<legis-type>A BILL</legis-type> 
<official-title>To direct the Secretary of Homeland Security to issue regulations concerning the shipping of extremely hazardous materials.</official-title>

<section id="HA088D476139546A1A316088C449433FB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Extremely Hazardous Materials Transportation Security Act of 2004</short-title></quote>.</text></section> 
<section id="H3C6E572312A94D6D8B051FD7C795F924" section-type="subsequent-section"><enum>2.</enum><header>Rulemaking</header> 
<subsection id="HE1DFE8D44D2E45EFA099FD5CBDD5CE00"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Homeland Security, in consultation with the heads of other appropriate Federal, State, and local government entities, security experts, representatives of the hazardous materials shipping industry and labor unions representing persons who work in the hazardous materials shipping industry, and other interested persons, shall issue, after notice and opportunity for public comment, regulations concerning the shipping of extremely hazardous materials.</text></subsection> 
<subsection id="H56E7B2592AA2437D87A3C8FEDAD3800"><enum>(b)</enum><header>Purposes of Regulations</header><text>The regulations shall be consistent, to the extent the Secretary determines appropriate, with and not duplicative of other Federal regulations and international agreements relating to the shipping of extremely hazardous materials and shall require—</text> 
<paragraph id="H7639B1F531EB454A89F66EBCC418905B"><enum>(1)</enum><text display-inline="yes-display-inline">physical security measures for such shipments, such as the use of passive secondary containment of tanker valves, additional security force personnel, and surveillance technologies and barriers;</text></paragraph> 
<paragraph id="HC7C3A09C2F4046328B6C849DE8952972"><enum>(2)</enum><text>concerned Federal, State, and local law enforcement authorities (including, if applicable, transit, railroad, or port authority police agencies) to be informed before an extremely hazardous material is transported within, through, or near an area of concern;</text></paragraph> 
<paragraph id="HFEA9834BB26B4EF982D60377928B8900"><enum>(3)</enum><text>coordination with Federal, State, and local law enforcement authorities to create response plans for a terrorist attack on a shipment of extremely hazardous materials;</text></paragraph> 
<paragraph id="H97C6C669328B4F059FAFF96D77FF90D"><enum>(4)</enum><text display-inline="yes-display-inline">the use of currently available technologies and systems to ensure effective and immediate communication between transporters of extremely hazardous materials, law enforcement authorities and first responders;</text></paragraph> 
<paragraph id="HD1EE1F535EA04B49AC4DE12CBDC68235"><enum>(5)</enum><text display-inline="yes-display-inline">comprehensive and appropriate training in the area of extremely hazardous materials transportation security for all individuals who transport, load, unload, or are otherwise involved in the shipping of extremely hazardous materials or who would respond to an accident or incident involving a shipment of extremely hazardous material or would have to repair transportation equipment and facilities in the event of such an accident or incident; and</text></paragraph> 
<paragraph id="HF359F0CD772F4FD79186C6CE4F0067EB" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">for the transportation of extremely hazardous materials through or near an area of concern, the Secretary to determine whether or not the transportation could be made by one or more alternate routes at lower security risk and, if the Secretary determines the transportation could be made by an alternate route, the use of such alternate route, except when the origination or destination of the shipment is located within the area of concern.</text></paragraph></subsection> 
<subsection id="H975DD2EA582E4A80941E69FF57B8602F" display-inline="no-display-inline"><enum>(c)</enum><header>Judicial relief</header><text>A person (other than an individual) who transports, loads, unloads, or is otherwise involved in the shipping of hazardous materials and violates or fails to comply with a regulation issued by the Secretary under this section may be subject, in a civil action brought in United States district court, for each shipment with respect to which the violation occurs—</text> 
<paragraph id="H879704C824584976917830A9F465ECF4"><enum>(1)</enum><text>to an order for injunctive relief; or</text></paragraph> 
<paragraph id="HCCF022D1BAFB4540B67D000082057BC1"><enum>(2)</enum><text>to a civil penalty of not more than $100,000.</text></paragraph></subsection> 
<subsection id="H198CC5B531F64685BBFF4FDF61EF8059"><enum>(d)</enum><header>Administrative penalties</header> 
<paragraph id="HDCEB471B4B3D4BBEAA5C4D881FE94999"><enum>(1)</enum><header>Penalty orders</header><text display-inline="yes-display-inline">The Secretary may issue an order imposing an administrative penalty of not more than $1,000,000 for failure by a person (other than an individual) who transports, loads, unloads, or is otherwise involved in the shipping of hazardous materials to comply with a regulation issued by the Secretary under this section.</text></paragraph> 
<paragraph id="HEA6ECF967F8F4058ACD74A5ED01E9B7"><enum>(2)</enum><header>Notice and hearing</header><text>Before issuing an order described in paragraph (1), the Secretary shall provide to the person against whom the penalty is to be assessed—</text> 
<subparagraph id="HAD912123D67941528675325ED120029"><enum>(A)</enum><text>written notice of the proposed order; and</text></subparagraph> 
<subparagraph id="HD5EFD8FC7303462392D07C79023E6319"><enum>(B)</enum><text>the opportunity to request, not later than 30 days after the date on which the person receives the notice, a hearing on the proposed order.</text></subparagraph></paragraph> 
<paragraph id="H4C0230B19DA7494DA9FBBE66D2D2E4D"><enum>(3)</enum><header>Procedures</header><text display-inline="yes-display-inline">The Secretary may issue regulations establishing procedures for administrative hearings and appropriate review of penalties issued under this subsection, including necessary deadlines. </text></paragraph></subsection> </section> 
<section id="H4A14DC61FEEB4FEBBE8E00A7A7D72DF"><enum>3.</enum><header>Whistleblower protection</header> 
<subsection id="HC487C575BC4C4030A7C5E484AAA6A485"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No person involved in the shippping of extremely hazardous materials may be discharged, demoted, suspended, threatened, harassed, or in any other manner discriminated against because of any lawful act done by the person—</text> 
<paragraph id="H039F98F1E6F640949F4C6B3904409F48"><enum>(1)</enum><text> to provide information, cause information to be provided, or otherwise assist in an investigation regarding any conduct which the person reasonably believes constitutes a violation of any law, rule or regulation related to the security of shipments of extremely hazardous materials, or any other threat to the security of shipments of extremely hazardous materials, when the information or assistance is provided to or the investigation is conducted by—</text> 
<subparagraph id="H488FCE0D77054511003B4CE2CECB095F"><enum>(A)</enum><text display-inline="yes-display-inline">a Federal regulatory or law enforcement agency;</text></subparagraph> 
<subparagraph id="HB8A63D40948A423086968784DF636827"><enum>(B)</enum><text>any Member of Congress or any committee of Congress; or</text></subparagraph> 
<subparagraph id="HEFAE3D4419F44496B37409F4FB2C0046"><enum>(C)</enum><text>a person with supervisory authority over the person (or such other person who has the authority to investigate, discover, or terminate misconduct);</text></subparagraph></paragraph> 
<paragraph id="H822AF6CE60F74F84B760B592243DA884"><enum>(2)</enum><text display-inline="yes-display-inline">to file, cause to be filed, testify, participate in, or otherwise assist in a proceeding or action filed or about to be filed relating to a violation of any law, rule or regulation related to the security of shipments of extremely hazardous materials or any other threat to the security of shipments of extremely hazardous materials; or</text></paragraph> 
<paragraph id="H4E271067A9FD40ADAB8DEB8D9C922396"><enum>(3)</enum><text>to refuse to violate or assist in the violation of any law, rule, or regulation related to the security of shipments of extremely hazardous materials.</text></paragraph></subsection> 
<subsection id="H75A4E3DF220D4E79A2E447D7D686D9B"><enum>(b)</enum><header>Enforcement action</header> 
<paragraph id="HE7F2611EF5D94621B0384C1900007190"><enum>(1) </enum><header>In general</header><text>A person who alleges discharge or other discrimination by any person in violation of subsection (a) may seek relief under subsection (c), by—</text> 
<subparagraph id="H5B80247E8E65424CBF7C726199A701E8"><enum>(A)</enum><text>filing a complaint with the Secretary of Labor; or</text></subparagraph> 
<subparagraph id="H29AF59BCF1314FD484CC8419B4447DCE"><enum>(B)</enum><text>if the Secretary has not issued a final decision within 180 days of the filing of the complaint and there is no showing that such delay is due to the bad faith of the claimant, bringing an action at law or equity for de novo review in the appropriate district court of the United States, which shall have jurisdiction over such an action without regard to the amount in controversy.</text></subparagraph></paragraph> 
<paragraph id="H1D9756A0F873404582496DDEF0DD3186"><enum>(2)</enum><header>Procedure</header> 
<subparagraph id="H6BB02C57B30F4EC584222D5F405CDA"><enum>(A)</enum><header>In general</header><text> An action under paragraph (1)(A) shall be governed under the rules and procedures set forth in <external-xref legal-doc="usc" parsable-cite="usc/49/42121">section 42121(b)</external-xref> of title 49, United States Code.</text></subparagraph> 
<subparagraph id="H89A90E39C5B54896AC4E784BD8C1E114"><enum>(B)</enum><header>Exception</header><text>Notification made under <external-xref legal-doc="usc" parsable-cite="usc/49/42121">section 42121(b)(1)</external-xref> of title 49, United States Code, shall be made to the person named in the complaint and to the person's employer.</text></subparagraph> 
<subparagraph id="H7597DDBE5B984F6FA07D083C7D004733"><enum>(C)</enum><header>Burdens of proof</header><text>An action brought under paragraph (1)(B) shall be governed by the legal burdens of proof set forth in <external-xref legal-doc="usc" parsable-cite="usc/49/42121">section 42121(b)</external-xref> of title 49, United States Code.</text></subparagraph> 
<subparagraph id="HCE75D67544CA454196E1579F72FD88C0"><enum>(D)</enum><header>Statute of limitations</header><text>An action under paragraph (1) shall be commenced not later than 90 days after the date on which the violation occurs.</text></subparagraph></paragraph></subsection> 
<subsection id="H7EFB2F0A0DD64689ABAB3901D93B3C57"><enum>(c)</enum><header>Remedies</header> 
<paragraph id="HBFDCFBB033724205957C08A56FECE8F"><enum>(1)</enum><header>In general</header><text>A person prevailing in any action under subsection (b)(1) shall be entitled to all relief necessary to make the person whole.</text></paragraph> 
<paragraph id="H0EA04CE3B5FA4DF5B438488C4EB1ABE2"><enum>(2)</enum><header>Compensatory damages</header><text>Relief for any action under paragraph (1) shall include—</text> 
<subparagraph id="H6C626D89FA8A4C25B10355960200E7DB"><enum>(A)</enum><text> reinstatement with the same seniority status that the person would have had, but for the discrimination;</text></subparagraph> 
<subparagraph id="HE98E76C720774CEEB39674D968A3E3FB"><enum>(B)</enum><text> the amount of any back pay, with interest; and</text></subparagraph> 
<subparagraph id="HC0E3A0041DC74F5492BC5F529A852D8"><enum>(C)</enum><text>compensation for any special damages sustained as a result of the discrimination, including litigation costs, expert witness fees, and reasonable attorney fees.</text></subparagraph></paragraph></subsection> 
<subsection id="HA725F31A3F764D8ABA7B27688EC75EBA"><enum>(d)</enum><header>Rights retained by person</header><text>Nothing in this section shall be deemed to diminish the rights, privileges, or remedies of any person under any Federal or State law, or under any collective bargaining agreement.</text></subsection></section> 
<section id="H3CF93333922646229395B5C3CBA37821"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions apply:</text> 
<paragraph id="H6D8D4055B39243F78860E1BA89FBFF2F"><enum>(1)</enum><header>Extremely hazardous material</header><text display-inline="yes-display-inline">The term <quote>extremely hazardous material</quote> means—</text> 
<subparagraph id="HC1B8169687394F62A808970202111323"><enum>(A)</enum><text display-inline="yes-display-inline">a material that is toxic by inhalation;</text></subparagraph> 
<subparagraph id="HC92858092CE94704A417A0ECEC642C00"><enum>(B)</enum><text>a material that is extremely flammable;</text></subparagraph> 
<subparagraph id="HAA80FE9D4B144189A7BAD29CD5E80031"><enum>(C)</enum><text>a material that is highly explosive; and</text></subparagraph> 
<subparagraph id="HD66EAE4F509A40AF8CFF4323BCE3417"><enum>(D)</enum><text>any other material designated by the Secretary to be extremely hazardous.</text></subparagraph> </paragraph> 
<paragraph id="H169D8C0A1219445A98382B76DF1CD9A3"><enum>(2)</enum><header>Area of concern</header><text display-inline="yes-display-inline">The term <quote>area of concern</quote> means an area that the Secretary determines could pose a particular interest to terrorists.</text></paragraph></section>
