<official-title>To amend title 38, United States Code, to revise the effective date for payment of lump sums to persons awarded the Medal of Honor who are in receipt of special pension pursuant to section 1562 of such title, and for other purposes.</official-title>

<section id="H2DC173A915724A89A0793E45D55BB3E6" section-type="section-one"><enum>1.</enum><header>Effective date for payment of lump sums to persons awarded the Medal of Honor</header> <text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/1562">Section 1562(f)</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="HDA01DF56BD9C40E7B1682353012FAE66"><enum>(1)</enum><text>in paragraph (1) by inserting <quote>on or after April 27, 1916,</quote> after <quote>under this section</quote>;</text></paragraph> 
<paragraph id="H42AAC7E77340433AB64DF24C5D255692"><enum>(2)</enum><text>in paragraph (2) by inserting <quote>or (4)</quote> after <quote>paragraph (1)</quote>; and </text></paragraph> 
<paragraph id="HF6BE1FDA885343CBAEAA96DFEE25BD2D"><enum>(3)</enum><text>by adding at the end the following new paragraphs:</text>

<paragraph id="H3E7E07DA222740D98540755DB4D82F3F" indent="up1"><enum>(3)</enum><text>If a person otherwise eligible for payment under paragraph (1) is deceased, the Secretary shall make the payment to the living person first listed below:</text> 
<subparagraph id="H386650F0102443EC8B8FAF6878400DE"><enum>(A)</enum><text>The decedent’s spouse.</text></subparagraph> 
<subparagraph id="HD65406F7F1C543CBBFD5C6AC3F7B46F0"><enum>(B)</enum><text>The decedent’s children (in equal shares).</text></subparagraph> 
<subparagraph id="H3D72D3AFCE7D456C9C544C04D6A6B8E7"><enum>(C)</enum><text>The decedent’s dependent parents (in equal shares).</text></subparagraph></paragraph> 
<paragraph id="H23A02AB6D8E043D39000B3D2E2A2CB1D" indent="up1"><enum>(4)</enum><text>If a person is awarded the Medal of Honor posthumously on or after April 27, 1916, the Secretary shall pay, in a lump sum, an amount equal to the total amount of special pension that the person would have received during the period beginning on the first day of the first month beginning after the date of the act for which the person was awarded the Medal of Honor and ending on the last day of the month preceding the month in which the person died to the living person first listed below:</text> 
<subparagraph id="H6F9A644DCD8E4F27B28B5E9E51645C9D"><enum>(A)</enum><text>The decedent’s spouse.</text></subparagraph> 
<subparagraph id="H4DB359DEFD84487D81F79857103F00B3"><enum>(B)</enum><text>The decedent’s children (in equal shares).</text></subparagraph>
