<official-title>To extend the terrorism risk insurance program.</official-title>

<section id="H59B95AA3972D410A9ED543878E410115" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Terrorism Risk Insurance Program Extension Act of 2004</short-title></quote>.</text></section> 
<section id="H76421133141E44FFBA4948F32BD8A6CE"><enum>2.</enum><header>Program years</header><text display-inline="no-display-inline">Paragraph (11) of section 102 of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended by adding at the end the following new subparagraphs:</text> 
<quoted-block style="OLC" id="H6F1EA2A6EB834D848716C5AC555900BA" display-inline="no-display-inline"> 
<subparagraph id="H77044B583B254FE7A25DEC003BFDDA5B"><enum>(E)</enum><header>Program year 4</header><text>The term <term>Program Year 4</term> means the period beginning on January 1, 2006 and ending on December 31, 2006.</text></subparagraph> 
<subparagraph id="H185DCE9EE4144909B888F334BE89BBC2"><enum>(F)</enum><header>Program year 5</header><text>The term <term>Program Year 5</term> means the period beginning on January 1, 2007 and ending on December 31, 2007.</text></subparagraph> 
<subparagraph id="H66D8CA43C50244A4BE00B6D7E5E337E"><enum>(G)</enum><header>Final program year</header><text>The term <term>Final Program Year</term> means the period beginning on January, 1, 2008 and ending on December 31, 2008.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HD2678BED361E45D8A7BD8DC953F6E400"><enum>3.</enum><header>Applicability of program to final program year</header><text display-inline="no-display-inline">Paragraph (5) of section 102 of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended—</text> 
<paragraph id="H458E17550F8E416A85F7346487AFBCC7"><enum>(1)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii) and realigning such paragraphs, as so redesignated, so as to be indented 6 ems from the left margin;</text></paragraph> 
<paragraph id="HDF95CA0AB5EC470EA33E5E1005F56D7E"><enum>(2)</enum><text>by striking all of the matter that precedes subparagraph (A) and inserting the following:</text>

<paragraph id="H86DDC6FE89A4421DA7C659DB10202C25"><enum>(5)</enum><header>Insured loss</header> 
<subparagraph id="HC810E222FCDD4D8FBECD2CCE6788B906"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>insured loss</term> means any loss resulting from an act of terrorism (including an act of war, in the case of workers' compensation) that is covered by primary or excess property and casualty insurance issued by an insurer if such loss—</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H2C11448C92FE4BA682264E72743CAA"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HF419A0D622AC41E99F1275E071911927"> 
<subparagraph id="H241128BAE8294DAE9EBA57E479B2009C"><enum>(B)</enum><header>Final program year</header><text>With respect to the Final Program Year, such term means only such losses as are described in subparagraph (A) that are covered by primary or excess property and casualty insurance that—</text> 
<clause id="H51159CB3E35E49A4B48FADF745189762"><enum>(i)</enum><text>is issued before January 1, 2008; and</text></clause> 
<clause id="H417BC603A6B7485088B77D4085C7C9F9"><enum>(ii)</enum><text>expires not later than December 31, 2008.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HAEBF42C0211D4EE6AA520799A33B22F6"><enum>4.</enum><header>Insurer deductible</header><text display-inline="no-display-inline">Paragraph (7) of section 102 of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended—</text> 
<paragraph id="H501B27722EBC491FBEDACB6372EB7E94"><enum>(1)</enum><text>by striking subparagraph (D) and inserting the following new subparagraph:</text> 
<quoted-block style="OLC" id="H36294C4A8B1C430800D935490068BFCB" display-inline="no-display-inline"> 
<subparagraph id="H17A9256B582340819D51AD2B403B41AF"><enum>(D)</enum><text display-inline="yes-display-inline">for Program Years 3, 4, and 5, the value of an insurer’s direct earned premiums over the calendar year immediately preceding such Program Year, multiplied by 15 percent;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H1ACBD72C58504E38837C45FC943EC8A6"><enum>(2)</enum><text>in subparagraph (E)—</text> 
<subparagraph id="H4AE62995317344F1B35F228CE1E10996"><enum>(A)</enum><text>by striking <quote>or Program Year 3</quote> and inserting <quote>Program Year 3, Program Year 4, or Program Year 5</quote>; and</text></subparagraph> 
<subparagraph id="H79B340233F5E4E9186D9E6009CD518D5"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HFAC2C4EFC4284CF283E1A1D57AF2090"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="HA332A1F6F06A4238B102FEFF1C72C818"><enum>(F)</enum><text display-inline="yes-display-inline">for the Final Program Year, the value of an insurer's direct earned premiums for the terms remaining under any policies for insurance described in paragraph (5)(B) as of the occurrence of the act of terrorism during such Year that results in insured losses, as determined by the Secretary, multiplied by 15 percent.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H20753009D90849BCBF48FF53C9899EA3"><enum>5.</enum><header>Mandatory availability</header><text display-inline="no-display-inline">Subsection (c) of section 103 of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended—</text> 
<paragraph id="H50E11B52224B480AAD40B16B64823418" display-inline="no-display-inline"><enum>(1)</enum><text>by striking all of the matter that precedes subparagraph (A) of paragraph (1) and inserting the following:</text>

<subsection id="H0EEA6A64633B48C18C61E67EEBAAFD0"><enum>(c)</enum><header>Mandatory availability</header><text>During the period beginning on the first day of the Transition Period and ending on the last day of Program Year 5, each entity that meets the definition of an insurer under section 102—</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HE9FC10AC03304B7C92AB43ACC001643"><enum>(2)</enum><text>by striking paragraph (2); and</text></paragraph> 
<paragraph id="H471446F3FFC04DEEAACE773896D1D915"><enum>(3)</enum><text>by redesignating subparagraphs (A) and (B) as paragraphs (1) and (2) and realigning such paragraphs, as so redesignated, so as to be indented 2 ems from the left margin.</text></paragraph></section> 
<section id="H0366A87E5A414E478F81A2D441D4C936"><enum>6.</enum><header>Insured loss shared compensation</header><text display-inline="no-display-inline">Subsection (e) of section 103 of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended—</text> 
<paragraph id="H09B8E20108574ED0932DF50016D4143D"><enum>(1)</enum><text>in paragraph (2)(A), by striking <quote>or Program Year 3</quote> and inserting <quote>, Program Year 3, Program Year 4, Program Year 5, or the Final Program Year</quote>;</text></paragraph> 
<paragraph id="HFA8AE0658DBB496BB8571DF294786DB3"><enum>(2)</enum><text>in paragraph (3), by striking <quote>or Program Year 3</quote> and inserting <quote>, Program Year 3, Program Year 4, Program Year 5, or the Final Program Year</quote>; and</text></paragraph> 
<paragraph id="H7E24E1A1E1C5434D99FB32127F00D1B5"><enum>(3)</enum><text>in paragraph (6)(C), by striking <quote>Program Year 3</quote> and inserting <quote>each of Program Year 3, Program Year 4, Program Year 5, and the Final Program Year</quote>.</text></paragraph></section> 
<section id="H220648BD85254175BCB1ACF152ECEB02"><enum>7.</enum><header>Coverage of group life insurance</header> 
<subsection id="HAC1DC059E326494BB81E2E2FF68F5400"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Section 102(5) of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended in the matter that precedes subparagraph (A) by inserting <quote>or group life insurance</quote> after <quote>property and casualty insurance</quote>. </text></subsection> 
<subsection id="H968983CCD0C04ADF987DDD1EFC6300B"><enum>(b)</enum><header>Technical and Conforming Amendments</header><text display-inline="yes-display-inline">The Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended— </text> 
<paragraph id="H3E354407C05147DDAFA40058F005D4EF"><enum>(1)</enum><text display-inline="yes-display-inline">in section 102(1)(B)(ii), by inserting <quote>and group life insurance</quote> after <quote>property and casualty insurance</quote>;</text></paragraph> 
<paragraph id="H99A34CB349FF451FA2515FE8238835F6"><enum>(2)</enum><text display-inline="yes-display-inline">in section102(4), by inserting <quote>or group life insurance</quote> after <quote>property and casualty insurance</quote>;</text></paragraph> 
<paragraph id="HE7D4B1BDD2E844C588DBE899F22FE18C"><enum>(3)</enum><text display-inline="yes-display-inline">in section 102(6)(B), by inserting <quote>or group life insurance coverage</quote> after <quote>property and casualty insurance coverage</quote>;</text></paragraph> 
<paragraph id="H3B9554A1E6D24D3AA65DD8C13603F272"><enum>(4)</enum><text>in section 102(12)(B)(v), by striking <quote>including group life insurance</quote> and inserting <quote>(except that this exclusion from the definition under this paragraph shall not be construed as affecting the inclusion of group life insurance coverage within the Program under this title)</quote>;</text></paragraph> 
<paragraph id="HAAB66ED8E13E40B2BCD8B9911CD607A2"><enum>(5)</enum><text display-inline="yes-display-inline">in section 103(e)(8)(A)(i), by inserting <quote>and group life insurance policies</quote> after <quote>property and casualty insurance policies</quote>;</text></paragraph> 
<paragraph id="H50D95762CFF1460FB6E47D5970D60036"><enum>(6)</enum><text display-inline="yes-display-inline">in subparagraphs (A)(iii) and (C) of section 103(e)(8), by inserting <quote>, or group life insurance coverage, as the case may be,</quote> after <quote>property and casualty insurance coverage</quote>;</text></paragraph> 
<paragraph id="H8465A4E170C049B49B46E94DEB37F98C"><enum>(7)</enum><text>in section 103—</text> 
<subparagraph id="HCC9CD148973E46DAA12E01C8D8A046A5"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subsection (h); and</text></subparagraph> 
<subparagraph id="HB3DC5B434A6A4EF5812BEB8C661B4975"><enum>(B)</enum><text>by redesignating subsection (i) as subsection (h); and</text></subparagraph></paragraph> 
<paragraph id="HE5E48A6D091F43EB8D54339F6585E8C7"><enum>(8)</enum><text>in paragraph (1) of section 108(d), by inserting <quote>and the group life insurance industry</quote> after <quote>property and casualty insurance industry</quote> .</text></paragraph></subsection></section> 
<section id="HDC24315F86E94FC49FD359C8C2AFD9C0"><enum>8.</enum><header>Termination of program</header><text display-inline="no-display-inline">Section 108 of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended—</text> 
<paragraph id="H12941D7BF3FD4B99A0F4BE973DFFD1F0"><enum>(1)</enum><text>in subsection (a), striking <quote>December 31, 2005</quote> and inserting <quote>December 31, 2008</quote>; and</text></paragraph> 
<paragraph id="HBBACEB77FF0E4C6AB6A8FDC0921B64B5"><enum>(2)</enum><text> in subsection (d), by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="H10ED5D5194BD41FCB6A0937D12D87567" display-inline="no-display-inline"> 
<paragraph id="H1726EEA23D4C4641B99372C7EE07AF25"><enum>(3)</enum><header>Final gao study and report</header><text>The Comptroller General of the United States shall conduct an assessment of the matters referred to in paragraph (1) and shall submit a report to the Congress, not later than June 30, 2007, on the results of such study.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
