<official-title>To amend title 18, United States Code, to provide penalties for failure to pay certain obligations to spouses and ex-spouses that are similar to the penalties imposed for failure to pay child support obligations, and for other purposes.</official-title>

<section id="H8B7B2E0677E24B2487E605328DB95113" section-type="section-one"><enum>1.</enum><header>Spousal obligations</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/11A">Chapter 11A</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="H7D0AA9B037944E77AEBDC2A74EF84DD4" display-inline="no-display-inline"> 
<section id="H8AE4E991C03F4ABEB66DD100D76F11B"><enum>228A.</enum><header>Failure to pay legal spousal obligations</header> 
<subsection id="HD2A0466A918B4239B67374B8DCB6C36"><enum>(a)</enum><header>Offense</header><text>Any person who—</text> 
<paragraph id="HA6BCA623EE184CA1B3AADA4CB3005579"><enum>(1)</enum><text>willfully fails to pay a court ordered obligation with respect to a spouse or former spouse who resides in another State, if such obligation has remained unpaid for a period longer than 1 year, or is greater than $5,000; </text></paragraph> 
<paragraph id="H85A936B81DF0490FB9F9980078526EA7"><enum>(2)</enum><text>travels in interstate or foreign commerce with the intent to evade a court ordered obligation with respect to a spouse or former spouse, if such obligation has remained unpaid for a period longer than 1 year, or is greater than $5,000; or </text></paragraph> 
<paragraph id="H8A82AE9CE8C44983815D53002280664D"><enum>(3)</enum><text>willfully fails to pay a court ordered obligation with respect to a spouse or former spouse who resides in another State, if such obligation has remained unpaid for a period longer than 2 years, or is greater than $10,000; </text></paragraph><continuation-text continuation-text-level="subsection">shall be punished as provided in subsection (c).</continuation-text></subsection> 
<subsection id="HB443C611AF0C4ABB979BD552A91813E8"><enum>(b)</enum><header>Presumption</header><text>The existence of an obligation that was in effect for the time period charged in the indictment or information creates a rebuttable presumption that the obligor has the ability to pay the obligation for that time period. </text></subsection> 
<subsection id="H4276E2B5E70043BC8DD07E00AE08A74F"><enum>(c)</enum><header>Punishment</header><text>The punishment for an offense under this section is—</text> 
<paragraph id="HC5728F7033FC490CBBABCA2E46096DB"><enum>(1)</enum><text>in the case of a first offense under subsection (a)(1), a fine under this title, imprisonment for not more than 6 months, or both; and </text></paragraph> 
<paragraph id="HE8C08FBAD1174D348FD6D064C79D6B99"><enum>(2)</enum><text>in the case of an offense under paragraph (2) or (3) of subsection (a), or a second or subsequent offense under subsection (a)(1), a fine under this title, imprisonment for not more than 2 years, or both. </text></paragraph></subsection> 
<subsection id="H4E75B3869113409BB409AF42CAE7E84E"><enum>(d)</enum><header>Mandatory restitution</header><text>Upon a conviction under this section, the court shall order restitution under section 3663A in an amount equal to the total unpaid obligation as it exists at the time of sentencing. </text></subsection> 
<subsection id="HD41E6D482C5D4C91987D62A3BB001C5D"><enum>(e)</enum><header>Venue</header><text>With respect to an offense under this section, an action may be inquired of and prosecuted in a district court of the United States for—</text> 
<paragraph id="HA019F1209B8543E999FBC42171B745F6"><enum>(1)</enum><text>the district in which the spouse or former spouse who is the subject of the obligation resided during a period during which the person who is alleged to have failed to pay the obligation or traveled with the intent to evade the obligation, allegedly failed to meet that obligation; </text></paragraph> 
<paragraph id="H042C2E676B674444A5B25DD7392B0069"><enum>(2)</enum><text>the district in which the alleged offender resided during a period described in paragraph (1); or </text></paragraph> 
<paragraph id="HBE0D005403E04AFA002B47972CB36BF6"><enum>(3)</enum><text>any other district with jurisdiction otherwise provided for by law. </text></paragraph></subsection> 
<subsection id="H2DFF9139B62743779B588F3525E04317"><enum>(f)</enum><header>Definitions</header><text>As used in this section—</text> 
<paragraph id="H5181EF3BCC5D4B4B899174A0EF330046"><enum>(1)</enum><text>the term <quote>Indian tribe</quote> has the meaning given that term in section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/479a">25 U.S.C. 479a</external-xref>); </text></paragraph> 
<paragraph id="H32C94BC888A04C0280E01F06BD82B19E"><enum>(2)</enum><text>the term <quote>State</quote> includes any State of the United States, the District of Columbia, and any commonwealth, territory, or possession of the United States; and </text></paragraph> 
<paragraph id="HF87FD38970A144F6818D9427B73B6BF5"><enum>(3)</enum><text>the term <quote>court ordered obligation to a spouse or former spouse</quote> means any amount determined under a court order pursuant to the law of a State or of an Indian tribe to be due from a person for the support and maintenance of a spouse or former spouse, or as an equitable or other distribution to a spouse or former spouse of assets in connection with a separation or divorce.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H20F07DF1130E4404A0DAEBE2B3FA4ECC"><enum>2.</enum><header>Conforming amendment to table of sections</header><text display-inline="no-display-inline">The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/11A">chapter 11A</external-xref> of title 18, United States Code, is amended by adding at the end the following new item:</text>
