<official-title>To establish a water supply enhancement demonstration program, including the demonstration of desalination, and for other purposes.</official-title>

<section id="H49A910ADB787410AB68F0677AAD513E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Quality Water Supply Enhancement Act</quote>.</text></section> 
<section id="H5AE8D3F4E3B144218EADAEF90900D69E"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text> 
<paragraph id="HADE72E7ED69347F5BB812EF58500C2B8"><enum>(1)</enum><text>to provide for the development of economically viable advanced water supply enhancement demonstration projects, including desalination, that would—</text> 
<subparagraph id="H1FBAF492F01444BEA000B7D8E95C2723"><enum>(A)</enum><text>substantially improve access to existing water supplies; and</text></subparagraph> 
<subparagraph id="HBE4469E3FD214576941C6740748CE700"><enum>(B)</enum><text>provide access to untapped water sources;</text></subparagraph></paragraph> 
<paragraph id="HBBA92B8E55674EC4A59678C3C657B820"><enum>(2)</enum><text display-inline="yes-display-inline">to facilitate the widespread commercialization of newly developed water supply for use in real-world applications; </text></paragraph> 
<paragraph id="HB09BEBC873704ED298FEFFBCC5CA5B16"><enum>(3)</enum><text>to provide objective analyses of water supply policies; and</text></paragraph> 
<paragraph id="HB0E0BC8C86A34C20B0BF4BBD00D31EBE"><enum>(4)</enum><text>to facilitate collaboration among Federal agencies in the development of advanced water supply demonstration projects, including desalination.</text></paragraph></section> 
<section id="HEAAF6D3535984D5FA439C0CBB3D3D7FF"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H980601A11D1A4E7E91F99CBE4C71C45F"><enum>(1)</enum><header>Advisory panel</header><text>The term <term>Advisory Panel</term> means the Water Supply Advisory Panel established under <internal-xref idref="HD7E092DE9B7F44DCA8322487BD2D60F7" legis-path="5.(a)">section 5(a)</internal-xref>.</text></paragraph> 
<paragraph id="H2DABC309253840A3B2A49F39B873384D"><enum>(2)</enum><header>Regional center</header><text>The term <term>Regional Center</term> means the Regional Center referenced in the National Water Supply Technology Program White Paper, with a specific region of the nation and a specific water theme as designated under <internal-xref idref="H3E1EBA77E8E94ED5AB37CD8E27ABA8C" legis-path="6.(b)(1)">section 6(b)</internal-xref>.</text></paragraph> 
<paragraph id="H40DD76D5E43F4F6E8C68DEBFAC7701F5"><enum>(3)</enum><header>Institute</header><text>The term <term>Institute</term> means the Water Supply Policy Institute designated by <internal-xref idref="H27EED54626BF4B33867430899B96DFC9" legis-path="8.(a)">section 8(a)</internal-xref>.</text></paragraph> 
<paragraph id="H2810042B13494C9582F78947F5768BCE"><enum>(4)</enum><header>Program</header><text>The term <term>program</term> means the water supply program established under <internal-xref idref="HF3F120A7A0F44A24A9FC607297D500B6" legis-path="4.(a)">section 4(a)</internal-xref>.</text></paragraph> 
<paragraph id="H50DEC83CDF644F2200CA5EC6901606C"><enum>(5)</enum><header>Program coordinator</header><text>The term <term>Program Coordinator</term> means the lead Facility as described in the National Water Supply Technology Program White Paper.</text></paragraph> 
<paragraph id="HD94D792B3ED44CF38D38FD20E5313ECE"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="HD183A96C297540A69BB7F2FB91B3503"><enum>(7)</enum><header>Water resource agencies</header><text>Federal agencies, as identified in the Interagency Consortium, developed by the Bureau of Reclamation, for Desalination and Membrane Separation.</text></paragraph> 
<paragraph id="H1B7CE809D87F495D87A5D2C1EC31BD02"><enum>(8)</enum><header>Water supply enhancement</header> 
<subparagraph id="HB077FA84CDC94134A58D3CA9D521DD5C"><enum>(A)</enum><header>In general</header><text>The term <term>water supply enhancement</term> means a demonstration project, including desalination, designed to improve water quality or make more efficient use of existing water sources.</text></subparagraph> 
<subparagraph id="H15F19C93BCB948D8947E41D764A8E3E"><enum>(B)</enum><header>Inclusions</header><text>The term <term>water supply enhancement</term> includes demonstration projects for—</text> 
<clause id="H9F50BB57EC38446781D5D7BF24895C27"><enum>(i)</enum><text>reducing water consumption in the production or generation of energy;</text></clause> 
<clause id="H1F75002C11414104AD6F9F70AD7DDCDA"><enum>(ii)</enum><text>desalination and related concentrate disposal;</text></clause> 
<clause id="H0B28BA960AEB4E209BF3DFCD4585671"><enum>(iii)</enum><text>water reuse;</text></clause> 
<clause id="H567E8CF047594D778B4FF800007F8347"><enum>(iv)</enum><text>contaminant removal;</text></clause> 
<clause id="H528BBF59D6AB4A588E51969ED66F9C52"><enum>(v)</enum><text>agriculture, industrial, and municipal efficiency; and</text></clause> 
<clause id="HC85DB330E971487DAB981232732D8517"><enum>(vi)</enum><text>water monitoring and systems analysis.</text></clause></subparagraph></paragraph></section> 
<section id="H3E39E856C42144FB8CA2E35563C61285"><enum>4.</enum><header>Desalination and water supply enhancement demonstration program</header> 
<subsection id="HF3F120A7A0F44A24A9FC607297D500B6"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall, in coordination with the Water Resource Agencies, and the Program Coordinator, establish a desalination and advanced water supply enhancement demonstration program and fund demonstration projects for the development and commercialization of, advanced water supply demonstration projects, including desalination. The Secretary shall be responsible for coordinating the Water Resource Agencies activities authorized under this Act.</text></subsection> 
<subsection id="H071EEAF7CCA84301BFDC001892E739C4"><enum>(b)</enum><header>Program coordinator</header> 
<paragraph id="HA3EFB6E14A2942168F9620EC1EF769"><enum>(1)</enum><header>In general</header><text>The program shall be carried out by the Secretary, in coordination with the Water Resources Agencies and the Program Coordinator.</text></paragraph> 
<paragraph id="H32A01C1CE56D4418A12B395258B7D6E8"><enum>(2)</enum><header>Duties</header><text>In carrying out the program, the Program Coordinator, in consultation with the Secretary and Water Resource Agencies, shall—</text> 
<subparagraph id="H29FE292A061F4FD69DF8AAE057B46027"><enum>(A)</enum><text>construct a facility at the office of the Program Coordinator for administering the program;</text></subparagraph> 
<subparagraph id="H04FD251BE7BD43BC8B8EF1BC0D7CCC2"><enum>(B)</enum><text>establish budgetary and contracting procedures for the program;</text></subparagraph> 
<subparagraph id="H473DB47E1DDF4F05BB58ADB5EDAC9400"><enum>(C)</enum><text>perform any administrative duties relating to the program;</text></subparagraph> 
<subparagraph id="HE12DD6F7618946FCB095822F5B915D00"><enum>(D)</enum><text>administer funds under <internal-xref idref="H95B92B194D24410C9D41A739C78C499D" legis-path="7.">section 7</internal-xref>;</text></subparagraph> 
<subparagraph id="H7F0336A0D06340EFA10012BD8BA31174"><enum>(E)</enum><text>conduct peer review of water supply enhancement demonstration proposals and research results;</text></subparagraph> 
<subparagraph id="H298F07A4134D4FA585007E46638ED8F1"><enum>(F)</enum><text>create a water supply enhancement demonstration roadmap to—</text> 
<clause id="H666D03C966FE43F0B734E59B80B884E3"><enum>(i)</enum><text>identify the best water supply demonstration projects; and</text></clause> 
<clause id="H2886133A81804EB098137CDCBBA78236"><enum>(ii)</enum><text>make determinations about which water supply demonstration projects would most substantially improve the use of existing water supplies;</text></clause></subparagraph> 
<subparagraph id="HA57CDF4F90F7465F90CFD3DE5F93396B"><enum>(G)</enum><text>coordinate budgets for demonstration projects at Regional Centers;</text></subparagraph> 
<subparagraph id="H518F182328A14FFF8F303E4C499CE7B2"><enum>(H)</enum><text>coordinate research carried out under the program;</text></subparagraph> 
<subparagraph id="H7B8A0752BD7A4D3FA200C494C577C651"><enum>(I)</enum><text>perform annual evaluations of demonstration projects and the progress made by Regional Centers;</text></subparagraph> 
<subparagraph id="H583292A0498A43B08DAB057C00C0DBC0"><enum>(J)</enum><text>establish a water supply demonstration transfer program—</text> 
<clause id="H27B9285D9D5741E7BF6E00D6006BD42B"><enum>(i)</enum><text>to identify commercially promising water supply demonstration projects; and</text></clause> 
<clause id="H007EAC1AB7614EF09B13FEDCCD72FCA9"><enum>(ii)</enum><text>to facilitate prototyping of, business planning for, regulatory acceptance of, and full commercialization of promising water supply demonstration projects through—</text> 
<subclause id="HEAFB5927C58B4DB598067FA5DB11C779"><enum>(I)</enum><text>project facilities;</text></subclause> 
<subclause id="H45AE985F55F34D9BA1A40616AA6305F9"><enum>(II)</enum><text>industry consortia; and</text></subclause> 
<subclause id="HDBB1154B387D454987B73BEA2B2214EC"><enum>(III)</enum><text>collaboration with commercial financing organizations;</text></subclause></clause></subparagraph> 
<subparagraph id="H2E38357739934691AA9F48423D5E40B9"><enum>(K)</enum><text display-inline="yes-display-inline">establish procedures and criteria to periodically assess Regional Centers under <internal-xref idref="H4B4757D92D5E45C19E09A8650826A298" legis-path="6.(g)">section 6(f)(2)</internal-xref>;</text> </subparagraph> 
<subparagraph id="HA3E68B3C358F44938DC4CDEE340331C"><enum>(L)</enum><text>establish procedures for providing information to the public on the results of demonstration projects conducted under the program; and</text></subparagraph> 
<subparagraph id="H3274BEA4848D4CCD840300B31CEC001D"><enum>(M)</enum><text>implement cross-cutting research to develop sensor and monitoring systems for water and energy efficiency and management.</text></subparagraph></paragraph></subsection></section> 
<section id="HE7C55DC984034655AF70F26CD6F03757"><enum>5.</enum><header>Water supply advisory panel</header> 
<subsection id="HD7E092DE9B7F44DCA8322487BD2D60F7"><enum>(a)</enum><header>Establishment</header><text>The Program Coordinator, in consultation with the Secretary, shall establish an advisory panel, to be known as the <quote>Water Supply Advisory Panel</quote>, to advise the Program with respect to—</text> 
<paragraph id="HE879651D8CEA4A7FAAABE6FA21F78600"><enum>(1)</enum><text>the direction of the program;</text></paragraph> 
<paragraph id="H53B8A11039364DC88CEC0362DF84B807"><enum>(2)</enum><text>reviewing the performance of any demonstration project carried out using amounts made available under the program;</text></paragraph> 
<paragraph id="H9C7BEFF10AA14441A1AC1B5628E1AD6"><enum>(3)</enum><text>facilitating the commercialization of the water supply demonstration successes developed under the program; and</text></paragraph> 
<paragraph id="HFD8D8851BD4F4DA1AAB1A8B55431A000"><enum>(4)</enum><text>evaluating water policy.</text></paragraph></subsection> 
<subsection id="H598134E39DF643E79B8F3CDDA150C0AA"><enum>(b)</enum><header>Membership</header><text>The Advisory Panel shall include members, with interest and expertise in water supply demonstration projects, that represent—</text> 
<paragraph id="HFE40EC338CCD4EC28EBEED81D730AB5E"><enum>(1)</enum><text>industry;</text></paragraph> 
<paragraph id="HAFB0E3597CB44A209C4ECBE3FCB4EE0"><enum>(2)</enum><text>educational institutions;</text></paragraph> 
<paragraph id="HF4DF4F1E1F1248379BB75972801C0404"><enum>(3)</enum><text>the Federal Government;</text></paragraph> 
<paragraph id="HC0DA63BF3FFB41D28BE3EF16DAAEF3E6"><enum>(4)</enum><text>nongovernmental organizations;</text></paragraph> 
<paragraph id="H724D46DA8E5047CD9FE6869D6E7B92D2"><enum>(5)</enum><text>international water technology institutions; and</text></paragraph> 
<paragraph id="H0C89B55C70F54C608B6C00DFA23B14CA"><enum>(6)</enum><text>the Regional Centers.</text></paragraph></subsection></section> 
<section id="HC458A0B0093D47638847494EFADACEE9"><enum>6.</enum><header>Regional centers in water supply enhancement</header> 
<subsection id="H9A4FB14F25434BA2B88E1CE8EF91FC6F"><enum>(a)</enum><header>In general</header><text>A Regional Center shall partner with one or more universities from the region, that shall be eligible for funding under <internal-xref idref="HF5845AEABE0C4B2C96C03B7222B4D1BD" legis-path="7.(a)">section 7(a)</internal-xref> to conduct demonstration projects on specific advanced water supply enhancement projects.</text></subsection> 
<subsection id="HF782653F2412468B965494CEA8AF772"><enum>(b)</enum><header>Initial regional centers</header><text>The Regional Centers as identified in the National Water Supply Technology Program White Paper, shall be grouped by region and theme, including, but not limited to the following:</text> 
<paragraph id="H3E1EBA77E8E94ED5AB37CD8E27ABA8C"><enum>(1)</enum><header>Northeast region</header><text>Reducing water quality impacts from power plant outfall and decentralized water treatment.</text></paragraph> 
<paragraph id="H02A814BC22A843F30015C4BDB05F00EB"><enum>(2)</enum><header>Central atlantic region</header><text>Produced water purification and use for power production and water reuse for mega-cities.</text></paragraph> 
<paragraph id="H63727748F3144AC29B6F7F567EDFCF02"><enum>(3)</enum><header>Southeast region</header><text>Shallow aquifer conjunctive water use; energy reduction for sea water desalination and membrane demonstration project development.</text></paragraph> 
<paragraph id="H2FD7E4323A87462A9FC6997F7B38DDC6"><enum>(4)</enum><header>Midwest region</header><text>Water efficiency in manufacturing and energy reduction in wastewater treatment.</text></paragraph> 
<paragraph id="HE37FA15A6CED4AFFA1CFF4B661BBEDA5"><enum>(5)</enum><header>Central region</header><text>Cogeneration of nuclear power and water, energy systems for pumping irrigation and mining water reuse.</text></paragraph> 
<paragraph id="H5A6E382A3218431490349FEDD5A0C4E4"><enum>(6)</enum><header>West region</header><text>Conjunctive management of hydropower and water; and watershed management.</text></paragraph> 
<paragraph id="H3F1A5708237A4512A4FD93151854D18F"><enum>(7)</enum><header>Southwest region</header><text>Water for power production in arid environments; energy reduction and waste disposal for brackish desalination; high water and energy efficiency in arid agriculture; and transboundary water management.</text></paragraph> 
<paragraph id="H5769166F136349609D256B2CFC6D1C13"><enum>(8)</enum><header>Pacific region</header><text>Point of use technology to reduce water treatment and conveyance energy; co-located energy production and water treatment; and water reuse for agriculture.</text></paragraph></subsection> 
<subsection id="HD58B62A5E71442EC9EB23689C4401F6"><enum>(c)</enum><header>Selection of university partners</header><text display-inline="yes-display-inline">In consultation with the Program Coordinator and the Advisory Panel, each Regional Center, within 6 months after the date of enactment of this Act, shall select a primary university partner and may nominate additional university partners.</text></subsection> 
<subsection id="H23B19AA8101D40028D512700E68F1191"><enum>(d)</enum><header>Operational procedures</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, each Regional Center shall submit to the Program Coordinator operational procedures for such Regional Center.</text></subsection> 
<subsection id="H7A8E62837D3E4A20AB7B370001DE30A3"><enum>(e)</enum><header>Additional regional centers</header><text>Subject to approval by the Advisory Panel, the Program Coordinator may, not sooner than 5 years after the date of enactment of this Act, designate not more than 4 additional Regional Centers if the Program Coordinator determines that there are additional water supply technologies that need to be researched.</text></subsection> 
<subsection id="H59D6048139044E848CF9A9ACCDCE0007"><enum>(f)</enum><header>Period of designation</header> 
<paragraph id="H317CACB86C7C475FBD16E2CD1DDA92C9"><enum>(1)</enum><header>In general</header><text>A designation under <internal-xref idref="HF782653F2412468B965494CEA8AF772" legis-path="6.(b)">subsection (b)</internal-xref>, <internal-xref idref="HD58B62A5E71442EC9EB23689C4401F6" legis-path="6.(c)">subsection (c)</internal-xref>, or <internal-xref idref="H23B19AA8101D40028D512700E68F1191" legis-path="6.(d)">subsection (d)</internal-xref> shall be for a period of 5 years.</text></paragraph> 
<paragraph id="HAB8643FF498D4584AFE9E947A5571E65"><enum>(2)</enum><header>Assessment</header><text>A Regional Center shall be subject to periodic assessments in accordance with procedures and criteria established under <internal-xref idref="H899965B7EBD94A25A199897F9F293574" legis-path="4.(b)(2)(K)(i)">section 4(b)(2)(K)</internal-xref>.</text></paragraph> 
<paragraph id="HA7E4C84983ED41BDA135193416FE1F7F"><enum>(3)</enum><header>Renewal</header><text>After the initial period under paragraph (1), a designation may be renewed for subsequent 5-year periods in accordance with procedures and criteria established under <internal-xref idref="H2E38357739934691AA9F48423D5E40B9" legis-path="4.(b)(2)(K)">section 4(b)(2)(K)</internal-xref>.</text></paragraph> 
<paragraph id="H1A64DE0FFCDD49D8A52CE140A2676F8"><enum>(4)</enum><header>Probation, termination, or nonrenewal</header> 
<subparagraph id="H29A4E5E078EB4130AA8D91F062E9FA36"><enum>(A)</enum><header>In general</header><text>Based on a periodic assessment conducted under <internal-xref idref="HAB8643FF498D4584AFE9E947A5571E65" legis-path="6.(f)(2)">paragraph (2)</internal-xref> and after review by the Secretary and Water Resource Agencies, the Secretary may determine not to renew the designation of a Regional Center.</text></subparagraph> 
<subparagraph id="H6FA20558348F4A5D8440B869CA16B9C4"><enum>(B)</enum><header>Termination</header><text>In coordination with the Water Resources Agencies, the Secretary may terminate or choose not to renew the designation of a Regional Center.</text></subparagraph></paragraph></subsection> 
<subsection id="H4B4757D92D5E45C19E09A8650826A298"><enum>(g)</enum><header>Executive director</header><text>A Regional Center shall be administered by an executive director.</text></subsection> 
<subsection id="H0C5581EFAF9A4013B0308EED76E7C37"><enum>(h)</enum><header>Publication of research results</header><text>A Regional Center shall periodically publish the results of any research carried out under the program in appropriate peer-reviewed journals.</text></subsection></section> 
<section id="H95B92B194D24410C9D41A739C78C499D"><enum>7.</enum><header>Program funding</header> 
<subsection id="HF5845AEABE0C4B2C96C03B7222B4D1BD"><enum>(a)</enum><header>Funding to regional centers</header> 
<paragraph id="H061242E8745546968D4F32E1ACA54B78"><enum>(1)</enum><header>In general</header><text>The Program Coordinator, in coordination with the Secretary, and Water Resource Agencies, shall provide funding to the Regional Center subject to the provisions of <internal-xref idref="HDCEAB4E67F0B4F9C9F5BF834CB6BEE30" legis-path="10.(b)">section 10(b)</internal-xref> to carry out demonstration projects identified in <internal-xref idref="HF782653F2412468B965494CEA8AF772" legis-path="6.(b)">section 6(b)</internal-xref> in coordination with other Regional Centers without cost-share requirements.</text></paragraph> 
<paragraph id="H024FF36499DD4F03A58D70901F376978"><enum>(2)</enum><header>Distribution</header><text>Of the funds made available to each Regional Center, 50 percent shall be distributed to regional university partners. Funds distributed to university partners within the region shall be distributed following a plan developed and included in the Regional Center’s operational procedures developed under <internal-xref idref="H23B19AA8101D40028D512700E68F1191" legis-path="6.(d)">section 6(d)</internal-xref> without cost-share requirements.</text></paragraph></subsection> 
<subsection id="H9B2E554ECD5D4D46AD98F7494DBE9FF"><enum>(b)</enum><header>Open-call funding</header> 
<paragraph id="H571BE48206954CD49F7C97D21917974F"><enum>(1)</enum><header>In general</header><text>The Program Coordinator, in coordination with the Secretary, and Water Resource Agencies, shall provide competitive funding mechanisms to eligible institutions and individuals for water supply demonstration projects.</text></paragraph> 
<paragraph id="H61F2FCE9C0C34E9000A972F6D0C37B79"><enum>(2)</enum><header>Eligible collaborative institutions</header><text>Each of the following are eligible for funding under <internal-xref idref="H571BE48206954CD49F7C97D21917974F" legis-path="7.(b)(1)">paragraph (1)</internal-xref>:</text> 
<subparagraph id="H98AE601E53E044E3AC65174D65C95CD5"><enum>(A)</enum><text>Nongovernmental organizations.</text></subparagraph> 
<subparagraph id="HC8772150F9F3420483A0EFEA7258A91F"><enum>(B)</enum><text>Department of Energy National Laboratories.</text></subparagraph> 
<subparagraph id="HD006AE945E324531B65061A0B9CFCABE"><enum>(C)</enum><text>Private corporations.</text></subparagraph> 
<subparagraph id="H9A5FFEE43DC14EFDBCA42CA643006641"><enum>(D)</enum><text>Industry consortia.</text></subparagraph> 
<subparagraph id="HE3461574FFF242ECA45EF4DE74B3B64"><enum>(E)</enum><text>Universities or university consortia.</text></subparagraph> 
<subparagraph id="H97833A39508C420A8FC9C2349894FCED"><enum>(F)</enum><text>Any other entity with expertise in the conduct of research on water supply technologies.</text></subparagraph> 
<subparagraph id="H887B787341EB4C08B3CF00E2866E92"><enum>(G)</enum><text>International research consortia.</text></subparagraph></paragraph> 
<paragraph id="HD2D42FEA1C524AEDB878157D7ECF41B"><enum>(3)</enum><header>Distribution of funds</header><text display-inline="yes-display-inline">Of the funds allotted for the program funding, the following percentages and restrictions apply:</text> 
<subparagraph id="H832EEA78906B40E495D767F249BAE9CA"><enum>(A)</enum><header>Nongovernmental organizations</header><text>No less than 15 percent and no more than 25 percent of the total funds shall be provided as block funding to nongovernmental organizations subject to a 50 percent nonprogram cost share that then may be redistributed by the nongovernmental organization along with non-program matching funds for individual projects.</text></subparagraph> 
<subparagraph id="H93220E3AB3A74F8CA7368D2D591687FB"><enum>(B)</enum><header>National laboratories</header><text>No less than 20 percent and no more than 30 percent of the total funds shall be provided to support individual projects from Department of Energy National Laboratories without matching fund requirements.</text></subparagraph></paragraph></subsection> 
<subsection id="HF3BFD4C5D14F4F23AA83E0E2E9126C87"><enum>(c)</enum><header>Federal agencies</header><text>No less than 15 percent and no more than 25 percent of the total funds shall be provided to support individual projects that are recommended by at least one other Federal Agency that is providing at least a 50 percent funding match.</text></subsection> 
<subsection id="HFB0B289DBD3D48BCA694529785BBD5F0"><enum>(d)</enum><header>Other entities</header><text>The remainder of funds may be provided to support individual projects subject to a 25 percent nonprogram cost share.</text> </subsection> 
<subsection id="H383B5D77055C4435A4D8A6CFD6E21820"><enum>(e)</enum><header>Term of grant</header> 
<paragraph id="H58BB0FC8BCB740EAAF451315BF63A671"><enum>(1)</enum><header>In general</header><text>Except as provided in <internal-xref idref="HB8D2C618D4E847B29B5EB3B7EC53DE73" legis-path="7.(e)(2)">paragraph (2)</internal-xref>, funds provided under this section shall be for a term of 2 years.</text></paragraph> 
<paragraph id="HB8D2C618D4E847B29B5EB3B7EC53DE73"><enum>(2)</enum><header>Renewal</header><text>The Program Coordinator, in consultation with the Secretary, and Water Resource Agencies, may renew demonstration project financing for up to 2 additional years as appropriate.</text></paragraph> </subsection> 
<subsection id="HCE95A62C016A478F8B9152F6D8F068FD"><enum>(f)</enum><header>Reporting</header><text>Organizations receiving funding under this section shall report on a bi-annual basis the results and status of research projects undertaken with funds from this Act.</text></subsection> 
<subsection id="H47D6494776DD4D3FB9FBA2326CF96946"><enum>(g)</enum><header>Treatment of funds</header><text>Amounts received under funding provided to a non-Federal entity by this program shall be considered to be non-Federal funds when used as matching funds by the non-Federal entity toward a Federal cost-shared project outside this program.</text></subsection> 
<subsection id="H95383243358D43E0AD7E7D7643251C11"><enum>(h)</enum><header>Criteria</header><text>The Program Coordinator, in coordination with the Secretary, and Water Resource Agencies, shall establish criteria for the submission and review of grant applications and the provision of funds under this section.</text></subsection> 
<subsection id="HCB38F511564B4A1E995982AFA675A166"><enum>(i)</enum><header>Cost-sharing requirement</header><text>A National Laboratory that receives funding under this section shall not be subject to a cost-sharing requirement.</text></subsection></section> 
<section id="H007EA42C0042481F82C94C55C9CAC2FA"><enum>8.</enum><header>National water supply policy institute</header> 
<subsection id="H27EED54626BF4B33867430899B96DFC9"><enum>(a)</enum><header>Designation</header><text>The Utton Center at the University of New Mexico Law School is designated as the National Water Policy Institute.</text></subsection> 
<subsection id="H85DA280E5B154947B8B1AE2F3EDBE59"><enum>(b)</enum><header>Duties</header><text>The Institute shall—</text> 
<paragraph id="HA22E69E0A772426BA2886C4C14312630"><enum>(1)</enum><text>perform objective research on relevant water, regulations, and policy pertinent to this Act;</text></paragraph> 
<paragraph id="H6561EC08BFE241D995C4C8CDC00EA36"><enum>(2)</enum><text>provide policy alternatives to increase national and international water supplies;</text></paragraph> 
<paragraph id="HFCDF7DDEED0A401EAA47B784B02C6FC3"><enum>(3)</enum><text>consult with the Regional Centers, industry, municipalities, nongovernmental organizations, other participants of the program, and any other interested persons, with priority for consultation services to be given to participants in the program; and</text></paragraph> 
<paragraph id="H64DE599BF0FF482D87B3DD00A2E1A08B"><enum>(4)</enum><text>conduct an annual water policy seminar to provide information on demonstration projects carried out or funded by the Institute.</text></paragraph></subsection> 
<subsection id="H42EDB2F608E94DFC93F6BCBC49474B57"><enum>(c)</enum><header>Partnerships</header><text>The Institute may enter into partnerships with other institutions to assist in carrying out the duties of the Institute under <internal-xref idref="H85DA280E5B154947B8B1AE2F3EDBE59" legis-path="8.(b)">subsection (b)</internal-xref>.</text></subsection> 
<subsection id="HE643A4E3111E4785A5216671B1B1B08C"><enum>(d)</enum><header>Executive director</header><text>The Institute shall be administered by an executive director, subject to approval by the Program Coordinator.</text></subsection></section> 
<section id="HEA8ABD84066B45E980793D80BCA2DB86"><enum>9.</enum><header>Reports</header> 
<subsection id="H00DA26AD4618404AB1CE84393E1E5C1F"><enum>(a)</enum><header>Reports to program coordinator</header><text>Any Regional Center, or collaborative institution that receives funding under <internal-xref idref="H95B92B194D24410C9D41A739C78C499D" legis-path="7.">section 7</internal-xref> shall submit to the Program Coordinator an annual report on activities carried out using amounts made available under this Act during the preceding fiscal year.</text></subsection> 
<subsection id="HCF41A527CB0E4876BA37E356EDE9CAEC"><enum>(b)</enum><header>Report to congress</header><text>Not later than 3 fiscal years after the date of enactment of this Act and every 5 years thereafter, the Program Coordinator shall submit to the Secretary, and other Water Resource Agencies, and Congress a report that describes the activities carried out under this Act.</text></subsection></section> 
<section id="H4167BA5AF8144653871EB2FED4468C67"><enum>10.</enum><header>Authorization of appropriations</header> 
<subsection id="H06A4C6E98D864364AC45AFF86D922ED5"><enum>(a)</enum><header>In general</header><text>There are authorized to be appropriated to the Secretary, and Water Resource Agencies, for each of fiscal years 2005 through 2009—</text> 
<paragraph id="HE317DD08F743416A91BE9459002DBDD5"><enum>(1)</enum><text>for the construction of a facility under <internal-xref idref="H29FE292A061F4FD69DF8AAE057B46027" legis-path="4.(b)(2)(A)">section 4(b)(2)(A)</internal-xref>, $20,000,000;</text></paragraph> 
<paragraph id="H30ABCB99B14247A198E67454A117C7B3"><enum>(2)</enum><text>for the administration of the program by the Program Coordinator and for administration of the facility constructed under <internal-xref idref="H29FE292A061F4FD69DF8AAE057B46027" legis-path="4.(b)(2)(A)">section 4(b)(2)(A)</internal-xref>, $5,000,000; </text></paragraph> 
<paragraph id="H730B2D3F32084B4086977906C117E149"><enum>(3)</enum><text>for demonstration projects carried out under the program, $200,000,000; and</text></paragraph> 
<paragraph id="HE1AD193F2F7840F1A108C1CD6CE000BD"><enum>(4)</enum><text>for Regional Centers to administer funding and to update, maintain, and operate the facilities, as necessary, $7,500,000.</text></paragraph></subsection> 
<subsection id="HDCEAB4E67F0B4F9C9F5BF834CB6BEE30"><enum>(b)</enum><header>Allocation</header><text>Of amounts made available under subsection (a)(3) for a fiscal year—</text> 
<paragraph id="H633C7047C5084404AB8FF617F9ADCAD"><enum>(1)</enum><text>not more than the lesser of $10,000,000 or 5 percent shall be made available to each Regional Center designated by <internal-xref idref="H3E1EBA77E8E94ED5AB37CD8E27ABA8C" legis-path="6.(b)(1)">section 6(b)</internal-xref> or under <internal-xref idref="H7A8E62837D3E4A20AB7B370001DE30A3" legis-path="6.(e)">section 6(e)</internal-xref> as block funding following the funding procedures in <internal-xref idref="HF5845AEABE0C4B2C96C03B7222B4D1BD" legis-path="7.(a)">section 7(a)</internal-xref>;</text></paragraph> 
<paragraph id="H868C61679A4B4DA194CBF369E6DDE055"><enum>(2)</enum><text>not more than the lesser of $10,000,000 or 5 percent shall be made available for the Institute designated by <internal-xref idref="H27EED54626BF4B33867430899B96DFC9" legis-path="8.(a)">section 8(a)</internal-xref>;</text></paragraph> 
<paragraph id="H545F5D4570104E4E881EE008C78500F6"><enum>(3)</enum><text>at least 15 percent shall be made available for demonstration projects implemented under <internal-xref idref="H583292A0498A43B08DAB057C00C0DBC0" legis-path="4.(b)(2)(J)">section 4(b)(2)(J)</internal-xref>; and</text></paragraph> 
<paragraph id="H1FA22E092CAF42578DAF702B22DA7C6D"><enum>(4)</enum><text>at least 30 percent shall be made available for the open-call funding program described in <internal-xref idref="H9B2E554ECD5D4D46AD98F7494DBE9FF" legis-path="7.(b)">section 7(b)</internal-xref>.</text></paragraph></subsection></section>
