<official-title>To amend the Public Health Service Act to provide for human embryonic stem cell research.</official-title>

<section section-type="section-one" id="H7FAE2B024818497E9997BB5685CA1E77" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Stem Cell Research Enhancement Act of 2004</quote>.</text></section> 
<section id="HE19F6047FE1144AB008364E54D56239B"><enum>2.</enum><header>Human embryonic stem cell research</header> <text display-inline="no-display-inline">Part H of title IV of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/289">42 U.S.C. 289 et seq.</external-xref>) is amended by inserting after section 498C the following:</text>

<section id="HEA5F3B98D4E94EDC86AC48236116B313"><enum>498D.</enum><header>Human embryonic stem cell research</header> 
<subsection id="H278680697AC342308F227DE0398200AF"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, the Secretary shall conduct and support research that utilizes human embryonic stem cells in accordance with this section.</text></subsection> 
<subsection id="HAEB7D16E60404332BE6D515159940262"><enum>(b)</enum><header>Requirements</header><text>The Secretary shall conduct or support research that utilizes human embryonic stem cells if the following requirements are met:</text> 
<paragraph id="H9FFDE68A5D334FFF82661B8BF92258C3"><enum>(1)</enum><text display-inline="yes-display-inline">The stem cells were derived from human embryos that have been donated from in vitro fertilization clinics, were created for the purposes of fertility treatment, and were in excess of the clinical need of the individuals seeking such treatment.</text></paragraph> 
<paragraph id="HD2E1A609884946688D42B6E9CC3D4E1"><enum>(2)</enum><text>Prior to the consideration of embryo donation and through consultation with the individuals seeking fertility treatment, it is determined that the embryos will never be implanted in a woman and would otherwise be discarded.</text></paragraph> 
<paragraph id="H1527FB4AFF384867B2BFDEDEA275EE72"><enum>(3)</enum><text>The individuals seeking fertility treatment donated the embryos with written informed consent and without receiving any financial or other inducements to make the donation.</text></paragraph> </subsection> 
<subsection id="HD9231634492F4CD9B600EB98F29E1459"><enum>(c)</enum><header>Guidelines</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this section, the Secretary, in consultation with the Director of NIH, shall promulgate guidelines to carry out this section.</text></subsection> 
<subsection id="HE700EFB077B940E68B43E45641D2BEE"><enum>(d)</enum><header>Determination</header><text>In determining whether this section authorizes or prohibits the conduct or support of research using a particular human embryonic stem cell line, the Secretary—</text> 
<paragraph id="H5A1C57054486422DA0A4AFB3611C353"><enum>(1)</enum><text>shall apply the requirements of subsection (b) regardless of the date on which the stem cell line is derived from a human embryo; and</text></paragraph> 
<paragraph id="H41ABEBC7DDB54041BE26F8BB94C8DCD6"><enum>(2)</enum><text>shall apply the guidelines promulgated under this section only if the stem cell line is derived from a human embryo on or after the date described in subsection (c).</text></paragraph></subsection> 
<subsection id="H255AFBBC5E324A15A8BAED465C92B05"><enum>(e)</enum><header>Reporting requirements</header><text>The Secretary shall annually prepare and submit to the appropriate committees of the Congress a report describing the activities carried out under this section during the preceding fiscal year, and including a description of whether and to what extent research under subsection (a) has been conducted in accordance with this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
