<section id="H5890B5F223D04CFCB8B32C00691F005D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Agricultural Assistance Act of 2004</short-title></quote>.</text></section> 
<section id="HB921132741704026A6C9412C9941F3CB"><enum>2.</enum><header>Definition of Secretary</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of Agriculture.</text> </section> 
<section id="H294D15ED828C4A5AA65616D97DE6D820"><enum>3.</enum><header>Crop disaster assistance</header> 
<subsection id="H19A84DC7F5064FA2942712BE3A700CE"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H69F4BAA55FE746C8B29290624BB08571"><enum>(1)</enum><header>Additional coverage</header><text>The term <term>additional coverage</term> has the meaning given the term in section 502(b) of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1502">7 U.S.C. 1502(b)</external-xref>).</text> </paragraph> 
<paragraph id="H43A833A99E2B4515933B78005479CBDB"><enum>(2)</enum><header>Insurable commodity</header> 
<subparagraph id="HED2F77C1B61449E78220F21CA89108F9"><enum>(A)</enum><header>In general</header><text>The term <term>insurable commodity</term> means an agricultural commodity for which the producers on a farm are eligible to obtain a policy or plan of insurance under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>).</text> </subparagraph> 
<subparagraph id="HD4E5D55061404C14B97E550000CC3CD4"><enum>(B)</enum><header>Exclusion</header><text>The term <term>insurable commodity</term> does not include livestock.</text> </subparagraph></paragraph> 
<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="HEBC2A747EAA14B67A41FF7C59B87C3F" reporting-committee-number="1"><enum>(3)</enum><header>Noninsurable commodity</header><text>The term <term>noninsurable commodity</term> means an eligible crop for which the producers on a farm are eligible to obtain assistance under section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>).</text> </paragraph></subsection> 
<subsection id="H63DDE2A054D145588BC72000910582C"><enum>(b)</enum><header>Assistance available</header><text>The Secretary shall use such sums as are necessary of funds of the Commodity Credit Corporation to make emergency financial assistance available to producers on a farm that have incurred qualifying losses for the 2004 crop of an agricultural commodity due to damaging weather or related condition, as determined by the Secretary.</text> </subsection> 
<subsection id="H534B7DF6D11C4FC8AEF1A2668E1D13FC"><enum>(c)</enum><header>Administration</header> 
<paragraph id="H5E870094357A4603A619093D1B7CF61C"><enum>(1)</enum><header>Use of former administrative authority</header><text>Except as provided in paragraph (2), the Secretary shall make assistance available under this section in the same manner as provided under section 815 of the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2001 (as enacted into law by <external-xref legal-doc="public-law" parsable-cite="pl/106/387">Public Law 106–387</external-xref>; 114 Stat. 1549A–55), including using the same loss thresholds for quantity and quality losses as were used in administering that section.</text> </paragraph> 
<paragraph id="HC0A8EFC0DD9348618EE993CF4170FE57"><enum>(2)</enum><header>Payment rate</header><text>The payment rate for a crop for assistance provided under this section to the producers on a farm shall be calculated as follows:</text> 
<subparagraph id="HAF1C6E95FC3543E5AC00FD806C3E3102"><enum>(A)</enum><text>If the producers obtained a policy or plan of insurance, including a catastrophic risk protection plan, for the crop under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>), 50 percent of the applicable price for the crop.</text> </subparagraph> 
<subparagraph id="H3A82E86C6FB84C6EABBCFC5740990030"><enum>(B)</enum><text>If a policy or plan of insurance, including a catastrophic risk protection plan, for the crop was not available to the producers under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>), 50 percent of the applicable price for the crop.</text> </subparagraph> 
<subparagraph id="H30066875D2F24D96BCBB4C27D0664300"><enum>(C)</enum><text>Subject to subsections (d) and (e), if the producers did not obtain a policy or plan of insurance, including a catastrophic risk protection plan, available for the crop under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>), 40 percent of the applicable price for the crop.</text> </subparagraph></paragraph></subsection> 
<subsection id="HC0F8B44D08C442C8B35D86906E01CB8B"><enum>(d)</enum><header>Ineligibility for Assistance</header><text>Except as provided in subsection (e), the producers on a farm shall not be eligible for assistance under this section with respect to losses to an insurable commodity or noninsurable commodity if the producers on the farm—</text> 
<paragraph id="H9F4AC85DE0D148089B51C432EFE3EF6"><enum>(1)</enum><text> in the case of an insurable commodity, did not obtain a policy or plan of insurance for the insurable commodity under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>) for the crop incurring the losses; and</text> </paragraph> 
<paragraph id="H56E37791675A4B1F8CE80000001B3129"><enum>(2)</enum><text>in the case of a noninsurable commodity, did not file the required paperwork, and pay the administrative fee by the applicable State filing deadline, for the noninsurable commodity under section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>) for the crop incurring the losses.</text> </paragraph></subsection> 
<subsection id="H215424E1EDA047729DE1B3F46645EF9D"><enum>(e)</enum><header>Contract waiver</header><text>The Secretary may waive subsection (d) with respect to the producers on a farm if the producers enter into a contract with the Secretary under which the producers agree—</text> 
<paragraph id="H05C88AF775134A339CBEC74D372FF749"><enum>(1)</enum><text> in the case of an insurable commodity, to obtain a policy or plan of insurance under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>) providing additional coverage for the insurable commodity for each of the next 2 crops; and</text> </paragraph> 
<paragraph id="H4AD60789E00149EAA4553CF1BEFB7000"><enum>(2)</enum><text>in the case of a noninsurable commodity, to file the required paperwork, and pay the administrative fee by the applicable State filing deadline, for the noninsurable commodity for each of the next 2 crops under section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>).</text> </paragraph></subsection> 
<subsection id="H4A526090F82D4063AF18658654730862"><enum>(f)</enum><header>Effect of Violation</header><text>In the event of the violation of a contract under subsection (e) by a producer, the producer shall reimburse the Secretary for the full amount of the assistance provided to the producer under this section.</text> </subsection></section> 
<section id="H83C68D6D1DD74ED58461A7006D5964E3"><enum>4.</enum><header>Livestock assistance</header> 
<subsection id="H03134EBA725D4B54B02B42EE22396C76"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H4CED96198CAE4B31A6F7E4981C339C2C"><enum>(1)</enum><header>Disaster county</header><text>The term <term>disaster county</term> means a county included in the geographic area covered by a qualifying natural disaster declaration for calendar year 2004. </text> </paragraph> 
<paragraph id="H9DB1660DD84D404CBC4EF322B2D86F89"><enum>(2)</enum><header>Qualifying natural disaster declaration</header><text>The term <term>qualifying natural disaster declaration</term> means—</text> 
<subparagraph id="H9A3F63B14D94496E8451DCB1875B5021"><enum>(A)</enum><text>a natural disaster declared by the Secretary under section 321(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1961">7 U.S.C. 1961(a)</external-xref>); or</text> </subparagraph> 
<subparagraph id="HDB6813A2C7584B3B9333339EDF73EF2"><enum>(B)</enum><text>a major disaster or emergency designated by the President under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>).</text> </subparagraph></paragraph></subsection> 
<subsection id="H972E8F2A509449C6A34770016EE0D97C"><enum>(b)</enum><header>Livestock assistance program</header> 
<paragraph id="H5EC0BCBBDC52470EB759CD92ABC4D4F0"><enum>(1)</enum><header>Assistance available</header> 
<subparagraph id="HEBFBE5642C6F4614961377D004A375A6"><enum>(A)</enum><header>In general</header><text>Subject to subsection (c), the Secretary shall use such sums as are necessary of funds of the Commodity Credit Corporation to establish a program under which payments are made to livestock producers for losses in a disaster county. </text> </subparagraph> 
<subparagraph id="H031DDF686F6B4A29BD69AD752C00A0E2"><enum>(B)</enum><header>Criteria</header><text>To carry out the program, the Secretary shall use the criteria established to carry out the 1999 Livestock Assistance Program, except that, in lieu of the gross revenue criteria used for the 1999 Livestock Assistance Program, the Secretary shall use the adjusted gross income limitation contained in section 1001D of the Food Security Act of 1985 (7 U.S.C. 1308-3a).</text> </subparagraph></paragraph></subsection> 
<subsection id="H0B9C666C6E90425386A3AA6E98C90096"><enum>(c)</enum><header>Relationship of livestock assistance programs</header><text>The amount of assistance that the producers would otherwise receive for a loss under the livestock assistance program shall be reduced by the amount of the assistance that the producers receive under any other livestock assistance program, as determined by the Secretary.</text> </subsection></section> 
<section id="HAB70F72A60C040E99D561EE600AB0041"><enum>5.</enum><header>Funding</header><text display-inline="no-display-inline">The Secretary shall use the funds, facilities, and authorities of the Commodity Credit Corporation to carry out this Act, and such funds shall remain available to carry out this Act until expended.</text> </section> 
<section id="H9FF2D06314634E79BE33BEF128C186BC"><enum>6.</enum><header>Regulations</header> 
<subsection id="H824213D0D2044899A4173B9F006BCCBC"> <enum>(a)</enum> <header>In general</header> <text>The Secretary may promulgate such regulations as are necessary to implement this Act.</text> </subsection> 
<subsection id="H76045245C28E4FC1B7F4CBA8CAECFFB8"> <enum>(b)</enum> <header>Procedure</header> <text>The promulgation of the regulations and administration of this Act shall be made without regard to—</text> 
<paragraph id="H2E9354785FA64966BAF213B83F12F64"> <enum>(1)</enum> <text>the notice and comment provisions of <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code;</text> </paragraph> 
<paragraph id="HD7FF65E154624EB59BAA21D50041B658"> <enum>(2)</enum> <text>the Statement of Policy of the Secretary of Agriculture effective July 24, 1971 (36 Fed. Reg. 13804), relating to notices of proposed rulemaking and public participation in rulemaking; and</text> </paragraph> 
<paragraph id="HE0CF168493274FAFA2EC6FD59A97096"> <enum>(3)</enum> <text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>).</text> </paragraph></subsection> 
<subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="HB7292CCFEE1A4E97B707159B8468FDA9" reporting-committee-number="1"><enum>(c)</enum><header>Congressional review of agency rulemaking</header><text>In carrying out this section, the Secretary shall use the authority provided under <external-xref legal-doc="usc" parsable-cite="usc/5/808">section 808</external-xref> of title 5, United States Code.</text> </subsection></section>
