<subsection id="H3AE83290B9664175ABECE03C4EB0BF28"><enum>(a)</enum><header>In general</header><text>Section 102 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/112">6 U.S.C. 112</external-xref>) is amended—</text> 
<paragraph id="H78FE968C227345B9BF32DAC0CD3E53E6"><enum>(1)</enum><text>by redesignating subsections (e), (f), and (g), as subsections (f), (g), and (h), respectively; and</text></paragraph> 
<paragraph id="H50268EF3E3C443E9B2B79194EAC7A0EA"><enum>(2)</enum><text>by inserting after subsection (d) the following new subsection (e):</text>

<subsection id="HDFBD5A5E66D340FCB14B7DBCC54DE2E"><enum>(e)</enum><header>Participation in foreign collection requirements and Management processes</header><text>The Secretary shall be a member of any Federal Government interagency board, established by executive order or any other binding interagency directive, that is responsible for establishing foreign collection information requirements and priorities for estimative analysis.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H5F1CEDAA26BF4A3496D084B542150078"><enum>(b)</enum><header>Homeland Security Information Requirements Board</header> 
<paragraph id="H7E88D89C91B54F7588FC00D4DFE5D8A8"><enum>(1)</enum><header>In general</header><text>Title I of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/111">6 U.S.C. 111 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="HFBEA029043C04DC0B65D443E7E7D5937"><enum>104.</enum><header>Homeland Security Information Requirements Board</header> 
<subsection id="HCCBD8DD1435B418B8478B87C7D54507"><enum>(a)</enum><header>Establishment of Board</header><text>There is established an interagency Homeland Security Information Requirements Board (hereinafter in this section referred to as the <quote>Information Requirements Board</quote>).</text></subsection> 
<subsection id="HB405D3E9AE6B4CE9A9A20C27A3EEBE"><enum>(b)</enum><header>Membership</header><text>The following officials are members of the Information Requirements Board:</text> 
<paragraph id="H237077F134F54DC400D30068E6C87EB9"><enum>(1)</enum><text>The Secretary of Homeland Security, who shall serve as the chairman of the Information Requirements Board.</text></paragraph> 
<paragraph id="H704C43E1661B45F785016600F7083DD8"><enum>(2)</enum><text>The Attorney General.</text></paragraph> 
<paragraph id="HE6A9A5387DE646DC00229E78BB7FF5DF"><enum>(3)</enum><text>The Secretary of Commerce.</text></paragraph> 
<paragraph id="H2F62F79574A14B7CA1F460545CC45C44"><enum>(4)</enum><text>The Secretary of the Treasury.</text></paragraph>

<subsection id="H160AAF98622A4A098710EE50154D496E"><enum>(c)</enum><header>Functions</header> 
<paragraph id="H21A40ACFC9BE47B397A23C305678FA53"><enum>(1)</enum><header>Oversight of homeland security requirements</header><text>The Information Requirements Board shall oversee the process for establishing homeland security requirements and collection management for all terrorism-related information and all other homeland security information (as defined in section 892(g)) collected within the United States.</text></paragraph> 
<paragraph id="H2442E946624E40BAB7F5915C41E96214"><enum>(2)</enum><header>Determination of collection priorities</header><text>The Information Requirements Board shall—</text> 
<subparagraph id="HE6B5A0B9B4964AC496E42B20189BCC15"><enum>(A)</enum><text>determine the domestic information collection requirements for information relevant to the homeland security mission; and</text></subparagraph> 
<subparagraph id="HC60684AD677944A8AD01161FF73D6D60"><enum>(B)</enum><text>prioritize the collection and use of such information.</text></subparagraph></paragraph> 
<paragraph id="H10BD978873B043CFB7B9B2C704D5F697"><enum>(3)</enum><header>Coordination of collection requirements and Management activities</header> 
<subparagraph id="H8D952F4B652F4AB0BBCA00B920757D82"><enum>(A)</enum><header>Coordination with counterpart agencies</header><text>The Chairman shall ensure that the Information Requirements Board carries out its activities in a manner that is fully coordinated with Board’s counterpart entities.</text></subparagraph> 
<subparagraph id="H6E40B3C3869442F3A03B9BED6C8DD63F"><enum>(B)</enum><header>Participation of counterpart entities</header><text>The Chairman and the Director of Central Intelligence shall ensure that each counterpart entity—</text> 
<clause id="H4AB3E57E733F404FBE4300B16942468F"><enum>(i)</enum><text>has at least one representative on the Information Requirement Board and on every sub-component of the Board; and</text></clause> 
<clause id="H504AB8FFD5F540A1ABABB0A687D4D99B"><enum>(ii)</enum><text>meets jointly with the Information Requirements Board (and, as appropriate, with any sub-component of the Board) as often as the Chairman and the Director of Central Intelligence determine appropriate.</text></clause></subparagraph> 
<subparagraph id="H361BB6632D3B40FFB734B70081C7F9B"><enum>(C)</enum><header>Counterpart entity defined</header><text>In this section, the term <term>counterpart entity</term> means an entity of the Federal Government that is responsible for foreign intelligence collection requirements and management, including the Office of the Deputy Director of Central Intelligence for Community Management and senior collection managers of each of the agencies under the National Foreign Intelligence Program (as defined in section 3(6) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(6)</external-xref>).</text></subparagraph></paragraph></subsection> 
<subsection id="H6DE0DD18CCED46119658A14D47CAC23F"><enum>(d)</enum><header>Meetings</header> 
<paragraph id="H25F2AE3B68A549578F00F0EFAFF4C085"><enum>(1)</enum><header>In general</header><text>The Information Requirements Board shall meet regularly at such times and places as its Chairman may direct.</text></paragraph> 
<paragraph id="H90EB547F8A31445D8B538F0071ED1586"><enum>(2)</enum><header>Invited representatives</header><text>The chairman may invite representatives of Federal agencies not specified in subsection (b) to attend meetings of the Information Requirements Board.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HF302EDF1244949CBAF3CC91306BDD9B2"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 103 the following new item:</text>

<section id="HBD87A9AD0DA34B61913705048BE5423C"><enum>102.</enum><header>Access to information</header> 
<subsection id="H31DA8530A9E84A7384EECEF341D7FC62"><enum>(a)</enum><header>Improvements to secure communications and information technology infrastructure</header><text>Paragraph (14) of section 201(d) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/121">6 U.S.C. 121(d)</external-xref>) is amended by striking <quote>in furtherance of the responsibilities under this section, and to disseminate information acquired and analyzed by the Department, as appropriate</quote> and inserting <quote>with maximum flexibility and speed, in furtherance of the responsibilities under this section, and to ensure the simultaneous dissemination of such data and information to all appropriate personnel</quote>.</text></subsection> 
<subsection id="H43F10D9AE6C1435380009BCA0093A0A4"><enum>(b)</enum><header>Improvement in access to information by Department personnel</header><text>Subsection (a) of section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/122">6 U.S.C. 122</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H33AFB84CDF644D0A90A13DE0668FFECA"><enum>(3)</enum><header>Utilization</header><text>Subject to the requirements of section 201(d)(12), the Secretary may provide access to any of the information and materials described in this subsection to any personnel of the Department that the Secretary determines requires such access to discharge duties assigned to such personnel.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H39FC96120FBE40D69426A15592C843B"><enum>(c)</enum><header>Establishment of procedures for automatic and immediate transfer of information to the Department</header><text>Subsection (b) of such section is amended—</text> 
<paragraph id="H09F3D5E644774295B186F915EC6E4653"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (1);</text></paragraph> 
<paragraph id="HE045D2BECA4F4342B2251BB3E7C6B4D"><enum>(2)</enum><text>by striking the period at the end of paragraph (2) and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HD2CA116BD7084939B4BE4CF24B079517"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="HF95B07BC359D45AE86D5B7B641672502"><enum>(3)</enum><text>the Secretary, in consultation with the appropriate Federal Government officials, shall identify and put into place systems, protocols, and procedures to ensure that appropriate personnel of the Department are provided access to such information automatically and immediately.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HDCADCE7C79A042D88CE7C4C9A2533738"><enum>(d)</enum><header>Effect of provision of information to the Terrorist Threat Integration Center</header><text>Subsection (d) of such section is amended by adding at the end the following new paragraph:</text> 
<quoted-block id="H4BF854E07EFD40B6B567B6019FA9E49D"> 
<paragraph id="H75F96B37D1DE447F96C31A6E47294B2"><enum>(3)</enum><header>Obligation to share information</header><text>Except as otherwise directed by the President or with the specific written agreement of the Secretary, no Federal agency or official shall be deemed to have discharged any obligation to share any information, report, assessment, or other material, including unevaluated intelligence information, with the Department solely by virtue of having provided that information, report, assessment, or other material to the Terrorist Threat Integration Center or to any entity that succeeds to any of the functions of the Terrorist Threat Integration Center.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<paragraph id="HFFBFABCF32E14D7DBCF17D77C85CBE88"><enum>(1)</enum><header>In general</header><text>Subtitle A of title II of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/121">6 U.S.C. 121 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H7C2A6275E4CB47729EE3F40513AF00D7"><enum>203.</enum><header>Use of Homeland Security Advisory System</header> 
<subsection id="H661B705A41314FF688FA8CB9CAF2FD73"><enum>(a)</enum><header>Public advisories</header><text>If the Secretary concludes that credible information indicates a potential terrorist threat to the United States that is not or cannot, on the basis of the information available, be limited to one or more States, regions, localities, facilities, sites, elements of the population, critical infrastructure sectors, or public or private sector activities or events, the Secretary shall, as appropriate—</text> 
<paragraph id="H22F6DEAD07C745E99701D6C5029CE36"><enum>(1)</enum><text>use the Homeland Security Advisory System administered under section 201(d)(7) to inform the public of the existence and nature of the threat and to convey information about the risk it poses to the population and territory of the United States;</text></paragraph> 
<paragraph id="H8DF0942BF3124B77BB8EB2BB590487D"><enum>(2)</enum><text>provide specific unclassified warning information and advice about appropriate protective measures and countermeasures pursuant to section 201(d)(7)(B), to State and local government agencies and authorities, the private sector, other entities, and the public; and</text></paragraph> 
<paragraph id="HA2894DADE5E249F4A41C8848306278A2"><enum>(3)</enum><text>provide specific classified warning information and advice about appropriate protective measures and countermeasures pursuant to section 201(d)(7)(B) to State and local government officials and individuals in the private sector, who—</text> 
<subparagraph id="HEE2135B47949448087BD48B500147CA8"><enum>(A)</enum><text>have the appropriate security clearance; and</text></subparagraph> 
<subparagraph id="HAB50F1871DC04B8C9146FFB1DF44DCF2"><enum>(B)</enum><text>in the Secretary’s judgment, need to have access to such information and advice in order to discharge their homeland security-related functions.</text></subparagraph></paragraph></subsection> 
<subsection id="HE02580EA6CF941F6A925EEDC8906303"><enum>(b)</enum><header>Limited advisories</header><text>If the Secretary concludes that credible information indicates a potential terrorist threat to one or more particular States, regions, localities, facilities, sites, elements of the population, critical infrastructure sectors, public or private sector activities or events, or any combination of the foregoing, the Secretary—</text> 
<paragraph id="H54306C2E25AC43A49239D01CD3F1456F"><enum>(1)</enum><text>shall, as appropriate, inform officials of the affected entities and provide specific warning information and advice about protective measures and countermeasures to those officials pursuant to section 201(d)(7)(B); and</text></paragraph> 
<paragraph id="H6389054B46F844F8A13B41C8AFE50207"><enum>(2)</enum><text>may, in the Secretary’s discretion, issue a public advisory relating to such threat.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H77FEB6308B714175B7356B7B20771013"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of such Act is amended by inserting after the item relating to section 202 the following:</text>

<subsection id="H1C63CF9763874F488463514700F60243"><enum>(a)</enum><header>Administration of the homeland security information network</header><text>Section 201(d) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/121">6 U.S.C. 121(d)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<subparagraph id="H76BA6CD05FFE4F3FAEE03B555F8C6BC9"><enum>(B)</enum><text>ensuring that the information sharing systems, developed in connection with the network created under subparagraph (A), utilize and are compatible with, to the greatest extent practicable, Federal, State, and local government and private sector antiterrorism systems and protocols that have been or are being developed.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA018A531DB36437F8CDFD69385DCFD5"><enum>(b)</enum><header>Coordination of dissemination of information to non-Federal entities</header> 
<paragraph id="H498B188CF7664442A9E8BFDD3360E6A0"><enum>(1)</enum><header>In general</header><text>Section 892 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/482">6 U.S.C. 482</external-xref>) is amended—</text> 
<subparagraph id="H7BE3DF4E315E481A91ED2D72157FC9B8"><enum>(A)</enum><text>by redesignating subsections (f) and (g) as subsections (g) and (h), respectively; and</text></subparagraph>

<paragraph id="H5590819DC7B8443DBCD0E7F676F78796"><enum>(1)</enum><header>In general</header><text>Except as otherwise directed by the President or with the specific written agreement of the Secretary, no element of the intelligence community nor any department, agency, or other entity having Federal law enforcement responsibilities, nor any partnership or joint venture consisting wholly or in part of such entities, shall disseminate its analytic products or conclusions related to threats to homeland security to State, local, or private sector officials without the prior approval of the Secretary, except that the head of such an element, department, agency, or other entity may disseminate an analytic product or conclusion without the Secretary's approval—</text> 
<subparagraph id="H116BA96C62F24BDD81085259E46000DA"><enum>(A)</enum><text>when and to the extent that exigent circumstances require that a specific analytic product or conclusion be disseminated in order to prevent, preempt, or disrupt an imminent threat of death or serious bodily injury or significant damage to United States persons, infrastructure or other interests; or</text></subparagraph> 
<subparagraph id="HC26E8D05794242E39BC9E8EE9531DE00"><enum>(B)</enum><text>when it is necessary to share an analytic product or conclusion with Federal, State, and local law enforcement officials relating to a law enforcement activity, if—</text> 
<clause id="HB0F2E53D976E472EB6AD6234051B32DB"><enum>(i)</enum><text>the Department is provided, as soon as feasible, notice of the potential of such a communication and is, to the extent practicable, included in the development of such communication through the Department's liaison at the headquarters of the Federal Bureau of Investigation; and</text></clause> 
<clause id="H2567C92051D042D994804D3EC5C5D76"><enum>(ii)</enum><text>the Secretary must approve any further dissemination of such analytic product or conclusion to non-law enforcement State and local officials, the private sector, or the public.</text></clause></subparagraph></paragraph> 
<paragraph id="HBFC413E4C85D4962B3B604D4457D5066"><enum>(2)</enum><text>When an analytic product or conclusion is disseminated pursuant to paragraph (1)(A), the Secretary and the appropriate entities or officials in other United States Government agencies shall be notified immediately of that dissemination.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H416F280D02A646B595432F21D4204794"><enum>(2)</enum><header>Definition</header><text>Subsection (g) of such section (as redesignated by paragraph (1)(A)) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H46D5427BD60E4C2BB58D6C1649BE6F66"><enum>(5)</enum><header>Analytic product or conclusion</header><text>The term <term>analytic product or conclusion</term> means any product of the analysis of one or more pieces of homeland security information in which inferences have been drawn from such information to arrive at a determination about a fact (including a potential threat) that was not explicit or apparent on the face of the information itself, but does not include mere summaries of homeland security information.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HDE46845269F049C187AE8EA507D74C4C"><enum>105.</enum><header>IAIP personnel recruitment</header> 
<subsection id="HA50BD841CAEC4215918E3EA5009FBC81"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/97">Chapter 97</external-xref> of title 5, United States Code, is amended by adding after section 9701 the following:</text>

<section id="H14882CF7F30F4DB4A97039CF3C193907"><enum>9702.</enum><header>Recruitment bonuses</header> 
<subsection id="H64EFE4AD67A54B5086DB075E66827F6E"><enum>(a)</enum><header>In general</header><text>Notwithstanding any provision of chapter 57, the Secretary of Homeland Security, acting through the Under Secretary for Information Analysis and Infrastructure Protection, may pay a bonus to an individual in order to recruit such individual for a position that—</text> 
<paragraph id="H321878AC4B46468CAF009401D208CC2E"><enum>(1)</enum><text>is within the Directorate for Information Analysis and Infrastructure Protection; and</text></paragraph> 
<paragraph id="H95E7AB9A892D4EB882DFBDFEEAFD3F0"><enum>(2)</enum><text>would otherwise be difficult to fill in the absence of such a bonus.</text></paragraph></subsection> 
<subsection id="HEFD945E24E564C378F9106884B7F2845"><enum>(b)</enum><header>Bonus amount</header> 
<paragraph id="H70596A60AACC462AB1BD3D26C900C959"><enum>(1)</enum><header>In general</header><text>The amount of a bonus under this section shall be determined under regulations of the Secretary of Homeland Security, but may not exceed 50 percent of the annual rate of basic pay of the position involved.</text></paragraph> 
<paragraph id="H791BABCD2A46404F85D09E2FD08BECAC"><enum>(2)</enum><header>Form of payment</header><text>A bonus under this section shall be paid in the form of a lump-sum payment and shall not be considered to be part of basic pay.</text></paragraph> 
<paragraph id="HFF74F4D944EC48C1BA65306888BAA972"><enum>(3)</enum><header>Computation rule</header><text>For purposes of paragraph (1), the annual rate of basic pay of a position does not include any comparability payment under section 5304 or any similar authority.</text></paragraph></subsection> 
<subsection id="HE3818373DD5946A49515057BF5C8D533"><enum>(c)</enum><header>Service agreements</header><text>Payment of a bonus under this section shall be contingent upon the employee entering into a written service agreement with the Department of Homeland Security. The agreement shall include—</text> 
<paragraph id="H545D947A9E094D6D842EEDF292AA9457"><enum>(1)</enum><text>the period of service the individual shall be required to complete in return for the bonus; and</text></paragraph> 
<paragraph id="H9B1B09177C2D431296449047373084EC"><enum>(2)</enum><text>the conditions under which the agreement may be terminated before the agreed-upon service period has been completed, and the effect of the termination.</text></paragraph></subsection> 
<subsection id="H8BB560EF058D4F57B9BAF191981861C9"><enum>(d)</enum><header>Eligibility</header><text>A bonus under this section may not be paid to recruit an individual for—</text> 
<paragraph id="H02257F1C10854B589057F229C840CA74"><enum>(1)</enum><text>a position to which an individual is appointed by the President, by and with the advice and consent of the Senate;</text></paragraph> 
<paragraph id="H16D5BD47E53447EDB8DCF5107F82CEC0"><enum>(2)</enum><text>a position in the Senior Executive Service as a noncareer appointee (as defined in section 3132(a)); or</text></paragraph> 
<paragraph id="HBF74CE8B2DD1477A9D7350A54FFBDCDD"><enum>(3)</enum><text>a position which has been excepted from the competitive service by reason of its confidential, policy-determining, policy-making, or policy-advocating character.</text></paragraph></subsection> 
<subsection id="H730A5FFA433E458ABE9E38075ECE708D"><enum>(e)</enum><header>Termination</header><text>The authority to pay bonuses under this section shall terminate on September 30, 2007.</text></subsection></section> 
<section id="H618A3ACA21104B4A9BA0CE49D337FE32"><enum>9703.</enum><header>Reemployed annuitants</header> 
<subsection id="HCC290C644EFF463C8357E0DB2C687BEC"><enum>(a)</enum><header>In general</header><text>If an annuitant receiving an annuity from the Civil Service Retirement and Disability Fund becomes employed in a position within the Department of Homeland Security, the annuitant’s annuity shall continue. An annuitant so reemployed shall not be considered an employee for the purposes of chapter 83 or 84.</text></subsection> 
<subsection id="H9CAA275E939041CCB9E89C3B83A6B7F9"><enum>(b)</enum><header>Applicability</header><text>This section shall apply—</text> 
<paragraph id="HC36436CBFFAA4032B3E469D91D70DA29"><enum>(1)</enum><text>during the 3-year period beginning on the date of the enactment of this section, to annuitants holding positions within the Directorate for Information Analysis and Infrastructure Protection; and</text></paragraph> 
<paragraph id="H159231B0E6C64721A1C969045DA514F"><enum>(2)</enum><text>after the end of the 3-year period described in paragraph (1), to annuitants holding positions within such directorate or other parts of the Department of Homeland Security as the Secretary of Homeland Security may designate.</text></paragraph></subsection> 
<subsection id="HBFC364997D6F4A53B603E42857CB4337"><enum>(c)</enum><header>Definition</header><text>For purposes of this section, the term <term>annuitant</term> has the meaning given such term under section 8331 or 8401, whichever is appropriate.</text></subsection></section> 
<section id="H45C6F1303C9A4E55B999A7CDA4CFB0B9"><enum>9704.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary of Homeland Security, in consultation with the Director of the Office of Personnel Management, may prescribe any regulations necessary to carry out section 9702 or 9703.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="HE40B584ED2B9483780EC9DD3CE4F4FD2"><enum>(b)</enum><header>Report on participation in Terrorist Threat Integration Center</header> 
<paragraph id="H059D41B7BA914803B9142363279883E0"><enum>(1)</enum><header>In general</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to each appropriate congressional committee an unclassified report that describes in detail the nature and scope of the participation of the Department of Homeland Security in, and interaction with, the Terrorist Threat Integration Center.</text></paragraph> 
<paragraph id="H373A13CBFDD849B39D582796487552AB"><enum>(2)</enum><header>Contents</header><text>The report required by paragraph (1) shall include the following information:</text> 
<subparagraph id="HBAAAF8B2988B4878998DEE227EC48200"><enum>(A)</enum><text>The total funding that has been provided by the Department to the Center and the cost of any personnel, services, or materials the Department has provided to the Center.</text></subparagraph> 
<subparagraph id="HD6C18406C65E4715B1FD65CE51E49EF"><enum>(B)</enum><text>The number, expertise, and employing component of Department personnel assigned to the Center.</text></subparagraph> 
<subparagraph id="H1B33E43796A9437BBDAB8DF4788B44D9"><enum>(C)</enum><text>Any non-Department regulation, policy or directive that governs the qualifications, job performance, or conduct of Department personnel assigned to the Center.</text></subparagraph> 
<subparagraph id="H01531257E4C24A9700D72131B7E46F0"><enum>(D)</enum><text>A description of all analytic products originated by the Center that are routinely disseminated to the Department, including the entities or officials within the Department that routinely receive such products, and the means by which such products are disseminated.</text></subparagraph> 
<subparagraph id="H157AE6E344D64DD298C4E595D1620218"><enum>(E)</enum><text>A description of how each analytic product provided to the Department by the Center is utilized by the Department, including a specification of which, if any, such products the Department routinely disseminates to State, local, or private sector officials.</text></subparagraph></paragraph> 
<paragraph id="H77573546E5EE4C189E845227F9E768B9"><enum>(3)</enum><header>Form of submission</header><text>The report required by this section shall be submitted in unclassified form, but may include a classified annex.</text></paragraph> 
<paragraph id="HB06847273FAF4620B604D273D8B9F611"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text>

<subparagraph display-inline="yes-display-inline" id="H356A570EF14043059F4938B3C67FC3FF"><enum>(A)</enum><text>The term <term>cybersecurity</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/44/3502">section 3502</external-xref> of title 44, United States Code, as in effect on the date of the enactment of the <short-title>Department of Homeland Security Authorization Act for Fiscal Year 2005</short-title>.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HC82103AA62654C96891F81C140B8F924"><enum>202.</enum><header>Assistant Secretary for Cybersecurity</header> 
<subsection id="H50263B544F98465C00A89C7312CDB51E"><enum>(a)</enum><header>In general</header><text>Subtitle A of title II of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/121">6 U.S.C. 121 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="HB80F51AE49DE458A9B6F252529CC6E2F"><enum>203.</enum><header>Assistant Secretary for Cybersecurity</header> 
<subsection id="HB2B22E44904F47EEA7976B20EE17A84C"><enum>(a)</enum><header>In general</header><text>There shall be in the Directorate for Information Analysis and Infrastructure Protection a National Cybersecurity Office headed by an Assistant Secretary for Cybersecurity (in this section referred to as the <quote>Assistant Secretary</quote>), who shall assist the Secretary in promoting cybersecurity for the Nation.</text></subsection> 
<subsection id="HDADB8007E68D46DEA143F369E528B854"><enum>(b)</enum><header>General authority</header><text>The Assistant Secretary, subject to the direction and control of the Secretary, shall have primary authority within the Department for all cybersecurity-related critical infrastructure protection programs of the Department, including with respect to policy formulation and program management.</text></subsection> 
<subsection id="H2B65B44CFB7D4AE38302A0E336C729A0"><enum>(c)</enum><header>Responsibilities</header><text>The responsibilities of the Assistant Secretary shall include the following:</text> 
<paragraph id="H93A3F046C2B144DEA3E8028628003090"><enum>(1)</enum><text>To establish and manage—</text> 
<subparagraph id="HAFB52F1CBB644061A02200198D74E611"><enum>(A)</enum><text>a national cybersecurity response system that includes the ability to—</text> 
<clause id="H323D5CD9EFC54908A79E61001E578062"><enum>(i)</enum><text>analyze the effect of cybersecurity threat information on national critical infrastructure; and</text></clause> 
<clause id="HE8B754347F0143E88BF2D9C0E4B8A58"><enum>(ii)</enum><text>aid in the detection and warning of attacks on, and in the restoration of, cybersecurity infrastructure in the aftermath of such attacks;</text></clause></subparagraph> 
<subparagraph id="H037C35C4727242519B23AE817C00EE57"><enum>(B)</enum><text>a national cybersecurity threat and vulnerability reduction program that identifies cybersecurity vulnerabilities that would have a national effect on critical infrastructure, performs vulnerability assessments on information technologies, and coordinates the mitigation of such vulnerabilities;</text></subparagraph> 
<subparagraph id="H208155BDD5324BEBB2624035D25CFA8D"><enum>(C)</enum><text>a national cybersecurity awareness and training program that promotes cybersecurity awareness among the public and the private sectors and promotes cybersecurity training and education programs;</text></subparagraph> 
<subparagraph id="H8BC1242583974023AAA72B86E332C246"><enum>(D)</enum><text>a government cybersecurity program to coordinate and consult with Federal, State, and local governments to enhance their cybersecurity programs; and</text></subparagraph> 
<subparagraph id="H595F88A1741A4691B905DFEBF3B4C7DF"><enum>(E)</enum><text>a national security and international cybersecurity cooperation program to help foster Federal efforts to enhance international cybersecurity awareness and cooperation.</text></subparagraph></paragraph> 
<paragraph id="H4C3996366B5445CDAE628C0084C10139"><enum>(2)</enum><text>To coordinate with the private sector on the program under paragraph (1) as appropriate, and to promote cybersecurity information sharing, vulnerability assessment, and threat warning regarding critical infrastructure.</text></paragraph> 
<paragraph id="HB5F40E7CC37A40CE8302289EC078DCAB"><enum>(3)</enum><text>To coordinate with other directorates and offices within the Department on the cybersecurity aspects of their missions.</text></paragraph> 
<paragraph id="HCC26A728392645A4851956CF53D01249"><enum>(4)</enum><text>To coordinate with the Under Secretary for Emergency Preparedness and Response to ensure that the National Response Plan developed pursuant to section 502(6) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/312">6 U.S.C. 312(6)</external-xref>) includes appropriate measures for the recovery of the cybersecurity elements of critical infrastructure.</text></paragraph> 
<paragraph id="H1CB51E6BCE984C32A58C6E1759F12CEC"><enum>(5)</enum><text>To develop processes for information sharing with the private sector, consistent with section 214, that—</text> 
<subparagraph id="HD079837A8A58406C9101EC652429884E"><enum>(A)</enum><text>promote voluntary cybersecurity best practices, standards, and benchmarks that are responsive to rapid technology changes and to the security needs of critical infrastructure; and</text></subparagraph> 
<subparagraph id="HD7BBF71FE80C4BEC8D82D2908CECDEEF"><enum>(B)</enum><text>consider roles of Federal, State, local, and foreign governments and the private sector, including the insurance industry and auditors.</text></subparagraph></paragraph> 
<paragraph id="H2B67F150AED04628A41299C33F16E7FC"><enum>(6)</enum><text>To coordinate with the Chief Information Officer of the Department in establishing a secure information sharing architecture and information sharing processes, including with respect to the Department’s operation centers.</text></paragraph> 
<paragraph id="H20B0D66F236D4AF7996DD94BA89CA712"><enum>(7)</enum><text>To consult with the Electronic Crimes Task Force of the United States Secret Service on private sector outreach and information activities.</text></paragraph> 
<paragraph id="H160CC529E5874E6EA688B1C6418639D1"><enum>(8)</enum><text>To consult with the Office for Domestic Preparedness to ensure that realistic cybersecurity scenarios are incorporated into tabletop and recovery exercises.</text></paragraph> 
<paragraph id="H34650FE310BF4C7C8B2CCE7B2E6885E8"><enum>(9)</enum><text>To consult and coordinate, as appropriate, with other Federal agencies on cybersecurity-related programs, policies, and operations.</text></paragraph> 
<paragraph id="H1D22FA7BA0624BCC8807E93E9F676700"><enum>(10)</enum><text>To consult and coordinate within the Department and, where appropriate, with other relevant Federal agencies, on security of digital control systems, such as Supervisory Control and Data Acquisition (SCADA) systems.</text></paragraph></subsection> 
<subsection id="H7744022211364663A645AA5C8D670400"><enum>(d)</enum><header>Authority over the National Communications System</header><text>The Assistant Secretary shall have primary authority within the Department over the National Communications System.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<section id="HBCDED912605241D5B7D87567700045D9"><enum>302.</enum><header>Special access programs</header><text display-inline="no-display-inline">For the purposes of carrying out the responsibilities of the Secretary under section 302 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/182">6 U.S.C. 182</external-xref>), the Secretary is authorized to establish and maintain special access programs associated with research, development, test and evaluation, and acquisition of technology or systems. Access to knowledge of such programs shall be strictly limited, and such programs shall be subject to restricted reporting requirements in the manner described in <external-xref legal-doc="usc" parsable-cite="usc/10/119">section 119</external-xref> of title 10, United States Code. Nothing in this section shall be construed to alter or diminish the effect of section 306(a) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/186">6 U.S.C. 186(a)</external-xref>).</text></section> 
<section id="H488A46DC63624772866CF8007E3B9955"><enum>303.</enum><header>Homeland Security Science and Technology Advisory Committee</header><text display-inline="no-display-inline">Section 311(c)(2) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/191">6 U.S.C. 191(c)(2)</external-xref>) is amended to read as follows:</text>

<subsection id="HE55CFE6749BD4479983ED4C654FF1F32"><enum>(a)</enum><header>In general</header><text>Beginning in fiscal year 2006, and annually thereafter, the Secretary of Homeland Security shall submit to the Congress budget request information for the Directorate of Science and Technology that includes research portfolio-based budget submissions and estimated funding summaries for each of—</text> 
<paragraph id="HDDA6AB68B5B5482F84736FC3A5968347"><enum>(1)</enum><text>the Office of Research and Development;</text></paragraph> 
<paragraph id="H91BB7D5E04594A16B471FEA42DA4073B"><enum>(2)</enum><text>the Office of Homeland Security Advanced Research Projects Agency;</text></paragraph> 
<paragraph id="H86E20CFEEDF541B0BC6576B9456D59C7"><enum>(3)</enum><text>the Office of Systems Engineering Development;</text></paragraph> 
<paragraph id="H5523D52248ED4971861DF6C8F02DF64F"><enum>(4)</enum><text>the Office of Plans, Programs, and Budget; and</text></paragraph> 
<paragraph id="H1F0F3411A79C4482AF9B2B3390F759EE"><enum>(5)</enum><text>such other major Directorate components as the Secretary may establish.</text></paragraph></subsection> 
<subsection id="H99722CC660DB46F2B119B6D102707203"><enum>(b)</enum><header>Submission</header><text>The Secretary shall submit the information required under subsection (a) at the same time as the submission of the President’s annual budget request to the Congress.</text></subsection></section> 
<section id="H053D1074552745A4A90043232EE7D3D1"><enum>305.</enum><header>Technology-related solicitations, contracts, and grants</header><text display-inline="no-display-inline">Not later than 60 days after the end of each fiscal year, the Under Secretary for Science and Technology shall transmit to the Congress a summary of the solicitations and resulting contracts and grants awarded by the Directorate of Science and Technology in the past fiscal year, including—</text> 
<paragraph id="HBC08196B75894384A7961FE86866700"><enum>(1)</enum><text>a description of each solicitation offered, the number of proposals received in response to each solicitation, and the number of proposals selected for funding for each solicitation;</text></paragraph> 
<paragraph id="H419019D7394A42D2BF789399D6816F90"><enum>(2)</enum><text>a description of the process used for proposal selection in each solicitation, including the role of peer review;</text></paragraph> 
<paragraph id="H912F149EECB34986B297AE5316ECEE53"><enum>(3)</enum><text>the status of contract funding with respect to each selected proposal;</text></paragraph> 
<paragraph id="H40DD224DFB6944218389EF101235A974"><enum>(4)</enum><text>a breakdown of the types of organizations receiving funding, such as institutions of higher education, small businesses, private industry, and nonprofit organizations; and</text></paragraph> 
<paragraph id="H4969EBF2307741C2B9C5009E52D70A4"><enum>(5)</enum><text>the number of transactions entered into as authorized under section 831(a)(1) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/391">6 U.S.C. 391(a)(1)</external-xref>) and a description of the benefits of the use of this authority by the Directorate of Science and Technology.</text></paragraph></section> 
<section id="HD0CCF814B6E840BCBC4738F20708E39C"><enum>306.</enum><header>Homeland security science investment</header> 
<subsection id="H913D0FD53B7F4963B3B30327022CAD50"><enum>(a)</enum><header>Assessment</header><text>The Secretary of Homeland Security shall conduct an assessment of—</text> 
<paragraph id="H72F5E1D57836475290CC2F36A088EB5B"><enum>(1)</enum><text>the development of national capabilities in homeland security science and technology to address basic scientific research needs, which shall—</text> 
<subparagraph id="H51777917F48949CE8021BCD41CFA602"><enum>(A)</enum><text>identify the most important scientific and technological challenges and priorities for homeland security;</text></subparagraph> 
<subparagraph id="H93F38EBCE08748858E834776362CCE95"><enum>(B)</enum><text>assess the extent to which the Department of Homeland Security research and development agenda is addressing the challenges and priorities identified under subparagraph (A);</text></subparagraph> 
<subparagraph id="H2D763B99E4FD4B75004D333EB5AE3D55"><enum>(C)</enum><text>assess whether the Department is effectively coordinating Federal research and development efforts in homeland security, particularly in the areas identified under subparagraph (A);</text></subparagraph> 
<subparagraph id="H70009E2A7C744DC79907FB9DC968CEB2"><enum>(D)</enum><text>assess the extent to which the agenda of the Department for basic research ensures that the Nation undertakes appropriate science investments to meet the long-term homeland security needs of the Nation, and recommend the extent to which such investments should be undertaken; and</text></subparagraph> 
<subparagraph id="H58F9AD59790541A0A658A5B07015B174"><enum>(E)</enum><text>identify the criteria used for setting the optimal level of investment in basic research; and</text></subparagraph></paragraph> 
<paragraph id="H5BF8A44B6ACD4A1092478E35E1FF94A6"><enum>(2)</enum><text>the methods used by the Directorate of Science and Technology for the prioritization of science and technology projects among, and within, research portfolios, including the selection and execution of such projects, which shall—</text> 
<subparagraph id="H7A27453D673A4A4BB9304C0002AFF462"><enum>(A)</enum><text>evaluate the process by which the Directorate obtains classified and unclassified threat and vulnerability information, and how that information is used to inform decisions on resource and funding allocations;</text></subparagraph> 
<subparagraph id="HDB6DFA164EBF4F09A19D0028E426D19C"><enum>(B)</enum><text>evaluate the usefulness of following a cost/benefit analysis to allocate funding among those portfolios and Directorate components; and</text></subparagraph> 
<subparagraph id="HE167C9C80CB44353BAFA0033BD0049EC"><enum>(C)</enum><text>evaluate the current methodology for selecting, funding, and awarding homeland security science programs at the national laboratories and academic institutions, and whether optimal use of such laboratories and institutions is being made.</text></subparagraph></paragraph></subsection> 
<subsection id="H4306B20BB3C8451D848400161485ADC"><enum>(b)</enum><header>Deadline</header><text>Not later than one year after the date of enactment of this Act, the Secretary shall transmit to the Congress the findings of the Department’s assessment under subsection (a), including recommendations for improvements where necessary.</text></subsection></section> 
<section id="HF319B8DD0F2F4AA8993D022D22E2CA59"><enum>307.</enum><header>Cybersecurity training programs and equipment</header> 
<subsection id="H62BA336C0D4D41EE9DAEC458A881261"><enum>(a)</enum><header>In general</header><text>The Secretary of Homeland Security, acting through the Assistant Secretary for Cybersecurity, may establish, in conjunction with the National Science Foundation, a program to award grants to institutions of higher education (and consortia thereof) for—</text> 
<paragraph id="H8BC03770099D435580753267D177C28F"><enum>(1)</enum><text>the establishment or expansion of cybersecurity professional development programs;</text></paragraph> 
<paragraph id="H3633632A46A14A098038BD05CE9F825E"><enum>(2)</enum><text>the establishment or expansion of associate degree programs in cybersecurity; and</text></paragraph> 
<paragraph id="H602C3ADCED5041989191BDBE2B99FEA9"><enum>(3)</enum><text>the purchase of equipment to provide training in cybersecurity for either professional development programs or degree programs.</text></paragraph></subsection> 
<subsection id="HE23E9CEC2D80488FA0EAD42D39EB29F8"><enum>(b)</enum><header>Roles</header> 
<paragraph id="HD59D5EF626264C04006E3ECEA821312"><enum>(1)</enum><header>Department of Homeland Security</header><text>The Secretary, acting through the Assistant Secretary for Cybersecurity and in consultation with the Director of the National Science Foundation, shall establish the goals for the program established under this section and the criteria for awarding grants under the program.</text></paragraph> 
<paragraph id="H7A9A889D622240A2904CC24FE1B778BF"><enum>(2)</enum><header>National Science Foundation</header><text>The Director of the National Science Foundation shall operate the program established under this section consistent with the goals and criteria established under paragraph (1), including soliciting applicants, reviewing applications, and making and administering grant awards. The Director may consult with the Assistant Secretary for Cybersecurity in selecting awardees.</text></paragraph> 
<paragraph id="H7A66EBA517594CAFAB3EB33400B01835"><enum>(3)</enum><header>Funding</header><text>The Secretary shall transfer to the National Science Foundation the funds necessary to carry out this section.</text></paragraph></subsection> 
<subsection id="HC8669985005F428EB067091D4F1D72F2"><enum>(c)</enum><header>Grant awards</header> 
<paragraph id="HB99F830253AD4DCE9F7FDC4251DDB4DE"><enum>(1)</enum><header>Peer review</header><text>All grant awards under this section shall be made on a competitive, merit-reviewed basis.</text></paragraph> 
<paragraph id="H4CED651D3CC84C9A8CD28086B895E228"><enum>(2)</enum><header>Focus</header><text>In making grant awards under this section, the Director shall, to the extent practicable, ensure geographic diversity and the participation of women and underrepresented minorities.</text></paragraph> 
<paragraph id="HE564BD740ED145AD80051E26C3815906"><enum>(3)</enum><header>Preference</header><text>In making grant awards under this section, the Director shall give preference to applications submitted by consortia of institutions to encourage as many students and professionals as possible to benefit from this program.</text></paragraph></subsection> 
<subsection id="HFA1709B5807C42759FEB67CC44AF17C"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary for carrying out this section $3,700,000 for fiscal year 2005.</text></subsection> 
<subsection id="HCADC09E7368A4C148CF06FC058B5827"><enum>(e)</enum><header>Definitions</header><text>In this section, the term <term>institution of higher education</term> has the meaning given that term in section 101(a) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></subsection></section> 
<section id="HF418CD3DA6824190B43CC019242D57C4"><enum>308.</enum><header>Joint development of counterterrorism and homeland security technologies, products, and services</header> 
<subsection id="HD4ED5E6B0C4F48F9BE882BBBD32DF497"><enum>(a)</enum><header>Authorization</header><text>For the purpose of jointly developing counterterrorism and homeland security technologies, products, and services, the Secretary of Homeland Security may enter into agreements or partnerships with foreign governments that are allies of the United States in the war on terrorism and have extensive experience in counterterrorism activities, including the Government of Israel and the Government of the United Kingdom.</text></subsection> 
<subsection id="HC61C8C5B8A564B02A2EEF2876DC4AFAE"><enum>(b)</enum><header>Funding</header><text>Of the amounts appropriated for programs administered by the Directorate of Science and Technology of the Department of Homeland Security for fiscal year 2005, there is authorized up to $20,000,000 to carry out this section.</text></subsection></section> 
<section id="H392ED0F8770B420CBE4DB2B4A3686938"><enum>309.</enum><header>Geospatial information</header> 
<subsection id="H512204D2AF5442E2A5A33451ED3103AE"><enum>(a)</enum><header>Coordination of geospatial information</header><text>With respect to geospatial technology, and interoperability of such technology, the Secretary of Homeland Security shall—</text> 
<paragraph id="H967F2E4F11FD48ACAAB5F5C748A16BF4"><enum>(1)</enum><text>identify the homeland security-related geospatial information needs of the Department of Homeland Security;</text></paragraph> 
<paragraph id="H8DA43FACAE38493D82C8AC615434EF68"><enum>(2)</enum><text>evaluate the geospatial information gathering activities of the Directorates of the Department, and take appropriate actions to enhance information sharing, integration, or consolidation with respect to such activities within the Department;</text></paragraph> 
<paragraph id="HA4DA4BFC34F84B9783192C9021168072"><enum>(3)</enum><text>evaluate geospatial technologies, including information, data, systems, services, hardware, and software, that are utilized by or available to the Department;</text></paragraph> 
<paragraph id="H43E4CD89C098420BA4FB334C9220BCFC"><enum>(4)</enum><text>evaluate whether geospatial information collected under projects for which the Department has provided grant funds is available to the Department;</text></paragraph> 
<paragraph id="H5DDAD5AB86D9470C00A4F7F569387784"><enum>(5)</enum><text>ensure that the Department is participating in and coordinating with the Federal Geographic Data Committee and other similar entities;</text></paragraph> 
<paragraph id="HD9DCCDC0E90A4D63943075B9AEA77370"><enum>(6)</enum><text>identify the homeland security-related geospatial information that is being collected by other Federal agencies, and evaluate its usefulness to the Department;</text></paragraph> 
<paragraph id="H2D73E2007E244429BB5F4FCB973325E1"><enum>(7)</enum><text>coordinate geospatial information sharing processes between the Department and other Federal, State, and local agencies; and</text></paragraph> 
<paragraph id="H01FF962758884BF79DA3ADD4AA8EF88D"><enum>(8)</enum><text>to the extent practicable, utilize commercial geospatial data and services to meet the geospatial information needs of the Department or to supplement the geospatial activities of the Department and its directorates.</text></paragraph></subsection> 
<subsection id="H7B25739EF02B494FA42D9031165818C2"><enum>(b)</enum><header>Geospatial Management Office</header><text>The Secretary of Homeland Security shall establish a Geospatial Management Office. The head of such office shall be the Geospatial Information Officer, who shall be responsible for coordinating the geospatial information activities of the Department of Homeland Security, with support and assistance from other Directorates and offices within the Department.</text></subsection> 
<subsection id="H595F19B14E95403DAA37DD562297A515"><enum>(c)</enum><header>Defined terms</header><text>As used in this subsection:</text> 
<paragraph id="HF78220AC3705403FB5ACDD80BE902058"><enum>(1)</enum><header>Geospatial information</header><text>The term <term>geospatial information</term> means graphical or digital data depicting natural or manmade physical features, phenomena, or boundaries of the earth and any information related thereto, including surveys, maps, charts, remote sensing data, and images.</text></paragraph> 
<paragraph id="HAD60C815F8A745248F6C81B1E243978"><enum>(2)</enum><header>Geospatial technology</header><text>The term <term>geospatial technology</term> means any technology utilized by analysts, specialists, surveyors, photogrammetrists, hydrographers, geodesists, cartographers, architects, or engineers for the collection, storage, retrieval, or dissemination of geospatial information, including global satellite surveillance systems, global position systems (GPS), geographic information systems (GIS), mapping equipment, geocoding technology, and remote sensing devices.</text></paragraph></subsection></section> 
<section id="H7220421868DB47DF9EE33F8420557E2D"><enum>310.</enum><header>Interoperable communications</header> 
<subsection id="H28207A465EAB471386A53233007ED997"><enum>(a)</enum><header>Coordination of public safety interoperable communications programs</header><text>The Secretary of Homeland Security shall establish a program to enhance public safety interoperable communications at all levels of government. Such program shall—</text> 
<paragraph id="H282C6956417C436591CCCC98F07B88FC"><enum>(1)</enum><text>establish a comprehensive national approach to achieving public safety interoperable communications;</text></paragraph> 
<paragraph id="H0D6F9DD90C6A43CF8DCA1F2DA9568CF0"><enum>(2)</enum><text>coordinate with other Federal agencies in carrying out paragraph (1);</text></paragraph> 
<paragraph id="H8436379376BC441196476F7E32EEF399"><enum>(3)</enum><text>develop, in consultation with other appropriate Federal agencies and State and local authorities, an appropriate baseline of communications interoperability for Federal, State, and local public safety agencies;</text></paragraph> 
<paragraph id="HE55EE5F338F446640049D88B3ED1FACA"><enum>(4)</enum><text>accelerate, in consultation with other Federal agencies, including the National Institute of Standards and Technology, the private sector, and nationally recognized standards organizations as appropriate, the development of national voluntary consensus standards for public safety interoperable communications;</text></paragraph> 
<paragraph id="HC8616B954CD243FBB292592CAA6C29FC"><enum>(5)</enum><text>encourage the development of flexible and open architectures, with appropriate levels of security, for short-term and long-term solutions to public safety communications interoperability;</text></paragraph> 
<paragraph id="HB5926C1FE50C4CA8B03CAA503725AE09"><enum>(6)</enum><text>assist other Federal agencies in identifying priorities for research, development, and testing and evaluation with regard to public safety interoperable communications;</text></paragraph> 
<paragraph id="HA136BB63595A4067ACB59DEA2684974D"><enum>(7)</enum><text>identify priorities within the Department for research, development, and testing and evaluation with regard to public safety interoperable communications;</text></paragraph> 
<paragraph id="H41D79AE921CB40978344989BA361FF91"><enum>(8)</enum><text>establish coordinated guidance for Federal grant programs for public safety interoperable communications;</text></paragraph> 
<paragraph id="HC32453C63B82415294972FFDED84B3E5"><enum>(9)</enum><text>provide technical assistance to State and local public safety agencies regarding planning, acquisition strategies, interoperability architectures, training, and other functions necessary to achieve public safety communications interoperability;</text></paragraph> 
<paragraph id="H5C91289A111047DEACBE5F4CA662081"><enum>(10)</enum><text>develop and disseminate best practices to improve public safety communications interoperability; and</text></paragraph> 
<paragraph id="H1E61A786B9DB40019E381F00C201AC73"><enum>(11)</enum><text>develop appropriate performance measures and milestones to systematically measure the Nation’s progress towards achieving public safety communications interoperability, including the development of national voluntary consensus standards.</text></paragraph></subsection> 
<subsection id="H56C169ABDBE047CB8C01B5B8782EA203"><enum>(b)</enum><header>Office of Public Safety Interoperable Communications</header> 
<paragraph id="HB14BB8FDED324B59842391DC8E58BD27"><enum>(1)</enum><header>Establishment</header><text>The Secretary may establish an Office of Public Safety Interoperable Communications to carry out this section.</text></paragraph> 
<paragraph id="H125C93EDA07041F38DBDCFB16E0091F5"><enum>(2)</enum><header>Applicability of <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name></header><text>The <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.) shall not apply to advisory groups established and maintained by the Office.</text></paragraph></subsection> 
<subsection id="H741BF69C7F784FF5A7AFE6A811345B3D"><enum>(c)</enum><header>Report</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary shall report to the Congress on Department of Homeland Security plans for accelerating the development of national voluntary consensus standards for public safety interoperable communications, a schedule of milestones for such development, and achievements of such development.</text></subsection></section> 
<section id="H4F9683C2EF6947A891121069CA6FDC30"><enum>311.</enum><header>Technology development and transfer</header> 
<subsection id="HD8295E0BB87548F18F1F8E45B35D4910"><enum>(a)</enum><header>Transfer program</header><text>Section 313 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/193">6 U.S.C. 193</external-xref>) is amended—</text> 
<paragraph id="H89854D5BDC8F421289495BF341A06F5E"><enum>(1)</enum><text>by adding at the end of subsection (b) the following new paragraph:</text>

<paragraph id="H7AFE32C2CEB54BB387255F0066C42FBA"><enum>(6)</enum><text>The establishment of a homeland security technology and equipment transfer program to facilitate the identification, modification, and commercialization of technology and equipment for use by Federal, State, and local governmental agencies, emergency response providers, and the private sector.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HDC1C62695D7F48EDBC6BC987D4F200E1"><enum>(2)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph> 
<paragraph id="H9DE22993709D4EAEB2A4112125A758FB"><enum>(3)</enum><text>by inserting after subsection (b) the following new subsection:</text>

<subsection id="H465AA2EC3595488C95DB7FF00300E7A7"><enum>(c)</enum><header>Technology transfer program</header><text>In developing the program described in subsection (b)(6), the Secretary, acting through the Under Secretary for Science and Technology, shall—</text> 
<paragraph id="HC675D576F12A4408A53E43A08CEBF3FA"><enum>(1)</enum><text>in consultation with the Under Secretary for Emergency Preparedness and Response and the Director of the Office for Domestic Preparedness, on an ongoing basis—</text> 
<subparagraph id="H36ABDC9511B04270B5358C3C260609E4"><enum>(A)</enum><text>conduct surveys and reviews of available appropriate technologies that have been developed, tested, evaluated, or demonstrated by the Department, other Federal agencies, or the private sector, and that may be useful in assisting Federal, State, and local governmental agencies, emergency response providers, or the private sector to prevent, prepare for, or respond to acts of terrorism;</text></subparagraph> 
<subparagraph id="HA3F831E77F7F4F2C8EE700A5C2BA83E4"><enum>(B)</enum><text>conduct or support tests, evaluations, or demonstrations as appropriate of technologies identified under subparagraph (A), including any necessary modifications to such technologies for counterterrorism use; and</text></subparagraph> 
<subparagraph id="HFDB7A302356E479AB8D3F463ECD7491"><enum>(C)</enum><text>communicate to Federal, State, and local governmental agencies, emergency response providers, or the private sector the availability of such technologies for counterterrorism use; and</text></subparagraph></paragraph> 
<paragraph id="HDFCCA4D3357A461AA92F2F678B43BE3B"><enum>(2)</enum><text>in support of the activities described in paragraph (1)—</text> 
<subparagraph id="HF3A17D9445A047669358D52E93D5EC69"><enum>(A)</enum><text>consult with Federal, State, and local emergency response providers;</text></subparagraph> 
<subparagraph id="H5526E2EC8B27472DA7C38BD6A7A0716B"><enum>(B)</enum><text>consult with government and nationally recognized standards organizations as appropriate;</text></subparagraph> 
<subparagraph id="HCE1B60FC5C0A4BAC81133632FB6F7C49"><enum>(C)</enum><text>enter into agreements and coordinate with other Federal agencies as the Secretary determines appropriate, in order to maximize the effectiveness of such technologies or to facilitate commercialization of such technologies; and</text></subparagraph> 
<subparagraph id="H81982B6E09AD40D49FE24DFAB7004FDE"><enum>(D)</enum><text>consult with existing technology transfer programs and Federal and State training centers that test, evaluate, and transfer military and other technologies for use by emergency response providers.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H175306162DFF40D382DDB99C44D1379D"><enum>(b)</enum><header>Report</header><text>Not later than one year after the date of enactment of this Act, the Under Secretary for Science and Technology shall transmit to the Congress a description of the progress the Department has made in implementing the provisions of section 313 of the Homeland Security Act of 2002, as amended by this Act, including a description of the process used to review unsolicited proposals received as described in subsection (b)(3) of such section.</text></subsection> 
<subsection id="HEF427C913B4A4BB5BFBB00BA73014F8"><enum>(c)</enum><header>Savings Clause</header><text>Nothing in this section (including the amendments made by this section) shall be construed to alter or diminish the effect of the limitation on the authority of the Secretary of Homeland Security under section 302(4) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/182">6 U.S.C. 182(4)</external-xref>) with respect to human health-related research and development activities.</text></subsection></section></title> 
<title id="HAA6234626D2E407DA1D2510400A7EB3"><enum>IV</enum><header>Critical Infrastructure Protection</header> 
<section id="HF647B032328C40D4B0C7825EDCF2F254"><enum>401.</enum><header>Liberty Shield Award for Innovation and Excellence in Critical Infrastructure Protection</header> 
<subsection id="H8FDC1E07CD19476A8347D6313284DB00"><enum>(a)</enum><header>In general</header><text>Title II of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/121">6 U.S.C. 121 et seq.</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H10FE163CE3574034B335662EAF53159B"><enum>(a)</enum><header>Establishment</header><text>There is hereby established the Liberty Shield Award for Innovation and Excellence in Critical Infrastructure Protection, which shall be evidenced by a medal of such design, materials, and inscriptions as the Secretary may prescribe.</text></subsection> 
<subsection id="HC1176313A8BB46B4A5A8A62FC90464A3"><enum>(b)</enum><header>Making and presentation of award</header> 
<paragraph id="H38301D11DF1047D4B6633F3461603486"><enum>(1)</enum><header>In general</header><text>The President (on the basis of recommendations received from the Secretary), or the Secretary, shall periodically make the award to companies and other organizations that in the judgment of the President or the Secretary significantly enhance the security of critical infrastructure through implementing innovative solutions, improvements, or practices, creating a competitive atmosphere for industry to adopt the most comprehensive homeland security solutions and systems, and that as a consequence are deserving of special recognition.</text></paragraph> 
<paragraph id="H3FF8C723E72143D8A0C44DFDBC849CF3"><enum>(2)</enum><header>Presentation</header><text>The presentation of the award shall be made by the President or the Secretary with such ceremonies as the President or the Secretary may consider proper.</text></paragraph> 
<paragraph id="H0E7F186AA67448189FD17C95B7A91494"><enum>(3)</enum><header>Publication and use of award</header><text>An organization to which an award is made under this section may publicize its receipt of such award and use the award in its advertising.</text></paragraph> 
<paragraph id="H78C94231801E4CFE9C684195399D3843"><enum>(4)</enum><header>Limitation on eligibility</header><text>An organization to which an award is made under this section shall be ineligible to receive another such award in the same category for a period of 5 years.</text></paragraph></subsection> 
<subsection id="H829CA6D2A675466785C211009B4DE56F"><enum>(c)</enum><header>Categories of awards</header> 
<paragraph id="HA298C8603CAB431F8CEB324B4B0AA8C"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2), (3), and (4), separate awards shall be made to qualifying organizations in each of the following categories:</text>

<paragraph id="H04D2C27985674D14B00457FE2EA00778"><enum>(2)</enum><header>Modification of categories</header><text>The Secretary may at any time expand, subdivide, or otherwise modify the list of categories under paragraph (1), and may establish separate awards for small businesses, units of government, or other organizations upon a determination that the objectives of this section would be better served thereby.</text></paragraph> 
<paragraph id="H34471B61DE1641F1B3DBB7DC02C55399"><enum>(3)</enum><header>Limitation on number of awards in category</header><text>Not more than two awards may be made within any category in any year, unless the Secretary determines that a third award is merited due to extraordinary circumstances.</text></paragraph></subsection> 
<subsection id="HC9F9C2203F6047338F3D3E0013A527A0"><enum>(d)</enum><header>Criteria for qualification</header> 
<paragraph id="H04702B059DAF49C0A96F50118FF65F05"><enum>(1)</enum><header>In general</header><text>An organization may qualify for an award under this section only if it—</text> 
<subparagraph id="H6F0499DF2EE647ADBD04212CF0D736D3"><enum>(A)</enum><text>applies to the Secretary, in writing, for the award;</text></subparagraph> 
<subparagraph id="HA60A8707E2B84BFDAC4FA975858783D0"><enum>(B)</enum><text>permits a rigorous evaluation of the way in which its business and other operations have implemented innovative solutions, improvements, or practices to secure critical infrastructure;</text></subparagraph> 
<subparagraph id="HD629E27FF509459BBA8D1DB000DCACE3"><enum>(C)</enum><text>agrees to share its experience to assist other American organizations improve their implementation of solutions, improvements, or practices to secure critical infrastructure; and</text></subparagraph> 
<subparagraph id="H09C2B42BBED347C9939C93E32B00E431"><enum>(D)</enum><text>meets such requirements and specifications as the Secretary, after receiving recommendations from the board of examiners established under paragraph (5), determines to be appropriate to achieve the objectives of this section.</text></subparagraph></paragraph> 
<paragraph id="HA8489E8C13BE4E8CAFB6C185C8F3E21"><enum>(2)</enum><header>Evaluation by Board of examiners</header><text>In applying subparagraph (1)(B) with respect to any organization, the Secretary shall rely upon an intensive evaluation by a competent board of examiners that reviews the evidence submitted by the organization and, through a site visit, verifies the effectiveness of and the accuracy of claims regarding the innovative solutions, improvements, or practices to secure critical infrastructure.</text></paragraph> 
<paragraph id="H893BE5CA801743878C003EA89881174"><enum>(3)</enum><header>Use of nonprofit entities</header> 
<subparagraph id="H9F0F1045BBAD4250AB61C1B05D5BAE08"><enum>(A)</enum><header>In general</header><text>The Secretary may, under appropriate contractual arrangements, carry out the responsibilities under subparagraphs (A) and (B) of paragraph (1) through one or more broad-based nonprofit entities that are leaders in the field of critical infrastructure and that have a history of public or government service.</text></subparagraph> 
<subparagraph id="HAA3EB952179341D9AF5222C373A626D2"><enum>(B)</enum><header>Board of examiners</header><text>The Secretary shall appoint a board of examiners for the award, consisting of at least 5 persons selected for their preeminence in the field of infrastructure protection.</text></subparagraph></paragraph></subsection> 
<subsection id="H25316D76CF67400CB29338A516E8CDA"><enum>(e)</enum><header>Information and technology transfer program</header><text>The Secretary shall ensure that all program participants receive the complete results of their audits as well as detailed explanations of all suggestions for improvements. The Secretary also shall provide information about the awards and the successful infrastructure protection strategies and programs of the award-winning participants to all participants and other appropriate groups.</text></subsection> 
<subsection id="HC8452F0C9CCD455789C3085C4D673123"><enum>(f)</enum><header>Funding</header><text>The Secretary may seek and accept gifts from public and private sources to carry out the program under this section. If additional sums are needed to cover the full cost of the program, the Secretary shall impose fees upon the organizations applying for the award in amounts sufficient to provide such additional sums. The Secretary may use appropriated funds to carry out responsibilities under this Act.</text></subsection> 
<subsection id="HE8B1F46498414D85BF3400F6A7EDFFD8"><enum>(g)</enum><header>Small business defined</header><text>As used in this section the term <term>small business</term> means a small business concern as defined in section 2 of <external-xref legal-doc="public-law" parsable-cite="pl/85/539">Public Law 85–539</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>) and implementing regulations of the Administrator of the Small Business Administration.</text></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H5B474C49641D4FB18EC9FD4BC7A9A0A9"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of such Act is amended by inserting at the end of the items relating to title II the following:</text>

<section id="HC88B8C9DA36040768F8FC180593B2B87"><enum>402.</enum><header>Sense of Congress regarding private sector participation in the Homeland Security Operations Center</header><text display-inline="no-display-inline">It is the sense of Congress that the Department of Homeland Security’s Homeland Security Operations Center should increase on-site participation of representatives from the private sector critical infrastructure sectors.</text></section> 
<section id="H49FA32DB579E4BA09D187F15E9C7007E"><enum>403.</enum><header>Treatment of global positioning system as critical infrastructure</header><text display-inline="no-display-inline">Section 201(d)(5) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/121">6 U.S.C. 121(d)(5)</external-xref>) is amended by inserting <quote>the civilian Global Positioning System (GPS) infrastructure,</quote> after <quote>communications systems,</quote>.</text></section> 
<section id="HA9F4547BB5724CC1B5FFC6BB3400102C"><enum>404.</enum><header>Coordination of critical infrastructure grants</header><text display-inline="no-display-inline">The Under Secretary for Information Analysis and Infrastructure Protection and the Director of the Office for Domestic Preparedness shall coordinate their activities and develop mechanisms to—</text> 
<paragraph id="H0F6EDC4E857A40ADB7ED97BEA9F67100"><enum>(1)</enum><text>ensure that grants related to critical infrastructure protection are consistent with priorities, recommendations, and activities of the Under Secretary for Information Analysis and Infrastructure Protection under section 201(d) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/121">6 U.S.C. 121(d)</external-xref>); and</text></paragraph> 
<paragraph id="H8A150517A3394C54B3B896A5FF5E885"><enum>(2)</enum><text>track and provide reporting on such grants by recipient, type of activity funded, and critical infrastructure sector addressed.</text></paragraph></section> 
<section id="H0BD1ED26A7A64454B1C9512D7556DCC5"><enum>405.</enum><header>Critical infrastructure protection awareness</header><text display-inline="no-display-inline">Within 6 months after the date of the enactment of this Act, the Secretary of Homeland Security shall develop and distribute print, video, and interactive critical infrastructure protection awareness and education materials for emergency response providers (as that term is defined in section 2 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>)) and owners and operators of such infrastructure, that describe critical infrastructure and its interdependent nature, its implications for local communities, and resources available for responding to critical infrastructure catastrophic events.</text></section></title> 
<title id="H5A6B0BC6BBE648B29B4F34CC56356C6B"><enum>V</enum><header>Emergency Preparedness and Response</header> 
<section id="H907730F56F7A4D08A9C07FFAF8860060"><enum>501.</enum><header>Terrorism exercise program requirements</header><text display-inline="no-display-inline">The Secretary of Homeland Security shall ensure that terrorism preparedness exercises conducted by the Department of Homeland Security and related information and training—</text> 
<paragraph id="H0DBDA3B55A1E4DB49BF06090F800A1FB"><enum>(1)</enum><text>enhance coordination and preparedness for acts of terrorism at all levels of Federal, State, and local governments and the private sector;</text></paragraph> 
<paragraph id="HC2571BE42C504DDABB7360F2CDD9D623"><enum>(2)</enum><text>are—</text> 
<subparagraph id="H358D4A462EB5467596DEE16675003874"><enum>(A)</enum><text>multidisciplinary in nature, including, as appropriate, cybersecurity components;</text></subparagraph> 
<subparagraph id="H9E79994011234F1C936CB900D8BC842B"><enum>(B)</enum><text>as realistic as practicable and risk-based;</text></subparagraph> 
<subparagraph id="H33380609BF474A0E99D2A3FEA729C71E"><enum>(C)</enum><text>evaluated against performance measures and followed by corrective action to solve identified deficiencies; and</text></subparagraph> 
<subparagraph id="H7BF5954BE64F44B2ADA0D218B700B188"><enum>(D)</enum><text>assessed to learn best practices, which shall be shared with appropriate Federal, State, and local personnel and authorities; and</text></subparagraph></paragraph> 
<paragraph id="H87F2A28F4B584BA49927AEDD4CE393F9"><enum>(3)</enum><text>assist State and local governments with the implementation of exercises that—</text> 
<subparagraph id="H567CAB0D81324AF29DDF61AF374866B7"><enum>(A)</enum><text>conform to the requirements of paragraph (2); and</text></subparagraph> 
<subparagraph id="H6874B80D8C344090858F5887D4320088"><enum>(B)</enum><text>are consistent with any applicable State homeland security strategy or plan.</text></subparagraph></paragraph></section> 
<section id="HAB4E382B7B4143D88BC27CF171370849"><enum>502.</enum><header>Grant award notification and distribution</header> 
<subsection id="H0CEE31C2D83647D1B5EEA02FAB11DC7"><enum>(a)</enum><header>Notification</header><text>With respect to any grant awarded by the Department of Homeland Security to any local government (as that term is defined in section 2 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>)), the Secretary of Homeland Security shall promptly provide notice of the award of such grant, including the name of the recipient and the amount of the award, to the appropriate State government official.</text></subsection> 
<subsection id="H3D34DE18B0AA4A71BF33D84CF4E34C25"><enum>(b)</enum><header>Distribution</header><text>In making any grant targeted to a high-threat, high-density urban area, the Secretary shall ensure, to the maximum extent practicable, that such grants are distributed among the jurisdictions that could reasonably be expected to provide support to the high-threat, high-density urban area following an act of terrorism, including interstate jurisdictions.</text></subsection></section> 
<section id="HC161A4A467E14F58B40010D31BA23732"><enum>503.</enum><header>Mutual aid program</header><text display-inline="no-display-inline">The Secretary of Homeland Security shall establish a program supporting the development of mutual aid systems for preparedness for and response to acts of terrorism and other emergencies throughout the Nation, by—</text> 
<paragraph id="HA45877401AFF4E0C9B753FFC32C449AB"><enum>(1)</enum><text>identifying and cataloging existing mutual aid agreements related to preparedness for and response to acts of terrorism and other emergencies at the State and local levels of government;</text></paragraph> 
<paragraph id="H0F2833EC8A77407898AD684B41ED5634"><enum>(2)</enum><text>disseminating to State and local governments examples of best practices in the development of mutual aid agreements and models of existing mutual aid agreements, including agreements involving interstate jurisdictions; and</text></paragraph> 
<paragraph id="H42A2F205341944D497B7A33758FA76F3"><enum>(3)</enum><text>completing an inventory of Federal response capabilities for acts of terrorism and other emergencies, making such inventory available to appropriate Federal, State, and local government officials, and ensuring that such inventory is as current and accurate as practicable.</text></paragraph></section> 
<section id="H68FDBDBA3FAD4900AD19E0B1F8C3EC33"><enum>504.</enum><header>National preparedness goal</header> 
<subsection id="HF2F3CF6DA1AA40DB9FB6BABEFCECBD8"><enum>(a)</enum><header>Deadline</header><text display-inline="yes-display-inline">No later than 120 days after the date of the enactment of this Act, and consistent with the provisions of section 505 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/315">6 U.S.C. 315</external-xref>), the Secretary of Homeland Security shall develop and publish a domestic emergency national preparedness goal, with a particular emphasis on preparedness for acts of terrorism.</text></subsection> 
<subsection id="H89E43AC96A7C4A6FBBF65F82027120C2"><enum>(b)</enum><header>Preparedness goal defined</header><text>The national preparedness goal shall—</text> 
<paragraph id="H743C330096C045799CF5D00F902CAEB"><enum>(1)</enum><text>establish measurable readiness priorities;</text></paragraph> 
<paragraph id="H5ED5454180BF4E03894D6EBED2D683D9"><enum>(2)</enum><text>balance the potential threat and magnitude of acts of terrorism, major disasters, and other emergencies with the resources required to prevent, respond to, and recover from them;</text></paragraph> 
<paragraph id="H8954A8766AE2465AAA00036E8809CD6F"><enum>(3)</enum><text>include readiness metrics and elements to measure achievement of the national preparedness goal;</text></paragraph> 
<paragraph id="HB2818F425F97463D87717074BAC8F743"><enum>(4)</enum><text>include standards for preparedness assessments and strategies; and</text></paragraph> 
<paragraph id="H1B1186146E2D4DD3927B5DE094AA5654"><enum>(5)</enum><text>establish a system for assessing the Nation’s overall preparedness to respond to major events, especially those involving acts of terrorism.</text></paragraph></subsection> 
<subsection id="HFF95A7464CA044CA9B9D0370550358A1"><enum>(c)</enum><header>Coordination and consultation</header><text>In developing the national preparedness goal, the Secretary shall—</text> 
<paragraph id="H235AD7D0AF734ECDA4A095949BC5C277"><enum>(1)</enum><text>coordinate with the heads of other appropriate Federal departments and agencies;</text></paragraph> 
<paragraph id="HCFA4C1D444694C88A7BDE3467DE0D4"><enum>(2)</enum><text>consult with State and local governments, including representatives of a cross section of emergency response provider disciplines; and</text></paragraph> 
<paragraph id="HEE459B679364444B965D86052E77A8DB"><enum>(3)</enum><text>consult with national voluntary consensus standards development organizations.</text></paragraph></subsection> 
<subsection id="H4BF1B9E37EEC4115A700A36E2F989E74"><enum>(d)</enum><header>Submission</header><text>Upon completion of the national preparedness goal, the Secretary shall submit to the Congress a description of such goal and the coordination and consultation process used to develop it under subsection (c).</text></subsection></section> 
<section id="HE2A72116BBCB4A3782E66E9DCBD6ECC"><enum>505.</enum><header>Clarification of responsibility for interoperative communications</header> 
<subsection id="H8DF7B65919CC4173BE1082A377FC4CDF"><enum>(a)</enum><header>Under Secretary for Emergency Preparedness and Response</header><text>Section 502(7) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/312">6 U.S.C. 312(7)</external-xref>) is amended—</text> 
<paragraph id="H13C675158ADB4E1C874B768B78F55248"><enum>(1)</enum><text>by striking <quote>developing comprehensive programs for developing interoperative communications technology, and</quote>; and</text></paragraph>

<subsection id="HEB9A2C5073B1427E8CFD418B921FB519"><enum>(a)</enum><header>Strategy</header> 
<paragraph id="H25B3CF5569054EF2A86189CF36B789F4"><enum>(1)</enum><header>In general</header><text>Consistent with the provisions of section 505 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/315">6 U.S.C. 315</external-xref>) and subsections (a) and (b) of section 304 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/184">6 U.S.C. 184</external-xref>), the Secretary of Homeland Security, in consultation with the heads of other appropriate Federal agencies, shall develop a comprehensive national biodefense strategy (in this section referred to as the <quote>biodefense strategy</quote>) for meeting the requirements, responsibilities, and authorities of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>), including sections 201(d)(1), 302(2), and 502(3) of such Act, with respect to the biodefense mission of the Department.</text></paragraph> 
<paragraph id="HB17C8FDA7256429396A08097A0371411"><enum>(2)</enum><header>Deadlines</header><text>The Secretary shall—</text> 
<subparagraph id="H7BB0BA37B87F403A98BC9232A709371C"><enum>(A)</enum><text>develop the biodefense strategy not later than one year after the date of the enactment of this Act; and</text></subparagraph> 
<subparagraph id="H69CA54820EBD41EA8EABF9800D1891E"><enum>(B)</enum><text>regularly update such strategy as necessary, but not less than every four years.</text></subparagraph></paragraph></subsection> 
<subsection id="H2E44A870F3A84CD8B0B0D978ACAF6990"><enum>(b)</enum><header>Contents</header><text>The biodefense strategy shall set forth the following:</text> 
<paragraph id="HA7D2F57EC0BD4CF88DFC7E4951DDB894"><enum>(1)</enum><text>The objectives, missions, and priorities, including how such objectives, missions, and priorities were established and will be updated.</text></paragraph> 
<paragraph id="H4223BD425AA543B6945FBDE818244D3F"><enum>(2)</enum><text>A description of the biological threats to and vulnerabilities of the Nation, including a prioritization of such threats in terms of risk.</text></paragraph> 
<paragraph id="H2D1B29E45AC04ABC8C5D3DA4CEDD8B91"><enum>(3)</enum><text>A specification of each Federal agency with research and development responsibilities regarding such objectives, missions, and priorities, and a description of such responsibilities.</text></paragraph> 
<paragraph id="H2945852088F64D2492344BC697904F8"><enum>(4)</enum><text>A specification of each Federal agency with other responsibilities regarding such objectives, missions, and priorities (including surveillance, threat and risk analysis, and incident response), and a description of such responsibilities.</text></paragraph> 
<paragraph id="H56E5D503D596478A8D32CA835DF88059"><enum>(5)</enum><text>The mechanisms by which coordination among the Federal agencies described in paragraphs (3) and (4) will be achieved.</text></paragraph> 
<paragraph id="HED5A4DE6564C4617A8963C5DB2005965"><enum>(6)</enum><text>The role of State and local governments and private sector institutions in the biodefense strategy, as identified by the Federal agencies described in paragraphs (3) and (4) with the responsibility and mission to coordinate and communicate with State and local governments and private sector institutions.</text></paragraph> 
<paragraph id="HB79BA18B10E04DAABEF8973B147CF5"><enum>(7)</enum><text>The mechanisms by which the Federal agencies referred to in paragraph (6) coordinate and communicate with State and local governments and private sector institutions.</text></paragraph> 
<paragraph id="H151A45A7CA5940F0B0856566FDFF27C7"><enum>(8)</enum><text>Performance benchmarks to measure progress in achieving the objectives of the biodefense strategy, including a specification of expected timeframes for implementation.</text></paragraph></subsection> 
<subsection id="H937875A7C54A48DC8E5BFCD0A33C62A7"><enum>(c)</enum><header>Other Agency Responsibilities</header><text>The Secretary shall obtain the concurrence of the relevant Federal agency head with respect to such other agency’s responsibilities or activities covered by this section.</text></subsection> 
<subsection id="H4C5F4B77AC3B43E2A9B9A6C720B3E7A2"><enum>(d)</enum><header>Submission</header><text>Upon its completion, the Secretary shall transmit a copy of the biodefense strategy to the Congress in an unclassified form with a classified annex as appropriate.</text></subsection></section> 
<section id="HDBE5D71C59734420A6709134B31424C2"><enum>507.</enum><header>National strategy to mitigate the radiological and nuclear threat</header> 
<subsection id="H7346295E3D824A54AD3E9148BD37901F"><enum>(a)</enum><header>Strategy</header> 
<paragraph id="HCFEE2B5D7B4244A784613375856F27FA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Consistent with the provisions of section 505 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/315">6 U.S.C. 315</external-xref>) and subsections (a) and (b) of section 304 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/184">6 U.S.C. 184</external-xref>), the Secretary of Homeland Security, in consultation with the heads of other appropriate Federal agencies, shall develop a comprehensive national strategy (in this section referred to as the <quote>strategy</quote>) for meeting the requirements, responsibilities, and authorities of the Department of Homeland Security under the Homeland Security Act of 2002 (including sections 201(d)(1), 302(2), and 502(2) and (3) (<external-xref legal-doc="usc" parsable-cite="usc/6/121">6 U.S.C. 121(d)(1)</external-xref>, 182(2), and 312(2) and (3))) with respect to mitigating the radiological and nuclear threat.</text></paragraph> 
<paragraph id="H60E02C0DA1774B18806549CA4D7E548E"><enum>(2)</enum><header>Deadline</header><text>The Secretary shall develop the strategy not later than one year after the date of enactment of this Act.</text></paragraph></subsection> 
<subsection id="H62DC3765E7B440DCB27630565EA85B22"><enum>(b)</enum><header>Contents</header><text>The strategy shall include—</text> 
<paragraph id="H0184863517614187959FC2CE998CE899"><enum>(1)</enum><text>radiological and nuclear mitigation objectives, missions, and priorities, including a description of how they were established and will be updated;</text></paragraph> 
<paragraph id="H332A8B4EE42041F8B5B974C25E650074"><enum>(2)</enum><text>a description of the radiological and nuclear threats to and vulnerabilities of the Nation, including a prioritization of such threats in terms of risk;</text></paragraph>

<paragraph id="H914C9790A05A499F96C0F079ED9E6163"><enum>(6)</enum><text>performance benchmarks to measure progress in achieving the strategy, including a specification of expected timeframes for implementation.</text></paragraph></subsection> 
<subsection id="H8FCCE19D667D4E73AEC92F0799912CDB"><enum>(c)</enum><header>Other Agency Responsibilities</header><text>The Secretary shall obtain the concurrence of the relevant Federal agency head with respect to such other agency’s responsibilities or activities covered by this section.</text></subsection> 
<subsection id="H19B72D8C4B044D12B13BEB3DF68D5657"><enum>(d)</enum><header>Submission</header><text>Upon its completion, the Secretary shall transmit a copy of the strategy to the Congress in an unclassified form, with a classified annex as appropriate.</text></subsection></section></title> 
<title id="H2C887814CA0447E6BAE0E696F950E16E"><enum>VI</enum><header>Security enforcement and investigations</header> 
<section id="HD674B8E5B97E45E6A9826700B5E2CB7"><enum>601.</enum><header>Plan for enhanced coordination and interoperability of maritime and airborne homeland security assets</header> 
<subsection id="HB0E227A4AF9B4C9BB1CDB6B2FA5CC101"><enum>(a)</enum><header>In general</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Homeland Security shall develop and submit to the appropriate congressional committees (as that term is defined in section 2 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>)) a plan to ensure—</text> 
<paragraph id="H31D1FE33F26B4209B4E024CF3C2BCF5F"><enum>(1)</enum><text>coordination of the operational planning and deployment of the maritime and airborne assets of the Directorate of Border and Transportation Security that are used for homeland security purposes in order to enhance mission capacity, improve efficiency of operations, and reduce duplication of efforts;</text></paragraph> 
<paragraph id="H4DA839B2B14B4B82A2868C7CFF2DFC1F"><enum>(2)</enum><text>coordination of the modernization plans of the assets described in paragraph (1) in order to enhance mission capacity, improve efficiency of operations, and reduce duplication of efforts;</text></paragraph> 
<paragraph id="H768DFB78B3964366969FD28700165B72"><enum>(3)</enum><text>coordination of the maintenance and repair capacity of the assets described in paragraph (1) in order to enhance mission capacity, improve efficiency of operations, and reduce duplication of efforts;</text></paragraph> 
<paragraph id="HBDD8BF7CE63D4428ACF0732F08710007"><enum>(4)</enum><text>interoperable communication systems among the Department of Homeland Security’s maritime and airborne assets that are used for homeland security purposes, to the extent practicable, in order to enhance mission capacity, improve efficiency of operations, and reduce duplication of efforts; and</text></paragraph> 
<paragraph id="H6F2558E51C0C4E6BA40679C2EAC928CA"><enum>(5)</enum><text>sharing of maritime information relating to vessels, crew, passengers, cargo, and cargo shippers among the appropriate elements of the Department of Homeland Security.</text></paragraph></subsection> 
<subsection id="HE343808E19DA410CB835F559DA446852"><enum>(b)</enum><header>Relationship with the Coast Guard</header><text>To the extent permitted by section 888 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/468">6 U.S.C. 468</external-xref>), the plan shall consider whether there are additional opportunities for enhanced coordination between the maritime and airborne assets within the Directorate of Border and Transportation Security Directorate and those of the Coast Guard.</text></subsection></section> 
<section id="H78714DF7CD2B4CB2B0D9557693D8035C"><enum>602.</enum><header>Access to border and transportation security information</header><text display-inline="no-display-inline">The Secretary of Homeland Security shall take any action necessary and appropriate to ensure—</text> 
<paragraph id="H67A91827050D40B78963C500668508B3"><enum>(1)</enum><text>that all appropriate personnel of the Directorate of Border and Transportation Security can promptly access and receive law enforcement and intelligence information contained in all databases utilized by the Directorate;</text></paragraph> 
<paragraph id="H935F6283C2AB41D9A23DCBAC1395E220"><enum>(2)</enum><text>the prompt transmittal of information between entities of the Directorate and the Directorate for Information Analysis and Infrastructure Protection and any other entity of the Department prescribed by the Secretary; and</text></paragraph> 
<paragraph id="H8D33C5A67B204D51B0724006B5678579"><enum>(3)</enum><text>that all actions taken under this section are consistent with the Secretary’s Department-wide efforts to ensure the compatibility of information systems and databases pursuant to section 102(b)(3) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/112">6 U.S.C. 112(b)(3)</external-xref>).</text></paragraph></section> 
<section id="H40E47933B0A645CBBA4714EDC2FB92EC"><enum>603.</enum><header>Combined enrollment centers for expedited inspection programs</header> 
<subsection id="H5AFA4122E37840E397947B073600391E"><enum>(a)</enum><header>In general</header><text>Not later than 6 months after the date of the enactment of this Act, the Secretary of Homeland Security shall initiate a pilot program under which the Department shall establish not less than 2 combined enrollment centers at locations away from United States ports of entry for programs that permit participants to receive expedited inspection at designated ports of entry.</text></subsection> 
<subsection id="H846EE06507C4412BAF4EB68CA6775B82"><enum>(b)</enum><header>Allocation</header><text>Of the combined enrollment centers established under subsection (a), at least 1 shall serve the northern border of the United States and at least 1 shall serve the southern border of the United States.</text></subsection></section> 
<section id="HDC3880216DA040C8B52443F0A36BCFBF"><enum>604.</enum><header>Expedited inspection program use at multiple ports of entry</header><text display-inline="no-display-inline">Not later than 18 months after the date of the enactment of this Act, the Secretary of Homeland Security shall permit individuals holding a valid identification card issued under a program that permits participants to receive expedited inspection at designated ports of entry to use such card at any port of entry at which such program is operating.</text></section></title>

<paragraph id="H73AA9DD0C9F241619058378B604F2705"><enum>(2)</enum><text>The significant management challenges identified by the Secretary with respect to each of the management responsibilities set forth in section 701 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/341">6 U.S.C. 341</external-xref>).</text></paragraph> 
<paragraph id="HFB3C37B3F07B4E46846B94D21E007043"><enum>(3)</enum><text>Plans and strategies, including the establishment of performance indicators or performance goals, to address such significant management challenges identified by the Secretary.</text></paragraph>

<subsection id="HE6952369C0D8495EB555328B3BFBB5EA"><enum>(c)</enum><header>Chief Acquisition Officer</header><text>Section 103 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/113">6 U.S.C. 113</external-xref>) is amended by redesignating subsection (e) as subsection (f), and by inserting after subsection (d) the following:</text>

<section id="H7A8ACEED0A894C85814FA1E31505AF44"><enum>704.</enum><header>Chief Human Capital Officer</header><text display-inline="no-display-inline">The Chief Human Capital Officer appointed under section 103(d)(3) shall report to the Secretary, or to any other official of the Department, as the Secretary may direct. The Chief Human Capital Officer—</text> 
<paragraph id="HA7E474E7748243829D1478B686E60E5"><enum>(1)</enum><text>shall assess the ability of Department personnel to fulfill the Department’s missions, and oversee the implementation of effective recruitment and retention efforts across the Department;</text></paragraph> 
<paragraph id="H8E99F6BBC9E941B3BB00E5CE5202A266"><enum>(2)</enum><text>shall ensure that all employees of the Department are informed of their rights and remedies under chapters 12 and 23 of title 5, United States Code, by—</text> 
<subparagraph id="H123B7BB17CEF46F2BCF0BD19E29F1EC"><enum>(A)</enum><text>participating in the 2302(c) Certification Program of the Office of Special Counsel;</text></subparagraph> 
<subparagraph id="H765D03C2D2114B819E8F82F4BB39A0A5"><enum>(B)</enum><text>achieving certification from the Office of Special Counsel of the Department’s compliance with <external-xref legal-doc="usc" parsable-cite="usc/5/2302">section 2302(c)</external-xref> of title 5, United States Code; and</text></subparagraph> 
<subparagraph id="H2CB6A86A10F4455DA4C13401654E68E"><enum>(C)</enum><text>informing the Congress of such certification not later than 24 months after the date of enactment of this paragraph; and</text></subparagraph></paragraph> 
<paragraph id="HD4BFA8E3E6FC4771A323A31700852650"><enum>(3)</enum><text>shall perform such other functions as may be required by law or prescribed by the Secretary.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="HAFFCFC6ED2354E4DA965FB9B6512B000"><enum>(1)</enum><header>Abolishment</header><text>Section 103(a) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/113">6 U.S.C. 113(a)</external-xref>) is amended by striking paragraph (7), and by redesignating paragraphs (8) and (9) as paragraph (7) and (8), respectively.</text></paragraph> 
<paragraph id="H54F9750C56F542848F70D59345E0B237"><enum>(2)</enum><header>Continued service</header><text>Notwithstanding the amendment made by subsection (a), an individual serving as Under Secretary for Management of the Department of Homeland Security immediately before the enactment of this Act may continue to serve in such role at the discretion of the Secretary of Homeland Security.</text></paragraph></subsection> 
<subsection id="H958F9C8A98364CF685128FB801146FF7"><enum>(f)</enum><header>Basic pay rates</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/5315">Section 5315</external-xref> of title 5, United States Code, is amended by inserting after the item relating to Chief Information Officer, Department of Homeland Security, the following: <quote>Chief Acquisition Officer, Department of Homeland Security.</quote>.</text></subsection></section> 
<section id="H8AF8794EF75E4239870966C19804293E"><enum>702.</enum><header>Additional budget-related submission</header> 
<subsection id="H60A3DBA1172C4A199030F359C147BBBA"><enum>(a)</enum><header>In general</header><text>Beginning in fiscal year 2006, and annually thereafter, the Secretary of Homeland Security shall submit to the Congress budget request information for the Department of Homeland Security’s information technology-related spending that is organized by directorate and by Department-wide critical mission area, including the integration of information technology systems to improve departmental operations, management, and information sharing.</text></subsection> 
<subsection id="HEF11EF53255642BE8CBE876B0019BFF"><enum>(b)</enum><header>Submission</header><text>The Secretary shall submit the information under subsection (a) at the same time as the submission of the President’s annual budget request to the Congress.</text></subsection></section> 
<section id="H7EFA6ED3CC694F7F901C2437DE174F8E"><enum>703.</enum><header>Congressional notification requirements</header> 
<subsection id="HB63B3918B7464A658823D938E566C2FC"><enum>(a)</enum><header>In general</header><text>Title I of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/111">6 U.S.C. 111 et seq.</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HAE5FA293F58E4BCCA7C6104E87D43F5"><enum>(a)</enum><header>In general</header><text>The Secretary shall keep each appropriate congressional committee fully and currently informed of the Department’s activities, including any significant initiative of any directorate, office, or component of the Department, and any significant failure or material delay in implementing any initiative for which notification is required by this subsection.</text></subsection> 
<subsection id="H6DCE3F0348714F9CA944DCE6A85941B6"><enum>(b)</enum><header>Copies of agreements, memoranda, and other instruments</header><text>The Secretary shall provide promptly to each appropriate congressional committee a copy of any agreement, memorandum, or other instrument that creates or evidences any obligation that is binding on the Department with respect to any other Federal, State, or local department, agency, or other entity, or to any private sector entity, excluding grants, contracts or cooperative agreements.</text></subsection> 
<subsection id="H18226868F48A431383F12D0D3637C66"><enum>(c)</enum><header>Unclassified versions of classified notifications</header> 
<paragraph id="HD5BB42F9A32E4A38AFAA7BD438A759CA"><enum>(1)</enum><header>In general</header> 
<subparagraph display-inline="yes-display-inline" id="H4750E9D3E39D4450B34666BF09B68F65"><enum>(A)</enum><text>The Secretary may submit any notification required under this section in classified form, if that is necessary in order to provide the information required by this section.</text></subparagraph> 
<subparagraph indent="up1" id="H460F220910D3491F98535955C000ECAF"><enum>(B)</enum><text>In carrying out subparagraph (A), the Secretary may submit any classified notification by delivering it to the premises of any committee of the House of Representatives or the Senate that the Speaker of the House or President of the Senate, has determined to have storage facilities appropriate for classified material of such type.</text></subparagraph></paragraph> 
<paragraph id="HE79F509269D846BF873BDA6473AC36"><enum>(2)</enum><header>Unclassified notification</header><text>When the Secretary submits a classified notification pursuant to paragraph (1), the Secretary shall provide to each appropriate congressional committee, at the same time the Secretary provides any classified notification to such committees under this section, a notification in an unclassified form containing as much of the substance of such classified notification as can be provided in an unclassified format.</text></paragraph> 
<paragraph id="H2A8F92B257FC48CF8E5E613C568FB4FE"><enum>(3)</enum><header>Prompt submission</header><text>If providing a notification in an unclassified form under paragraph (2) would delay the Secretary’s submission of the notification, the Secretary shall submit the unclassified notification required by paragraph (2) as soon as practicable after submission of the classified notification to which it relates.</text></paragraph></subsection> 
<subsection id="HC655EDEFD3C94B09AC95726BE1163B9"><enum>(d)</enum><header>Sense of Congress</header><text>Notwithstanding the requirements of subsections (a) through (c), it is the sense of the Congress that senior officials of the Department should routinely consult with the appropriate congressional committees prior to adopting any significant initiative to implement the statutory responsibilities of the Department.</text></subsection> 
<subsection id="H238F29F9CD34405394CB380265843FBC"><enum>(e)</enum><header>Significant initiative defined</header><text>As used in this section, the term <term>significant initiative</term>—</text> 
<paragraph id="H1E3EAE6DE5694634BFBEB26FEAF05D00"><enum>(1)</enum><text>means any new or largely unprecedented program, activity, or system of the Department or any significant expansion of an existing program, activity, or system, that implements any of the Department’s responsibilities under this Act or any other legally binding mandate; and</text></paragraph> 
<paragraph id="HD675565E572144BF9513C59DF12C1241"><enum>(2)</enum><text>includes any agreement, joint venture, or cooperative arrangement the Department enters into in order to carry out any aspect of the statutory mission of the Department, or to provide material assistance to any other Federal, State, or local government entity in discharging that entity’s homeland security-related responsibilities.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
