<official-title>To amend the Occupational Safety and Health Act of 1970 with respect to enforcement provisions.</official-title>

<section id="H2344371C320C4624B6716B47BD7FD54E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>OSHA and Employer Cooperation Act of 2004</short-title></quote>.</text> </section> 
<section id="HFC2F93B699FE411695C9F65C80CD388D"><enum>2.</enum><header>Enforcement of the Occupational Safety and Health Act of 1970</header> 
<subsection id="H7B88CCA10BBA4FECA2CF40603D008F57"><enum>(a)</enum><header>Time periods for issuing citations</header><text>Section 9 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/658">29 U.S.C. 658</external-xref>) is amended by striking <quote>with reasonable promptness</quote> and inserting <quote>within thirty working days</quote>. Section 10 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/659">29 U.S.C. 659</external-xref>) is amended by striking <quote>within a reasonable time</quote> and inserting <quote>within thirty days</quote>.</text></subsection> 
<subsection id="HAA62E329A114419DBC58A2E5466E37CD"><enum>(b)</enum><header>Time periods for contesting citations</header><text>Section 10 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/659">29 U.S.C. 659</external-xref>) is amended by striking <quote>fifteen</quote> each place it appears and inserting <quote>thirty</quote>.</text></subsection> 
<subsection id="H5FD2F68D86924693A86EAAE88CDD75E"><enum>(c)</enum><header>Right to correct violative condition</header><text>Section 9 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/658">29 U.S.C. 658</external-xref>) is amended by adding at the end the following: </text> 
<quoted-block style="OLC" id="H41C0A96242B94C02A2561FA3D3A32003" display-inline="no-display-inline"> 
<subsection id="H109E0B1566334516AF92DA47750189A"><enum>(d)</enum><text>The Secretary may not assess a penalty under section 17 in connection with the initial issuance of a citation, with the exception of willful violations, if the employer corrects the violative condition and provides the Secretary an abatement certification within 72 hours.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3CA9912B132D4C0E8DF67D92006546F0"><enum>(d)</enum><header>Multiemployer worksites</header><text>Section 9 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/658">29 U.S.C. 658</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H4718913C9AF24FA28283EA468E0415C5"><enum>(e)</enum><text>On multiemployer work sites, the Secretary may only cite the employer whose employees were exposed to a condition which is in violation of a requirement of any standard, rule or order promulgated pursuant to section 6 of this Act, or of any regulations prescribed pursuant to this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H30EBF902CA8B41DDA49D263037B4C764"><enum>(e)</enum><header>Penalties</header><text>Section 17 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/666">29 U.S.C. 666</external-xref>) is amended by inserting the following:</text> 
<quoted-block id="H10B56A4EC0264E6E8279B08BC3E355ED" style="OLC"> 
<subsection id="H94A1D41ED0184DB39F9CFE1F7B15A0D0"><enum>(m)</enum><text>The Secretary shall not use <quote>other than serious</quote> citations as a basis for issuing subsequent, repeat or willful citations.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0777600ACEA04012A8268BCA14343DA0"><enum>(f)</enum><header>Written statement to employer following inspection</header><text>Section 8 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/657">29 U.S.C. 657</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="H28CCFC31E0F443659B91E7C9B2B321CA" style="OLC"> 
<subsection id="H8EFB2EDED92D46579E57BA94FB45AADF"><enum>(i)</enum><text>At the closing conference after the completion of an inspection, the inspector shall provide the employer or a representative of the employer with a written statement that clearly and concisely provides the following information:</text></subsection> 
<paragraph id="HCE84481F04ED43A78E0133C0BD78C5BC"><enum>(1)</enum><text>The results of the inspection, including each alleged hazard, if any, and each citation that will be issued, if any.</text></paragraph> 
<paragraph id="H4ADF419E510F4DC39F28E31DB275CB6D"><enum>(2)</enum><text>The right of the employer to contest a citation, a penalty assessment, an amended citation, and an amended penalty assessment.</text></paragraph> 
<paragraph id="H6C540617CB6541BAACCCC6C96D3967EB"><enum>(3)</enum><text>An explanation of the procedure to follow in order to contest a citation, a penalty assessment, an amended citation, and an amended penalty assessment, including when and where to contest a citation and the required contents of the notice of intent to contest.</text></paragraph> 
<paragraph id="H34BAB9C810A04B2CA12546F2A5C631E5"><enum>(4)</enum><text>The Secretary’s responsibility to affirm, amend, or dismiss the citation and penalty assessment, if any.</text></paragraph> 
<paragraph id="H974E5C9503DA461587DFF05148925DC"><enum>(5)</enum><text>The informal review process.</text></paragraph> 
<paragraph id="HE162544D4D4846B392563F191C8F9028"><enum>(6)</enum><text>The procedures before the Occupational Safety and Health Review Commission.</text></paragraph> 
<paragraph id="H44E1EC1268D544E6B8FB748042C1517D"><enum>(7)</enum><text>The right of the employer to seek judicial review.</text></paragraph>
