<official-title>To amend title XVIII of the Social Security Act to provide for coverage of screening ultrasound for abdominal aortic aneurysms under part B of the Medicare Program.</official-title>

<section id="H03478EAC3DDC42599E4724CF7106004B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Screening Abdominal Aortic Aneurysms Very Efficiently (SAAAVE) Act</short-title></quote>.</text></section> 
<section id="H7C96AFB10FE34889A79EF25BE34E79B" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Medicare coverage of screening ultrasound for abdominal aortic aneurysms</header> 
<subsection id="HF8235D0B6A784793B11F80976BD2A7B4"><enum>(a)</enum><header>In general</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>), as amended by sections 611, 612, 613, 642, and 706 of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>), is amended—</text> 
<paragraph id="H2D0FC5B95C9D40DAA92F245125C132C6"><enum>(1)</enum><text>in subsection (s)(2)—</text> 
<subparagraph id="HC74C2A3EE8DC41C4BFAA0794565D98F8"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of subparagraph (Y);</text></subparagraph> 
<subparagraph id="HAB212528835640E8869ED25240D33584"><enum>(B)</enum><text>by adding <quote>and</quote> at the end of subparagraph (Z); and</text></subparagraph> 
<subparagraph id="HA39633B77109443E8941956BF79B6CE"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text>

<paragraph id="H31B4968E439D46C7B223E747C2D1EB21"><enum>(AA)</enum><text>screening ultrasound for abdominal aortic aneurysm (as defined in subsection (bbb)) for an individual who has not been previously furnished such a screening ultrasound and who—</text> 
<quoted-block style="OLC" id="H92074C74C0334573B952DDF51F6B7F6F" display-inline="no-display-inline"> 
<subparagraph id="H5985B5E0088941CCB2BF56FB595F15DA"><enum>(i)</enum><text>has a family history of abdominal aortic aneurysm;</text></subparagraph> 
<subparagraph id="H9B7B4A56DA324360BFFD214E1F348466"><enum>(ii)</enum><text>manifests risk factors for cardiovascular disease (such as smoking or hypertension);</text></subparagraph> 
<subparagraph id="HEDB5155B1419414AB9B46C3B9FF667B0"><enum>(iii)</enum><text>evidences arthrosclerotic vascular disease; or</text></subparagraph> 
<subparagraph id="HB1A00E9BFB8F45F69895A07DBE00784B"><enum>(iv)</enum><text>has other risk factors for abdominal aortic aneurysm as the Secretary may specify;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H25B0C480B77947C598E84E8771E961B4"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> 
<quoted-block style="other" id="H47E4619DCC3F4EE6903CF269001B22CA" display-inline="no-display-inline" other-style="archaic"> 
<subsection id="H5014F0D904F74548A4BC868D7EBFC276"><enum>(bbb)</enum><header>Screening ultrasound for abdominal aortic aneurysm</header><text display-inline="yes-display-inline">The term <quote>screening ultrasound for abdominal aortic aneurysm</quote> means—</text> 
<paragraph id="H85F1094CF2FF45FA88BCCBA0AEC5EB1F"><enum>(1)</enum><text>a procedure using sound waves (or such other procedures using alternative technologies, of commensurate accuracy and cost, that the Secretary may specify) provided for the early detection of abdominal aortic aneurysm, and</text></paragraph> 
<paragraph id="H6A9A61FE869046A79293AEA5F7E88E3D"><enum>(2)</enum><text>includes a physician’s interpretation of the results of the procedure.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HA722A11984004D3B93698F9FC03861FF"><enum>(b)</enum><header>Inclusion of screening ultrasound for abdominal aortic aneurysm in screening services for which education, counseling, and referral is provided for under benefits for initial preventive physical examination</header><text display-inline="yes-display-inline">Section 1861(ww)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ww)(2)</external-xref>), as added by section 611(b) of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>), is amended by adding at the end the following new subparagraph:</text>

<paragraph id="H365CDAA6FDC04D5786137C07151F2005"><enum>(L)</enum><text display-inline="yes-display-inline">Screening ultrasound for abdominal aortic aneurysm as defined in section 1861(bbb).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H11E3FA024AAC44169E00B22E61258692"><enum>(c)</enum><header>Payment for screening ultrasound for abdominal aortic aneurysm</header> 
<paragraph id="H496637EC8F024331828208C7321FE802" display-inline="yes-display-inline"><enum>(1)</enum><text>Section 1848(j)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(j)(3)</external-xref>) is amended by inserting <quote>(2)(AA)</quote> after <quote>(2)(W)</quote>. </text></paragraph></subsection> 
<subsection id="HC67FB61085384D6B901E3FAD49F7BA7"><enum>(d)</enum><header>Frequency and quality standards</header><text>Section 1862(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(a)(1)</external-xref>), as amended by sections 303, 611, 612, and 613 of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003, is amended—</text> 
<paragraph id="HFBA990F580234F6485414CB519512FCA"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of subparagraph (L);</text></paragraph> 
<paragraph id="H7FBADCCAEC654293A99F13CDD27D8DF8"><enum>(2)</enum><text>by striking the semicolon at the end of subparagraph (M) and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HDDE207D279284F7A80EED160C3FF4E80"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="H2C54B7FDC6754DA800724516123FD655" display-inline="no-display-inline"> 
<paragraph id="HA86C1D42F4BA4D4E8203EF271B20A434"><enum>(N)</enum><text>in the case of screening ultrasound for abdominal aortic aneurysm—</text> 
<subparagraph id="H4599358D8E084121B9B96B24CB9FDA76"><enum>(i)</enum><text>which is performed more frequently than is provided for under section 1861(s)(2)(AA); or</text></subparagraph> 
<subparagraph id="H69255D382AA64F7CA8F0EAB1E0CAC335"><enum>(ii)</enum><text>which is performed by an individual or diagnostic laboratory that does not meet quality assurance standards established by the Secretary, including with respect to individuals performing screening ultrasound for abdominal aortic aneurysm (other than physicians) and diagnostic laboratories, that the individual or laboratory is certified by the appropriate State licensing or certification agency or, in the case of a services performed in a State that does not license or certify such individuals or laboratories, by a national certification or accreditation organization recognized by the Secretary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H0A1A29E228E64CCAB92E82FC94E335A7"><enum>(e)</enum><header>Non-application of part b deductible</header><text>Section 1833(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(b)</external-xref>) is amended—</text> 
<paragraph id="HDAA53069DB0546EDACCFACBD181E0276"><enum>(1)</enum><text>by striking <quote>and</quote> after <quote>section 1861(jj)),</quote>; and</text></paragraph> 
<paragraph id="H0241140EF19D4CF39B8979A8D3AA987E"><enum>(2)</enum><text>by inserting <quote>, and (7) such deductible shall not apply with respect to screening ultrasound for abdominal aortic aneurysm (as defined in section 1861(bbb))</quote> after <quote>1861(nn))</quote>.</text></paragraph></subsection> 
<subsection id="HD0DBBE47CA32407088305C3BC9653A9"><enum>(f)</enum><header>Consultation in establishment of quality assurance standards and designation of recognition of national accreditation organizations</header><text display-inline="yes-display-inline">The Secretary shall consult with national medical, vascular technologist and sonographer societies in establishing—</text> 
<paragraph id="H9BF5F2E5936F469FB958E93FF2A473D"><enum>(1)</enum><text>risk factors under section 1861(s)(2)(A)(iv) of the Social Security Act, as added by subsection (a)(1)(C), and</text></paragraph> 
<paragraph id="HCFBBC6CB3086490FBA4FEADC2945BDA6"><enum>(2)</enum><text>quality assurance standards under section 1862(a)(1)(N)(ii) of such Act, as added by subsection (d)(3).</text></paragraph></subsection> 
<subsection id="H27EE93DE2BEA40B493C68980CB7500AD"><enum>(g)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to screening ultrasounds for abdominal aortic aneurysm performed on or after January 1, 2005.</text></subsection></section> 
<section id="H680AE71832DE407BBE43B3C54ED4BF3F"><enum>3.</enum><header>National educational and information campaign</header> 
<subsection id="H5284398A8F0C4BC58CCDB6FB89503E0"><enum>(a)</enum><header>In general</header><text>After consultation with national medical, vascular technologist and sonographer societies, the Secretary of Health and Human Services shall carry out a national education and information campaign to promote awareness among health care practitioners and the general public with respect to the importance of early detection and treatment of abdominal aortic aneurysms.</text></subsection> 
<subsection id="HCD11FE9A717F4FD7B626E99193CE8466"><enum>(b)</enum><header>Use of funds</header><text>The Secretary may use amounts appropriated pursuant to this subsection to make grants to national medical, vascular technologist, and sonographer societies (in accordance with procedures and criteria specified by the Secretary) to enable them to educate practitioners and providers about matters relating to such aneurysms.</text></subsection> 
<subsection id="H9E4CDE3D927143E9A1CD7B25BD1767CB"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated for fiscal year 2005 and each fiscal year thereafter such sums as may be necessary to carry out this section.</text></subsection></section>
