<section section-type="section-one" id="H7CA5A1C0E92646DB8E72A4E0001B00AC" display-inline="no-display-inline"><enum>1.</enum><header>Additional authorization of appropriations for the Reclamation Safety of Dams Act of 1978</header> 
<subsection id="HF91A4458017F46B2A4FE2E126924DBCD"><enum>(a)</enum><header>Reimbursement of certain modification costs</header><text>Section 4(c) of the Reclamation Safety of Dams Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/43/508">43 U.S.C. 508(c)</external-xref>) is amended by striking <quote>(c) With respect to</quote> and all that follows through <quote>2001</quote> and inserting the following:</text>

<subsection id="H254F0B1ABC904FE596113E4433C5CB75"><enum>(c)</enum><header>Reimbursement of certain modification costs</header><text>With respect to the additional amounts authorized to be appropriated by section 5</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H770F9B3E662C4721932567922B6ED7AA"><enum>(b)</enum><header>Authorization of appropriations</header><text>Section 5 of the Reclamation Safety of Dams Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/43/509">43 U.S.C. 509</external-xref>) is amended in the first sentence—</text> 
<paragraph id="H44D063AD03C54990A680A9687178E6BE"><enum>(1)</enum><text>by inserting <quote>and, effective October 1, 2003, not to exceed an additional $540,000,000 (October 1, 2003, price levels),</quote> after <quote>(October 1, 2001, price levels),</quote>; and</text></paragraph> 
<paragraph id="H9EFFB7949C3547FE82448C289BA9A9AC"><enum>(2)</enum><text>by striking <quote>$750,000</quote> and inserting <quote>$1,250,000 (October 1, 2003, price levels), as adjusted to reflect any ordinary fluctuations in construction costs indicated by applicable engineering cost indexes,</quote>.</text></paragraph></subsection></section> 
<section id="H272AD9AE5324423CA4CF63D7F4377100"><enum>2.</enum><header>Participation by project beneficiaries</header> 
<subsection id="H9C9852D3A9EA4150B6D29CB5C1358351"><enum>(a)</enum><header>Cost containment; modification status</header><text>Section 4 of the Reclamation Safety of Dams Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/43/508">43 U.S.C. 508</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HEFBBA59D058349638594578E4FDB0672"><enum>(e)</enum> 
<paragraph display-inline="yes-display-inline" id="H680625BD26CA4048883EF61599F382C9"><enum>(1)</enum><text>During the construction of the modification, the Secretary shall consider cost containment measures recommended by a project beneficiary that has elected to consult with the Bureau of Reclamation on a modification.</text></paragraph> 
<paragraph indent="up1" id="H7798A69ECBD04D2A8E0069EABD00157B"><enum>(2)</enum><text>The Secretary shall provide to project beneficiaries on a periodic basis notice regarding the costs and status of the modification.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB75B01F193EC472E007245EDCB677046"><enum>(b)</enum><header>Project beneficiaries</header><text>The Reclamation Safety of Dams Act of 1978 is amended by inserting after section 5 (<external-xref legal-doc="usc" parsable-cite="usc/43/509">43 U.S.C. 509</external-xref>) the following:</text>

<section id="H31FA74DB89274FA9BFDB0099A3E89ED0"><enum>5A.</enum> 
<subsection display-inline="yes-display-inline" id="H4A94E70D75E24272B52BC43D55F56E72"><enum>(a)</enum><text>On identifying a Bureau of Reclamation facility for modification, the Secretary shall provide to the project beneficiaries written notice—</text> 
<paragraph id="HB92C5A81BCC34159A0217157E2022560"><enum>(1)</enum><text>describing the need for the modification and the process for identifying and implementing the modification; and</text></paragraph> 
<paragraph id="H3693759558A1416FB0E13EE7EAB7CC67"><enum>(2)</enum><text>summarizing the administrative and legal requirements relating to the modification.</text></paragraph></subsection> 
<subsection id="H9B5FF1B48C3041D79C00A5D17555B436"><enum>(b)</enum><text>The Secretary shall—</text> 
<paragraph id="HD9B79110E19349439289000770D17BA8"><enum>(1)</enum><text>provide project beneficiaries an opportunity to consult with the Bureau of Reclamation on the planning, design, and construction of the proposed modification; and</text></paragraph> 
<paragraph id="H90EFD26B98D5452384FBB1FC0C02139"><enum>(2)</enum><text>in consultation with project beneficiaries, develop and provide timeframes for the consultation described in paragraph (1).</text></paragraph></subsection> 
<subsection id="H0DD6631E164B47BDA873CE3D785487C3"><enum>(c)</enum> 
<paragraph display-inline="yes-display-inline" id="HC451D59BED1D4226865B045CF921E6F3"><enum>(1)</enum><text>Prior to submitting the reports required under section 5, the Secretary shall consider any alternative submitted in writing, in accordance with the timeframes established under subsection (b), by a project beneficiary that has elected to consult with the Bureau of Reclamation on a modification.</text></paragraph> 
<paragraph indent="up1" id="H5C1B610CB2674459BD762145EED97794"><enum>(2)</enum><text>The Secretary shall provide to the project beneficiary a timely written response describing proposed actions, if any, to address the recommendation.</text></paragraph> 
<paragraph indent="up1" id="H0FD12121C37946AEB00037791282AD9E"><enum>(3)</enum><text>The response of the Secretary shall be included in the reports required by section 5.</text></paragraph></subsection> 
<subsection id="H9E2B153362B5443997EFCC618D005886"><enum>(d)</enum><text>The Secretary may waive 1 or more of the requirements of subsections (a), (b), and (c), if the Secretary determines that implementation of the requirement could have an adverse impact on dam safety or security.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
