<section id="HFB1E33621A6341888C3EC85EDD608DF" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Terrorism Insurance Backstop Extension Act of 2004</quote>.</text></section> 
<section id="H083AD46556F4458CAC593633D6587932"><enum>2.</enum><header>Extension of terrorism insurance program</header> 
<subsection id="H611B12A2CE7648C18C009FBA0000BC00"><enum>(a)</enum><header>Program years 4 and 5</header><text>Paragraph (11) of section 102 of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended by adding at the end the following new subparagraphs:</text> 
<quoted-block id="HC636BC5CB16D4F9C8E8C4C2C16495D01" style="OLC"> 
<subparagraph id="HE9BCD954B5984F298BA1DC25C6403EC9"><enum>(E)</enum><header>Program year 4</header><text>The term <quote>Program Year 4</quote> means the period beginning on January 1, 2006 and ending on December 31, 2006.</text></subparagraph> 
<subparagraph id="H7617042F5B3F4135BFAB32F6CF164EB0"><enum>(F)</enum><header>Program year 5</header><text>The term <quote>Program Year 5</quote> means the period beginning on January 1, 2007 and ending on December 31, 2007.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8C0E3600E9864119BB00AD7D06C82A9"><enum>(b)</enum><header>Insurer deductible</header><text>Paragraph (7) of section 102 of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended—</text> 
<paragraph id="H0A4CEB4E117C46879C45ECA8C3CBE97C"><enum>(1)</enum><text>by redesignating subparagraph (E) as subparagraph (G);</text></paragraph> 
<paragraph id="H33C5FD746B4C44080040CBB5656F84FE"><enum>(2)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H8F8483EEF70C4776A1CBFBA7EA0026FD"><enum>(3)</enum><text>by inserting after subparagraph (D) the following new subparagraphs:</text>

<subsection id="HAD47E2132132430A8EA0DCACFC2603B7"><enum>(c)</enum><header>Mandatory availability</header><text>Subsection (c) of section 103 of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended—</text> 
<paragraph id="H8EA2A67B46F14BA5AF284223D4198FFA"><enum>(1)</enum><text>by striking all of the matter that precedes subparagraph (A) of paragraph (1) and inserting the following:</text>

<paragraph id="HBFFCE2344F3F45D08B5922F06CD66BED"><enum>(3)</enum><text>by redesignating subparagraphs (A) and (B) as paragraphs (1) and (2) and realigning such paragraphs, as so redesignated, so as to be indented 2 ems from the left margin.</text></paragraph></subsection> 
<subsection id="H750289D0C3E54ABAA5ADD42204638842"><enum>(d)</enum><header>Insured loss shared compensation</header><text>Subsection (e) of section 103 of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended—</text> 
<paragraph id="HEC8EF2D04DC24FDE9F211500D720FAAF"><enum>(1)</enum><text>in paragraph (2)(A), by striking <quote>or Program Year 3</quote> and inserting <quote>, Program Year 3, Program Year 4, or Program Year 5</quote>;</text></paragraph>

<subparagraph id="H3B28EC4C41044C0DB10097B2851C4A8"><enum>(B)</enum><text>in section 103—</text>

<subparagraph id="HF86FE26FEB3C4C0B98003689AD929735"><enum>(F)</enum><text display-inline="yes-display-inline">for each of the periods referred to in subparagraphs (A) through (E), the amounts provided under such subparagraphs, as such amounts shall be increased by the Secretary before the expiration of the 90-day period beginning on the date of the enactment of the Terrorism Insurance Backstop Extension Act of 2004, based on the increase in the size of the Program caused by the inclusion of group life insurance pursuant to such Act, in proportion to the increased premiums involved.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause> 
<subclause id="HB345BAA5C05D4720899770479DA66050"><enum>(III)</enum><text display-inline="yes-display-inline">in paragraph (7)(C), by inserting <quote>or group life insurance</quote> after <quote>workers compensation</quote>;</text></subclause>

<paragraph id="HCC08675579284B258B6225E3FFBB7DEB"><enum>(3)</enum><header>Required rulemaking</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of the Treasury shall issue final regulations to carry out this subsection.</text></paragraph></subsection> 
<subsection id="H8C0E583C47854D42968E4CD0A1E33C26"><enum>(f)</enum><header>Study on long-term solutions</header><text>Section 103 of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended by striking subsection (i) and inserting the following new subsection:</text>

<paragraph id="HCAC0B5B09AD9437A90A54CDCEA545100"><enum>(2)</enum><header>Final GAO study and report</header><text display-inline="yes-display-inline">Subsection (d) of section 108 of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended by adding at the end the following new paragraph:</text>
