<official-title>To amend the Servicemembers Civil Relief Act to make certain improvements and technical corrections to that Act.</official-title>

<section id="HE5E430BA32C446138FE4603DD111E6CE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Servicemembers Legal Protection Act of 2004</short-title></quote>.</text></section> 
<section id="HCEC0B5A271234A2BB6B7AD4D1942CFA1"><enum>2.</enum><header>Clarification of meaning of <quote>judgment</quote> as used in the Act</header><text display-inline="no-display-inline">Section 101 of the Servicemembers Civil Relief Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/511">50 U.S.C. App. 511</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HBBF1236140974949AC17C977C2AAF601"><enum>(9)</enum><header>Judgment</header><text display-inline="yes-display-inline">The term <term>judgment</term> means any judgment, decree, order, or ruling, final or temporary.</text></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H51C7035573D54AC98F81B91E0873A3BF"><enum>3.</enum><header>Requirements relating to waiver of rights under the Act</header> <text display-inline="no-display-inline">Section 107 of the Servicemembers Civil Relief Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/517">50 U.S.C. App. 517</external-xref>) is amended—</text> 
<paragraph id="HE161190EB987487600ABEECD37693FAA"><enum>(1)</enum><text>In subsection (a), by inserting after the first sentence the following new sentence: <quote>Any such waiver that applies to an action listed in subsection (b) of this section is effective only if it is in writing and is executed as an instrument separate from the obligation or liability to which it applies.</quote>; </text> </paragraph> 
<paragraph id="H7A26FC2EC7794836BEEA2C128C631B"><enum>(2)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph> 
<paragraph id="H007162F74E7143AD8BA9E741191FC3D1"><enum>(3)</enum><text>by inserting after subsection (b) the following new subsection (c):</text>

<subsection id="HD23FBB46367E473C877F971BA7E46C7F"><enum>(c)</enum><header>Prominent display of certain contract rights waivers</header><text display-inline="yes-display-inline">Any waiver in writing of a right or protection provided by this Act that applies to a contract, lease, or similar legal instrument must be in at least 12 point type.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HFCF516FA6F79478BA75E8279C1A73F92"><enum>4.</enum><header>Right of servicemember plaintiffs to request stay of civil proceedings</header><text display-inline="no-display-inline">Section 202(a) of the Servicemembers Civil Relief Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/522">50 U.S.C. App. 522(a)</external-xref>) is amended by inserting <quote>plaintiff or</quote> before <quote>defendant</quote>.</text></section> 
<section id="HC85CEC8AD357492F9905D2325D54AE87"><enum>5.</enum><header>Termination of leases</header> 
<subsection id="H531F8FCC47FE46D2BEC4BF003304BF8F"><enum>(a)</enum><header>Joint leases</header><text display-inline="yes-display-inline">Subsection (a) of section 305 of the Servicemembers Civil Relief Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/535">50 U.S.C. App. 535</external-xref>) is amended—</text> 
<paragraph id="HE4DB5B2EE5A34CF7B6958B178000DEA"><enum>(1)</enum><text>by designating the text of that subsection as paragraph (1), inserting before <quote>The lessee on a</quote> the following: <quote><header-in-text level="paragraph">In general</header-in-text> </quote>, redesignating paragraphs (1) and (2) thereof as subparagraphs (A) and (B), respectively, and realigning that text so as to be indented two ems to the right; and</text></paragraph> 
<paragraph id="HF6D9C181D4DC48BDA2D3B94DC452733"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="HA008AB9C3F3D4FF295377BB7DB826123" display-inline="no-display-inline"> 
<paragraph id="HA1436E9640D349E2A67165B5AD7BAFE9"><enum>(2)</enum><header>Joint leases</header><text display-inline="yes-display-inline">A lessee’s termination of a lease pursuant to this subsection shall terminate any obligation a dependent of the lessee may have under the lease.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H979B11738186492A9C975ECD42A03D30"><enum>(b)</enum><header>Motor vehicles leases</header> 
<paragraph id="H45F841D805C149A7A57B8B90F205E9ED"><enum>(1)</enum><header>Applicability to pcs orders from states outside conus</header><text display-inline="yes-display-inline">Subparagraph (B) of subsection (b)(2) of such section is amended by striking <quote>military orders for</quote> and all that follows through <quote>or to deploy</quote> and inserting </text> 
<quoted-block style="USC" id="H4071C13F599E4088849CA3488DC3E15" display-inline="yes-display-inline"><text display-inline="yes-display-inline">military orders—</text> 
<clause id="H0BB0F284E7CA4475A2D4B2D653D06374"><enum>(i)</enum><text>for a change of permanent station—</text> 
<subclause id="H2F27286F14644D59BF68A8C03D7C1473"><enum>(I)</enum><text>from a location in the continental United States to a location outside the continental United States; or</text></subclause> 
<subclause id="HD77BB277D8924E9F832D59CD1BC55EB1"><enum>(II)</enum><text>from a location in a State outside the continental United States to any location outside that State; or</text></subclause></clause> 
<clause id="H9BAC978C4DAF462683E625479DFA8924"><enum>(ii)</enum><text>to deploy</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H6A4C694C2EDB4C359734F0E28D49B3DE"><enum>(2)</enum><header>Definitions</header><text>Such section is further amended by adding at the end the following new subsection:</text>

<subsection id="HEB7FAFDC57484FBBB299D28F29A925CD"><enum>(i)</enum><header>Definitions</header> 
<paragraph id="H4510D28A56704FC9B98FC0171021E1CB"><enum>(1)</enum><header>Military orders</header><text>The term <term>military orders</term>, with respect to a servicemember, means official military orders, or any notification, certification, or verification from the servicemember’s commanding officer, with respect to the servicemember’s current or future military duty status.</text></paragraph> 
<paragraph id="H17059967FB944A90B966E91EDF6ED744"><enum>(2)</enum><header>Conus</header><text>The term <term>continental United States</term> means the 48 contiguous States and the District of Columbia.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H0EDBC70AC59F4D24A9CB7D7E88C4403"><enum>(c)</enum><header>Coverage of individual deployments</header><text display-inline="yes-display-inline">Subsection (b) of such section is further amended in paragraph (1)(B) and paragraph (2)(B)(ii) (as designated by subsection (b) of this section) by inserting <quote>, or as an individual in support of a military operation,</quote> after <quote>deploy with a military unit</quote>.</text></subsection> </section> 
<section id="HE840544E459F42BAA3C13735B73F374"><enum>6.</enum><header>Prevention of double taxation of certain servicemembers</header><text display-inline="no-display-inline">Section 511(c) of the Servicemembers Civil Relief Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/571">50 U.S.C. App. 571(c)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H3148B58B270C4E689500E0E193B39492"><enum>(5)</enum><header>Use, excise, or similar taxes</header><text>A tax jurisdiction may not impose a use, excise, or similar tax on the personal property of a nonresident servicemember when the laws of the tax jurisdiction fail to provide a credit against such taxes for sales, use, exercise, or similar taxes previously paid on the same property to another tax jurisdiction.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>
