<official-title>To require the United States Trade Representative to pursue a complaint of anti-competitive practices against certain oil exporting countries.</official-title>

<section section-type="section-one" id="H4C601088E85542B4934852984CCCB84E" display-inline="no-display-inline"><enum>1.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> 
<paragraph id="H9E626BCA55A948529B02A93FF0C24FCA"><enum>(1)</enum><text>Gasoline prices have risen 80 percent since January, 2002, with oil recently trading at more than $40 per barrel for the first time ever.</text></paragraph> 
<paragraph id="H1A1A052692084776BDD9601CBBFE74D7"><enum>(2)</enum><text>Rising gasoline prices have placed an inordinate burden on American families.</text></paragraph> 
<paragraph id="H4348056A4840408A00B8275307BCCE4D"><enum>(3)</enum><text>High gasoline prices have hindered and will continue to hinder economic recovery.</text></paragraph> 
<paragraph id="HE1DAAD6A2D7C40AEBBDE466D39B28DE"><enum>(4)</enum><text>The Organization of Petroleum Exporting Countries (OPEC) has formed a cartel and engaged in anti-competitive practices to manipulate the price of oil, keeping it artificially high.</text></paragraph> 
<paragraph id="H04D750246E8E45B0943626CB991160FB"><enum>(5)</enum><text>Six member nations of OPEC—Indonesia, Kuwait, Nigeria, Qatar, the United Arab Emirates and Venezuela—are also members of the World Trade Organization.</text></paragraph> 
<paragraph id="HAC4CE20FA5964BB394F7A2FE4FD45649"><enum>(6)</enum><text>The agreement among OPEC member nations to limit oil exports is an illegal prohibition or restriction on the exportation or sale for export of a product under Article XI of the GATT 1994.</text></paragraph> 
<paragraph id="H6B8438320C2A4F62A915A9E56399AFAE"><enum>(7)</enum><text>The export quotas and resulting high prices harm American families, undermine the American economy, impede American and foreign commerce, and are contrary to the national interests of the United States.</text></paragraph></section> 
<section id="H93A351AA357D460A85572B7C8FEB206B"><enum>2.</enum><header>Actions to curb certain cartel anti-competitive practices</header> 
<subsection id="H1FADE57FC7E148FBBC44A816627839FA"><enum>(a)</enum><header>Definitions</header> 
<paragraph id="H5E548BBA363C4F048611158B12DA62AB"><enum>(1)</enum><header>Gatt 1994</header><text>The term <term>GATT 1994</term> has the meaning given such term in section 2(1)(B) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3501">19 U.S.C. 3501(1)(B)</external-xref>.</text></paragraph> 
<paragraph id="HB16B3CF9515B4FF0B5E6A13800F4645E"><enum>(2)</enum><header>Understanding on Rules and Procedures Governing the Settlement of Disputes</header><text>The term <term>Understanding on Rules and Procedures Governing the Settlement of Disputes</term> means the agreement described in section 101(d)(16) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(16)</external-xref>).</text></paragraph> 
<paragraph id="HCBF09E9FCD034441B591B01834268E4"><enum>(3)</enum><header>World Trade Organization</header> 
<subparagraph id="H108417236C0C427D83112E8198E05100"><enum>(A)</enum><header>In general</header><text>The term <term>World Trade Organization</term> means the organization established pursuant to the WTO Agreement.</text></subparagraph> 
<subparagraph id="H1DA76237CE7A43388E1D126824C7B97"><enum>(B)</enum><header>WTO agreement</header><text>The term <term>WTO Agreement</term> means the Agreement Establishing The World Trade Organization entered into on April 15, 1994.</text></subparagraph></paragraph></subsection> 
<subsection id="HA4E9559995BF4679B5011B8772D9CA75"><enum>(b)</enum><header>Action by President</header> 
<paragraph id="HDBCAC6727156445699A303C1F93CD323"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, the President shall, not later than 15 days after the date of enactment of this Act, initiate consultations with the countries described in paragraph (2) to seek the elimination by those countries of any action that—</text> 
<subparagraph id="H3292D63FD71144D397555B511B5B5948"><enum>(A)</enum><text>limits the production or distribution of oil, natural gas, or any other petroleum product,</text></subparagraph> 
<subparagraph id="H401EB4A846DE4FE7846523E584C3F067"><enum>(B)</enum><text>sets or maintains the price of oil, natural gas, or any petroleum product, or</text></subparagraph> 
<subparagraph id="H07AEC1AD768341A4BCA5F0B48FD156A7"><enum>(C)</enum><text>otherwise is an action in restraint of trade with respect to oil, natural gas, or any petroleum product,</text></subparagraph><continuation-text continuation-text-level="paragraph">when such action constitutes an act, policy, or practice that is unjustifiable and burdens and restricts United States commerce.</continuation-text></paragraph> 
<paragraph id="H76722D93B83C4800BD539B4162F1BEF0"><enum>(2)</enum><header>Countries described</header><text>The countries described in this paragraph are the following:</text> 
<subparagraph id="H72C9FF3B9A73400F8B62309406008BDE"><enum>(A)</enum><text>Indonesia.</text></subparagraph> 
<subparagraph id="HAFF65327A70847BA86958626C26FDB00"><enum>(B)</enum><text>Kuwait.</text></subparagraph>

<subparagraph id="H6AA687D3AF244CDFA1374275B6A6D7A8"><enum>(D)</enum><text>Qatar.</text></subparagraph> 
<subparagraph id="H92C460F7F3134C1B8E2D3D99CCED2329"><enum>(E)</enum><text>The United Arab Emirates.</text></subparagraph> 
<subparagraph id="HE9D3D9344D0549BEBDC69FE8C6210009"><enum>(F)</enum><text>Venezuela.</text></subparagraph></paragraph></subsection> 
<subsection id="H45E577C1DD944157B23D923487FF1CD2"><enum>(c)</enum><header>Initiation of WTO dispute proceedings</header><text>If the consultations described in subsection (b) are not successful with respect to any country described in subsection (b)(2), the United States Trade Representative shall, not later than 60 days after the date of enactment of this Act, institute proceedings pursuant to the Understanding on Rules and Procedures Governing the Settlement of Disputes with respect to that country and shall take appropriate action with respect to that country under the trade remedy laws of the United States.</text></subsection></section>
