<legis-type>A BILL</legis-type> 
<official-title>To provide for review of determinations on whether schools and local educational agencies made adequate yearly progress for the 2002–2003 school year taking into consideration subsequent regulations and guidance applicable to those determinations, and for other purposes.</official-title>

<section id="HE91B2EAE86AC48E6B0D3AEC4E47F8E9F" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>No Child Left Behind Fairness Act of 2004</quote>.</text></section> 
<section id="HD268B8D49F7B431D94CD51DCE1688EE2"><enum>2.</enum><header>Review of determinations on whether schools made adequate yearly progress for 2002–2003 school year</header> 
<subsection id="HDFD71704140B42E28EC5994BA4AD9BE"><enum>(a)</enum><header>In general</header><text>The Secretary of Education shall require each local educational agency to provide each school served by the agency with an opportunity to request a review of a determination by the agency that the school did not make adequate yearly progress for the 2002–2003 school year.</text></subsection> 
<subsection id="HFA5B7F9B8DCF4D4A8F709D878FC6092E"><enum>(b)</enum><header>Final determination</header><text>Not later than 30 days after receipt of a request by a school for a review under this section, a local educational agency shall issue and make publicly available a final determination on whether the school made adequate yearly progress for the 2002–2003 school year.</text></subsection> 
<subsection id="HBC2F6A7454DB46C6BC001C6206789B2F"><enum>(c)</enum><header>Evidence</header><text>In conducting a review under this section, a local educational agency shall—</text> 
<paragraph id="H5E9ED47F8A034863985C6E5BD754D43"><enum>(1)</enum><text>allow the principal of the school involved to submit evidence on whether the school made adequate yearly progress for the 2002–2003 school year; and</text></paragraph> 
<paragraph id="H0662ABD0F22A4EBBBC52A267E0491CF0"><enum>(2)</enum><text>consider that evidence before making a final determination under subsection (b).</text></paragraph> </subsection> 
<subsection id="H6C7625303BE048838D13762496931E00"><enum>(d)</enum><header>Standard of review</header><text>In conducting a review under this section, consistent with the plan under section 1111 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311</external-xref>) for the State involved, a local educational agency shall revise its original determination that a school did not make adequate yearly progress for the 2002–2003 school year if the agency finds that the school made such progress taking into consideration—</text> 
<paragraph id="HC6EB97498CAD424A8520AD2E51169292"><enum>(1)</enum><text>the amendments made to part 200 of title 34 of the Code of Federal Regulations on December 9, 2003 (68 Fed. Reg. 68698) (relating to accountability for the academic achievement of students with the most significant cognitive disabilities); or</text> </paragraph> 
<paragraph id="H49A0C89AA1C644448939D6AFC6360ED"><enum>(2)</enum><text>any regulation or guidance that, subsequent to the date of such original determination, was issued by the Secretary relating to—</text> 
<subparagraph id="HAFB52818101146CD86205E8C3EA44800"><enum>(A)</enum><text>the assessment of limited English proficient children;</text></subparagraph> 
<subparagraph id="H5740600113124BDB005F6923B0777D3"><enum>(B)</enum><text>the inclusion of limited English proficient children as part of the subgroup described in section 1111(b)(2)(C)(v)(II)(dd) of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6311(b)(2)(C)(v)(II)(dd)) after such children have obtained English proficiency; or</text></subparagraph> 
<subparagraph id="H7F80CEAE3C1B4F26BDBD28392EFB439F"><enum>(C)</enum><text>any requirement under section 1111(b)(2)(I)(ii) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(2)(I)(ii)</external-xref>).</text></subparagraph></paragraph></subsection> 
<subsection id="H2E54FA5892264F31865BA1F2A9187047"><enum>(e)</enum><header>Effect of revised determination</header><text/> 
<paragraph id="HF719B6386F3F419C8568043060CD008F"><enum>(1)</enum><header>In general</header><text>If pursuant to a review under this section a local educational agency determines that a school made adequate yearly progress for the 2002–2003 school year, upon such determination—</text> 
<subparagraph id="HB85052DD489C418DA164D16C94529D79"><enum>(A)</enum><text>any action by the Secretary, the State educational agency, or the local educational agency that was taken because of a prior determination that the school did not make such progress shall be terminated; and</text></subparagraph> 
<subparagraph id="H128282C466914E6888C812BECBA13480"><enum>(B)</enum><text>any obligations or actions required of the local educational agency or the school because of the prior determination shall cease to be required.</text></subparagraph></paragraph> 
<paragraph id="H01E9952393F24C5DAC1C9B27D25B6EA1"><enum>(2)</enum><header>Exceptions</header><text>Notwithstanding paragraph (1), a determination under this section shall not affect any obligation or action required of a local educational agency or school under the following:</text> 
<subparagraph id="HAED1D7F2E8554B2982BFAA4F62B14C5C"><enum>(A)</enum><text>Section 1116(b)(13) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6316">20 U.S.C. 6316(b)(13)</external-xref>) (requiring a local educational agency to continue to permit a child who transferred to another school under such section to remain in that school until completion of the highest grade in the school).</text></subparagraph> 
<subparagraph id="H1E1CAAF99A5F408FB954D50761604EEF"><enum>(B)</enum><text>Section 1116(e)(8) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6316">20 U.S.C. 6316(e)(8)</external-xref>) (requiring a local educational agency to continue to provide supplemental educational services under such section until the end of the school year).</text></subparagraph></paragraph> 
<paragraph id="HF164F1BFA5A24092AE932DE77F2F9442"><enum>(3)</enum><header>Subsequent determinations</header><text display-inline="yes-display-inline">In determining whether a school is subject to school improvement, corrective action, or restructuring as a result of not making adequate yearly progress, the Secretary, a State educational agency, or a local educational agency may not take into account a previous determination that the school did not make adequate yearly progress for the 2002–2003 school year if such determination was revised under this section and the school received a final determination of having made adequate yearly progress for the 2002–2003 school year.</text></paragraph></subsection> 
<subsection id="H9EA7E14D410946008B7FC06800BD17DB"><enum>(f)</enum><header>Notification</header><text> The Secretary—</text> 
<paragraph id="H7EEE094DA3D54BB0A3DCCF8C0C8712E"><enum>(1)</enum><text>shall require each State educational agency to notify each school served by the agency of the school’s ability to request a review under this section; and</text></paragraph> 
<paragraph id="H4DD223876C054F9F90255EBAF9473F57"><enum>(2)</enum><text>not later than 30 days after the date of the enactment of this section, shall notify the public by means of the Department of Education’s website of the review process established under this section.</text></paragraph></subsection></section> 
<section id="H2C297CC312E74B9FB6007673FEE2D700"><enum>3.</enum><header>Review of determinations on whether local educational agencies made adequate yearly progress for 2002–2003 school year</header> 
<subsection id="HBAC80C7C9C754BA1BB82C2EA758FA8E1"><enum>(a)</enum><header>In general</header><text>The Secretary shall require each State educational agency to provide each local educational agency in the State with an opportunity to request a review of a determination by the State educational agency that the local educational agency did not make adequate yearly progress for the 2002–2003 school year.</text></subsection> 
<subsection id="HAC253A2E310046C6925F7BD23000089"><enum>(b)</enum><header>Application of certain provisions</header><text>Except as inconsistent with, or inapplicable to, this section, the provisions of section 2 shall apply to review by a State educational agency of a determination described in subsection (a) in the same manner and to the same extent as such provisions apply to review by a local educational agency of a determination described in section 2(a).</text></subsection></section> 
<section id="H79DA2E0FC1B2420EA4F43FB1CBC66A5"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H0864AB5293E54E23AAEF66A610C94B63"><enum>(1)</enum><text>The term <term>adequate yearly progress</term> has the meaning given to that term in section 1111(b)(2)(C) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(2)(C)</external-xref>).</text></paragraph> 
<paragraph id="H7AAF7DC1FB9A41019CCDEBC8F345F02"><enum>(2)</enum><text>The term <term>local educational agency</term> means a local educational agency (as that term is defined in section 9101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) receiving funds under part A of title I of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>).</text></paragraph> 
<paragraph id="HAFAF3573C1BE4442939500DF03CC03DF"><enum>(3)</enum><text>The term <term>Secretary</term> means the Secretary of Education.</text></paragraph> 
<paragraph id="HCAA2530AABA743D9996573935B80355E"><enum>(4)</enum><text>The term <term>school</term> means an elementary school or a secondary school (as those terms are defined in section 9101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) served under part A of title I of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>).</text></paragraph> 
<paragraph id="H5440F684CE284ADAB48FC900DCDFCD81"><enum>(5)</enum><text>The term <term>State educational agency</term> means a State educational agency (as that term is defined in section 9101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) receiving funds under part A of title I of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>).</text></paragraph></section>
