<official-title>To ensure that advertising campaigns paid for by the Federal Government are unbiased, and for other purposes.</official-title>

<section section-type="section-one" id="H03A424D90FBC435096EF3371E0EEAAD8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Advertising Reform Act of 2004</short-title></quote>.</text></section> 
<section id="H790BF5629466430984D1E5A5F3F6E1A2"><enum>2.</enum><header>Findings and purposes</header> 
<subsection id="H6F580B37EB0E42D1ABCBE971565924E3"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> 
<paragraph id="H0CA66788ED9C4CC6B520E752165E58EB"><enum>(1)</enum><text>a February 2004 Congressional Research Service report states that the advertising industry estimates the Federal Government spends over $1,000,000,000 each year on advertising;</text></paragraph> 
<paragraph id="HD8B89ADAF0324E1BBA66C4A46FF40835"><enum>(2)</enum><text>under the rules and regulations that apply to the Federal Government and advertising campaigns run by the Federal Government, there are few restrictions on advertising by the Federal Government; and</text></paragraph> 
<paragraph id="HBB1B1B2CC8D14E3EA436350080AC99D6"><enum>(3)</enum><text>currently, there is no single agency charged with tracking and overseeing advertising expenditures by Federal agencies.</text></paragraph></subsection> 
<subsection id="HBDA942A15C3948948CCECAB039432948"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are to—</text> 
<paragraph id="H48FB83615CCF45EEA5CC1EEFD4F9BAB6"><enum>(1)</enum><text>ensure that advertising campaigns paid for by the Federal Government are unbiased and do not contain a political message or covert propaganda;</text></paragraph> 
<paragraph id="HBCAC182FC304400E8C80CEB55B6D32D5"><enum>(2)</enum><text>highlight the lack of oversight and evaluation of advertising campaigns paid for by the Federal Government; and</text></paragraph> 
<paragraph id="H27341D13A3634765B97F1487E34CCA82"><enum>(3)</enum><text>ensure that advertising campaigns in excess of $10,000,000 per year are evaluated and approved by an independent entity such as the General Accounting Office.</text></paragraph></subsection></section> 
<section id="HAF364602F60448718856F3E6B4CAEBD6"><enum>3.</enum><header>Limitation on advertising expenditures</header> 
<subsection id="HC5C0C29A3C144D3788B710356F40D44F"><enum>(a)</enum><header>In general</header><text>In any fiscal year, if the amounts appropriated to an agency exceed $10,000,000 to prepare or produce print, radio, or television advertising campaigns, as well as video news releases, uses of outdoor media, and Internet advertisements on websites not operated by the Federal Government, those amounts shall not be expended by the agency unless—</text> 
<paragraph id="H4F503DE45C6448E9B225C5E253BC5952"><enum>(1)</enum><text>any proposed advertisement is submitted to the Comptroller General of the United States for review; and</text></paragraph> 
<paragraph id="H62AC99ED8C294BDE887DFF97E9B5417"><enum>(2)</enum><text>the Comptroller General determines that the proposed advertisement does not contain a political message, and is not false, misleading, or deceptive.</text></paragraph></subsection> 
<subsection id="H01F3570294714FC6ACCD169DA2F05ED"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H74378C263A304EB5A86213B112F5B44"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning provided that term by <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="H9972610432DC4DCC94A2C153E8955B2"><enum>(2)</enum><header>False, misleading, or deceptive</header><text>The term <term>false, misleading, or deceptive</term> has the meaning provided that term under rules and regulations promulgated by the Federal Trade Commission.</text></paragraph></subsection></section>
