<official-title>To authorize and facilitate hydroelectric power licensing of the Tapoco Project, and for other purposes.</official-title>

<section section-type="section-one" id="H3DA9BB7F105E49CDB014D04B7163B9E9" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tapoco Project Licensing Act of 2004</short-title></quote>.</text></section> 
<section id="HD5FDC33AE1B24CE69017B9C0609CF3AC"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H903737E9DBCD45FA8C4CA5579BAB249"><enum>(1)</enum><header>APGI</header><text>The term <term>APGI</term> means Alcoa Power Generating Inc., its successors and assigns.</text></paragraph> 
<paragraph id="HBE4FBA79421F46DF93308EBBC5C0EA00"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Energy Regulatory Commission.</text></paragraph> 
<paragraph id="HBF6BA9B00DDA45BF95C1EBA767DB058"><enum>(3)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Tapoco Hydroelectric Project, P–2169, Settlement Agreement, Appendix B, Proposed Land Swap Areas, National Park Service and APGI</quote>, numbered TP514, Issue No. 9, and dated June 8, 2004.</text></paragraph> 
<paragraph id="HC35438422F224DD3B808F66BE3C4AB9F"><enum>(4)</enum><header>Park</header><text>The term <term>Park</term> means Great Smoky Mountains National Park.</text></paragraph> 
<paragraph id="HCF2FD847A44B47869F07E1C1FE393B26"><enum>(5)</enum><header>Project</header><text>The term <term>Project</term> means the Tapoco Hydroelectric Project, FERC Project No. 2169, including the Chilhowee Dam and Reservoir in the State of Tennessee.</text></paragraph> 
<paragraph id="H8CAC66F83D304224A9B82E23851F48EB"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section> 
<section id="HAC47D4B124AA4D4B87306B12FA4D19E9"><enum>3.</enum><header>Land exchange</header> 
<subsection id="HBBC426BBAF4C4F28987FE517DF66E79B"><enum>(a)</enum><header>Authorization</header> 
<paragraph id="H017C83AE45AD459F0020DA087C6CC917"><enum>(1)</enum><header>In general</header><text>Upon the conveyance by APGI of title acceptable to the Secretary of the land identified in paragraph (2), the Secretary shall simultaneously convey to APGI title to the land identified in paragraph (3).</text></paragraph> 
<paragraph id="HF72A089B0F9743868FF89C59C179F730"><enum>(2)</enum><header>Description of land to be conveyed by APGI</header><text>The land to be conveyed by APGI to the Secretary is the approximately 186 acres of land, subject to any encumbrances existing before February 21, 2003—</text> 
<subparagraph id="H5584306DEFEA4B1685BD29971651D503"><enum>(A)</enum><text>within the authorized boundary of the Park, located northeast of United States Highway 129 and adjacent to the APGI power line; and</text></subparagraph> 
<subparagraph id="H2DE61CE824644B4DA6E1BFC763D4ECE2"><enum>(B)</enum><text>as generally depicted on the map as <quote>Proposed Property Transfer from APGI to National Park Service</quote>.</text></subparagraph></paragraph> 
<paragraph id="H88478F88351C4736A6815E2C4052866F"><enum>(3)</enum><header>Description of land to be conveyed by the Secretary</header><text>The land to be conveyed by the Secretary to APGI is the approximately 110 acres of land within the Park that is—</text> 
<subparagraph id="HA86DCDFEA3444FB0934C5279E82065DB"><enum>(A)</enum><text>adjacent to or flooded by the Chilhowee Reservoir;</text></subparagraph> 
<subparagraph id="HE847316202A14839BD0011A000703F6B"><enum>(B)</enum><text>within the boundary of the Project as of February 21, 2003; and</text></subparagraph> 
<subparagraph id="HD81513C53AAD4EA6BD00EAE4E5874495"><enum>(C)</enum><text>as generally depicted on the map as <quote>Proposed Property Transfer from National Park Service to APGI</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="HB5DB91C427794C76AC1DC4EC8600ADC"><enum>(b)</enum><header>Minor adjustments to conveyed land</header><text>The Secretary and APGI may mutually agree to make minor boundary or acreage adjustments to the land identified in subsection (a).</text></subsection> 
<subsection id="H7719A7FD5A6C42D5BDB219F5EE7F7344"><enum>(c)</enum><header>Opportunity to mitigate</header><text>If the Secretary determines that all or part of the land to be conveyed to the Secretary under subsection (a)(2) is unsuitable for inclusion in the Park, APGI shall have the opportunity to make the land suitable for inclusion in the Park.</text></subsection> 
<subsection id="HBD328884A459482E803410D5C4366B6"><enum>(d)</enum><header>Conservation easement</header><text>The Secretary shall reserve a conservation easement over any land transferred to APGI under subsection (a)(3) that, subject to any terms and conditions imposed by the Commission in any license that the Commission may issue for the Project. The conservation easement shall—</text> 
<paragraph id="H918209FE5832458581FAC669AF50D711"><enum>(1)</enum><text>specifically prohibit any development of the land by APGI, other than any development that is necessary for the continued operation and maintenance of the Chilhowee Reservoir;</text></paragraph> 
<paragraph id="H9ADD6A2C31094F428053880478EE7376"><enum>(2)</enum><text>authorize public access to the easement area, subject to National Park Service regulations; and</text></paragraph> 
<paragraph id="H6E57049EEA114708A3547F11ABC6CD31"><enum>(3)</enum><text>authorize the National Park Service to enforce Park regulations on the land and in and on the waters of Chilhowee Reservoir lying on the land, to the extent not inconsistent with any license condition considered necessary by the Commission.</text></paragraph></subsection> 
<subsection id="HF6B8CF9E3D664C56A1BE676808E67CDB"><enum>(e)</enum><header>Applicability of certain laws</header><text>Section 5(b) of <external-xref legal-doc="public-law" parsable-cite="pl/90/401">Public Law 90–401</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/460l-22">16 U.S.C. 460<italic>l</italic>–22</external-xref>(b)), shall not apply to the land exchange authorized under this section.</text></subsection> 
<subsection id="H7A62849B2FA244F9A118AAF450BBDA26"><enum>(f)</enum><header>Reversion</header> 
<paragraph id="HC8756F9A08E44E4EAC86046D7513FDDC"><enum>(1)</enum><header>In general</header><text>The deed from the Secretary to APGI shall contain a provision that requires the land described in subsection (a)(3) to revert to the United States if—</text> 
<subparagraph id="HA1E5A4CC6D3C4DDEB3BD00E887C463EC"><enum>(A)</enum><text>the Chilhowee Reservoir ceases to exist; or</text></subparagraph> 
<subparagraph id="HD5093DBD36E34CCC95008EF766BA2A0"><enum>(B)</enum><text>the Commission issues a final order decommissioning the Project from which no further appeal may be taken.</text></subparagraph></paragraph> 
<paragraph id="HBC988801EE224D9DB652A70266AFAD32"><enum>(2)</enum><header>Applicable law</header><text>A reversion under this subsection shall not eliminate APGI’s responsibility to comply with all applicable provisions of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/791a">16 U.S.C. 791a et seq.</external-xref>), including regulations.</text></paragraph></subsection> 
<subsection id="HF88FBDC7DADB406193CC6559E4CC84F4"><enum>(g)</enum><header>Boundary adjustment</header> 
<paragraph id="H00644EDCC6C3472E8F89B4DC31F7C545"><enum>(1)</enum><header>In general</header><text>On completion of the land exchange authorized under this section, the Secretary shall—</text> 
<subparagraph id="HB9C05CCA256848F78048D4AE77CA8495"><enum>(A)</enum><text>adjust the boundary of the Park to include the land described in subsection (a)(2); and</text></subparagraph> 
<subparagraph id="H01BE64F5FECB42AF95C4F63F156FAD25"><enum>(B)</enum><text>administer any acquired land as part of the Park in accordance with applicable law (including regulations).</text></subparagraph></paragraph> 
<paragraph id="HFEE00CCFA7474DD7ADD22858A24456D2"><enum>(2)</enum><header>National Park Service land</header><text>Notwithstanding the exchange of land under this section, the land described in subsection (a)(3) shall remain within the boundary of the Park.</text></paragraph> 
<paragraph id="HB1F2B402F15E4CF7A5A06DE52F42A03"><enum>(3)</enum><header>Public notice</header><text>The Secretary shall publish in the Federal Register notice of any boundary revision under paragraph (1).</text></paragraph></subsection></section> 
<section id="HD0EF274D190A4B0CB017E0FD499C34D5"><enum>4.</enum><header>Project licensing</header><text display-inline="no-display-inline">Notwithstanding the continued inclusion of the land described in section 3(a)(3) in the boundary of the Park (including any modification made pursuant to section 3(b)) on completion of the land exchange, the Commission shall have jurisdiction to license the Project.</text></section> 
<section id="HBABD675B94C249878FB8C8E9028C1F0"><enum>5.</enum><header>Land acquisition</header> 
<subsection id="H06ED55EAD43A46A1935B1DECE2B8003D"><enum>(a)</enum><header>In general</header><text>The Secretary or the Secretary of Agriculture may acquire, from willing owners only, by purchase, donation, or exchange, any land or interest in land that—</text> 
<paragraph id="HB24831A88E7844F499072CA7906E4C00"><enum>(1)</enum><text>may be transferred by APGI to any nongovernmental organization; and</text></paragraph> 
<paragraph id="H1167A583FA884DF9BCD83F1072E125EC"><enum>(2)</enum><text>is identified as <quote>Permanent Easement</quote> or <quote>Term Easement</quote> on the map entitled <quote>Tapoco Hydroelectric Project, P–2169, Settlement Agreement, Appendix B, Proposed Land Conveyances in Tennessee</quote>, numbered TP616, Issue No. 15, and dated March 11, 2004.</text></paragraph></subsection> 
<subsection id="HBBE40800D3964E72A000616C90D3EDB1"><enum>(b)</enum><header>Land acquired by the Secretary of the Interior</header><text>The Secretary shall—</text> 
<paragraph id="H4397E2FE53FA4946B7C277CC7BF81B20"><enum>(1)</enum><text>adjust the boundary of the Park to include any land or interest in land acquired by the Secretary under subsection (a);</text></paragraph> 
<paragraph id="HF2FD22F4DB374D5995E09C8C8CCED4E5"><enum>(2)</enum><text>administer any acquired land or interest in land as part of the Park in accordance with applicable law (including regulations); and</text></paragraph> 
<paragraph id="H638A12531AC14792A828E51B6E06C727"><enum>(3)</enum><text>publish notice of the adjustment in the Federal Register.</text></paragraph></subsection> 
<subsection id="HC79F5AA3673145EFB4EAC621E9B39BF6"><enum>(c)</enum><header>Land acquired by the Secretary of Agriculture</header> 
<paragraph id="H41827D201B8E42459E6584D8ECA8FCB"><enum>(1)</enum><header>Boundary adjustment</header><text>The Secretary of Agriculture shall—</text> 
<subparagraph id="H95C5EE4A7BA646E3A2D298334DCCC8F"><enum>(A)</enum><text>adjust the boundary of the Cherokee National Forest to include any land acquired under subsection (a);</text></subparagraph> 
<subparagraph id="H349F736C1D7E4808A7E177E096D2C000"><enum>(B)</enum><text>administer any acquired land or interest in land as part of the Cherokee National Forest in accordance with applicable law (including regulations); and</text></subparagraph> 
<subparagraph id="H68D31E924D184C7FAA21F26C0000C0C2"><enum>(C)</enum><text>publish notice of the adjustment in the Federal Register.</text></subparagraph></paragraph> 
<paragraph id="H4AACFF1922A64A949DA23C4C00BD9D22"><enum>(2)</enum><header>Management</header><text>The Secretary of Agriculture shall evaluate the feasibility of managing any land acquired by the Secretary of Agriculture under subsection (a) in a manner that retains the primitive, back-country character of the land.</text></paragraph></subsection></section> 
<section id="H063E940F0F894555A7267F7D78F28676"><enum>6.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this Act.</text></section>
