<legis-type>A BILL</legis-type> 
<official-title>To amend title 38, United States Code, to provide that an injury or death sustained as a result of participation in a medical research program of the Department of Veterans Affairs shall be treated for purpose of benefits under laws administered by the Secretary of Veterans Affairs in the same manner as if the injury were incurred as a result of military service, and for other purposes.</official-title>

<section id="HFEF31837985D4A9FB3BC765918632182" section-type="section-one"><enum>1.</enum><header>Injuries and deaths sustained as a result of participation in a medical research program of the Department of Veterans Affairs to be treated in the same manner as if incurred as a result of military service</header> <text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/1151">Section 1151</external-xref> of title 38, United States Code, is amended by adding at the end the following new subsection:</text> 
<quoted-block style="USC" id="H8504F29B5B25479FB6A04C90F29FD5E" display-inline="no-display-inline"> 
<subsection id="H5A49F2FB55E440B69980644E1F429FAB"><enum>(c)</enum><text>In the case of an individual who after January 1, 1980, participated in a medical research program conducted by the Department under <external-xref legal-doc="usc" parsable-cite="usc/38/7303">section 7303</external-xref> of this title, a subsequent disability, or the death, of the individual shall be treated for the purposes of the first sentence of subsection (a) in the same manner as if the disability or death were a qualifying additional disability or qualifying death, and the individual (if not a veteran) shall be treated for the purposes of that sentence in the same manner as if the individual were a veteran, if—</text> 
<paragraph id="H1ECB89AE236642329BCFBA86A9FBEFBA"><enum>(1)</enum><text>the disability or death was caused by that individual’s participation in that research program;</text> </paragraph> 
<paragraph id="H09689F60E358401D00BF888BF2BB9CA"><enum>(2)</enum><text>the disability or death was not the result of the individual’s willful misconduct; and</text></paragraph> 
<paragraph id="H467E9A5EDDA84D4AACB7EB4FCC78D50"><enum>(3)</enum><text>the proximate cause of the disability or death was—</text> 
<subparagraph id="H6BBC450BFE454A41BC9986ABAF77DA81"><enum>(A)</enum><text>carelessness, negligence, lack of proper skill, error in judgment, or similar instance of fault on the part of the Department in the conduct of the research program; or</text></subparagraph> 
<subparagraph id="H508BA27BE84E48F8B9698528B486DDE9"><enum>(B)</enum><text>an event not reasonably foreseeable.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H63C18A502FA5478DBB1C16D7631FC100"><enum>2.</enum><header>Independent study of adjudications under section 1151</header> 
<subsection id="H8E0567D0A1F643DBB7A003FDA5162CF"><enum>(a)</enum><header>Study Required</header><text> The Secretary of Veterans Affairs shall provide, by contract, for an independent study to be conducted on the experience of the Department of Veterans Affairs in adjudicating claims under <external-xref legal-doc="usc" parsable-cite="usc/38/1151">section 1151</external-xref> of title 38, United States Code.</text></subsection> 
<subsection id="HF411BB11066A4D2387D8798D0231D821"><enum>(b)</enum><header>Matter to be studied</header><text>The entity selected to perform the study under subsection (a) shall evaluate the resolution of a representative sample of claims under <external-xref legal-doc="usc" parsable-cite="usc/38/1151">section 1151</external-xref> of title 38, United States Code, selected from the period of 1998 through 2002 and shall make a determination, for each claim selected for such purpose, as to whether the resolution of the claim was in accordance with the standard specified in that section, as in effect at the time of the resolution of the claim.</text></subsection> 
<subsection id="H0A53E1E371894A22AD72F4513330CE3D"><enum>(c)</enum><header>Report</header><text>The contract under subsection (a) shall provide for a report on the results of the study to be submitted to the Secretary of Veterans Affairs and the Committees on Veterans’ Affairs of the Senate and House of Representatives not later than one year after the date of the enactment of this Act. The report shall include—</text> 
<paragraph id="H9F55BEC726C94937BC67B2F1C8AC71D6"><enum>(1)</enum><text>the results of the review conducted pursuant to the contract; and</text></paragraph> 
<paragraph id="HAF1F53E5A8BF482F8302BCF3B030D8BB"><enum>(2)</enum><text>such recommendations for administrative and legislative changes as would, in the opinion of the entity conducting the study, improve the resolution of claims under that section or provide for a more appropriate standard for the resolution of claims under that section.</text></paragraph></subsection></section>
