<official-title>To authorize the Secretary of the Army to provide Federal assistance for environmental infrastructure projects in northern and northeastern Kentucky.</official-title>

<section id="H2FCBD07EC84B4D839332674CA7ECD17D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PRIDE Plus Act</short-title></quote>.</text></section> 
<section id="H8399759DFB8F4506BE290283D53B49F5" section-type="subsequent-section"><enum>2.</enum><header>Northern and Northeastern Kentucky</header> 
<subsection id="HD2E848E8ACD2491BBC6C114E040010DE"><enum>(a)</enum><header>Northern and northeastern kentucky defined</header><text>In this section, the term <quote>Northern and Northeastern Kentucky</quote> means the counties of Bath, Boone, Boyd, Bracken, Campbell, Carroll, Carter, Elliot, Fleming, Gallatin, Grant, Greenup, Harrison, Henry, Kenton, Lewis, Mason, Nicholas, Oldham, Owen, Pendleton, Robertson, Scott, and Trimble, Kentucky.</text></subsection> 
<subsection id="H38B5F0F1E1104DF19B641C6D2922F268"><enum>(b)</enum><header>Establishment of program</header><text>The Secretary of the Army may establish a program to provide environmental assistance to non-Federal interests in Northern and Northeastern Kentucky.</text></subsection> 
<subsection id="HB1A54D905C0645F2A600F08FA143CF46"><enum>(c)</enum><header>Form of assistance</header><text>Assistance under this section may be in the form of design and construction assistance for water-related environmental infrastructure and resource protection and development projects in Northern and Northeastern Kentucky, including projects for wastewater treatment and related facilities, water supply and related facilities, environmental restoration, and surface water resource protection and development.</text></subsection> 
<subsection id="HF7352D71B81449DB94DA076B8400D3BE"><enum>(d)</enum><header>Public ownership requirement</header><text>The Secretary may provide assistance for a project under this section only if the project is publicly owned.</text></subsection> 
<subsection id="HCE13C176740F48E5950018C5001B5B5F"><enum>(e)</enum><header>Local cooperation agreements</header> 
<paragraph id="HC284E648673645EFA2464DB44E232CDD"><enum>(1)</enum><header>In general</header><text>Before providing assistance under this section, the Secretary shall enter into a local cooperation agreement with a non-Federal interest to provide for design and construction of the project to be carried out with the assistance.</text></paragraph> 
<paragraph id="H31F07CE2C08741009146ECF830CCB0D9"><enum>(2)</enum><header>Requirements</header><text>Each local cooperation agreement entered into under this subsection shall provide for the following:</text> 
<subparagraph id="H91B06FBD9CF642EEA1507D1BE357B21B"><enum>(A)</enum><header>Plan</header><text>Development by the Secretary, in consultation with appropriate Federal and State officials, of a facilities or resource protection and development plan, including appropriate engineering plans and specifications.</text></subparagraph> 
<subparagraph id="H379B909317C94D58BC76D33DA0C2BF74"><enum>(B)</enum><header>Legal and institutional structures</header><text>Establishment of such legal and institutional structures as are necessary to ensure the effective long-term operation of the project by the non-Federal interest.</text></subparagraph></paragraph> 
<paragraph id="HE6F53DD8EA3D457394AD581F18AC0310"><enum>(3)</enum><header>Cost sharing</header> 
<subparagraph id="H5302E67AFE9743C69FD6E8703F7CB6B7"><enum>(A)</enum><header>In general</header><text>The Federal share of the project costs under each local cooperation agreement entered into under this subsection shall be 75 percent. The Federal share may be in the form of grants or reimbursements of project costs.</text></subparagraph> 
<subparagraph id="HE6AD7EA8BAB7460EBAB4F014B3F8BB7D"><enum>(B)</enum><header>Credit for design work</header><text>The non-Federal interest shall receive credit for the reasonable costs of design work completed by the non-Federal interest before entering into a local cooperation agreement with the Secretary for a project.</text></subparagraph> 
<subparagraph id="HD09AE6A824F44132A5A4950214335F02"><enum>(C)</enum><header>Credit for interest</header><text>In case of a delay in the funding of the non-Federal share of a project that is the subject of an agreement under this section, the non-Federal interest shall receive credit for reasonable interest incurred in providing the non-Federal share of the project’s costs.</text></subparagraph> 
<subparagraph id="H9B5EC81B2CCE4718B06413A818AD732F"><enum>(D)</enum><header>Land, easements, and rights-of-way credit</header><text>The non-Federal interest shall receive credit for land, easements, rights-of-way, and relocations toward the non-Federal share of project costs (including all reasonable costs associated with obtaining permits necessary for the construction, operations, and maintenance of the project on publicly owned or controlled land), but not to exceed 25 percent of total project costs.</text></subparagraph> 
<subparagraph id="H1770D6362BE74376A9DBBFE586DDE37B"><enum>(E)</enum><header>Operations and maintenance</header><text>The non-Federal share of operation and maintenance costs for projects constructed with assistance provided under this section shall be 100 percent.</text></subparagraph></paragraph></subsection> 
<subsection id="HCB989A80F0E14D998028F7FF006E42A4"><enum>(f)</enum><header>Applicability of other federal and state laws</header><text>Nothing in this section waives, limits, or otherwise affects the applicability of any provision of Federal or State law that would otherwise apply to a project to be carried out with assistance provided under this section.</text></subsection> 
<subsection id="H5F320BD72E1D4456B992BAB406CCB063"><enum>(g)</enum><header>Report</header><text>Not later than December 31, 2005, the Secretary shall transmit to Congress a report on the results of the program carried out under this section, including a recommendation concerning whether the program should be implemented on a national basis.</text></subsection> 
<subsection id="H9F3E018AB2824B0EA9476766F30065DE"><enum>(h)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $10,000,000. Such funds shall remain available until expended.</text></subsection></section>
