shall promulgate interim final regulations that are consistent with the Verified Internet Pharmacy Sites certification program developed by the National Association of Boards of Pharmacy to carry out the amendments made by this section.</text></paragraph> 
<paragraph id="HABCFBA64775247B1AF4B2C934E98F2C9"><enum>(2)</enum><header>Effective date</header><text>The requirement of licensure under section 511 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (as added by this section) shall take effect on the date determined by the Secretary of Health and Human Services but in no event later than 90 days after the effective date of the interim final regulations under paragraph (1).</text></paragraph></subsection> 
<subsection id="HD6EA3794BB9A4ECEA704FB168C74C45"><enum>(e)</enum><header>Return to sender</header><text>Section 801 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Federal Food, Drug, and Cosmetic Act" id="HCC8A06D511564DC5B207235FE62FD410"> 
<subsection id="H5BD05243D62E4470A9EF0362DC00CE34"><enum>(p)</enum><header>Unlicensed Internet pharmacy</header><text>If an Internet pharmacy is not licensed by the Secretary in accordance with section 511, any shipment of a prescription drug from such an Internet pharmacy to an individual shall be refused admission into the United States and the Secretary shall return the prescription drug, other than a prescription drug that is required to be destroyed, to the Internet pharmacy at the expense of the Internet pharmacy.</text></subsection> 
<subsection id="H914DD0B1A23343EFBF1B2C1F54003290"><enum>(q)</enum><header>Licensed Internet pharmacy</header><text>If a shipment of a prescription drug from an Internet pharmacy licensed by the Secretary in accordance with section 511 to an individual is refused admission into the United States, the Secretary shall—</text> 
<paragraph id="H7601A3CB136640C0803D75D542A26DC8"><enum>(1)</enum><text>return the prescription drug, other than a prescription drug that is required to be destroyed, to the Internet pharmacy at the expense of the Internet pharmacy; and</text></paragraph>

<section id="H24B4C9A2C4334376A1A760AC5635556E"><enum>5.</enum><header>Administrative detention and temporary hold</header> 
<subsection id="H080AD372A0C14D8DB842387C106BD6E1"><enum>(a)</enum><header>In general</header><text>The <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> is amended by adding after section 815 (as added by section 9) the following:</text>

<paragraph id="H8805BF31287A4DFF9C10B82BA024D1BD"><enum>(1)</enum><header>Detention authority</header> 
<subparagraph id="HB4A9FFCA4D9841F596BB81104F4F3600"><enum>(A)</enum><header>In general</header><text>An officer or qualified employee of the Food and Drug Administration may order the detention, in accordance with this subsection, of any prescription drug that is found during an inspection, examination, or investigation under this Act conducted by the officer or qualified employee, if the officer or qualified employee has credible evidence or information indicating that the prescription drug presents a risk to the public health.</text></subparagraph> 
<subparagraph id="H446913BE03A44D019F8950FEA3441DE4"><enum>(B)</enum><header>Approval</header><text>A prescription drug may be detained under subparagraph (A) only if the Secretary or an official designated by the Secretary approves the order of detention.</text></subparagraph></paragraph> 
<paragraph id="HC9615FDB288648818476D7F1EF3F58D"><enum>(2)</enum><header>Period of detention</header><text>A prescription drug may be detained under paragraph (1) for a reasonable period, not to exceed 20 days, unless a greater period, not to exceed 30 days, is necessary, to enable the Secretary to commence an action under this subsection or section 302.</text></paragraph> 
<paragraph id="H73487A7479FC4EB0B1332B912E09E5E9"><enum>(3)</enum><header>Security of detained article</header> 
<subparagraph id="H99955F21C9DC46819C381F8CD2681882"><enum>(A)</enum><header>In general</header><text>An order under paragraph (1) with respect to a prescription drug—</text> 
<clause id="HD83BDFC62A4842ADA0F15ED54F365D45"><enum>(i)</enum><text>may require that the prescription drug be labeled or marked as detained; and</text></clause> 
<clause id="HB483036136A4455A8B48FBD300B98268"><enum>(ii)</enum><text>shall require that the prescription drug be removed to a secure facility, as appropriate.</text></clause></subparagraph> 
<subparagraph id="H3E89485592CA402BB1876622B998CA99"><enum>(B)</enum><header>No transfer</header><text>A prescription drug subject to an order under paragraph (1) shall not be transferred by any person from the place at which the prescription drug is ordered detained or from the place to which the prescription drug is removed, until released by the Secretary or until the expiration of the detention period applicable under the order, whichever occurs first.</text></subparagraph> 
<subparagraph id="HCCD14E6035BD46A595CB6B5DE11615BB"><enum>(C)</enum><header>Effect of paragraph</header><text>This paragraph does not authorize the delivery of a prescription drug pursuant to the execution of a bond while the prescription drug is subject to an order under paragraph (1).</text></subparagraph> 
<subparagraph id="H93081BA8F90E49BBAE61BB7B7CCF5879"><enum>(D)</enum><header>Effect of bonding provision</header><text>Section 801(b) does not authorize the delivery of a prescription drug pursuant to the execution of a bond while the prescription drug is subject to an order under paragraph (1).</text></subparagraph></paragraph> 
<paragraph id="HE77B72BC0B4C4A40893CC76385D8B637"><enum>(4)</enum><header>Appeal of detention order</header> 
<subparagraph id="H04B03515C6ED48ABBCEABE14BBF213C8"><enum>(A)</enum><header>In general</header><text>With respect to a prescription drug detained under paragraph (1), any person that would be entitled to be a claimant for the prescription drug if the prescription drug were seized under paragraph (1) may appeal the order of detention to the Secretary.</text></subparagraph> 
<subparagraph id="H3E523C6D94BD4FD1A31CF7CD597FDF93"><enum>(B)</enum><header>Action by the Secretary</header><text>Not later than 5 days after an appeal is filed, the Secretary, after providing opportunity for an informal hearing, shall confirm or terminate the order, and confirmation by the Secretary shall be considered to be a final agency action for purposes of <external-xref legal-doc="usc" parsable-cite="usc/5/702">section 702</external-xref> of title 5, United States Code.</text></subparagraph> 
<subparagraph id="H2E00ACC588D54A1D9C009BE7C51CBE60"><enum>(C)</enum><header>Failure to Act</header><text>If, during the 5-day period specified in subparagraph (B), the Secretary fails to provide an opportunity for hearing or to confirm or terminate the order, the order shall be deemed to be terminated.</text></subparagraph> 
<subparagraph id="H016C07001FA3420AAC84F8FAA6F9C8E8"><enum>(D)</enum><header>Effect of commencement of court action</header><text>The process under this paragraph for the appeal of an order under paragraph (1) with respect to a prescription drug terminates if the Secretary commences an action under subsection (a) or section 302 regarding the prescription drug.</text></subparagraph></paragraph></subsection> 
<subsection id="HCCE9FA8D380346FAA4791030A400647D"><enum>(b)</enum><header>Effect of Section</header><text>Nothing in this section applies to a prescription drug imported by an individual under section 812 or to a commercial transaction conducted between an Internet pharmacy and an individual.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8A108225863D444AADFF8BADFCCE484D"><enum>(b)</enum><header>Temporary hold at port of entry</header><text>Section 801 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381</external-xref>) (as amended by section 4(e)) is amended by adding at the end the following:</text>

<paragraph id="HA65B7A9D0CB2438590BB1FE44139E387"><enum>(1)</enum><header>In general</header><text>If an officer or qualified employee of the Food and Drug Administration has credible evidence or information indicating that a prescription drug presents a risk to the public health, and the officer or qualified employee is unable to inspect, examine, or investigate the prescription drug upon the prescription drug’s being offered for import at a port of entry into the United States, the officer or qualified employee shall request the Secretary of the Treasury to hold the prescription drug at the port of entry for a reasonable period of time, not to exceed 24 hours, for the purpose of enabling the Secretary to inspect, examine, or investigate the prescription drug as appropriate.</text></paragraph> 
<paragraph id="H843C3455AD0148DF9FA9FA828988DF40"><enum>(2)</enum><header>Approval</header> 
<subparagraph id="H8AE7143E2FC44011B8D2F473905CCD7F"><enum>(A)</enum><header>In general</header><text>An officer or qualified employee of the Food and Drug Administration may make a request under paragraph (1) only if the Secretary or an official designated by the Secretary approves the request.</text></subparagraph> 
<subparagraph id="H777A32CEFF8741C69C74004078FACD14"><enum>(B)</enum><header>Designees</header><text>An official may not be designated under subparagraph (A) unless the official is the director of the district under this Act in which the prescription drug is located, or is an official senior to that director.</text></subparagraph></paragraph> 
<paragraph id="H76CD9665871B40EC88E2B2460901FB19"><enum>(3)</enum><header>Notification</header><text>With respect to a prescription drug for which a request under paragraph (1) is made, the Secretary, promptly after the request is made, shall notify the State in which the port of entry involved is located that the request has been made, and as applicable, that the prescription drug, is being held under this subsection.</text></paragraph> 
<paragraph id="H9AF460B41FF947C4A7C24EDE20A5E611"><enum>(4)</enum><header>Removal</header><text>A prescription drug held under paragraph (1) shall be removed to a secure facility, as appropriate.</text></paragraph> 
<paragraph id="HB114923302EC49B284282CD562C97372"><enum>(5)</enum><header>No transfer</header><text>During the period in which a prescription drug is held under this subsection, the prescription drug shall not be transferred by any person from the port of entry into the United States for the prescription drug or from the secure facility to which the prescription drug has been removed.</text></paragraph> 
<paragraph id="H63832DE15D0643089EED492EB845047B"><enum>(6)</enum><header>Effect of bonding provision</header><text>Subsection (b) does not authorize the delivery of a prescription drug held under this subsection pursuant to the execution of a bond while the prescription drug is held under this subsection.</text></paragraph> 
<paragraph id="HF912EDD0E61C4CE69112BDFA8596FB7D"><enum>(7)</enum><header>Effect of subsection</header><text>Nothing in this subsection applies to a prescription drug imported by an individual under section 812 or to a commercial transaction conducted between an Internet pharmacy and an individual.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H246AF2EDBB454CFBA94F8BB9905EB9B7"><enum>(c)</enum><header>Prohibited Act</header><text>Section 301 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) (as amended by section 4(b)) is amended by adding at the end the following:</text>

<subsection id="H6AB9D5A6C89048F7A37D490017C3263E"><enum>(a)</enum><header>In general</header><text>The <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> is amended by adding after section 816 (as added by section 5) the following:</text>

<subsection id="H1FAD66A7CECD4F0AAF11B3C6585E6914"><enum>(a)</enum><header>Prescription drug</header><text>If the Secretary determines that the importation of a particular prescription drug or particular dosage form of a prescription drug into the United States presents a risk to the public health, the Secretary may immediately order the suspension of the importation of the particular prescription drug or particular dosage form of the prescription drug.</text></subsection> 
<subsection id="HA47C2D9519E541FDB1CBABDDB2710844"><enum>(b)</enum><header>Suspension</header><text>If the Secretary determines that a drug importation facility, pharmacy, Internet pharmacy, or wholesaler is engaged in a pattern of importing or offering for importation a prescription drug into the United States in violation of any of the requirements of this Act, the Secretary may immediately order the suspension of that person from engaging in the importation or offering for importation of prescription drugs into the United States.</text></subsection> 
<subsection id="HACF5D173C31C40EDB2CC1952C7BC827C"><enum>(c)</enum><header>Canada or permitted country</header><text>If the Secretary determines that there is a pattern of prescription drugs being imported or offered for importation into the United States from Canada or a permitted country in violation of any of the requirements of this Act, the Secretary may immediately order the suspension of the importation or offering for importation into the United States of prescription drugs from Canada or that permitted country, as appropriate.</text></subsection> 
<subsection id="HF8FF07B6FDA94B09A094F9C09700004E"><enum>(d)</enum><header>Appeal of suspension order</header> 
<paragraph id="H6F45416C85B143ADA598D7F6C5BDE155"><enum>(1)</enum><header>In general</header> 
<subparagraph id="HB01B0C81DC5F4F62B1756D28137C8D1C"><enum>(A)</enum><header>Prescription drugs</header><text>With respect to the importation of a prescription drug, the importation of which is suspended under subsection (a), any person that would be entitled to be a claimant for the prescription drug may appeal the suspension order to the Secretary.</text></subparagraph> 
<subparagraph id="H4BFD42F60F6A434BA7D695B4D55D00DA"><enum>(B)</enum><header>Suspended persons</header><text>With respect to a drug importation facility, pharmacy, Internet pharmacy, or wholesaler subject to a suspension order under subsection (b) or (c), the drug importation facility, pharmacy, Internet pharmacy or wholesaler may appeal the suspension order to the Secretary.</text></subparagraph></paragraph> 
<paragraph id="H20302DC7DBE64394BCB098C1FB427662"><enum>(2)</enum><header>Action by the Secretary</header><text>Not later than 30 days after an appeal is filed, the Secretary, after providing opportunity for an informal hearing, shall confirm or terminate the order.</text></paragraph> 
<paragraph id="HDB7B9AA45ED34C5A82E08647DB949C4F"><enum>(3)</enum><header>Failure to Act</header><text>If, during the 30-day period specified in paragraph (2), the Secretary fails to provide an opportunity for a hearing or to confirm or terminate the order, the order shall be deemed to be terminated.</text></paragraph></subsection> 
<subsection id="HF8F8318B9E2C4816AB92D16387751501"><enum>(e)</enum><header>No judicial review</header><text>An order under this section shall not be subject to judicial review.</text></subsection>

<paragraph id="HFF68910F8C6C442A9959006DB3F6C8F6"><enum>(2)</enum><header>Effect of bonding provision</header><text>Subsection (b) does not authorize the delivery of a prescription drug pursuant to the execution of a bond while the prescription drug is held under this subsection.</text></paragraph> 
<paragraph id="HF0C8436D6D224253961E5084D6827D98"><enum>(3)</enum><header>Removal</header><text>A prescription drug held under this subsection shall be removed to a secure facility, as appropriate.</text></paragraph> 
<paragraph id="HE892024563584A9085EDE8BB91C9D3B7"><enum>(4)</enum><header>No transfer</header><text>During a period in which a prescription drug is held under this subsection, the prescription drug shall not be transferred by any person from the port of entry into the United States for the prescription drug or from the secure facility to which the prescription drug has been removed.</text></paragraph> 
<paragraph id="HD7ACB8ADBE624B22ABA0AADB113BBCF1"><enum>(5)</enum><header>Permissible delivery</header><text>A prescription drug held under this subsection may be delivered to a person that is not a debarred person under section 306(b)(4) if the person affirmatively establishes, at the expense of the person, that the prescription drug complies with the requirements of this Act, as determined by the Secretary.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HE7900B99A94744F2A1196893C348D50"><enum>8.</enum><header>Registration of prescription drug importation facilities</header> 
<subsection id="H57AE1C0E01004AE2A12299A382247E05"><enum>(a)</enum><header>Registration of certain importers</header><text>The <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> is amended by adding after section 813 (as added by section 2) the following:</text>

<section id="H2744601653924FD1A3E0A3D4DECC5EA"><enum>814.</enum><header>Registration of certain importers</header> 
<subsection id="H266D868AA6344F8B8156E1A31C9A32"><enum>(a)</enum><header>In general</header><text>A drug importation facility, pharmacy, Internet pharmacy, or wholesaler engaged in the importation or offering for importation of prescription drugs into the United States, or in the dispensing of such drugs, shall register with the Secretary in accordance with this section.</text></subsection> 
<subsection id="HFE5E8D50D4724F10B19BE4F08C93BB6"><enum>(b)</enum><header>Registration</header> 
<paragraph id="HFCADF53B935B425CA96D0566BDFCE7CE"><enum>(1)</enum><header>In general</header><text>To register, the owner, operator, or agent in charge of a drug importation facility, pharmacy, Internet pharmacy, or wholesaler shall submit to the Secretary a registration that discloses—</text> 
<subparagraph id="H9604C2942AC64636993E3EC6CA271212"><enum>(A)</enum><text>the name and address of each drug importation facility, pharmacy, Internet pharmacy, or wholesaler at which, and all trade names under which, the registrant conducts business;</text></subparagraph> 
<subparagraph id="HE3F7054A94CD417DA9E1C9C3B1E79DFF"><enum>(B)</enum><text>the name of each prescription drug to be imported into the United States by each drug importation facility, pharmacy, Internet pharmacy, or wholesaler; and</text></subparagraph> 
<subparagraph id="H337EE35AEC694421B5611F936D615301"><enum>(C)</enum><text>the name and address of an agent for service of process in the United States.</text></subparagraph></paragraph> 
<paragraph id="H2891A86E5D3B40D6AFE99B1996874C72"><enum>(2)</enum><header>Change in information</header><text>The registrant shall notify the Secretary in a timely manner of any change in the information provided under paragraph (1).</text></paragraph> 
<paragraph id="HBF10002BA8194B8BA425285833A4515D"><enum>(3)</enum><header>Procedure</header><text>Not later than 60 days after receipt of a completed registration under paragraph (1), the Secretary shall—</text> 
<subparagraph id="HD88D2367FFC24DFEAF17F5D03711187C"><enum>(A)</enum><text>assign a registration number to each registered drug importation facility, pharmacy, Internet pharmacy, and wholesaler; and</text></subparagraph> 
<subparagraph id="H1E76E3559A0B4F2A90F3121264F800AF"><enum>(B)</enum><text>notify the registrant of the receipt of the registration.</text></subparagraph></paragraph> 
<paragraph id="HCE1479CEB60B42728E6BC6BEA6DBDC88"><enum>(4)</enum><header>List</header> 
<subparagraph id="HAE10992567E04746BD009CF339DFF0C9"><enum>(A)</enum><header>In general</header><text>The Secretary shall compile, maintain, and periodically update a list of registrants.</text></subparagraph> 
<subparagraph id="H5F45ED71D8F945E1AB11B9EA72402D42"><enum>(B)</enum><header>Availability</header><text>The Secretary shall make the list described under subparagraph (A) and information submitted by a registrant under paragraph (1) available to the public on an Internet website and through a toll-free telephone number.</text></subparagraph></paragraph></subsection> 
<subsection id="HDFBF868688FC40B8917800617BEFF664"><enum>(c)</enum><header>Electronic filing</header> 
<paragraph id="H1CB9F2492E96472EB3E32C31FADBA682"><enum>(1)</enum><header>In general</header><text>For the purpose of reducing paperwork and reporting burdens, the Secretary shall provide for, and require the use of, electronic methods of submitting to the Secretary registrations required under this section and shall provide for electronic methods of receiving the registrations.</text></paragraph> 
<paragraph id="H7BDF4C3951184D28B5E93C59BF6E5DD"><enum>(2)</enum><header>Authentication</header><text>In providing for the electronic submission of such registrations under this section, the Secretary shall ensure that adequate authentication protocols are used to allow identification of the registrant and validation of the data as appropriate.</text></paragraph></subsection> 
<subsection id="H6EA1A4E023E84D00A06F43DB87705FB0"><enum>(d)</enum><header>Effect of Section</header> 
<paragraph indent="down1" id="H58A1C3E1AD6D4DBABA65005E51A88675"><enum>(1)</enum><header>Authority</header><text>Nothing in this section authorizes the Secretary to require an application, review, or licensing process for a drug importation facility, pharmacy, or wholesaler.</text></paragraph> 
<paragraph indent="down1" id="H54926C2BC61443A69E2E4BA769009841"><enum>(2)</enum><header>Importation by individuals</header><text>Nothing in this section applies to a prescription drug imported by an individual under section 812 or to a commercial transaction conducted between an Internet pharmacy and an individual.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H773F02DE2E1D4E4C80781F84FFD929A1"><enum>(b)</enum><header>Regulations</header> 
<paragraph id="H08F0F3B0B74D44E98E882D085CA34C21"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services shall promulgate regulations to carry out section 814 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (as added by this section).</text></paragraph> 
<paragraph id="H56D543C199E948B487C9F6BEBAED52"><enum>(2)</enum><header>Effective date</header><text>The requirement of registration under section 814 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> takes effect—</text> 
<subparagraph id="H370F6F9AC2684568A3959B1FFA94D9C9"><enum>(A)</enum><text>on the effective date of the final regulations under paragraph (1); or</text></subparagraph> 
<subparagraph id="H953EB39B288640B09300C43DF199B9D"><enum>(B)</enum><text>if the final regulations have not been made effective as of the expiration of that period, on the date that is 1 year after the date of enactment of this Act, subject to compliance with the final regulations when the final regulations are made effective.</text></subparagraph></paragraph></subsection> 
<subsection id="H0A53D38104FC41559328094CB9AF8447"><enum>(c)</enum><header>Importation; failure to register</header><text>Section 801 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381</external-xref>) (as amended by section 7(e)) is amended by adding at the end the following:</text>

<paragraph id="H67291D8D7A114FC3A604CD99399C33E"><enum>(1)</enum><header>In general</header><text>If a drug importation facility, pharmacy, Internet pharmacy, or wholesaler engaged in the importation or offering for importation of prescription drugs into the United States has not submitted a registration to the Secretary in accordance with section 814, a prescription drug that is being imported or offered for importation into the United States shall not be delivered to the importer, owner, or consignee of the prescription drug until the drug importation facility, pharmacy, Internet pharmacy, or wholesaler is registered in accordance with section 814.</text></paragraph> 
<paragraph id="H87177A1045264D20818100009B897888"><enum>(2)</enum><header>Effect of subsection (b)</header><text>Subsection (b) does not authorize the delivery of the prescription drug pursuant to the execution of a bond while the prescription drug is held under this subsection.</text></paragraph> 
<paragraph id="H81ED5536C5AF4867A83FA11876BB59D2"><enum>(3)</enum><header>Removal</header><text>A prescription drug held under this subsection shall be removed to a secure facility, as appropriate.</text></paragraph>

<section id="H73998E6FDCDF4CF4A749252F02B00931"><enum>9.</enum><header>Maintenance and inspection of records for prescription drugs</header><text display-inline="no-display-inline">The <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> is amended by adding after section 814 (as added by section 8) the following:</text>

<subsection id="HBEE05383BCCA4F94BE1D4880C3A92CD5"><enum>(a)</enum><header>In general</header><text>The Secretary may by regulation establish requirements relating to the establishment and maintenance, for not longer than 2 years, of records by—</text> 
<paragraph id="HC721BF04A9964B769C005E00A4CA2D5F"><enum>(1)</enum><text>a drug importation facility, pharmacy, Internet pharmacy, or wholesaler engaged in the importation of prescription drugs into the United States, or in the dispensing of such drugs; and</text></paragraph> 
<paragraph id="H8D880D1A965F48529893F7D765174F49"><enum>(2)</enum><text>any person that processes, packages, distributes, receives, holds, or transports a prescription drug imported under this subchapter.</text></paragraph></subsection> 
<subsection id="H78438B7A508C437DBA25E5C870BB00E1"><enum>(b)</enum><header>Inspection</header> 
<paragraph id="H739321376D6C43C081BDC12C01A0EC95"><enum>(1)</enum><header>In general</header><text>If the Secretary has reason to believe that a prescription drug imported under this subchapter presents a risk to the public health, the drug importation facility, pharmacy, Internet pharmacy, or wholesaler that imports the prescription drug, and each person that processes, packages, distributes, receives, holds, or transports the prescription drug shall, at the request of an officer or employee duly designated by the Secretary, permit the officer or employee, upon presentation of appropriate credentials and a written notice to such pharmacy or person, at reasonable times, within reasonable limits and in a reasonable manner, to have access to and copy all records relating to the prescription drug that are needed to enable the Secretary to determine whether the prescription drug presents a risk to the public health.</text></paragraph> 
<paragraph id="H746F9637BD044649837F3755F7E4C47"><enum>(2)</enum><header>Applicability</header><text>Paragraph (1) applies to all records maintained by or on behalf of the drug importation facility, pharmacy, Internet pharmacy, or wholesaler or such other person in any format (including paper and electronic formats) and at any location.</text></paragraph></subsection> 
<subsection id="HB355CB6864E34ED494DD301493FABD4C"><enum>(c)</enum><header>Protection of sensitive information</header><text>The Secretary shall take appropriate measures to ensure that there are in effect effective procedures to prevent the unauthorized disclosure of any trade secret or confidential information that is obtained by the Secretary under this section or any commercial or financial information that is privileged or confidential.</text></subsection> 
<subsection id="HD8B7233C67C5426BAB131B7F38FCD1AB"><enum>(d)</enum><header>Effect of Section</header><text>Nothing in this section applies to a prescription drug imported by an individual under section 812 or to a commercial transaction conducted between an Internet pharmacy and an individual.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HCD066F01E8954FA7814E001B4D1E5EC0"><enum>10.</enum><header>Advance notice of imported prescription drug shipments</header> 
<subsection id="HDD9A6463F02644DCA1774B8F2FE600F9"><enum>(a)</enum><header>In general</header><text>Section 801 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (as amended by section 8(b)) is amended by adding at the end the following:</text>

<paragraph id="H49FB6CF0701A4D3FA1CEEE2A6011194"><enum>(1)</enum><header>In general</header><text>For purposes of enabling the Secretary to inspect at ports of entry a prescription drug that is being imported or offered for importation into the United States, the person importing or offering for importation the prescription drug shall, in advance, provide to the Secretary a notice that includes—</text> 
<subparagraph id="HF08FA9889C6F4BB78EA359B066831E3D"><enum>(A)</enum><text>the established name (as defined by section 502(e)), dosage form, and quantity of the prescription drug;</text></subparagraph> 
<subparagraph id="H8049AE2807604E7DAAC75601B4A6D258"><enum>(B)</enum><text>the name of the shipper of the prescription drug;</text></subparagraph> 
<subparagraph id="HE53F7F7DF77F46D0AC1603CEEE9F2F50"><enum>(C)</enum><text>the name of the country from which the prescription drug originates;</text></subparagraph> 
<subparagraph id="H4E9DC10F82774AC8893B205BB229C481"><enum>(D)</enum><text>the country from which the prescription drug is shipped;</text></subparagraph> 
<subparagraph id="H8D2A0A142940488083020035932FC3F8"><enum>(E)</enum><text>the name of the port of entry of the prescription drug;</text></subparagraph> 
<subparagraph id="HC7AF2033363C4B87BC77E219F09C2C93"><enum>(F)</enum><text>documentation from the drug importation facility located in Canada or a permitted country specifying—</text> 
<clause id="HC8E5DF6044C1410D91BB908D5E16F22E"><enum>(i)</enum><text>the original source of the prescription drug; and</text></clause> 
<clause id="H3D174992C828426AB7DA6FE59200FE22"><enum>(ii)</enum><text>the quantity of each lot of the prescription drug originally received by the facility from that source;</text></clause></subparagraph> 
<subparagraph id="H04C52E34FCE140EABC13CFD6497678CA"><enum>(G)</enum><text>the lot or control number assigned to the prescription drug by the manufacturer of the prescription drug;</text></subparagraph> 
<subparagraph id="HCB9BEC7890524E2EAEB2DFDCE851D0E"><enum>(H)</enum><text>the name, address, telephone number, and professional license number of the drug importation facility located in Canada or a permitted country; and</text></subparagraph> 
<subparagraph id="H781B8243D28546A68445BA211913008E"><enum>(I)</enum><text>certification from the drug importation facility located in a foreign country or from the manufacturer of the prescription drug that the prescription drug—</text> 
<clause id="H9E1FADF7D4AA476EBD12667910F5CE55"><enum>(i)</enum><text>is approved for marketing in the United States and is not adulterated or misbranded; and</text></clause> 
<clause id="H593EC7DF9B5F431D874977776DFEBB17"><enum>(ii)</enum><text>meets all labeling requirements under this Act.</text></clause></subparagraph></paragraph> 
<paragraph id="H67C72C9C173746389FD516D25DF8EB14"><enum>(2)</enum><header>Refusal of admission</header><text>A prescription drug imported or offered for importation without submission of a notice under paragraph (1) shall be refused admission into the United States.</text></paragraph> 
<paragraph id="H782A3DE23AD342D00045C6F8F62D7667"><enum>(3)</enum><header>Period of advance notice</header><text>The period in which the notice under paragraph (1) is required to be made in advance of the time of the importation of a prescription drug or the offering of a prescription drug for importation shall be not less than 24 hours and not more than 5 days.</text></paragraph> 
<paragraph id="H19445001BD1C45489DD900B27ED2DC71"><enum>(4)</enum><header>Failure to provide notice</header> 
<subparagraph id="H4642B5CA96AB4111A5D8DB3EE90673D"><enum>(A)</enum><header>In general</header><text>If a prescription drug is being imported or offered for importation into the United States and notice is not provided in advance in accordance with paragraph (1), the prescription drug shall be held at the port of entry for the prescription drug, and may not be delivered to the importer, owner, or consignee of the prescription drug, until the notice is submitted to the Secretary and the Secretary examines the notice and determines that the notice is in accordance with the requirements under paragraph (1).</text></subparagraph></paragraph> 
<paragraph id="HBB0E9EF7BD1147C195650065337C407C"><enum>(5)</enum><header>Effect of bonding provision</header><text>Subsection (b) does not authorize the delivery of a prescription drug pursuant to the execution of a bond while the prescription drug is held under this subsection.</text></paragraph> 
<paragraph id="H2FEF15195FD24691825944C095B302A3"><enum>(6)</enum><header>Removal</header><text>A prescription drug held under this subsection shall be removed to a secure facility, as appropriate.</text></paragraph> 
<paragraph id="HD006F861723D4F6BB28D711F574DA417"><enum>(7)</enum><header>No transfer</header><text>During a period in which a prescription drug is held under this subsection, the prescription drug shall not be transferred by any person from the port of entry into the United States for the article or from the secure facility to which the prescription drug has been removed.</text></paragraph>

<subsection id="H69A4BD880C004C95AEC719BC51CA5186"><enum>(a)</enum><header>In general</header><text>Section 801 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381</external-xref>) (as amended by section 10(a)) is amended by adding at the end the following:</text>

<paragraph id="H8CDA10E355E54369BD9920F7DE35FCB8"><enum>(1)</enum><header>In general</header><text>If a prescription drug has been refused admission under subsection (a), other than such a prescription drug that is required to be destroyed, the Secretary may require the owner or consignee of the prescription drug to affix to the container of the prescription drug a label that clearly and conspicuously bears the statement: <quote>UNITED STATES: REFUSED ENTRY</quote>.</text></paragraph> 
<paragraph id="H96FF6FB877904736B9CE61F1CC8D00DA"><enum>(2)</enum><header>Expenses</header><text>All expenses in connection with affixing a label under paragraph (1)—</text> 
<subparagraph id="HA372B3D4EFAE48DE82A46520C9222C7D"><enum>(A)</enum><text>shall be paid by the owner or consignee of the prescription drug; and</text></subparagraph> 
<subparagraph id="H4B64E9EEC43E4CB7BFF4D8642D6535C6"><enum>(B)</enum><text>in default of such payment, shall constitute a lien against future importations made by the owner or consignee.</text></subparagraph></paragraph> 
<paragraph id="H04ED0B2DB9734B2F90DB5F9443DFE21E"><enum>(3)</enum><header>Effective period</header><text>A requirement under paragraph (1) with respect to a prescription drug remains in effect until the Secretary determines that the prescription drug has been brought into compliance with this Act.</text></paragraph> 
<paragraph id="H48F4C9F83FA241B9B64260A0CDC5143C"><enum>(4)</enum><header>Effect of subsection</header><text>Nothing in this subsection applies to a prescription drug imported by an individual under section 812 or to a commercial transaction conducted between an Internet pharmacy and an individual.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC3363A5B46B042C59442694FD3A15E26"><enum>(b)</enum><header>Misbranded prescription drugs</header><text>Section 502 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/352">21 U.S.C. 352</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H5E5C02AAF56C4659827046161570A0D0"><enum>(1)</enum><text>it is a prescription drug refused admission into the United States that fails to bear a label required by the Secretary under section 801(v);</text></paragraph> 
<paragraph id="H78E0D49C57EA458E9FD4AF7C3439CF3B"><enum>(2)</enum><text>the Secretary finds that the prescription drug presents a risk to the public health; and</text></paragraph> 
<paragraph id="H9DE6EE9A8EE04A238858DEE97FF1584"><enum>(3)</enum><text>on or after notifying the owner or consignee of the prescription drug that the label is required under section 801(v), the Secretary informs the owner or consignee that the prescription drug presents such a risk.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD33BBF74B50C431190D08CC4DE8E32C1"><enum>(c)</enum><header>Rule of construction</header><text>With respect to a prescription drug that is imported or offered for importation into the United States, nothing in this section limits the authority of the Secretary of Health and Human Services or the Secretary of the Treasury to require the marking of prescription drugs refused admission under any other provision of law.</text></subsection></section> 
<section id="H31AD08C912E944E0BCF64EC1000095B"><enum>12.</enum><header>Prohibition of port shopping</header><text display-inline="no-display-inline">Section 502 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/352">21 U.S.C. 352</external-xref>) (as amended by section 11(b)) is amended by adding at the end the following:</text>

<subsection id="HAAFDD1C59C9849AFA7783E77EEFA755E"><enum>(x)</enum><header>Port shopping</header> 
<paragraph id="H833F75DD67304B2CA38360D369E7347B"><enum>(1)</enum><header>In general</header><text>If—</text> 
<subparagraph id="HF6AAAE7B61F94F97AD58FBD3375B74D3"><enum>(A)</enum><text>it is a prescription drug imported or offered for importation into the United States; and</text></subparagraph> 
<subparagraph id="H6B2D7409468C4E7D9815B5476B97B7AB"><enum>(B)</enum><text>the prescription drug has previously been refused admission under section 801(a);</text></subparagraph><continuation-text continuation-text-level="paragraph">unless the person reoffering the prescription drug affirmatively establishes, at the expense of the owner or consignee of the prescription drug, that the prescription drug complies with the applicable requirements of this Act, as determined by the Secretary.</continuation-text></paragraph> 
<paragraph id="H1E66F29577584E4B8C94DDE06BA1AFB"><enum>(2)</enum><header>Effect of paragraph</header><text>Nothing in this paragraph applies to importation of a prescription drug under section 812 or to a commercial transaction conducted between an Internet pharmacy and an individual.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H47C35129903F4FAD8916C2E6C605C7B2"><enum>13.</enum><header>Authority to commission other Federal and State officials to conduct inspections</header><text display-inline="no-display-inline">Section 702(a) of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/372">21 U.S.C. 372(a)</external-xref>) is amended—</text> 
<paragraph id="H919D34AB7A384E6C9CA529F3C4F0937"><enum>(1)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (5) and (6), respectively; and</text></paragraph> 
<paragraph id="H27EA4D7B86384C34800971CABC249F6F"><enum>(2)</enum><text>inserting after paragraph (2) the following:</text> 
<quoted-block id="H318E5016DE4D41E89B6C04741B3BEF91"> 
<paragraph id="H0F1F59920C1E42A39CCB4FC3EDB3E860"><enum>(3)</enum> 
<subparagraph display-inline="yes-display-inline" id="H97C719BE65CA4A1784E161B392F75597"><enum>(A)</enum><text>The Secretary, pursuant to a memorandum of understanding between the Secretary and the head of another Federal agency, may conduct examinations and investigations for the purposes of enforcing compliance with the amendments made by the <short-title>Safe IMPORT Act of 2004</short-title> through the officers and employees of the other agency.</text></subparagraph> 
<subparagraph indent="up1" id="H622D52CBC70C4682AFAAB0134DBF7322"><enum>(B)</enum><text>A memorandum of understanding under subparagraph (A) shall include—</text> 
<clause id="HDD9D2544887F48D986199C6E2923B914"><enum>(i)</enum><text>provisions to ensure adequate training of officers and employees to conduct the examinations and investigations; and</text></clause> 
<clause id="HEA7504EAFC9C4A95B47B50079F7F76EC"><enum>(ii)</enum><text>provisions regarding reimbursement that may, in the discretion of the head of the other agency, require reimbursement, in whole or in part, from the Secretary for the examinations or investigations performed under this paragraph by the officers or employees of the other agency.</text></clause></subparagraph> 
<subparagraph indent="up1" id="H29293EB2B6AB418C99F752267708007D"><enum>(C)</enum><text>A memorandum of understanding under subparagraph (A) shall be effective only with respect to examinations or inspections at facilities or other locations that are jointly regulated by the Secretary and the other agency.</text></subparagraph> 
<subparagraph indent="up1" id="HA253F111127F4B4BB484412EB537FC09"><enum>(D)</enum><text>Not later than 60 days after the end of each fiscal year in which the head of a Federal agency carries out 1 or more examinations or inspections under a memorandum of understanding under subparagraph (A), the Secretary and the agency head shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and to the Committee on Energy and Commerce of the House of Representatives, a report that discloses, for that year—</text> 
<clause id="H50A748FEA89F4598A6E84314C9A17F66"><enum>(i)</enum><text>the number of officers or employees that carried out 1 or more programs, projects, or activities under the memorandum of understanding;</text></clause> 
<clause id="HCF6BA6E69EC94B2CAC24D5BF7B500D"><enum>(ii)</enum><text>the number of additional articles that were inspected or examined as a result of the memorandum of understanding; and</text></clause> 
<clause id="H18B2D0FD8D654FDF930051D5F08BEE7F"><enum>(iii)</enum><text>the number of additional examinations or investigations that were carried out pursuant to the memorandum of understanding.</text></clause></subparagraph></paragraph> 
<paragraph id="H317F62C0BFA04A389CA8DA2B3285290"><enum>(4)</enum> 
<subparagraph display-inline="yes-display-inline" id="HB64E8A96D00C49079DA4BC9726C97A7"><enum>(A)</enum><text>The Secretary may enter into a contract with a State to use the State Board of Pharmacy personnel of the State to conduct examinations and inspection for the purpose of carrying out the amendments made by the <short-title>Safe IMPORT Act of 2004</short-title>.</text></subparagraph> 
<subparagraph indent="up1" id="H7E5BAF8C1E4A47DD8E8031E78D5831AE"><enum>(B)</enum><text>A contract entered into under subparagraph (A) shall—</text> 
<clause id="H6C47866FC4BB4F429827859F0030F4DF"><enum>(i)</enum><text>ensure adequate training of officers and employees to conduct the examinations and investigations; and</text></clause> 
<clause id="H42C4FB6B57734B29B82949E2669E2400"><enum>(ii)</enum><text>be effective only with respect to examinations or inspections of drug importation facilities, pharmacies, Internet pharmacies, and wholesalers located in the State.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H1ED6E4849DB543A0BC55197C4FB008EC"><enum>14.</enum><header>User fees relating to prescription drug importation</header><text display-inline="no-display-inline">Subchapter C of chapter VII of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/397f">21 U.S.C. 397f et seq.</external-xref>) is amended by adding at the end the following:</text>

<part id="H0DE8C281FAE44B0686F80BC46F0C91B"><enum>5</enum><header>Fees relating to prescription drug importation</header> 
<section id="HE7D0C9AAD45B40FD8B60F65F9689224"><enum>740A.</enum><header>Fees relating to prescription drug importation</header> 
<subsection id="H9D0518EBFBC94DD3A8C6A710F2D4056"><enum>(a)</enum><header>Registration fee</header><text>The Secretary shall establish a user fee program under which a drug importation facility, pharmacy, Internet pharmacy, or wholesaler registering with the Secretary under section 814 shall be required to pay a fee to the Secretary.</text></subsection> 
<subsection id="H1E09067BDE5349589DEF00D3D759B438"><enum>(b)</enum><header>Collection</header> 
<paragraph id="H9D02B0EC71EC41A9B2354DCAAC4ED346"><enum>(1)</enum><header>Collection on initial registration</header><text>A fee under this section shall be payable for the fiscal year in which the drug importation facility, pharmacy, Internet pharmacy, or wholesaler first registers under section 814 (or reregisters under that section if that person has withdrawn its registration and subsequently reregisters).</text></paragraph> 
<paragraph id="H5CD6039CFD6A42B5A3D7D6EA5F56959C"><enum>(2)</enum><header>Collection in subsequent years</header><text>After the fee is paid for that fiscal year, the fee shall be payable on or before October 1 of each year.</text></paragraph> 
<paragraph id="H0A78C743979A490E986DF94D002CE251"><enum>(3)</enum><header>One fee per facility</header><text>The fee shall be paid only once for each drug importation facility, pharmacy, Internet pharmacy, or wholesaler registered for a fiscal year in which the fee is payable.</text></paragraph></subsection> 
<subsection id="HACE38F22CEBF4C2FB0FD3786A2B7A744"><enum>(c)</enum><header>Fee amount</header><text>The amount of the fee shall be determined each year by the Secretary and shall be based on the anticipated costs to the Secretary of enforcing the amendments made by the <short-title>Safe IMPORT Act of 2004</short-title> in the subsequent fiscal year.</text></subsection> 
<subsection id="H1932686FAA81438AACFE207D3831B55B"><enum>(d)</enum><header>Use of fees</header><text>The fees collected under this section shall be used, without further appropriation, to enforce the amendments made by the <short-title>Safe IMPORT Act of 2004</short-title>.</text></subsection> 
<subsection id="H929266C85D44434100D91A4E80A912"><enum>(e)</enum><header>Annual fee setting</header><text>The Secretary shall establish, 60 days before the beginning of each fiscal year beginning after September 30, 2004, for that fiscal year, registration fees.</text></subsection> 
<subsection id="HC8C9590AEA5F40AD9000B060FA878F00"><enum>(f)</enum><header>Effect of failure to pay fees</header> 
<paragraph id="HBDA063CBF3A649379E6C6833DC891CF3"><enum>(1)</enum><header>Due date</header><text>A fee payable under this section shall be paid by the date that is 30 days after the date on which the fee is due.</text></paragraph> 
<paragraph id="H5B7665613E994388868EF300056139EE"><enum>(2)</enum><header>Failure to pay</header><text>If a registered drug importation facility, pharmacy, Internet pharmacy, or wholesaler subject to a fee under this section fails to pay the fee, the Secretary shall not permit the drug importation facility pharmacy, Internet pharmacy, or wholesaler to engage in importation or offering for importation prescription drugs under this Act until all such fees owed by that person are paid.</text></paragraph></subsection> 
<subsection id="H6D88BA4F49084EE087CEBBAFA15B31A9"><enum>(g)</enum><header>Reports</header> 
<paragraph id="H8D76B8A3F6704077812ED27700487B3D"><enum>(1)</enum><header>Fee establishment</header><text>Not later than 60 days before each fiscal year, the Secretary shall—</text> 
<subparagraph id="HF3A4B715329E4AB3B7F4C1634F71CF35"><enum>(A)</enum><text>publish user fees under this section for that fiscal year;</text></subparagraph> 
<subparagraph id="HE8C13C14608242A88994144E1EC63284"><enum>(B)</enum><text>hold a meeting at which the public may comment on the recommendations; and</text></subparagraph> 
<subparagraph id="HC07B2F3DC1714501BB3873CFFC385F66"><enum>(C)</enum><text>provide for a period of 30 days for the public to provide written comments on the recommendations.</text></subparagraph></paragraph> 
<paragraph id="HE79D54144B6E435391B8341FE3E8B809"><enum>(2)</enum><header>Performance and fiscal report</header><text>Beginning with fiscal year 2005, not later than 60 days after the end of each fiscal year during which fees are collected under this section, the Secretary shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that describes—</text> 
<subparagraph id="H0D034B94AE6842A59D304D59A2A8CCDB"><enum>(A)</enum><text>implementation of the user fee authority during the fiscal year; and</text></subparagraph> 
<subparagraph id="HBEC81BBB752E4255A4D21C3DACE83650"><enum>(B)</enum><text>the use by the Secretary of the fees collected during the fiscal year for which the report is made.</text></subparagraph></paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H01F41DA5FE5643A000FFE44413905482"><enum>15.</enum><header>Anticounterfeiting provisions</header> 
<subsection id="HEF1CCFECDA9D4D9B9E559C7DE93CCBD" display-inline="no-display-inline"><enum>(a)</enum><header>Required records</header><text>Section 503(e) of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/353">21 U.S.C. 353(e)</external-xref>) is amended by striking paragraph (1) and inserting the following:</text> 
<quoted-block act-name="Federal Food, Drug, and Cosmetic Act" display-inline="yes-display-inline" id="H4B55DC11B2A548A2AD3B9C959300CE3B"> 
<paragraph id="HB48F9DEB6C3D4DC8961E58F3C8EF8469" display-inline="no-display-inline"><enum>(1)</enum><text>A distributor of record that is engaged in the wholesale distribution of a drug subject to subsection (b), shall—</text> 
<subparagraph indent="up1" id="HAFD5BF8BB20E4AF58D3C3D267D008C56"><enum>(A)</enum><text>before each wholesale distribution of the drug—</text> 
<clause id="HB8A11ADF58074EFEBF82E6A056F1004B"><enum>(i)</enum><text>with respect to each wholesale distribution of a drug subject to subsection (b), provide the person that receives the drug a statement that identifies the immediately previous distributor of record from which the drug was purchased; and</text></clause> 
<clause id="HB87E08376FFC4CB08FB38858E3691339"><enum>(ii)</enum><text>with respect to a drug subject to subsection (b) that is imported to the United States, provide the person that receives the drug a statement (in such form and containing such information as the Secretary may require) identifying each prior sale, purchase, or trade of the drug (including the date of transmission and the names and addresses of all parties to the transaction); and</text></clause></subparagraph> 
<subparagraph indent="up1" id="H6E7D25A47CF84B9BA41978B22918A53B"><enum>(B)</enum><text>create, maintain for 2 years, and make available to the Secretary for inspection at reasonable time, records that—</text> 
<clause id="H95D53AC68C28470E979734542619D3C6"><enum>(i)</enum><text>with respect to each wholesale distribution of a drug subject to subsection (b), identifies—</text> 
<subclause id="H5AFF2CB1BF6B49D9916CE8546FAE04B6"><enum>(I)</enum><text>the immediately previous distributor of record from which the drug was purchased; and</text></subclause> 
<subclause id="HE5E549DFEF9341399071571C00E628C0"><enum>(II)</enum><text>the immediately subsequent distributor of record to which the drug was sold or otherwise transferred; and</text></subclause></clause> 
<clause id="H266885AA069C41EE9300901F945800DC"><enum>(ii)</enum><text>with respect to a drug subject to subsection (b) that is imported to the United States, identifies—</text> 
<subclause id="H471612BF84AA415DA2276EB9E4F02E80"><enum>(I)</enum><text>each previous distributor of record from which the drug was purchased or otherwise transferred; and</text></subclause> 
<subclause id="H6EAF634E159948EE96C05FA875F06EF4"><enum>(II)</enum><text>each subsequent distributor of record to which the drug was sold or otherwise transferred, to the extent feasible.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7AB736A0F1C64EBF85177FC68203436C"><enum>(b)</enum><header>Electronic track and trace technology</header><text>Not later than December 31, 2007, the Secretary of Health and Human Services shall require the adoption and use of electronic track and trace technology for a prescription drug at the case and pallet level that will identify each sale, purchase, or trade of that case or pallet (including the date of transmission and the names and addresses of all parties to the transaction) .</text></subsection> 
<subsection id="HAC915BBE40554CC8BF1ED5B2CC476BE9"><enum>(c)</enum><header>Distributors of record</header><text>Section 503(e) of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/353">21 U.S.C. 353(e)</external-xref>) is amended by striking paragraph (3) and inserting the following:</text> 
<quoted-block act-name="Federal Food, Drug, and Cosmetic Act" id="H788BF37F7E75498AA14F3CB9A697BE71"> 
<paragraph indent="up1" id="H96F2EE95B4A6439287E1582DF2D47D42"><enum>(3)</enum><text>For the purposes of this subsection and subsection (d)—</text> 
<subparagraph id="H24BD0C5E80F14D7C991EE043D3F86CF"><enum>(A)</enum><text>the term <term>distributor of record</term>—</text> 
<clause id="H4A20065F364442A7AB9075969622A4FF"><enum>(i)</enum><text>means a person that takes title to or possession of a drug subject to subsection (b) from manufacture to retail sale;</text></clause> 
<clause id="HE461DC3E45634F86B9D990C26500D4FA"><enum>(ii)</enum><text>includes a person that manufacturers, processes, packs, distributes, receives, holds, imports, or offers for importation a drug subject to subsection (b); and</text></clause> 
<clause id="HCBBCCDAFF8834396AAA038532EF85714"><enum>(iii)</enum><text>does not include a transporter;</text></clause></subparagraph> 
<subparagraph id="H59669291F5FD4616BBE944BF8EB6F4E5"><enum>(B)</enum><text>the term <term>transporter</term> means the United States Postal Service, or equivalent governmental service of a foreign country, or a private carrier engaged in the business of transporting packages for hire; and</text></subparagraph> 
<subparagraph id="HC7D96A94C062463A802040EA416E8740"><enum>(C)</enum><text>the term <term>wholesale distribution</term> means the distribution of a drug subject to subsection (b) to other than the consumer or patient but not including an intracompany sale or distribution of a drug described in subsection (c)(3)(B).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H26AE6C6EF7894615B75F116FE91D5255"><enum>(d)</enum><header>Anticounterfeiting programs</header><text>Section 503(e) of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/353">21 U.S.C. 353(e)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Federal Food, Drug, and Cosmetic Act" id="H7659DC20FEBE4AF9B715ED9469025D99"> 
<paragraph indent="up1" id="H03B7D17BE62B4DF89B51C2B316BF013B"><enum>(4)</enum><text>The Secretary shall—</text> 
<subparagraph id="H4D5C5B8BFA3148F6AA00D6C9682588B"><enum>(A)</enum><text>establish a network to be known as the <quote>Counterfeit Alert Network</quote> for the purpose of providing prompt notification to health professionals and the public of counterfeit drugs subject to subsection (b);</text></subparagraph> 
<subparagraph id="H127E494E549A4EDE9FB181A225F608D"><enum>(B)</enum> 
<clause display-inline="yes-display-inline" id="H137534FD11184A3683D9EFE21753E57"><enum>(i)</enum><text>develop and publish an Internet accessible-reference document to facilitate the positive identification by health professionals and regulatory agency personnel of prescription drugs marketed in the United States and Canada; and</text></clause> 
<clause indent="up1" id="HF4B9A061B8CC454EBEAE12C983347F49"><enum>(ii)</enum><text>update the materials described under clause (i) quarterly and when a new permitted country is designated by the Secretary;</text></clause></subparagraph> 
<subparagraph id="H5AE24DF2055D4346BA0020D7A100BF26"><enum>(C)</enum><text>develop and publish educational materials to help health professionals and consumers identify and report cases of counterfeit drugs subject to subsection (b);</text></subparagraph> 
<subparagraph id="H7C5340F55DFB4D06AF1E9CA7C0096512"><enum>(D)</enum><text>develop and publish secure business practice guidelines for the sale and distribution of such drugs in cooperation with members of a drug supply chain; and</text></subparagraph> 
<subparagraph id="HD08857905B054713BF6BA84FB287DA78"><enum>(E)</enum><text>in cooperation with the National Association of Boards of Pharmacy, develop and publish revised model rules for licensure of drug wholesalers for adoption by the States.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H67F7256DB1C54505BC3FC2C5BA1B062B"><enum>16.</enum><header>Conforming amendments</header> 
<subsection id="HA755DC3B80FA49A994A82EB44100ECEE"><enum>(a)</enum><text>Section 1006 of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/956">21 U.S.C. 956</external-xref>) is repealed.</text></subsection> 
<subsection id="H6BB87DA8136C49C3A9D12427931536A5"><enum>(b)</enum><text>The <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>) is amended—</text> 
<paragraph id="HB6F46C9946974745BFAE57CCE9BC0331"><enum>(1)</enum><text>in section 301(aa)—</text>
