<official-title>To provide funding for the operations and maintenance by the Corps of Engineers of essential waterways.</official-title>

<section id="H89444101C4B74E3CAA11AEE535D9306B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Essential Waterways Operations and Maintenance Act of 2004</short-title></quote>.</text></section> 
<section id="HA094F3C4C637421892F006FB1D842BEB"><enum>2.</enum><header>Essential waterways operations and maintenance</header> 
<subsection id="HC41010C0D8094815ACA07926EDBDD3FB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For each fiscal year, there shall be available to the Secretary of the Army, acting through the Chief of Engineers, for operations and maintenance of essential waterways 5 percent of the amount of duties collected during the preceding fiscal year on articles transported by vessel unladen for purposes of entering the customs territory of the United States.</text></subsection> 
<subsection id="HCF35BAB3059842EC9FED69868300A443"><enum>(b)</enum><header>Selection criteria for essential waterways</header><text display-inline="yes-display-inline">For purposes of this section, an essential waterway is a waterway that— </text> 
<paragraph id="H7E304C112CC5426AB1CEA7ABC2529BFF"><enum>(1)</enum><text> the Secretary of the Army determines provides service to one of the 25 highest ranked United States ports in terms of total tonnage of cargo transported through the port; </text></paragraph> 
<paragraph id="H030286A696324517B43FBDDD69939BDE"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary of Energy, in consultation with the Secretary of Homeland Security, determines is a critical component of the United States energy infrastructure; and</text></paragraph> 
<paragraph id="H15E26EE6B15C423595551243C7D074ED"><enum>(3)(A)</enum><text>the Secretary of Homeland Security determines provides service to at least one militarily and economically strategic port; or</text></paragraph> 
<paragraph id="H72048D4224DB4EB381002307D365AC37"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Transportation determines provides service to at least one commercially strategic port.</text></paragraph></subsection>
<subsection id="H4E1C293984654D22978603AA079F05"><enum>(c)</enum><header>Maintenance of Effort</header><text>Amounts made available to the Secretary of the Army pursuant to subsection (a) are in addition to amounts otherwise made available to the Secretary for operations and maintenance. </text></subsection> 
<subsection id="H97567802543E4CEFB851ADF372456483"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section, the following terms apply:</text> 
<paragraph id="H5A425097FAC6478DB7C02388F939E7BB"><enum>(1)</enum><header>Customs territory of the united states</header><text>The term <quote>customs territory of the United States</quote> has the meaning given that term in general note 2 of the Harmonized Tariff Schedule of the United States. </text></paragraph> 
<paragraph id="H5C7CCE591EAA4DBE965DA464806703BE"><enum>(2)</enum><header>Vessel</header><text>The term <quote>vessel</quote> has the meaning given that term in section 401 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1401">19 U.S.C. 1401</external-xref>).</text></paragraph></subsection></section>
