<section id="HC724DCAE81054AA2A906F5BEFE848800" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text> </section> 
<section id="H8E7E0E7751CA4551A865286882EB39C9"><enum>2.</enum><header>Crop loss assistance</header> 
<subsection id="H5585BF528F4E40CFB674C74E46E64DE"><enum>(a)</enum><header>In general</header><text>The Secretary of Agriculture (referred to in this Act as the <quote>Secretary</quote>) shall use such sums as are necessary of the funds of the Commodity Credit Corporation to make emergency financial assistance available to producers on a farm that have incurred losses in a 2004 crop due to a disaster, as determined by the Secretary.</text></subsection> 
<subsection id="H8AEA7D93A23247A5B01617391974FC6F"><enum>(b)</enum><header>Administration</header><text>Subject to subsection (a), the Secretary shall make assistance available under this section in the same manner as provided under section 1102 of the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 1999 (<external-xref legal-doc="usc" parsable-cite="usc/7/1421">7 U.S.C. 1421</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/105/277">Public Law 105–277</external-xref>), including using the same loss thresholds as were used in administering that section.</text></subsection> 
<subsection id="HEBDC5E5AF75845BCBCD1C500B9467C4B"><enum>(c)</enum><header>Qualifying losses</header><text>Assistance under this section may be made for losses associated with crops that are, as determined by the Secretary—</text> 
<paragraph id="H6B91B60A0AE041B300F950A8F694AF74"><enum>(1)</enum><text>quantity losses;</text></paragraph> 
<paragraph id="H49BCD58FC9744989912C76E010A5CC7"><enum>(2)</enum><text>quality losses; or</text></paragraph> 
<paragraph id="HB4159C7D097E4E7CA95FE5009840B500"><enum>(3)</enum><text>severe economic losses due to damaging weather or related condition.</text></paragraph></subsection> 
<subsection id="HBD6BDA1853804D83B9854D8C00698EBD"><enum>(d)</enum><header>Crops covered</header><text>Assistance under this section shall be applicable to losses for all crops (including losses of trees from which a crop is harvested, livestock, and fisheries), as determined by the Secretary, due to disasters.</text></subsection> 
<subsection id="H6B4BA397831B43EFBD43EB7450C935B9"><enum>(e)</enum><header>Crop insurance</header><text>In carrying out this section, the Secretary shall not discriminate against or penalize producers on a farm that have purchased crop insurance under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>).</text></subsection></section> 
<section id="H567943162F5F481289AF2D5E006F78A4"><enum>3.</enum><header>Commodity Credit Corporation</header><text display-inline="no-display-inline">The Secretary shall use the funds, facilities, and authorities of the Commodity Credit Corporation to carry out this Act.</text></section> 
<section id="H8E4E7577A39041BA80425529D5FC613E"><enum>4.</enum><header>Emergency designation</header> <text display-inline="no-display-inline">The entire amount made available under this Act is designated by Congress as an emergency requirement pursuant to section 402 of S. Con. Res. 95 (108th Congress), as made applicable to the House of Representatives by H. Res. 649 (108th Congress).</text></section> 
<section id="H539BE758AA8444F7A0C7B93D151E6763"><enum>5.</enum><header>Regulations</header> 
<subsection id="H4ADB1331FAEF4340AD0243E34600057"><enum>(a)</enum><header>In general</header><text>The Secretary may promulgate such regulations as are necessary to implement this Act.</text></subsection> 
<subsection id="HC4FC5218D7B646828E5565BDE5E2100"><enum>(b)</enum><header>Procedure</header><text>The promulgation of the regulations and administration of this Act shall be made without regard to—</text> 
<paragraph id="H7ACAFD3B40D0421DB76977BF16402E75"><enum>(1)</enum><text>the notice and comment provisions of <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code;</text></paragraph> 
<paragraph id="H92D671F493AA4DD8991E1EE75BCC7745"><enum>(2)</enum><text>the Statement of Policy of the Secretary of Agriculture effective July 24, 1971 (36 Fed. Reg. 13804), relating to notices of proposed rulemaking and public participation in rulemaking; and</text></paragraph> 
<paragraph id="H6ED933823E66419F9765E3300085CCC6"><enum>(3)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>).</text></paragraph></subsection> 
<subsection id="H08B5C5BBF5664107A869726B79F2DA77"><enum>(c)</enum><header>Congressional review of agency rulemaking</header><text>In carrying out this section, the Secretary shall use the authority provided under <external-xref legal-doc="usc" parsable-cite="usc/5/808">section 808</external-xref> of title 5, United States Code.</text></subsection></section>
