<official-title>To amend the Small Business Act to modify the women’s business center program.</official-title>

<section id="HBD60D966961244D6AB4CEADC735F07A3" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Women's Business Sustainability Extension Act of 2004</short-title></quote>.</text></section>
<section id="H15E2E8D7BE0C43E7AC7D833814DC8B3E"><enum>2.</enum><header>Women's business centers</header>
<subsection id="HF2CB63FF66AE483C946F556000E311EA"><enum>(a)</enum><header>Funding priority</header><text display-inline="yes-display-inline">Section 29(k) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/656">15 U.S.C. 656(k)</external-xref>) is amended—</text>
<paragraph id="H05D38E2B11884956BB9272004B28FF76"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="HB2DF4A632DCD428CBB3EAEF5685E31CE" style="OLC">
<subparagraph id="H41A6208EB8804243A2829FC74ACAE5D"><enum>(C)</enum><header>Funding priority</header><text display-inline="yes-display-inline">Subject to available funds, and reservation of funds, the Administration shall, for fiscal year 2004, allocate—</text>
<clause id="HBB139296A6F146C089B0A584F5F7F4CD"><enum>(i)</enum><text display-inline="yes-display-inline">$150,000 for each eligible women's business center established under subsection (b), except for centers that request a lesser amount;</text></clause>
<clause id="H94DF7EF14DD046CC9B68173FB3EF11D"><enum>(ii)</enum><text display-inline="yes-display-inline">from the funds reserved under subsection (k)(4)(A), not more than $125,000 to each eligible women's business center established under subsection (l); and</text></clause>
<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="H298AB300758145D3B2D6101E59111394" reporting-committee-number="1"><enum>(iii)</enum><text display-inline="yes-display-inline">any funds remaining after allocations are made under clauses (i) and (ii) to new eligible women's business centers and eligible women's business centers that did not receive funding in the prior fiscal year under subsection (b).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H54531D4DDF05499F815579096BB296CD" reporting-committee-number="1"><enum>(2)</enum><text>in paragraph (4)(A), by adding at the end the following:</text>

<subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="H33FBBD5ADAF9425D860045C161002F5B" reporting-committee-number="1"><enum>(b)</enum><header>Fundraising plan</header><text>Section 29(l)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/656">15 U.S.C. 656(l)(2)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H20FB8646F2994E8BA2AE971425B28BAF" reporting-committee-number="1"><enum>(F)</enum><text>for grants to be distributed after June 30, 2005, a plan that demonstrates a clear, fixed timeframe for fundraising and self-sufficiency, unless the Administrator grants an exception for an organization that serves low-income or other underserved areas.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="HD2ADE55D9140465FB8807FDD78200040" reporting-committee-number="1"><enum>(c)</enum><header>Reallocation of unused funds</header><text>Section 29(l) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/656">15 U.S.C. 656(l)</external-xref>) is amended by adding at the end the following:</text>

<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H06D35C890FA5426900BAEC4924D9F04E" reporting-committee-number="1"><enum>(6)</enum><header>Reallocation of unused funds</header><text>If, at the beginning of the third quarter of a women's business center funding year, the Administrator determines, based on credible evidence, that any portion of the amount made available to carry out this subsection is unlikely to be used by a women's business center, the Administration may use the unused portion to award supplemental grants of not more than $25,000 to any women's business center established under this section to carry out the purposes of this section, subject to the provisions of this section.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="HF5C260607C614821AA7039D3EA65D878" reporting-committee-number="1"><enum>(d)</enum><header>Performance evaluations</header><text>Section 29 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/656">15 U.S.C. 656</external-xref>) is amended by adding at the end the following:</text>

<subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="H85118E1D662F415A9CDC4297BF4BC052" reporting-committee-number="1"><enum>(m)</enum><header>Internal program performance evaluations</header>
<paragraph id="HBBCE3BE3BA3747669000CAB1A6960043"><enum>(1)</enum><header>Access and use of information</header><text>The Administrator of the Small Business Administration may access and use client contact information from women's business centers established under this section solely to conduct internal program performance evaluations and financial and programmatic audits.</text></paragraph>
<paragraph id="HBCD1A031DA3D495C91A4F9DCBB9ED51"><enum>(2)</enum><header>Privacy requirement</header><text>The Administrator of the Small Business Administration—</text>
<subparagraph id="HCA476484DC804B639F488F0884CCC22D"><enum>(A)</enum><text>shall only use client information collected under paragraph (1) for internal program performance evaluations and financial and programmatic audits; and </text></subparagraph>
<subparagraph id="H27DFAAF934A642F7BC008E2C3F60CB6E"><enum>(B)</enum><text>shall not disclose or distribute any of the collected information for any other purpose.</text></subparagraph></paragraph>
<paragraph id="H7A795414214D46369C94019DE9825353"><enum>(3)</enum><header>Notification requirement</header><text>A women's business center shall notify each client—</text>
<subparagraph id="HDE9186C0EA664F2487FF0053ECE35721"><enum>(A)</enum><text>that information about the client will be collected;</text></subparagraph>
<subparagraph id="H94C8C218CF0F4D0CAB5E306100D770C3"><enum>(B)</enum><text>the purposes for which the client information may be used; and</text></subparagraph>
<subparagraph id="H5452119B41614B56A71C16542C22A82B"><enum>(C)</enum><text>that the client, if contacted, will be contacted solely for program performance evaluation or audit purposes. </text></subparagraph></paragraph>
<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H14C2839DA9DE4BBBA47853BB76310398" reporting-committee-number="1"><enum>(4)</enum><header>Report to congress</header><text>The Administrator of the Small Business Administration shall include findings from any internal program performance evaluations in the Administration's annual report to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
