<section section-type="section-one" id="HECF5C9398386440688A0E3F92D3B4607" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guard and Reserve Retirement Retainer Act of 2004</short-title></quote>.</text></section> 
<section id="HF9141EAA9BCD4247A4A5392C09BDCF00"><enum>2.</enum><header>Eligibility for reduced non-regular service retired pay before age 60</header> 
<subsection id="H79ADBF94FD874F94B277B87991A74816"><enum>(a)</enum><header>Eligibility beginning at age 55</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/12731">Section 12731(a)(1)</external-xref> of title 10, United States Code, is amended by striking <quote>60 years of age</quote> and inserting <quote>55 years of age</quote>.</text></subsection> 
<subsection id="H4D1329E5987341D797B3176BF8154342"><enum>(b)</enum><header>Reduced retired pay when commenced before age 60</header><text>Section 12739 of such title is amended—</text> 
<paragraph id="H453331C39A8A47039B4E477F49C5B280"><enum>(1)</enum><text>in subsection (a), by inserting <quote>, subject to subsection (d),</quote> after <quote>this chapter is</quote>;</text></paragraph> 
<paragraph id="HA4E74FF132374434A0BB519F10E6FDD"><enum>(2)</enum><text>by redesignating subsection (d) as subsection (e); and</text></paragraph> 
<paragraph id="HEAE8FFAAC3A748F8AAEC81BD5DF5DF0"><enum>(3)</enum><text>by inserting after subsection (c) the following new subsection (d):</text>

<subsection id="HDDD17BE7A5844DF7BA8B76032200DB98"><enum>(d)</enum><text>In the case of a person to whom payment of retired pay under this chapter commences after the person attains 55 years of age and before the person attains 60 years of age, the total amount of the monthly retired pay computed under subsections (a), (b), and (c) shall be reduced by the percentage specified for the age of the person when payment of the retired pay commences, as follows:</text>

<section id="H27ED164ED27B4E49B600F4E3F512FAF0"><enum>3.</enum><header>Continuation of age 60 as minimum age for eligibility of non-regular service retirees for health care</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/1074">Section 1074(b)</external-xref> of title 10, United States Code, is amended—</text> 
<paragraph id="H48FD00ECEF5D40BAB16308F8046FD0EB"><enum>(1)</enum><text>by inserting <quote>(1)</quote> after <quote>(b)</quote>; and</text></paragraph> 
<paragraph id="H22AD8752F3744AD4B7A23D7D8D899BC3"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph indent="up1" id="H8007B1553C6F4DE1AD5E12275B3C57C9"><enum>(2)</enum><text>Paragraph (1) does not apply to a member or former member entitled to retired pay for non-regular service under chapter 1223 of this title who is under 60 years of age.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HFFEC6CF6961C4A63B15FF790232942D2"><enum>4.</enum><header>Effective date and applicability</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on the first day of the first month that begins more than 180 days after the date of the enactment of this Act.</text></section>
