<official-title>To amend title 38, United States Code, to authorize the Secretary of Veterans Affairs to enter into certain major medical facility leases, to authorize that Secretary to transfer real property subject to certain limitations, and for other purposes.</official-title>

<section section-type="section-one" id="HDF8AFE1846444943BD26E3E6A5192B2B" display-inline="no-display-inline"><enum>1.</enum><header>Short title; references to title 38, United States Code</header> 
<subsection id="HDB38F264E89C46C8A4219BD64262BD35"><enum>(a)</enum><header>Short title</header><text>This Act may be cited as the <quote><short-title>Veterans Medical Facilities Management Act of 2004</short-title></quote>.</text></subsection> 
<subsection id="H492AFC87AC7E45DBBDA83E9E11366399"><enum>(b)</enum><header>References to title 38, United States Code</header><text>Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of title 38, United States Code.</text></subsection></section> 
<section id="HAAD5FF1F0E17416181861BE44F2F9095" display-inline="no-display-inline"><enum>2.</enum><header>Major medical facility leases</header> 
<subsection id="HDE0F68C11EAC4B18B3EE54A995611415"><enum>(a)</enum><header>Authorized leases</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs may enter into contracts for major medical facility leases at the following locations, in an amount for each facility lease not to exceed the amount shown for that location:</text> 
<paragraph id="H25FF1F1E5D954AF488AE00BADBB0180"><enum>(1)</enum><text display-inline="yes-display-inline">Wilmington, North Carolina, Outpatient Clinic, $1,320,000.</text></paragraph>

<subsection id="H558619F68735425EBDB03C9085D26032"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary of Veterans Affairs for fiscal year 2005 for the Medical Care account, $24,420,000 for the leases authorized in subsection (a).</text></subsection> 
<subsection id="H2DE2C2B7613D43FD85F4DB7EEA8021B" display-inline="no-display-inline"><enum>(c)</enum><header>Authority for lease of certain lands of University of Colorado</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/38/8103">section 8103</external-xref> of title 38, United States Code, the Secretary of Veterans Affairs may enter into a lease for real property located at the Fitzsimons Campus of the University of Colorado for a period up to 75 years.</text> </subsection></section> 
<section id="H1F8C6BDECB9543F49597E263931D4F91"><enum>3.</enum><header>Department of Veterans Affairs Capital Asset Fund</header> 
<subsection id="HDB5204D8DA82425293EF1F6DB2681FF2"><enum>(a)</enum><header>Establishment of fund</header> 
<paragraph id="H1B4E778F6D204277003608C9EF9CADFC" display-inline="yes-display-inline"><enum>(1)</enum><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/81">chapter 81</external-xref> is amended by adding at the end the following new section:</text>

<section id="H7FF953C456E943939100007FF3F59814"><enum>8117.</enum><header>Authority for transfer of real property; Capital Asset Fund </header> 
<subsection id="HCFCFF8C0613B47EFABE6F912AE8D2593"><enum>(a)</enum> 
<paragraph id="H3ABEDDD2ACBF42C1A6E68D5FF1766200" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary may transfer real property under the jurisdiction or control of the Secretary (including structures and equipment associated therewith) to another department or agency of the United States or to a State (or a political subdivision of a State) or to any public or private entity, including an Indian tribe. Such a transfer may be made only if the Secretary receives compensation of not less than the fair market value of the property, except that no compensation is required, or compensation at less than fair market value may be accepted, in the case of a transfer to a grant and per diem provider (as defined in <external-xref legal-doc="usc" parsable-cite="usc/38/2002">section 2002</external-xref> of this title). When a transfer is made to a grant and per diem provider for less than fair market value, the Secretary shall require in the terms of the conveyance that if the property transferred is used for any purpose other than a purpose under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/20">chapter 20</external-xref> of this title, all right, title, and interest to the property shall revert to the United States.</text></paragraph> 
<paragraph id="HA4990EE154E4410282BD2FDFF3C59821" indent="up1"><enum>(2)</enum><text>The Secretary may exercise the authority provided by this section notwithstanding sections 521, 522 and 541–545 of title 40. Any such transfer shall be in accordance with this section and <external-xref legal-doc="usc" parsable-cite="usc/38/8122">section 8122</external-xref> of this title.</text></paragraph> 
<paragraph id="H79AF5217A60B4124B6E87528F0147CF8" indent="up1"><enum>(3)</enum><text>The authority provided by this section may not be used in a case to which <external-xref legal-doc="usc" parsable-cite="usc/38/8164">section 8164</external-xref> of this title applies.</text></paragraph> 
<paragraph id="H5D0D1583A9784FF6A529F07D1FE9B223" indent="up1"><enum>(4)</enum><text>The Secretary may enter into partnerships or agreements with public or private entities dedicated to historic preservation to facilitate the transfer, leasing, or adaptive use of structures or properties specified in subsection (b)(3)(D).</text></paragraph> 
<paragraph id="HC9DC99A002C949978E57425929CC00E7" indent="up1"><enum>(5)</enum><text>The authority of the Secretary under paragraph (1) expires on the date that is seven years after the date of the enactment of this section. </text></paragraph></subsection> 
<subsection id="H728A6F6F115D4AC7A1B17CC424D53969"><enum>(b)</enum> 
<paragraph id="HEBBA648A2FF94039AD35672793075112" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">There is established in the Treasury of the United States a revolving fund to be known as the Department of Veterans Affairs Capital Asset Fund (hereinafter in this section referred to as the <quote>Fund</quote>). Amounts in the Fund shall remain available until expended.</text></paragraph> 
<paragraph id="HA52066DA424149E1A8344018C3FD1717" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Proceeds from the transfer of real property under this section shall be deposited into the Fund. </text></paragraph> 
<paragraph id="H53604E8816F44C8B004DC14800AF964C" indent="up1"><enum>(3)</enum><text>To the extent provided in advance in appropriations Acts, amounts in the Fund may be expended for the following purposes:</text> 
<subparagraph id="H22C10AEA6F7745B8AC3B299FF14809E1"><enum>(A)</enum><text>Costs associated with the transfer of real property under this section, including costs of demolition, environmental remediation, maintenance and repair, improvements to facilitate the transfer, and administrative expenses.</text></subparagraph> 
<subparagraph id="H9F6C0DBC76684124B1F4FCF85936BC06"><enum>(B)</enum><text display-inline="yes-display-inline"> Costs, including costs specified in subparagraph (A), associated with future transfers of property under this section. </text></subparagraph> 
<subparagraph id="H8D97A99160DD4827BD6988B273906773"><enum>(C)</enum><text>Costs associated with enhancing medical care services to veterans by improving, renovating, replacing, updating, and establishing patient care facilities through construction projects to be carried out for an amount less than the amount specified in 8104(a)(3)(A) for a major medical facility project.</text></subparagraph> 
<subparagraph id="HFF7EA4ABF17A42A8A038A5B2C43169D"><enum>(D)</enum><text display-inline="yes-display-inline"> Costs, including costs specified in subparagraph (A), associated with the transfer, lease or adaptive use of a structure or other property under the jurisdiction of the Secretary that is listed on the National Register of Historic Places.</text></subparagraph></paragraph></subsection> 
<subsection id="HEA18F8881B9E4428B54409C219800740"><enum>(c)</enum><text display-inline="yes-display-inline">The Secretary shall include in the budget justification materials submitted to Congress for any fiscal year in support of the President’s budget for that year for the Department specification of the following:</text> 
<paragraph id="HF8F4787FFA3A4F47AEB9712FA9DEF1C"><enum>(1)</enum><text>The real property transfers to be undertaken in accordance with this section during that fiscal year.</text></paragraph> 
<paragraph id="H0A6CEC3E94814F78B6B8E727BB8D62A0"><enum>(2)</enum><text>All transfers completed under this section during the preceding fiscal year and completed and scheduled to be completed during the year during which the budget is submitted.</text></paragraph> 
<paragraph id="HBF802C76FC19427283DA6F2F2C00E7A3"><enum>(3)</enum><text>The deposits into, and expenditures from, the Fund that are incurred or projected for each of the preceding fiscal year, the current fiscal year, and the fiscal year covered by the budget.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HAD0ABA1FAB494A4F84C293E3CDFBCBE7" display-inline="no-display-inline" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 8116 the following new item:</text>

<subsection id="HD7C9097B0F744D039528A70588E80CF"><enum>(b)</enum><header>Initial authorization of appropriations</header><text>There is authorized to be appropriated to the Department of Veterans Affairs Capital Asset Fund established under <external-xref legal-doc="usc" parsable-cite="usc/38/8117">section 8117</external-xref> of title 38, United States Code (as added by subsection (a)), the amount of $10,000,000.</text></subsection> 
<subsection id="HC9B1FD8D62384FE782BD625FDD2F6D4C"><enum>(c)</enum><header>Termination of nursing home revolving fund</header> 
<paragraph display-inline="yes-display-inline" id="H11096D8CA71E46AAA6633D00E50060BC"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/38/8116">Section 8116</external-xref> is repealed.</text></paragraph> 
<paragraph indent="up1" id="H53C957A6967E45498374A996761F0021"><enum>(2)</enum><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/81">chapter 81</external-xref> is amended by striking the item relating to section 8116.</text></paragraph></subsection> 
<subsection id="HF9BD543012BF44318E262F4500515FA3"><enum>(d)</enum><header>Transfer of unobligated balances to capital asset fund</header><text display-inline="yes-display-inline">Any unobligated balances in the nursing home revolving fund under <external-xref legal-doc="usc" parsable-cite="usc/38/8116">section 8116</external-xref> of title 38, United States Code, as of the date of the enactment of this Act shall be deposited in the Department of Veterans Affairs Capital Asset Fund established under <external-xref legal-doc="usc" parsable-cite="usc/38/8117">section 8117</external-xref> of title 38, United States Code (as added by subsection (a)).</text></subsection> 
<subsection id="HCD0BBAFB1D6C44AEB37B6820080961B7"><enum>(e)</enum><header>Procedures applicable to transfers</header> 
<paragraph id="H76B751A9D8754838AF766DF303E198AB" display-inline="yes-display-inline"><enum>(1)</enum><text>Paragraph (2) of <external-xref legal-doc="usc" parsable-cite="usc/38/8122">section 8122(a)</external-xref> is amended to read as follows:</text> 
<quoted-block style="OLC" id="H443A9C39323645BEB35E12D08508D181" display-inline="no-display-inline"> 
<paragraph id="H4894F95FC80B46D5BD08007972733B84" indent="up1"><enum>(2) </enum><text display-inline="yes-display-inline">Except as provided in paragraph (3), the Secretary may not during any fiscal year transfer to any other department or agency of the United States or to any other entity real property that is owned by the United States and administered by the Secretary unless the proposed transfer is described in the budget submitted to Congress pursuant to <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105</external-xref> of title 31 for that fiscal year.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph> 
<paragraph id="H2CED9BF9F58D4209BDBD93669B1703BF" indent="up1"><enum>(2)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/38/8122">Section 8122(d)</external-xref> is amended—</text> 
<subparagraph id="H898B9B672D2749209DE8A2992D05BFCA"><enum>(A)</enum><text>by inserting “(1)” before “Real property”; and</text></subparagraph> 
<subparagraph id="HD06943993B6F455F8700903353D56975"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block style="USC" id="HD7B351CB55464470913809E344B7DE41" display-inline="no-display-inline"> 
<paragraph id="H5236D178EB5E4EF98DA484CB8135F07E" indent="up1"><enum>(2)</enum><text>The Secretary may transfer real property under this section, or under <external-xref legal-doc="usc" parsable-cite="usc/38/8117">section 8117</external-xref> of this title if the Secretary—</text> 
<subparagraph id="HD431BB429CF7419BAD2E912E3BB94100"><enum>(A)</enum><text>places a notice in the real estate section of local newspapers and in the Federal Register of the Secretary’s intent to transfer that real property (including land, structures, and equipment associated with the property);</text></subparagraph> 
<subparagraph id="H0E21BF19FF8445E4A9CCF2EBE193F200"><enum>(B)</enum><text>holds a public hearing;</text></subparagraph> 
<subparagraph id="H1945F587A7034213A1D61800EC954487"><enum>(C)</enum><text display-inline="yes-display-inline">provides notice to the Administrator of General Services of the Secretary’s intention to transfer that real property and waits for 30 days to elapse after providing that notice; and</text></subparagraph> 
<subparagraph id="H12B23A72C44D4C47BAD9EAB5F3C4549B"><enum>(D)</enum><text>after such 30-day period has elapsed, notifies the congressional veterans’ affairs committees of the Secretary’s intention to dispose of the property and waits for 60 days to elapse from the date of that notice.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H404A69C683464466B0B9005D58A69535" indent="up1"><enum>(3)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/38/8164">Section 8164(a)</external-xref> is amended by inserting <quote>8117 or</quote> after <quote>rather than under section</quote>.</text></paragraph> 
<paragraph id="H2095342912B44976BDCB60ED2847898E" indent="up1"><enum>(4)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/38/8165">Section 8165(a)(2)</external-xref> is amended by striking “nursing home revolving fund” and inserting “Capital Asset Fund established under <external-xref legal-doc="usc" parsable-cite="usc/38/8117">section 8117</external-xref> of this title.”.</text></paragraph></subsection> 
<subsection id="H643E7A992E4A410EACFDAC6FD500039"><enum>(f)</enum><header>Contingent effectiveness</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect at the end of the 30-day period beginning on the date on which the Secretary of Veterans Affairs certifies to Congress that the Secretary is in compliance with subsection (b) of <external-xref legal-doc="usc" parsable-cite="usc/38/1710B">section 1710B</external-xref> of title 38, United States Code. Such certification shall demonstrate a plan for, and commitment to, ongoing compliance with the requirements of that subsection.</text></subsection> 
<subsection id="H6E7771549067470C979F052EA847DFDA"><enum>(g)</enum><header>Continuing reports</header><text>Following a certification under subsection (f), the Secretary shall submit to Congress an update on that certification every six months until the certification is included in the Department's annual budget submission.</text></subsection></section> 
<section id="HC25B42461D7445B1B6EB5CD9E0878506"><enum>4.</enum><header>Annual report to Congress on inventory of Department of Veterans Affairs historic properties</header> 
<subsection id="HFDF51F4D6BA04FAA99CB4B87F46DCB93"><enum>(a)</enum><header>In general</header><text>Not later than December 15 of 2005, 2006, and 2007, the Secretary of Veterans Affairs shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report on the historic properties administered or controlled by the Secretary.</text> </subsection> 
<subsection id="H919F9FA2B9CE491C9C908E314C4E4B82" display-inline="no-display-inline"><enum>(b)</enum><header>Initial report</header><text>In the initial report under subsection (a), the Secretary shall set forth a complete inventory of the historic structures and property under the jurisdiction of the Secretary. The report shall include a description and classification of each such property based upon historical nature, current physical condition, and potential for transfer, leasing, or adaptive use. </text></subsection> 
<subsection id="HB8DD49AB6EE144A8B054B367C0747E67"><enum>(c)</enum><header>Subsequent reports</header><text>In reports under subsection (a) after the initial report, the Secretary shall provide an update of the status of each property identified in the initial report, with the proposed and actual disposition of each property. Each such report shall include any recommendation of the Secretary for legislation to enhance the transfer, leasing or adaptive use of such properties. </text></subsection></section> 
<section id="HF0BC33FEB2D64D04842E494E8C5072AC"><enum>5.</enum><header>Authority to use project funds to construct or relocate surface parking incidental to a construction or nonrecurring maintenance project</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/8109">Section 8109</external-xref> is amended by adding at the end the following new subsection:</text>

<subsection id="HE0544A9C708D48C5872D7F558E85D5E2"><enum>(j)</enum><text>Funds in a construction account or capital account that are available for a construction project or a nonrecurring maintenance project may be used for the construction or relocation of a surface parking lot incidental to that project.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H8DA158A970EC404D8F479F98AFC7A7A" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header>Inapplicability of limitation on use of advance planning funds to authorized major medical facility projects</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/8104">Section 8104</external-xref> is amended by adding at the end the following new subsection:</text>

<subsection id="H8E9693F728944D298B57F8FBCF8772A5"><enum>(g)</enum><text>The limitation in subsection (f) does not apply to a project for which funds have been authorized by law in accordance with subsection (a)(2).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H6303222439F34B71B345A12BF23C5F99"><enum>7.</enum><header>Improvement in enhanced-use lease authorities</header> <text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/8166">Section 8166(a)</external-xref> is amended by inserting <quote>land use,</quote> in the second sentence after <quote>relating to</quote>.</text></section> 
<section id="H664488B5B7BB4BB78DBC350013BDEA31"><enum>8.</enum><header>Extension of authority to provide care under long-term care pilot programs</header><text display-inline="no-display-inline">Subsection (h) of section 102 of the Veterans Millennium Health Care and Benefits Act (<external-xref legal-doc="usc" parsable-cite="usc/38/1710B">38 U.S.C. 1710B</external-xref> note) is amended—</text>

<paragraph id="H64AB17428CB24D7AA5F1417C33DBEB05" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In the case of a veteran who is participating in a pilot program under this section as of the end of the three-year period applicable to that pilot program under paragraph (1), the Secretary may continue to provide to that veteran any of the services that could be provided under the pilot program. The authority to provide services to any veteran under the preceding sentence applies during the period beginning on the date specified in paragraph (1) with respect to that pilot program and ending on December 31, 2005.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
