<official-title>To amend the Magnuson-Stevens Fishery Conservation and Management Act to provide for stewardship of fishery resources for the American public, and for other purposes.</official-title>

<section id="H798AEA86EDDB463DAE102474DD994DB6" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Fisheries Management Reform Act of 2004</short-title></quote>.</text></section> 
<section id="H6884B9079C42419EB7FFA8CAEC3C0000"><enum>2.</enum><header>Amendment references</header><text display-inline="no-display-inline"> Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to such section or other provision of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801 et seq.</external-xref>).</text></section> 
<section id="H9782208137C446C0924C41000600B029"><enum>3.</enum><header>Representation of the public interest on Regional Fishery Management Councils</header><text display-inline="yes-display-inline"/> 
<subsection id="HE00F859E839D446FA79B171E1553B07B"><enum>(a)</enum><header>Appointment of members by Administrator</header><text/> 
<paragraph id="H02E79E394F934135B6FA876697BA097B"><enum>(1)</enum><header>Appointment of members</header><text>Section 302 (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852</external-xref>) is amended—</text> 
<subparagraph id="HA6CB93FABE3844DC81A9CF173C11E00"><enum>(A)</enum><text>by striking <quote>appointed by the Secretary</quote> each place it appears and inserting <quote>appointed by the Administrator of the National Oceanic and Atmospheric Administration</quote>;</text></subparagraph> 
<subparagraph id="HB80AA69B9AE444558CC3E0BF24D00B4"><enum>(B)</enum><text>in paragraphs (2) and (6) of subsection (b) by striking <quote>The Secretary</quote> each place it appears and inserting <quote>The Administrator of the National Oceanic and Atmospheric Administration</quote>;</text></subparagraph> 
<subparagraph id="HFF938BF9F4CA4ED1BE1188E54821D445"><enum>(C)</enum><text>in paragraph (5)(A) of subsection (b) by striking <quote>The Secretary</quote> the first and second places it appears and inserting <quote>The Administrator of the National Oceanic and Atmospheric Administration</quote>;</text></subparagraph> 
<subparagraph id="H0D88FC62BF6E40778C1702D40081AA90"><enum>(D)</enum><text>in subsection (b) by striking <quote>the Secretary</quote> each place it appears, other than in paragraph (6)(B), and inserting <quote>the Administrator</quote>; and</text></subparagraph> 
<subparagraph id="HAB6B5258B47743BF86AFCF391F78D03B"><enum>(E)</enum><text>in subsection (b)(2)(B)(iii) by striking <quote>the Secretary’s</quote> and inserting <quote>the Administrator’s</quote>.</text></subparagraph></paragraph> 
<paragraph id="HE53028C9089D4088AF6B3D151BFAAC42"><enum>(2)</enum><header>Application with respect to current members of Councils</header><text/> 
<subparagraph id="HC342BF0B7C194CD8AF2500503B2400F6"><enum>(A)</enum><header>Appointment not affected</header><text>The amendment made by paragraph (1)(A) shall not affect any appointment by the Secretary of Commerce made before the date of the enactment of this Act.</text></subparagraph> 
<subparagraph id="HB4BB6D1E36C14C5B98777717C5A35973"><enum>(B)</enum><header>Removal</header><text>In applying section 302(b)(6) of the Magnuson-Stevens Fishery Conservation and Management Act, as amended by this subsection, to a member of a Regional Fishery Management Council appointed before the date of the enactment of this Act, <quote>by the Secretary</quote> shall be substituted for <quote>by the Administrator</quote>. </text></subparagraph></paragraph></subsection> 
<subsection id="HEEE96F359A6B450A88411E8E4D4F3600"><enum>(b)</enum><header>Representation by State officials</header><text>Section 302(b)(1)(A) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(b)(1)(A)</external-xref>) is amended by adding at the end the following: <quote>Such official shall represent the interests of the general public.</quote>.</text></subsection> 
<subsection id="H4439B56363C34A5E9BCB27510319A7AE"><enum>(c)</enum><header>Allocation of Appointments</header><text>Section 302(b)(2)(B) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(b)(2)(B)</external-xref>) is amended in the first sentence—</text> 
<paragraph id="HBECC15BD1C7A40A8AA29F891EE47BB22"><enum>(1)</enum><text>by striking <quote>of the active participants</quote> and inserting <quote>among the active participants</quote>; and</text></paragraph> 
<paragraph id="H0CC9757A8599493C9B3CBEE7AFC9DA5C"><enum>(2)</enum><text>by inserting before the period the following: <quote>and representatives of the public interest in marine fish conservation, including individuals who do not derive any of their annual income from commercial or recreational fishing and who are knowledgeable regarding the conservation and management of the fishery resources of the geographic area concerned</quote>.</text></paragraph></subsection> 
<subsection id="HF551BDD4838E4DC6B6FC00407400A473"><enum>(d)</enum><header>Consultation by States in submitting nominees</header><text>Section 302(b)(2)(C) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(b)(2)(C)</external-xref>) is amended—</text> 
<paragraph id="H25E66E94FB3942298FE1C2D303FF47F0"><enum>(1) </enum><text display-inline="yes-display-inline">in the second sentence by inserting <quote>and representatives of conservation organizations</quote> after <quote>commercial and recreational fishing interests</quote>; and</text></paragraph> 
<paragraph id="HAFD98865CC5549D588455B053DB7D39D"><enum>(2)</enum><text>by striking the third sentence and inserting the following: <quote>Each list shall consist of a broad slate of candidates for each vacancy, shall include at least two representatives from each of the commercial fishing industry sector, the recreational fishing sector, and the marine fish conservation public interest sector who do not derive any of their annual income from commercial or recreational fishing, and shall consist solely of individuals who are knowledgeable regarding the conservation and management of the fishery resources of the geographic area concerned.</quote>.</text></paragraph></subsection> 
<subsection id="HA98956AFF7F74E38982CE29DE1750068"><enum>(e)</enum><header>Training of appointed members</header> 
<paragraph id="H8F7E89A5A5FC416E8C000062789129E9"><enum>(1)</enum><header>Training requirement</header><text>Section 302(b) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(b)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H673C638EACB04BF79D870030219ED5AE" display-inline="no-display-inline"> 
<paragraph id="HC709FA3590F14BF30039B9B042F65BB3"><enum>(7)</enum><header>Training of appointed members</header> 
<subparagraph id="HCEA992DE8279459B83CE57C23742738"><enum>(A)</enum><header>In general</header><text>The Secretary shall provide to each member of a Council appointed by the Secretary under this subsection, by not later than 6 months after the date of the member’s appointment, training in matters relating to the functions of the Council, including—</text> 
<clause id="HB96EE2B13A0E4DEAB778E25290F82FBC"><enum>(i)</enum><text>fishery science and basic fish stock assessment;</text></clause> 
<clause id="H0532713A95E14C93BBD866B701D7F34D"><enum>(ii)</enum><text>social science and fishery economics;</text></clause> 
<clause id="HE661982878BC49B8A8D071AE1C028D84"><enum>(iii)</enum><text>the requirements of this Act, the National Environmental Policy Act of 1969, <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code (popularly known as the Administrative Procedures Act), and other relevant statutes or regulations;</text></clause> 
<clause id="H0E27C8365B014E2D9D4297D29F3EFC41"><enum>(iv)</enum><text>conflict of interest policies that apply to Council members; and</text></clause> 
<clause id="H2EA2DBF453EC486FBB623301C3465DB9"><enum>(v)</enum><text>the public process for developing fishery management plans.</text></clause></subparagraph> 
<subparagraph id="HD893C54E5244493F92084BA13752D7C5"><enum>(B)</enum><header>Restriction on voting</header><text>A member of a Council to whom the Secretary is required to provide training under this paragraph may not vote on any decision of the Council before the date the member completes such training.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H1519F90F3DFF4691A6DCFAFD75D1200"><enum>(2)</enum><header>Limitation on application</header><text>The amendment made by paragraph (1) shall not apply to a member of a Regional Fishery Management Council appointed before the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="H53FA882C3C954BBFA218A1FECD81D910"><enum>(f)</enum><header>Technical correction</header><text>Section 302(b)(2)(B) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(b)(2)(B)</external-xref>) is amended in the second sentence by striking <quote>Merchant Marine and Fisheries</quote> and inserting <quote>Resources</quote>.</text></subsection></section> 
<section id="H831D839ED9A4479CB0BBFF4FC696A8AD"><enum>4.</enum><header>Qualification of voting council members; disclosure of financial interest and recusal</header> 
<subsection id="H4DB28B26308D4EF8A3A456F813570043"><enum>(a)</enum><header>Qualifications of voting council members</header><text>Section 302(b)(2)(A) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(b)(2)(A)</external-xref>) is amended by—</text> 
<paragraph id="H38CC44135F49411F84C3F3626B790052"><enum>(1)</enum><text>inserting after <quote>geographical area concerned</quote> the following: <quote>, and must not have been found by the Secretary, after notice and an opportunity for a hearing in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/554">section 554</external-xref> of title 5, United States Code, to have committed an act prohibited by section 307(1)(D), (E), (F), (H), (I), or (L) or section 307(2)</quote>; and</text></paragraph> 
<paragraph id="H97373B7B596C4163BE7C75886E559CFF"><enum>(2)</enum><text>striking <quote>of the Fishery Conservation Amendments of 1990</quote> and replacing with <quote>of the Fisheries Management Reform Act of 2004</quote>. </text></paragraph></subsection> 
<subsection id="H581B3D09604746F8B8B9F77015CC526"><enum>(b)</enum><header>Disclosure of financial interest and recusal</header><text/> 
<paragraph id="H8C954ABC05BA44CBA7C8C70046299C24"><enum>(1)</enum><header>Amendments relating to disclosure and recusal</header><text>Section 302(j) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(j)</external-xref>) is amended as follows:</text> 
<subparagraph id="H89A6A1308D1D46A98CFACA6E23610050"><enum>(A)</enum><text>By striking the heading and inserting <quote><header-in-text level="subsection">Disclosure of Financial Interest and Recusal</header-in-text>.—</quote>.</text></subparagraph> 
<subparagraph id="HDF5A665B62874663986CB19B482BF28"><enum>(B)</enum><text>By striking paragraph (6), and redesignating paragraphs (7) and (8) in order as paragraphs (6) and (7).</text></subparagraph> 
<subparagraph id="H761F2BB6D2CE4925ABDA70792F99E998"><enum>(C)</enum><text>In paragraph (6), as so redesignated, by striking so much as precedes subparagraph (B) and inserting the following:</text>

<clause id="HB02B868DE17646B18F54FF298D17934" indent="up2"><enum>(ii)</enum><text>An affected individual who is prohibited from voting on a Council decision may not participate in any Council deliberations relating to the decision.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H8E35132D6C884968A81980A3E3F1305F"><enum>(D)</enum><text display-inline="yes-display-inline">In paragraph (6)(B), as so redesignated—</text>

<subparagraph id="H5FA3BD71186D4F4EB375001E8C76F6FB" indent="up1"><enum>(E)</enum><text>The Secretary, in consultation with the Councils and by not later than one year after the date of enactment of the Fisheries Management Reform Act of 2004, shall promulgate regulations that allow for the making of determinations under subparagraphs (B) and (C).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H6A08F7AB78924D54975C12B86C117700"><enum>(2)</enum><header>Conforming amendment</header><text>Section 307(1)(O) (<external-xref legal-doc="usc" parsable-cite="usc/16/1857">16 U.S.C. 1857(1)(O)</external-xref>) is amended by striking <quote>302(j)(7)(A)</quote> and inserting <quote>307(j)(6)(A)</quote>. </text></paragraph></subsection></section> 
<section id="HD86D349E1D8A41199700754F3315D8F2"><enum>5.</enum><header>Regional science and technical teams</header><text display-inline="no-display-inline"> Section 302(g) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(g)</external-xref>) is amended—</text> 
<paragraph id="H9EC943E4ED4D4905A060F3CEEEF8F6B"><enum>(1)</enum><text>by redesignating paragraph (5) as paragraph (6), and by inserting after paragraph (4) the following:</text> 
<quoted-block id="H07ED83FFF9E04548B1ADA1002717C9B" style="OLC"> 
<paragraph id="H00A5ED5D148E4550830713FD984E01A3"><enum>(5)</enum><header>Regional science and technical teams</header> 
<subparagraph id="H46CB99F4516E40FCAF4D7384D9541700" display-inline="yes-display-inline"><enum>(A)</enum><text>The Secretary shall establish regional science and technical teams to provide the Secretary with recommendations to carry out section 303(e).</text></subparagraph> 
<subparagraph id="H1D3AAED587DB43479DD7C2221CC69E29" indent="up1"><enum>(B)</enum><text>Each science and technical team established under this paragraph shall consist of Federal, State, and academic qualified independent scientists.</text></subparagraph> 
<subparagraph id="H76CA45EB528F4A0D890002F748AEC3D" indent="up1"><enum>(C)</enum><text>Each science and technical team established under this paragraph shall—</text> 
<clause id="H379B4612BEAB460DB72E922675034E22"><enum>(i)</enum><text>based on the best scientific information available, recommend to the Secretary—</text> 
<subclause id="H6C1C3ADDD71743D397BE488820086DA"><enum>(I)</enum><text>acceptable biological catch and bycatch limits, including annual limits, that are consistent with the national standard set forth in section 301(a)(1) and that consider predator-prey relationships and other ecological factors;</text></subclause> 
<subclause id="H9F1D2B3824DA4286BAF410A2BFD4CB2"><enum>(II)</enum><text>specific habitat and area protections necessary to protect essential fish habitats; and</text></subclause> 
<subclause id="H91673C05641D410A8D0090ECC8006087"><enum>(III)</enum><text>specific requirements necessary to protect species listed as threatened species or endangered species under section 4 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533</external-xref>);</text></subclause></clause> 
<clause id="HEC476F68FFA94692B1D47B50DE2D5C79"><enum>(ii)</enum><text>allow an opportunity for public input, including with respect to catch and bycatch limits and habitat protection measures recommended by the team, consider such input in developing its recommendations, and create a public record of such input and the team’s response to such input; and</text></clause> 
<clause id="H1910105B1F6E4481BF009FDFDE4EB1E6"><enum>(iii)</enum><text>publish its recommendations in the Federal Register.</text></clause></subparagraph> 
<subparagraph id="H80242BFD6D9944989D3982239B59E905" indent="up1"><enum>(D)</enum><text>Recommendations of a regional science and technical team submitted to the Secretary under this paragraph must be subjected to peer review by qualified independent scientists.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H6759F138C5634A9D9157D5F474A99FCB"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H49B37353F4C644FB9BEB0098AD46E4E0" display-inline="no-display-inline"> 
<paragraph id="HD6AAD295A9004C1DBF01D3A807A3D7DF" indent="up1"><enum>(7)</enum><text>For the purposes of this subsection, the term <term>qualified independent scientists</term> means individuals who—</text> 
<subparagraph id="HDD806D5335AD4B0683AE1F82C47EBD0"><enum>(A)</enum><text>through publication of peer-reviewed scientific literature and academic training, have demonstrated scientific expertise in fisheries science or marine ecology; and</text></subparagraph> 
<subparagraph id="H19E06F59CF694A9AAC7385C15FD95100"><enum>(B)</enum><text>have no direct financial interest, and are not employed by any person with a direct financial interest, in any fishery.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H37B4D4996BCB494BBD13C28C1E64D872"><enum>6.</enum><header>Contents of fishery management plans</header><text display-inline="yes-display-inline"/> 
<subsection id="HBB28A8FD9CF542590020008BEA6CD5E8"><enum>(a)</enum><header>Required provisions regarding protection, restoration, and promotion of ecosystems</header><text>Section 303(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/16/1853">16 U.S.C. 1853(a)(1)</external-xref>) is amended—</text> 
<paragraph id="H66E2DB92E94447F1B9582E6404D6A11"><enum>(1)</enum><text>in subparagraph (A) by inserting before the semicolon the following: <quote>and the associated ecosystem</quote>;</text></paragraph> 
<paragraph id="HB793AB001F2048EF87B7575E9FBDB3F"><enum>(2)</enum><text>by striking <quote>and</quote> after the semicolon at the end of subparagraph (B), by striking the period at the end of subparagraph (C) and inserting <quote>; and</quote>, and by adding at the end the following:</text> 
<quoted-block id="H8E69B7201B7F4273A1F82C8E9E9BE9D" style="OLC"> 
<subparagraph id="H9F7D04273FF84506A52768FF41A11284"><enum>(D)</enum><text>consistent with the conservation and management measures developed by the Secretary pursuant to subsection (e), except a Council may modify any conservation and management measure to provide greater conservation in order to achieve plan objectives, including to protect and maintain the ecological role of forage fish.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H49963CFC57EC4324907E7C76F9412C80"><enum>(3)</enum><text>by amending paragraph (14) to read as follows:</text>

<paragraph id="H63BFEFE9B5FC40119C41B04128638692"><enum>(14)</enum><text>allocate any quotas or other conservation and management measures established by the Secretary under subsection (e) fairly and equitably among the commercial, recreational, and charter fishing sectors in the fishery, and allow individual sectors of the fishery to develop allocation plans subject to the approval of the Council.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8A89A67252AC434191D2C75E6D9E4456"><enum>(b)</enum><header>Development of conservation and management measures by Secretary</header><text>Section 303 (<external-xref legal-doc="usc" parsable-cite="usc/16/1853">16 U.S.C. 1853</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HFAE054DE21ED40B5A1284401002EF98C"><enum>(e)</enum><header>Development of conservation and management measures by Secretary</header><text>The Secretary shall, based on recommendations of the regional science and technical teams established under section 302(g)(5), provide Councils conservation and management measures for incorporation into fishery management plans, plan amendments, or annual specifications, that establish—</text> 
<paragraph id="HDFBEFDC2C88C48C79580BD4C92165EF0"><enum>(1)</enum><text>catch and bycatch limits that do not exceed acceptable biological catch limits, including annual limits, that are consistent with the national standard set forth in section 301(a)(1) and that consider predator-prey relationships and other ecological factors;</text></paragraph> 
<paragraph id="H53AB9338ECEA45E78545FCB874F647E"><enum>(2)</enum><text>specific habitat and area protections necessary to protect essential fish habitats; and</text></paragraph> 
<paragraph id="HA442D21B71AF4C4C8FF77423480000D5"><enum>(3)</enum><text>specific requirements necessary to protect species listed as endangered species or threatened species under section 4 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
