<section id="HDEE812926BEE4D72A0EFF2892675C85D"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="H2B42143121924283A17F6E43CA4C6DAB"><enum>(1)</enum><header>County</header><text>The term <term>County</term> means Lincoln County, Nevada.</text></paragraph> 
<paragraph id="HD3982CA9DE2B4837925B4FF3007602F"><enum>(2)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Lincoln County Conservation, Recreation, and Development Act Map</quote> and dated June 14, 2004.</text></paragraph> 
<paragraph id="H7A4168C1C69B4FD990E27477AB267BB"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="H4DC32CCFCA8747CFB60223741F0025DC"><enum>(4)</enum><header>Special account</header><text>The term <term>special account</term> means the special account established under section 103(b)(3).</text></paragraph></section> 
<section id="H11F36CFBC2224A909C01EB139D6FC203"><enum>102.</enum><header>Conveyance of Lincoln County land</header> 
<subsection id="H5767C80DFFA843A1ABD7B78050E0411F"><enum>(a)</enum><header>In general</header><text>Notwithstanding sections 202 and 203 of the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1711">43 U.S.C. 1711</external-xref>, 1712), the Secretary, in cooperation with the County, in accordance with that Act, this title, and other applicable law and subject to valid existing rights, shall conduct sales of— </text> 
<paragraph id="H6A32A6D02DF6471D83A00072187281D6"><enum>(1)</enum><text>the land described in subsection (b)(1) to qualified bidders not later than 75 days after the date of the enactment of this Act; and</text></paragraph> 
<paragraph id="HC3032C6082A142F7A2DF240184E008F"><enum>(2)</enum><text display-inline="yes-display-inline">the land described in subsection (b)(2) to qualified bidders as such land becomes avalable for disposal.</text></paragraph></subsection> 
<subsection id="H7210C061881B4D59885093F9607EEB96"><enum>(b)</enum><header>Description of land</header><text>The land referred to in subsection (a) consists of—</text> 
<paragraph id="H981FCC72EE7C4563B278AC80CFDA9898"><enum>(1)</enum><text>the land identified on the map as <quote>Tract A</quote> and <quote>Tract B</quote> totaling approximately 13,328 acres; and</text></paragraph> 
<paragraph id="H724A63737A724071A69CC1B81E5825C3"><enum>(2)</enum><text display-inline="yes-display-inline">between 87,000 and 90,000 acres of Bureau of Land Management-managed public land in Lincoln County identified for disposal by the Bureau of Land Management either through— </text> 
<subparagraph id="HCFC59DE4C67441D5AC00F7B3FE4B05A0"><enum>(A)</enum><text>the Ely Resource Management Plan (intended to be finalized in 2005); or</text></subparagraph> 
<subparagraph id="HF3F4B7D088F743938470190045BDD6A6"><enum>(B)</enum><text>a subsequent amendment to that land use plan undertaken with full public involvement.</text></subparagraph></paragraph></subsection> 
<subsection id="H18D8B1B38B1E432F97345CA0114794A"><enum>(c)</enum><header>Availability</header><text>Each map and legal description shall be on file and available for public inspection in (as appropriate)—</text> 
<paragraph id="H142C8091186D4C50BDE3FCD4199896F2"><enum>(1)</enum><text>the Office of the Director of the Bureau of Land Management;</text></paragraph> 
<paragraph id="H86D66EDBCAAE4F7288E587999FAEE24B"><enum>(2)</enum><text>the Office of the Nevada State Director of the Bureau of Land Management;</text></paragraph> 
<paragraph id="H67DAFD66B7FA4DF200CE56CEECA47B33"><enum>(3)</enum><text>the Ely Field Office of the Bureau of Land Management; and</text></paragraph> 
<paragraph id="H0C69573D1A6B4BDB8150BFD76E00A70"><enum>(4)</enum><text>the Caliente Field Station of the Bureau of Land Management.</text></paragraph></subsection> 
<subsection id="HF2CD3C7A4EB141EDA776385D3450E902"><enum>(d)</enum><header>Joint selection required</header><text>The Secretary and the County shall jointly select which parcels of land described in subsection (b)(2) to offer for sale under subsection (a).</text></subsection> 
<subsection id="H80CAFE3CE86A4468AC66AFF7016B492"><enum>(e)</enum><header>Compliance with local planning and zoning laws</header><text>Before a sale of land under subsection (a), the County shall submit to the Secretary a certification that qualified bidders have agreed to comply with—</text> 
<paragraph id="HDAD50278944748BC925EB5986223D188"><enum>(1)</enum><text>County and city zoning ordinances; and</text></paragraph> 
<paragraph id="H4F0A871BA2A94B7BB8EB00612D429100"><enum>(2)</enum><text>any master plan for the area approved by the County.</text></paragraph></subsection> 
<subsection id="H3FDCB80AAAA84BC5AF7E4E3BAD405B05"><enum>(f)</enum><header>Method of sale; consideration</header><text>The sale of land under subsection (a) shall be—</text> 
<paragraph id="H3EC0C858DC9742A580A4589ECDF51F96"><enum>(1)</enum><text>through a competitive bidding process unless otherwise determined by the Secretary; and</text></paragraph> 
<paragraph id="HADDB8C6739C44D84B0C01CB6C74F2223"><enum>(2)</enum><text>for not less than fair market value.</text></paragraph></subsection> 
<subsection id="H50E731DD136D477A86BF48F4D06706F"><enum>(g)</enum><header>Withdrawal</header> 
<paragraph id="H568D533EFD854C52A257A188FB6C868F"><enum>(1)</enum><header>In general</header><text>Subject to valid existing rights and except as provided in paragraph (2), the land described in subsection (b) is withdrawn from—</text> 
<subparagraph id="H4A0E0BD3C86D40C3B4C41FDBA536212B"><enum>(A)</enum><text>all forms of entry and appropriation under the public land laws, including the mining laws; and</text></subparagraph> 
<subparagraph id="H351480B76F5A46A58C00F947D3CF979"><enum>(B)</enum><text>operation of the mineral leasing and geothermal leasing laws.</text></subparagraph></paragraph> 
<paragraph id="H8C25FC6222FC4827BEF9ED102F52D6F1"><enum>(2)</enum><header>Exception</header><text>Paragraph (1)(A) shall not apply to a competitive sale or an election by the County to obtain the land described in subsection (b) for public purposes under the Act of June 14, 1926 (43 U.S.C. 869 et seq; commonly known as the <quote>Recreation and Public Purposes Act</quote>).</text></paragraph></subsection> 
<subsection id="H0716A8EFB74B404C94B4F05A99F4B92"><enum>(h)</enum><header>Deadline for sale</header> 
<paragraph id="H4EFBE41F737D41899F5B00FBFB2F5A3"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Secretary shall—</text> 
<subparagraph id="H80A9FC6CB4384606B7268FCE15BCAD18"><enum>(A)</enum><text>notwithstanding the Lincoln County Land Act of 2000 (114 Stat. 1046), not later than 75 days after the date of the enactment of this title, offer by sale the land described in subsection (b)(1) if there is a qualified bidder for such land; and</text></subparagraph> 
<subparagraph id="H60B2260855114B2386A5A65C2BBBDE63"><enum>(B)</enum><text display-inline="yes-display-inline">offer for sale annually lands identified for sale in subsection (b)(2) until such lands are disposed of or unless the county requests a postponement under paragraph (2).</text></subparagraph></paragraph> 
<paragraph id="H109AF18911C044DBAD8CB01E5B29E4DC"><enum>(2)</enum><header>Postponement; exclusion from sale</header> 
<subparagraph id="H134D7877498D4A92A27D797961CBF784"><enum>(A)</enum><header>Request by County for postponement or exclusion</header><text>At the request of the County, the Secretary shall postpone or exclude from the sale all or a portion of the land described in subsection (b)(2).</text></subparagraph> 
<subparagraph id="H9B48F00B21F4461C98FD46FA5126A305"><enum>(B)</enum><header>Indefinite postponement</header><text>Unless specifically requested by the County, a postponement under subparagraph (A) shall not be indefinite.</text></subparagraph></paragraph></subsection></section> 
<section id="H94B07AA4251846F7BC2D16BEB42BFE49"><enum>103.</enum><header>Disposition of proceeds</header> 
<subsection id="H6872AD4739244A58A7181FBFB1A66EA4"><enum>(a)</enum><header>Initial land sale</header><text>Section 5 of the Lincoln County Land Act of 2000 (114 Stat. 1047) shall apply to the disposition of the gross proceeds from the sale of land described in section 102.</text></subsection> 
<subsection id="H23FC3A820E17458A8063D08400F30408"><enum>(b)</enum><header>Subsequent land sales</header><text>Of the gross proceeds of the sale of the land described in section 102(b)(2)—</text> 
<paragraph id="H82E19DA9459C48A4BDC2F4484E655BD2"><enum>(1)</enum><text>5 percent shall be paid directly to the State for use in the general education program of the State;</text></paragraph> 
<paragraph id="HA2690B18BB274F1FA01D9C707D3437C"><enum>(2)</enum><text>45 percent shall be paid to the County for use for economic development in the County, including County parks, trails, and natural areas; and</text></paragraph> 
<paragraph id="H51FEFD3F7F2D4FD08BAD38AADC95B600"><enum>(3)</enum><text>the remainder shall be deposited in a special account in the Treasury of the United States and shall be available without further appropriation to the Secretary until expended for—</text> 
<subparagraph id="HA9F17FA97732432C93FB298BF61786B5"><enum>(A)</enum><text>the inventory, evaluation, protection, and management of unique archaeological resources (as defined in section 3 of the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470bb">16 U.S.C. 470bb</external-xref>)) of the County;</text></subparagraph> 
<subparagraph id="H4CE1BEEDD18645D3887767481B32C5E9"><enum>(B)</enum><text>the development and implementation of a multispecies habitat conservation plan for the County; and</text></subparagraph> 
<subparagraph id="HDDC0C14603774342BF7E68A70000C251"><enum>(C)</enum><text>the reimbursement of costs incurred by the Nevada State Office and the Ely Field Office of the Bureau of Land Management for—</text> 
<clause id="H9DA497A358834EE988A0A7A661D13269"><enum>(i)</enum><text>preparing for the sale of land under section 103(a), including the costs of—</text> 
<subclause id="HE2564DF77FB74EFE94C92DC171BC2935"><enum>(I)</enum><text>conducting any land boundary surveys;</text></subclause> 
<subclause id="H0761A23D81984EFB9BDCA4DF9998BBAB"><enum>(II)</enum><text>complying with the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></subclause> 
<subclause id="H3F2AD41ABBE340DF80831B18E09DD200"><enum>(III)</enum><text>conducting any appraisals;</text></subclause> 
<subclause id="HB267DD69F295493C940029CFCC913226"><enum>(IV)</enum><text>obtaining environmental and cultural clearances; and</text></subclause> 
<subclause id="H0E45EAA93BA8451796CBE542D7C82224"><enum>(V)</enum><text>providing public notice of the sale;</text></subclause></clause> 
<clause id="H963EA9426B2C4EE99CAECF6D8E4B2B3F"><enum>(ii)</enum><text>processing public land use authorizations and rights-of-way relating to the development of the land conveyed under section 102(b)(2);</text></clause> 
<clause id="HE7F084DDAF74432BB0BE76FC98CB866F"><enum>(iii)</enum><text>processing the Silver State OHV trail and implementing the management plan required by section 401(c)(2) of this Act; and</text></clause> 
<clause id="H43218FD04B4F4C68B75D4EC1BB49599"><enum>(iv)</enum><text>processing wilderness designations, including but not limited to, the costs of appropriate fencing, signage, public education, and enforcement for the wilderness areas designated.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H0B1FEF5616A84B6D97F67D8B37B884F1"><enum>(c)</enum><header>Investment of special account</header><text>Any amounts deposited in the special account shall earn interest in an amount determined by the Secretary of the Treasury on the basis of the current average market yield on outstanding marketable obligations of the United States of comparable maturities and may be expended according to the provisions of this section.</text></subsection></section></title> 
<title id="H2B3770F38B97493A9CC906AF9F75C4AE"><enum>II</enum><header>Wilderness areas</header> 
<section id="H65776E4E34074F01B500C70118C6B104"><enum>201.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="H6F6CE6B1A07C45B88288E179A2F76C50"><enum>(1)</enum><text>public land in the County contains unique and spectacular natural resources, including—</text> 
<subparagraph id="H4A5A492D77474E99BD1E7CFD94B2E5B5"><enum>(A)</enum><text>priceless habitat for numerous species of plants and wildlife; and</text></subparagraph> 
<subparagraph id="HC92B9BDB898246B4B173E3A6B4002C00"><enum>(B)</enum><text>thousands of acres of land that remain in a natural state; and</text></subparagraph></paragraph> 
<paragraph id="H522D29F98E2E47A5835446345D531421"><enum>(2)</enum><text>continued preservation of those areas would benefit the County and all of the United States by—</text> 
<subparagraph id="HD25659B9096641739DFDF2E1EB000071"><enum>(A)</enum><text>ensuring the conservation of ecologically diverse habitat;</text></subparagraph> 
<subparagraph id="HCE3E8F1BC0CE456C972EBA6EA6002400"><enum>(B)</enum><text>protecting prehistoric cultural resources;</text></subparagraph> 
<subparagraph id="H7CEBEA28F8BA4CB8935B626C1B9DEEC"><enum>(C)</enum><text>conserving primitive recreational resources; and</text></subparagraph> 
<subparagraph id="H97773CEF34154C05843DB035F8B2CAF"><enum>(D)</enum><text>protecting air and water quality.</text></subparagraph></paragraph></section> 
<section id="H73898A2BB64C47109E8D5EA8412295B6"><enum>202.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="H0B6D43417D0C43C09D244D9FCA6E44BF"><enum>(1)</enum><header>County</header><text>The term <term>County</term> means Lincoln County, Nevada.</text></paragraph> 
<paragraph id="HE82458EACF7C446EA100B6D1C681B82"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="HE40AFC18934949308841E62B28C8C101"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means the State of Nevada.</text></paragraph></section> 
<section id="HDE22ADD28C0E42309C77471BFF00326E"><enum>203.</enum><header>Additions to National Wilderness Preservation System</header> 
<subsection id="HB1259461E85946B7A89E89766FCBDFFA"><enum>(a)</enum><header>Additions</header><text>The following land in the State is designated as wilderness and as components of the National Wilderness Preservation System:</text> 
<paragraph id="HF6CC806CF8CA4F038D17AB2BC2B7469C"><enum>(1)</enum><header>Mormon Mountains Wilderness</header><text display-inline="yes-display-inline">Certain Federal land managed by the Bureau of Land Management, comprising approximately 149,677 acres, as generally depicted on the map entitled <quote>Lincoln County Conservation, Recreation, and Development Act Map</quote>, dated September 20, 2004, which shall be known as the <quote>Mormon Mountains Wilderness</quote>.</text></paragraph> 
<paragraph id="H8CC695D05B204041B39DB26D6800DD8C"><enum>(2)</enum><header>Meadow Valley Range Wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 124,833 acres, as generally depicted on the map entitled <quote>Southern Lincoln County Wilderness Map</quote>, dated June 1, 2004, which shall be known as the <quote>Meadow Valley Range Wilderness</quote>.</text></paragraph> 
<paragraph id="HB73A973C50374C9CB9E9F72CCBD9CA62"><enum>(3)</enum><header>Delamar Mountains Wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 111,389 acres, as generally depicted on the map entitled <quote>Southern Lincoln County Wilderness Map</quote>, dated June 1, 2004, which shall be known as the <quote>Delamar Mountains Wilderness</quote>.</text></paragraph> 
<paragraph id="H8C050E14ED994BB9B2673E90975C9FA7"><enum>(4)</enum><header>Clover Mountains Wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 85,757 acres, as generally depicted on the map entitled <quote>Southern Lincoln County Wilderness Map</quote>, dated June 1, 2004, which shall be known as the <quote>Clover Mountains Wilderness</quote>.</text></paragraph> 
<paragraph id="HEC1A674C89964CC293E0FA3D887623F8"><enum>(5)</enum><header>South Pahroc Range Wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 25,638 acres, as generally depicted on the map entitled <quote>Western Lincoln County Wilderness Map</quote>, dated June 1, 2004, which shall be known as the <quote>South Pahroc Range Wilderness</quote>.</text></paragraph> 
<paragraph id="HDEF442318A064620971D39F3A1639825"><enum>(6)</enum><header>Worthington Mountains Wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 30,936 acres, as generally depicted on the map entitled <quote>Western Lincoln County Wilderness Map</quote>, dated June 1, 2004, which shall be known as the <quote>Worthington Mountains Wilderness</quote>.</text></paragraph> 
<paragraph id="HED0033F3F30448E5B1AFA9BA5FC4098"><enum>(7)</enum><header>Weepah Spring Wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 51,117 acres, as generally depicted on the map entitled <quote>Western Lincoln County Wilderness Map</quote>, dated June 1, 2004, which shall be known as the <quote>Weepah Spring Wilderness</quote>.</text></paragraph> 
<paragraph id="HF24870F3E6A3472BAFD71D304E56727"><enum>(8)</enum><header>Parsnip Peak Wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 45,837 acres, as generally depicted on the map entitled <quote>Northern Lincoln County Wilderness Map</quote>, dated June 1, 2004, which shall be known as the <quote>Parsnip Peak Wilderness</quote>.</text></paragraph>

<paragraph id="HF0A7A2B15A814E89AF007599EC412F36"><enum>(12)</enum><header>Tunnel Spring Wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 5,530 acres, as generally depicted on the map entitled <quote>Southern Lincoln County Wilderness Map</quote>, dated June 1, 2004, which shall be known as the <quote>Tunnel Spring Wilderness</quote>.</text></paragraph></subsection> 
<subsection id="H61B5F63E510940BDAC30E69FFA9CB6CE"><enum>(b)</enum><header>Boundary</header><text>The boundary of any portion of a wilderness area designated by subsection (a) that is bordered by a road shall be at least 100 feet from the edge of the road to allow public access.</text></subsection> 
<subsection id="H6B5B9944233743F598F5C62EAA069300"><enum>(c)</enum><header>Map and legal description</header> 
<paragraph id="H85AE77CB47A947DC80440014CF7FBADF"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this title, the Secretary shall file a map and legal description of each wilderness area designated by subsection (a) with the Committee on Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate.</text></paragraph> 
<paragraph id="H51A2D6BC466147F4841ED241D69FF9F"><enum>(2)</enum><header>Effect</header><text>Each map and legal description shall have the same force and effect as if included in this section, except that the Secretary may correct clerical and typographical errors in the map or legal description.</text></paragraph> 
<paragraph id="H77A31848D8D747FD9FE48DBCF1D47395"><enum>(3)</enum><header>Availability</header><text>Each map and legal description shall be on file and available for public inspection in (as appropriate)—</text> 
<subparagraph id="HD6E0847F19424FE6A81700F2CCC07C"><enum>(A)</enum><text>the Office of the Director of the Bureau of Land Management;</text></subparagraph> 
<subparagraph id="HCECEC165E3EA4804803ED0CEE50052FD"><enum>(B)</enum><text>the Office of the Nevada State Director of the Bureau of Land Management;</text></subparagraph> 
<subparagraph id="H14205BAF95294DA28FCBAD7076C71E6"><enum>(C)</enum><text>the Ely Field Office of the Bureau of Land Management; and</text></subparagraph> 
<subparagraph id="HBC9469026B1944AA87E96B787B2D545B"><enum>(D)</enum><text>the Caliente Field Station of the Bureau of Land Management.</text></subparagraph></paragraph></subsection> 
<subsection id="HF12799C4A94248A5B7D2A3D7D25F152C"><enum>(d)</enum><header>Withdrawal</header><text>Subject to valid existing rights, the wilderness areas designated by subsection (a) are withdrawn from—</text> 
<paragraph id="H7459DBF4E1B041B3BCE764873753303F"><enum>(1)</enum><text>all forms of entry, appropriation, and disposal under the public land laws;</text></paragraph> 
<paragraph id="H17910B26212B49A4004DC84EFCC5431"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph> 
<paragraph id="HF93FC1BCFC844A8D9D215642AB886348"><enum>(3)</enum><text>operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text></paragraph></subsection></section> 
<section id="H36F51B195FF14FD9A7DACEF12A3B481"><enum>204.</enum><header>Administration</header> 
<subsection id="HD55215C8B3F74C8AA3F6EF82D8F4907D"><enum>(a)</enum><header>Management</header><text>Subject to valid existing rights, each area designated as wilderness by this title shall be administered by the Secretary in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that—</text> 
<paragraph id="HD7A28B336025497A88A1AB2B5B01E0D4"><enum>(1)</enum><text>any reference in that Act to the effective date shall be considered to be a reference to the date of the enactment of this title; and</text></paragraph> 
<paragraph id="H9B7CD33EB72D4D1E98F7B998EAB9E7E6"><enum>(2)</enum><text>any reference in that Act to the Secretary of Agriculture shall be considered to be a reference to the Secretary of the Interior.</text></paragraph></subsection> 
<subsection id="H8EAFA7A3AFE3488593D9BEEF5B4DC22F"><enum>(b)</enum><header>Livestock</header><text>Within the wilderness areas designated under this title that are administered by the Bureau of Land Management, the grazing of livestock in areas in which grazing is established as of the date of enactment of this title shall be allowed to continue, subject to such reasonable regulations, policies, and practices that the Secretary considers necessary, consistent with section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>), including the guidelines set forth in Appendix A of House Report 101–405.</text></subsection> 
<subsection id="H1B886C5BC1444380A225842ED042559"><enum>(c)</enum><header>Incorporation of acquired land and interests</header><text>Any land or interest in land within the boundaries of an area designated as wilderness by this title that is acquired by the United States after the date of the enactment of this title shall be added to and administered as part of the wilderness area within which the acquired land or interest is located.</text></subsection> 
<subsection id="HFF7ED12048934B50908053BA865900EF"><enum>(d)</enum><header>Water rights</header> 
<paragraph id="H4CDE1862952D49D1A5F4D002536BCC12"><enum>(1)</enum><header>Findings</header><text>Congress finds that—</text> 
<subparagraph id="H16E3C28DF55D4F79ABAF7BFE00698BA8"><enum>(A)</enum><text>the land designated as Wilderness by this title is within the Northern Mojave Desert, and Great Basin Deserts, is arid in nature, and includes ephemeral streams;</text></subparagraph> 
<subparagraph id="H05B3E4A98F014A8B9F7BDA2019600054"><enum>(B)</enum><text>the hydrology of the land designated as wilderness by this title is predominantly characterized by complex flow patterns and alluvial fans with impermanent channels;</text></subparagraph> 
<subparagraph id="H5A5E4CFDDC364E11BC11B270FD806600"><enum>(C)</enum><text>the subsurface hydrogeology of the region is characterized by ground water subject to local and regional flow gradients and unconfined and artesian conditions;</text></subparagraph> 
<subparagraph id="HAD42FE6B90B3403A806FB0674BA4FC11"><enum>(D)</enum><text>the land designated as wilderness by this title is generally not suitable for use or development of new water resource facilities; and</text></subparagraph> 
<subparagraph id="HC1ABE9ACEEDF404DA35119C7B8C7B9F7"><enum>(E)</enum><text>because of the unique nature and hydrology of the desert land designated as wilderness by this title, it is possible to provide for proper management and protection of the wilderness and other values of lands in ways different from those used in other legislation.</text></subparagraph></paragraph> 
<paragraph id="H854C76289A684597948CC23F8CB7B88"><enum>(2)</enum><header>Statutory construction</header><text>Nothing in this title—</text> 
<subparagraph id="HB0A5BE74C43147CD95FE6DDBE6D2ED14"><enum>(A)</enum><text>shall constitute or be construed to constitute either an express or implied reservation by the United States of any water or water rights with respect to the land designated as wilderness by this title;</text></subparagraph> 
<subparagraph id="H0BE5BC4D92354E90AC1007D1D2B2D3BF"><enum>(B)</enum><text>shall affect any water rights in the State existing on the date of the enactment of this title, including any water rights held by the United States;</text></subparagraph> 
<subparagraph id="H0B96E1DDEC5A4A9F97037F40969D19AE"><enum>(C)</enum><text>shall be construed as establishing a precedent with regard to any future wilderness designations;</text></subparagraph> 
<subparagraph id="HB9039329E19F47BF93296F9893735DF5"><enum>(D)</enum><text>shall affect the interpretation of, or any designation made pursuant to, any other Act; or</text></subparagraph> 
<subparagraph id="H53B02A7E668F474FA3D3D2DFE3EE933"><enum>(E)</enum><text>shall be construed as limiting, altering, modifying, or amending any of the interstate compacts or equitable apportionment decrees that apportion water among and between the State and other States.</text></subparagraph></paragraph> 
<paragraph id="H6986981763FA4243BB006C33B84EE757"><enum>(3)</enum><header>Nevada water law</header><text>The Secretary shall follow the procedural and substantive requirements of the law of the State in order to obtain and hold any water rights not in existence on the date of enactment of this title with respect to the wilderness areas designated by this title.</text></paragraph> 
<paragraph id="H24482DEF886349189D6F9BA892851139"><enum>(4)</enum><header>New projects</header> 
<subparagraph id="H26BA2D8CC6004377AE5EF9DDCB59CB6F"><enum>(A)</enum><header>Water resource facility</header><text>As used in this paragraph, the term <term>water resource facility</term>—</text> 
<clause id="H0D9FED7F33CC40CAA7F0920099C23E7E"><enum>(i)</enum><text>means irrigation and pumping facilities, reservoirs, water conservation works, aqueducts, canals, ditches, pipelines, wells, hydropower projects, and transmission and other ancillary facilities, and other water diversion, storage, and carriage structures; and</text></clause> 
<clause id="H0ECF93F7B1A24D6FA94D9BA87E9CE23D"><enum>(ii)</enum><text>does not include wildlife guzzlers.</text></clause></subparagraph> 
<subparagraph id="H1EAC4E507C9B4060BB255FECCEB283DB"><enum>(B)</enum><header>Restriction on new water resource facilities</header><text>Except as otherwise provided in this Act, on and after the date of the enactment of this Act, neither the President nor any other officer, employee, or agent of the United States shall fund, assist, authorize, or issue a license or permit for the development of any new water resource facility within the wilderness areas designated by this Act.</text></subparagraph></paragraph></subsection></section> 
<section id="H60A835E5582A4928B888613B61003E61"><enum>205.</enum><header>Adjacent management</header> 
<subsection id="H6B7F2147402746A3BC3EF4E130AC92C4"><enum>(a)</enum><header>In general</header><text>Congress does not intend for the designation of wilderness in the State pursuant to this title to lead to the creation of protective perimeters or buffer zones around any such wilderness area.</text></subsection> 
<subsection id="H6033E449A798477AB4FB0067725CBC5B"><enum>(b)</enum><header>Nonwilderness activities</header><text>The fact that nonwilderness activities or uses can be seen or heard from areas within a wilderness designated under this title shall not preclude the conduct of those activities or uses outside the boundary of the wilderness area.</text></subsection></section> 
<section id="H7BE440BF450A4389892FF3E4649F1544"><enum>206.</enum><header>Military overflights</header><text display-inline="no-display-inline">Nothing in this title restricts or precludes—</text> 
<paragraph id="HBFF8FED9A28047079381FCF66D2D0070"><enum>(1)</enum><text>low-level overflights of military aircraft over the areas designated as wilderness by this title, including military overflights that can be seen or heard within the wilderness areas;</text></paragraph> 
<paragraph id="H6610A5713E654DFCA51B00BE02A3B45"><enum>(2)</enum><text>flight testing and evaluation; or</text></paragraph> 
<paragraph id="H1DD50F3C95E641F6A5081165BF3CC843"><enum>(3)</enum><text>the designation or creation of new units of special use airspace, or the establishment of military flight training routes, over the wilderness areas.</text></paragraph></section> 
<section id="H8FB4A6677E2742E7BA5336770000EE44"><enum>207.</enum><header>Native American cultural and religious uses</header><text display-inline="no-display-inline">Nothing in this title shall be construed to diminish the rights of any Indian tribe. Nothing in this title shall be construed to diminish tribal rights regarding access to Federal land for tribal activities, including spiritual, cultural, and traditional food-gathering activities.</text></section> 
<section id="HE184BFC463AA4FD2A5B3943346AF0CF"><enum>208.</enum><header>Release of Wilderness Study Areas</header> 
<subsection id="HD887F9971BFA49BEAE7EA3A89C5F8D6B"><enum>(a)</enum><header>Finding</header><text>Congress finds that, for the purposes of section 603 of the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782</external-xref>), the public land in the County administered by the Bureau of Land Management in the following areas has been adequately studied for wilderness designation:</text> 
<paragraph id="H580886A6D31C44CFBFCE16C36C8D5CC2"><enum>(1)</enum><text>The Table Mountain Wilderness Study Area.</text></paragraph> 
<paragraph id="H740FFEF0889348F0B91B914FF02BDE1"><enum>(2)</enum><text>Evergreen A, B, and C Wilderness Study Areas.</text></paragraph> 
<paragraph id="HCE156A06D555496585D17883CFC9DD68"><enum>(3)</enum><text>Any portion of the wilderness study areas—</text> 
<subparagraph id="H262DC59AD21D41E5AC93E29058E3CB13"><enum>(A)</enum><text>not designated as wilderness by section 204(a); and</text></subparagraph> 
<subparagraph id="H1A8126F2DDC849758B00F810028A3C"><enum>(B)</enum><text>depicted as released on—</text> 
<clause id="H6BFEF3DD288140CCA4F7B8F83622A85F"><enum>(i)</enum><text>the map entitled <quote>Northern Lincoln County Wilderness Map</quote> and dated June 1, 2004;</text></clause> 
<clause id="H3C8C2D4C455D4EAABF11D114AD8EB1A2"><enum>(ii)</enum><text>the map entitled <quote>Southern Lincoln County Wilderness Map</quote> and dated June 1, 2004; or</text></clause> 
<clause id="H994243E3718046CE814FCB865DC4E6D9"><enum>(iii)</enum><text>the map entitled <quote>Western Lincoln County Wilderness Map</quote> and dated June 1, 2004.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H67C34F9721D947ACB6751693F39C6F7E"><enum>(b)</enum><header>Release</header><text>Any public land described in subsection (a) that is not designated as wilderness by this title—</text> 
<paragraph id="HA4D63F3A87004DD3BF28530023AEB4D"><enum>(1)</enum><text>is no longer subject to section 603(c) of the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>);</text></paragraph> 
<paragraph id="H4458A8CD6BDE4FCDB73F2832FABEC1B3"><enum>(2)</enum><text>shall be managed in accordance with—</text> 
<subparagraph id="H0D79304D2C814CB0BC2DB450CF743341"><enum>(A)</enum><text>land management plans adopted under section 202 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>); and</text></subparagraph> 
<subparagraph id="H742D2EEDEBAC46B891320005E0C97ECA"><enum>(B)</enum><text>existing cooperative conservation agreements; and</text></subparagraph></paragraph> 
<paragraph id="HA973684A7567465A97AB761597696559"><enum>(3)</enum><text>shall be subject to the <act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></paragraph></subsection></section> 
<section id="H1477CDBAA17F44E8BF6F441D21597D61"><enum>209.</enum><header>Wildlife management</header> 
<subsection id="H51891D3DFFC146B4B525BB1239DF4013"><enum>(a)</enum><header>In general</header><text>In accordance with section 4(d)(7) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(7)</external-xref>), nothing in this title affects or diminishes the jurisdiction of the State with respect to fish and wildlife management, including the regulation of hunting, fishing, and trapping, in the wilderness areas designated by this title.</text></subsection> 
<subsection id="HEFEC925A11ED466BAD77FA05DBE7C533"><enum>(b)</enum><header>Management activities</header><text>In furtherance of the purposes and principles of the Wilderness Act, management activities to maintain or restore fish and wildlife populations and the habitats to support such populations may be carried out within wilderness areas designated by this title where consistent with relevant wilderness management plans, in accordance with appropriate policies such as those set forth in Appendix B of House Report 101–405, including the occasional and temporary use of motorized vehicles, if such use, as determined by the Secretary, would promote healthy, viable, and more naturally distributed wildlife populations that would enhance wilderness values and accomplish those purposes with the minimum impact necessary to reasonably accomplish the task.</text></subsection> 
<subsection id="HB70CDB78E7364224B424BEAA35F8744"><enum>(c)</enum><header>Existing activities</header><text>Consistent with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)</external-xref>) and in accordance with appropriate policies such as those set forth in Appendix B of House Report 101–405, the State may continue to use aircraft, including helicopters, to survey, capture, transplant, monitor, and provide water for wildlife populations, including bighorn sheep, and feral stock, horses, and burros.</text></subsection> 
<subsection id="H1183FE96E0CA4A49A2D302F4DF60BBFC"><enum>(d)</enum><header>Wildlife water development projects</header><text>Subject to subsection (f), the Secretary shall authorize structures and facilities, including existing structures and facilities, for wildlife water development projects, including guzzlers, in the wilderness areas designated by this Act if—</text> 
<paragraph id="H5067C25E276642E68BF0F475FDA25068"><enum>(1)</enum><text>the structures and facilities will, as determined by the Secretary, enhance wilderness values by promoting healthy, viable, and more naturally distributed wildlife populations; and</text></paragraph> 
<paragraph id="HFC93CE7606F24621BEFC813B24DF0076"><enum>(2)</enum><text>the visual impacts of the structures and facilities on the wilderness areas can reasonably be minimized.</text></paragraph></subsection> 
<subsection id="HEDF5BDFFE23140CD97B918FD6789878D"><enum>(e)</enum><header>Hunting, fishing, and trapping</header><text>In consultation with the appropriate State agency (except in emergencies), the Secretary may designate by regulation areas in which, and establish periods during which, for reasons of public safety, administration, or compliance with applicable laws, no hunting, fishing, or trapping will be permitted in the wilderness areas designated by this Act.</text></subsection> 
<subsection id="H2370B1CA10A747EC9C00FB7368A91432"><enum>(f)</enum><header>Cooperative Agreement</header><text>The terms and conditions under which the State, including a designee of the State, may conduct wildlife management activities in the wilderness areas designated by this title are specified in the cooperative agreement between the Secretary and the State, entitled <quote>Memorandum of Understanding between the Bureau of Land Management and the Nevada Department of Wildlife Supplement No. 9,</quote> and signed November and December 2003, including any amendments to that document agreed upon by the Secretary and the State and subject to all applicable laws and regulations. Any references to Clark County in that document shall also be deemed to be referred to and shall apply to Lincoln County, Nevada.</text></subsection></section> 
<section id="H291FB2D92E1A40C28EF2FF7CB8E794D"><enum>210.</enum><header>Wildfire management</header><text display-inline="no-display-inline">Consistent with section 4 of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133</external-xref>), nothing in this title precludes a Federal, State, or local agency from conducting wildfire management operations (including operations using aircraft or mechanized equipment) to manage wildfires in the wilderness areas designated by this title.</text></section> 
<section id="H0D60BCFE3BA44C6DB2C46F2B3C454F07"><enum>211.</enum><header>Climatological data collection</header><text display-inline="no-display-inline">Subject to such terms and conditions as the Secretary may prescribe, nothing in this title precludes the installation and maintenance of hydrologic, meteorologic, or climatological collection devices in the wilderness areas designated by this title if the facilities and access to the facilities are essential to flood warning, flood control, and water reservoir operation activities.</text></section></title> 
<title id="HA63A043580A64EA6003300BE60342015"><enum>III</enum><header>Utility corridors</header> 
<section id="H005761A265D94861B4ECEBB9A9136C23"><enum>301.</enum><header>Utility corridor and rights-of-way</header> 
<subsection id="HE7C78BFDAB3B4EF8BD65DDE22ED71406"><enum>(a)</enum><header>Utility corridor</header> 
<paragraph id="H623FEC1CF038431CAE6000F3DEE9E595"><enum>(1)</enum><header>In general</header><text>Consistent with title II of the Act and notwithstanding sections 202 and 503 of the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1711">43 U.S.C. 1711</external-xref>, 1763), the Secretary of the Interior (referred to in this section as the <quote>Secretary</quote>) shall establish on public land a 2,640-foot wide corridor for utilities in Lincoln County and Clark County, Nevada, as generally depicted on the map entitled <quote>Lincoln County Conservation, Recreation, and Development Act</quote>, and dated June 14, 2004.</text></paragraph> 
<paragraph id="HF13D84E1E05546D5A6C86B6E6437ED45"><enum>(2)</enum><header>Availability</header><text>Each map and legal description shall be on file and available for public inspection in (as appropriate)—</text>

<subsection id="HF08CB8414DA642059BCDCDBB1D18DF49"><enum>(b)</enum><header>Rights-of-Way</header> 
<paragraph id="H34CB37FD666F439EA654B311798713CE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding sections 202 and 503 of the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1711">43 U.S.C. 1711</external-xref>, 1763) and subject to valid existing rights, the Secretary shall grant to the Southern Nevada Water Authority and the Lincoln County Water District nonexclusive rights-of-way to Federal land in Lincoln County and Clark County, Nevada, for any roads, wells, well fields, pipes, pipelines, pump stations, storage facilities, or other facilities and systems that are necessary for the construction and operation of a water conveyance system, as depicted on the map.</text></paragraph> 
<paragraph id="HDF06B9266FAA44CEB1F27F2647557200"><enum>(2)</enum><header>Applicable law</header><text>A right-of-way granted under paragraph (1) shall be granted in perpetuity and shall not require rental payment. </text></paragraph> 
<paragraph id="H26A30AA430234852A9C42BA658F1D2FB"><enum>(3)</enum><header>Compliance with nepa</header><text>Before granting a right-of-way under paragraph (1), the Secretary shall comply with the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), including the identification and consideration of potential impacts to fish and wildlife resources and habitat.</text></paragraph></subsection> 
<subsection id="HA14C6550FC914FA5B0D8DD59A7247DE6"><enum>(c)</enum><header>Withdrawal</header><text>Subject to valid existing rights, the utility corridors designated by subsection (a) are withdrawn from—</text> 
<paragraph id="HC18736326E704FC58CA5B39364DE00DA"><enum>(1)</enum><text>all forms of entry, appropriation, and disposal under the public land laws;</text></paragraph> 
<paragraph id="HE224ED9E776548F0BDC64E352210243"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph> 
<paragraph id="H43A4525FAB694F9C9722912063EF2EAE"><enum>(3)</enum><text>operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text></paragraph></subsection> 
<subsection id="H2FE1A5AAEE01401DA520B8C0677208F0"><enum>(d)</enum><header>State water law</header><text>Nothing in this title shall—</text> 
<paragraph id="HEC8C00D8F937482387788BCAFB1EF77D"><enum>(1)</enum><text>prejudice the decisions or abrogate the jurisdiction of the Nevada State Engineer with respect to the appropriation, permitting, certification, or adjudication of water rights;</text></paragraph> 
<paragraph id="H11D9A9D7D3FF4597A1C7299FDEE5890"><enum>(2)</enum><text>preempt Nevada State water law; or</text></paragraph> 
<paragraph id="HAFE4805E481A4E589EF45141A96387E"><enum>(3)</enum><text>limit or supersede existing water rights or interest in water rights under Nevada State law.</text></paragraph></subsection> 
<subsection id="H60E15542CFDC4BF1B9A1D856D41430CA"><enum>(e)</enum><header>Water resources study</header> 
<paragraph id="H1A2F0BF2E1A14D6E8EF9BA3B5252EF77"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through the United States Geological Survey and the Desert Research Institute, shall conduct a study to investigate ground water quantity, quality, and flow characteristics in the deep carbonate and alluvial aquifers of White Pine County, Nevada. The study shall—</text> 
<subparagraph id="HD61E3264F7F24099B397C9EDCA28B7FC"><enum>(A)</enum><text>include new and review of existing data;</text></subparagraph> 
<subparagraph id="H4F715E59B74A4BAF8EF9FE80490050DC"><enum>(B)</enum><text>determine the volume of water stored in aquifers in those areas;</text></subparagraph> 
<subparagraph id="H32707D4162664D0CB149C6FAF7D4BED"><enum>(C)</enum><text>determine the discharge and recharge characteristics of each aquifer system;</text></subparagraph> 
<subparagraph id="H2D56C2D402F74AB68DB6B2C467B4CE4"><enum>(D)</enum><text>determine the hydrogeologic and other controls that govern the discharge and recharge of each aquifer system; and</text></subparagraph> 
<subparagraph id="H17616D9189C8470EBB7D08C0499D7BB6"><enum>(E)</enum><text>develop maps at a consistent scale depicting aquifer systems and the recharge and discharge areas of such systems.</text></subparagraph></paragraph> 
<paragraph id="H36FFCEC4AFBB49B78B473200CFB000A7"><enum>(2)</enum><header>Timing; availability</header><text>The Secretary shall complete a draft of the water resources report required under paragraph (1) not later than 30 months after the date of the enactment of this Act. The Secretary shall then make the draft report available for public comment for a period of not less than 60 days. The final report shall be submitted to the Committee on Resources in the House of Representatives and the Committee on Energy and Natural Resources in the Senate and made available to the public not later than 36 months after the date of the enactment of this Act.</text></paragraph></subsection></section> 
<section id="HDB504DFEC41B490499518430AB7D9B70"><enum>302.</enum><header>Relocation of right-of-way and utility corridors located in Clark and Lincoln Counties in the State of Nevada</header> 
<subsection id="H3C69CB28EF9040DEBA06A8255E787C1E"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H1E88B3842DFF41AA82008122DFC0CF3E"><enum>(1)</enum><header>Agreement</header><text>The term <term>Agreement</term> means the land exchange agreement between Aerojet-General Corporation and the United States, dated July 14, 1988.</text></paragraph> 
<paragraph id="H66A05A139A814A099814584B703C155D"><enum>(2)</enum><header>Corridor</header><text>The term <term>corridor</term> means—</text> 
<subparagraph id="H22D4E6F0E5454BAA9E25B32F188E9C94"><enum>(A)</enum><text>the right-of-way corridor that is—</text> 
<clause id="H3898AD36CD384A1A8E2DA069EC005300"><enum>(i)</enum><text>identified in section 5(b)(1) of the Nevada-Florida Land Exchange Authorization Act of 1988 (102 Stat. 55); and</text></clause> 
<clause id="H9CB8D13AEB0C49C795EC88AE951EAD9E"><enum>(ii)</enum><text>described in section 14(a) of the Agreement;</text></clause></subparagraph> 
<subparagraph id="HAA8BB455B97C4D8E8F603BFE1E296995"><enum>(B)</enum><text>such portion of the utility corridor identified in the 1988 Las Vegas Resource Management Plan located south of the boundary of the corridor described in subparagraph (A) as is necessary to relocate the right-of-way corridor to the area described in subsection (c)(2); and</text></subparagraph> 
<subparagraph id="H97D617B4417E4156ABBA25BE08E570E0"><enum>(C)</enum><text>such portion of the utility corridor identified in the 2000 Caliente Management Framework Plan Amendment located north of the boundary of the corridor described in subparagraph (A) as is necessary to relocate the right-of-way corridor to the area described in subsection (c)(2).</text></subparagraph></paragraph> 
<paragraph id="H1F29CC08A098491888BC38F0ED9D7548"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></subsection> 
<subsection id="HCC06610AECE3490187E4E6BBBA4E3B08"><enum>(b)</enum><header>Relinquishment and fair market value</header> 
<paragraph id="H8DA2994D2439494CAEDBA24D460406D4"><enum>(1)</enum><header>In general</header><text>The Secretary shall, in accordance with this section, relinquish all right, title, and interest of the United States in and to the portion of the corridor described in section 302(a)(2)(A) not later than 30 days after receipt of a payment in an amount equal to the fair market value of the corridor (plus any costs relating to the right-of-way relocation described in this title).</text></paragraph> 
<paragraph id="HFCCA0E061F9947F2AA08E0EB2CA3E68"><enum>(2)</enum><header>Fair market value</header> 
<subparagraph id="H8E3491F5E3104DE1B929ABFAC253BF01"><enum>(A)</enum><header>In general</header><text>The fair market value of the corridor shall be equal to the amount by which the value of the discount described in the 1988 appraisal of the corridor that was applied to the land underlying the corridor has increased, as determined by the Secretary using the multiplier determined under subparagraph (B).</text></subparagraph> 
<subparagraph id="H15A32FE9B8ED4B65A4D793D5A192C85"><enum>(B)</enum><header>Multiplier</header><text>Not later than 60 days after the date of enactment of this Act, the Appraisal Services Directorate of the Department of the Interior shall determine an appropriate multiplier to reflect the change in the value of the land underlying the corridor between—</text> 
<clause id="H5CFB57678C8C4C20929F2F98B2166C00"><enum>(i)</enum><text>the date on which the corridor was transferred in accordane with the Agreement; and</text></clause> 
<clause id="H7C350349EA524E748F13C5EA57846F69"><enum>(ii)</enum><text>the date of enactment of this Act.</text></clause></subparagraph></paragraph> 
<paragraph id="H47A91096F9A446AF8B3900D2A71530E3"><enum>(3)</enum><header>Proceeds</header><text display-inline="yes-display-inline">Proceeds under this subsection shall be deposited in the account established under section 103.</text></paragraph></subsection> 
<subsection id="H7E24253DD1034489A875A82C26269884"><enum>(c)</enum><header>Relocation</header> 
<paragraph id="H979DE55F4374438FA5130074A4B751F7"><enum>(1)</enum><header>In general</header><text>The Secretary shall relocate to the area described in paragraph (2), the portion of IDI–26446 and UTU–73363 identified as NVN–49781 that is located in the corridor relinquished under subsection (b)(1).</text></paragraph> 
<paragraph id="H4B6D096A82514D41B54E6FEBB0BF1706"><enum>(2)</enum><header>Description of area</header><text>The area referred to in paragraph (1) is the area located on public land west of United States Route 93.</text></paragraph> 
<paragraph id="H89E3EE95BBF94EC8BC232E3FB4876692"><enum>(3)</enum><header>Requirements</header><text>The relocation under paragraph (1) shall be conducted in a manner that—</text> 
<subparagraph id="H844F637DA336424E8162BA5B36C8895C"><enum>(A)</enum><text>minimizes engineering design changes; and</text></subparagraph> 
<subparagraph id="H361D3BC91A2446B08CC26BDEB9489306"><enum>(B)</enum><text>maintains a gradual and smooth interconnection of the corridor with the area described in paragraph (2).</text></subparagraph></paragraph> 
<paragraph id="HE46176C91231468E8DCD9968E386F0F2"><enum>(4)</enum><header>Authorized uses</header><text>The Secretary may authorize the location of any above ground or underground utility facility, transmission lines, gas pipelines, natural gas pipelines, fiber optics, telecommunications, water lines, wells (including monitoring wells), cable television, and any related appurtenances in the area described in paragraph (1).</text></paragraph></subsection> 
<subsection id="HFFD5BEB95D0E45DF805F32F2C1F6C5B2"><enum>(d)</enum><header>Effect</header><text>The relocation of the corridor under this section shall not require the Secretary to update the 1998 Las Vegas Valley Resource Management Plan or the 2000 Caliente Management Framework Plan Amendment.</text></subsection> 
<subsection id="H6B7F013983C341B39785D70077DEF421"><enum>(e)</enum><header>Waiver of certain requirements</header><text>The Secretary shall waive the requirements of the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>) that would otherwise be applicable to the holders of the right-of-way corridor described in subsection (a)(2)(A) with respect to an amendment to the legal description of the right-of-way corridor.</text></subsection></section></title> 
<title id="HA3BEC97B933E47E59B69BEFFFD62EFAB"><enum>IV</enum><header>Silver State Off-Highway Vehicle Trail</header> 
<section id="H338C452F0A8D4506B944BF9CEBAE83A6"><enum>401.</enum><header>Silver State Off-Highway Vehicle Trail</header> 
<subsection id="H16B192B300A24379B7D96D80DE252BC1"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H1C9153D03CF94C5EBC1EA34400753739"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="HCBA94D5AC93A43CE802571C047848000"><enum>(2)</enum><header>Map</header><text>The term <term>Map</term> means the map entitled <quote>Lincoln County Conservation, Recreation and Development Act Map</quote> and dated June 14, 2004.</text></paragraph> 
<paragraph id="H3EB48869EFA54B18ACBD2247A7CC2577"><enum>(3)</enum><header>Trail</header><text>The term <term>Trail</term> means the system of trails designated in subsection (b) as the Silver State Off-Highway Vehicle Trail.</text></paragraph></subsection> 
<subsection id="H15E2284DBAC9403AB5A517C4C8978017"><enum>(b)</enum><header>Designation</header><text>The trails that are generally depicted on the Map are hereby designated as the <quote>Silver State Off-Highway Vehicle Trail</quote>.</text></subsection> 
<subsection id="HA1B386A1C9E44007A59217999C71364F"><enum>(c)</enum><header>Management</header> 
<paragraph id="H03E310F9ACEF4C4FA19B40C396995271"><enum>(1)</enum><header>In general</header><text>The Secretary shall manage the Trail in a manner that—</text> 
<subparagraph id="HD77AA11F99D0471FB19280FE5BCED0BB"><enum>(A)</enum><text>is consistent with motorized and mechanized use of the Trail that is authorized on the date of the enactment of this title pursuant to applicable Federal and State laws and regulations;</text></subparagraph> 
<subparagraph id="H62C15DD94949492FBD06EAF632715619"><enum>(B)</enum><text>ensures the safety of the people who use the Trail; and</text></subparagraph> 
<subparagraph id="H10BEA0456C204CDEB1D2BFABF74BA77"><enum>(C)</enum><text>does not damage sensitive habitat or cultural resources.</text></subparagraph></paragraph> 
<paragraph id="HEF3A083B48FD445DBDA3000042485683"><enum>(2)</enum><header>Management plan</header> 
<subparagraph id="H90B62979C96E4C52A7FB8644FD9EA001"><enum>(A)</enum><header>In general</header><text>Not later than 3 years after the date of the enactment of this title, the Secretary, in consultation with the State, the County, and any other interested persons, shall complete a management plan for the Trail.</text></subparagraph> 
<subparagraph id="H379A4BC76FA54323A5E3E91243A2B690"><enum>(B)</enum><header>Components</header><text>The management plan shall—</text> 
<clause id="H0AA649197D024614B9576FFD3593C5AA"><enum>(i)</enum><text>describe the appropriate uses and management of the Trail;</text></clause> 
<clause id="HFDBB454AAEB846E185C72F01CFE4AAC0"><enum>(ii)</enum><text>authorize the use of motorized and mechanized vehicles on the Trail; and</text></clause> 
<clause id="HCDEF7F956BC44D5482FDAF487F16C7D4"><enum>(iii)</enum><text>describe actions carried out to periodically evaluate and manage the appropriate levels of use and location of the Trail.</text></clause></subparagraph></paragraph> 
<paragraph id="HCEEC8585517D494B88D7635EAC712828"><enum>(3)</enum><header>Monitoring and Evaluation</header> 
<subparagraph id="H243E8CA49FF6413BB31BF2E128CCAB1"><enum>(A)</enum><header>Annual assessment</header><text display-inline="yes-display-inline">The Secretary shall annually assess the effects of the use of off-highway vehicles on the Trail and, in consultation with the Nevada Division of Wildlife, assess the effects of the Trail on wildlife and wildlife habitat to minimize environmental impacts and prevent damage to cultural resources from the use of the Trail.</text></subparagraph> 
<subparagraph id="H21BD269446674ADD8B1D212E5CBFCCA8"><enum>(B)</enum><header>Closure</header><text>The Secretary, in consultation with the State and the County, may temporarily close or permanently reroute, subject to subparagraph (C), a portion of the Trail if the Secretary determines that—</text> 
<clause id="H2A788C33D24D4CDD82E5E72600003899"><enum>(i)</enum><text>the Trail is having an adverse impact on—</text> 
<subclause id="H97E49670466F4D71BA3EA3967D7D9CD4"><enum>(I)</enum><text>natural resources; or</text></subclause> 
<subclause id="H65B24EE9C11D4AC883C951009D3EAE8E"><enum>(II)</enum><text>cultural resources;</text></subclause></clause> 
<clause id="HFF979E9E8AAB44D98435BE1D55EA14DF"><enum>(ii)</enum><text>the Trail threatens public safety;</text></clause> 
<clause id="H1CD5BF5FB21B42F1A11B120090C964BC"><enum>(iii)</enum><text>closure of the Trail is necessary to repair damage to the Trail; or</text></clause> 
<clause id="HAD5A2BBB1C554B8E825315F7C0E56900"><enum>(iv)</enum><text>closure of the Trail is necessary to repair resource damage.</text></clause></subparagraph> 
<subparagraph id="H3BC87527E4C24D04BC09177146FFBEF1"><enum>(C)</enum><header>Rerouting</header><text>Portions of the Trail that are temporarily closed may be permanently rerouted along existing roads and trails on public lands currently open to motorized use if the Secretary determines that such rerouting will not significantly increase or decrease the length of the Trail.</text></subparagraph> 
<subparagraph id="H41DA37A93A8D40A59DD72EE9B8D50300"><enum>(D)</enum><header>Notice</header><text>The Secretary shall provide information to the public regarding any routes on the Trail that are closed under subparagraph (B), including by providing appropriate signage along the Trail.</text></subparagraph></paragraph> 
<paragraph id="H746D94FB087843A698A632AAD124A796"><enum>(4)</enum><header>Notice of open routes</header><text>The Secretary shall ensure that visitors to the Trail have access to adequate notice regarding the routes on the Trail that are open through use of appropriate signage along the Trail and through the distribution of maps, safety education materials, and other information considered appropriate by the Secretary.</text></paragraph></subsection> 
<subsection id="H68D050606C9545488DA8214812D0B917"><enum>(d)</enum><header>No effect on non-federal land and interests in land</header><text>Nothing in this section shall be construed to affect ownership, management, or other rights related to non-Federal land or interests in land.</text></subsection> 
<subsection id="HEBD99846EF68403CA700A240A43ED086"><enum>(e)</enum><header>Map on file</header><text>The Map shall be kept on file at the appropriate offices of the Secretary.</text></subsection> 
<subsection id="HEB0DC52132904630AF179DAF678D1F43"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this section.</text></subsection></section></title> 
<title id="H4129AFF29DFA48CAAAA7756B64FCFC22"><enum>V</enum><header>Open space parks</header> 
<section id="HB1E9F616E7314C6990AB6B71F6ECE72F"><enum>501.</enum><header>Open space park conveyance to lincoln County, Nevada</header> 
<subsection id="HEAC40B8B24164175837865A15DC84C45"><enum>(a)</enum><header>Conveyance</header><text>Notwithstanding section 202 and 203 of the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1171">43 U.S.C. 1171</external-xref>, 1712), the Secretary may convey to the County, subject to valid existing rights, for no consideration, all right title, and interest of the United States in and to the parcels of land described in subsection (b).</text></subsection> 
<subsection id="H8FC1D552F95C4ECA8B1217B61108D4E2"><enum>(b)</enum><header>Description of land</header><text>The parcels of land referred to in subsection (a) are the parcels of land depicted as <quote>Lincoln County Parks Proposal</quote> on the map entitled <quote>Lincoln County Conservation, Recreation, and Development Act Map</quote> and dated June 14, 2004.</text></subsection> 
<subsection id="H11797D6F21CC4E3890E126A9E6D030AB"><enum>(c)</enum><header>Costs</header><text>Any costs relating to any conveyance under subsection (a), including costs for surveys and other administrative costs, shall be paid by the County, or in accordance with section 104(b)(2) of this Act.</text></subsection> 
<subsection id="HC8E4B5EF52CC4EDBACF5ACBDAE898992"><enum>(d)</enum><header>Use of land</header> 
<paragraph id="HE092553FA08348AD87704E3C2908A4C"><enum>(1)</enum><header>In general</header><text>Any parcel of land conveyed to the County under subsection (a) shall be used only for—</text> 
<subparagraph id="H4EE9D9414C6744EBA9C9D76323838AB"><enum>(A)</enum><text>the conservation of natural resources; or</text></subparagraph> 
<subparagraph id="H0BD8FF02B7FB4AB4A70000FB1713DD54"><enum>(B)</enum><text>public parks.</text></subparagraph></paragraph> 
<paragraph id="H81C0EC904E2E4C1EA203D1267B81D3C"><enum>(2)</enum><header>Facilities</header><text>Any facility on a parcel of land conveyed under subsection (a) shall be constructed and managed in a manner consistent with the uses described in paragraph (1).</text></paragraph></subsection> 
<subsection id="HCF29CB94E3EC483D8168818902575948"><enum>(e)</enum><header>Reversion</header><text>If a parcel of land conveyed under subsection (a) is used in a manner that is inconsistent with the uses specified in subsection (d), the parcel of land shall, at the discretion of the Secretary, revert to the United States.</text></subsection></section> 
<section id="H455349008B6E44218EDA7EF797669D9C"><enum>502.</enum><header>Open space park conveyance to the State of Nevada</header> 
<subsection id="H16745B7E98944CE18DF0BC88C3F98C45"><enum>(a)</enum><header>Conveyance</header><text>Notwithstanding section 202 of the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>), the Secretary shall convey to the State of Nevada, subject to valid existing rights, for no consideration, all right, title, and interest of the United States in and to the parcels of land described in subsection (b), if there is a written agreement between the State and Lincoln County, Nevada, supporting such a conveyance.</text></subsection> 
<subsection id="HEB9189895BA1403984BAA84662DD75BD"><enum>(b)</enum><header>Description of land</header><text>The parcels of land referred to in subsection (a) are the parcels of land depicted as <quote>NV St. Park Expansion Proposal</quote> on the map entitled <quote>Lincoln County Conservation, Recreation, and Development Act Map</quote> and dated June 14, 2004.</text></subsection> 
<subsection id="H60E5C07917B44D2D88B5643EFFF120"><enum>(c)</enum><header>Costs</header><text>Any costs relating to any conveyance under subsection (a), including costs for surveys and other administrative costs, shall be paid by the State.</text></subsection> 
<subsection id="H86D8598F8AEC4811A183C0EA00DB1088"><enum>(d)</enum><header>Use of land</header> 
<paragraph id="H3D3A031C69214598AC6DD16F7CD664F"><enum>(1)</enum><header>In general</header><text>Any parcel of land conveyed to the State under subsection (a) shall be used only for—</text> 
<subparagraph id="H77D48707873D43E59E05CF4B65AD77DF"><enum>(A)</enum><text>the conservation of natural resources; or</text></subparagraph> 
<subparagraph id="H1F2F38DC14DD4BB79531A3027323C276"><enum>(B)</enum><text>public parks.</text></subparagraph></paragraph> 
<paragraph id="HC3CA79D8187F4A108B297B1BD393E818"><enum>(2)</enum><header>Facilities</header><text>Any facility on a parcel of land conveyed under subsection (a) shall be constructed and managed in a manner consistent with the uses described in paragraph (1).</text></paragraph></subsection> 
<subsection id="H7D73BB6D84CB4A4D9CCDCED2C703C3FD"><enum>(e)</enum><header>Reversion</header><text>If a parcel of land conveyed under subsection (a) is used in a manner that is inconsistent with the uses specified in subsection (d), the parcel of land shall, at the discretion of the Secretary, revert to the United States.</text></subsection></section></title> 
<title id="H3100D5761C034D468331AE08572718BB"><enum>VI</enum><header>Jurisdiction transfer</header> 
<section id="H124C7735E8D741CD94C949F5647DFF73"><enum>601.</enum><header>Transfer of administrative jurisdiction between the Fish and Wildlife Service and the Bureau of Land Management</header> 
<subsection id="H4BC562A0EBCA4E23977863D34549DC8B"><enum>(a)</enum><header>In general</header><text>Administrative jurisdiction over the land described in subsection (b) is transferred from the United States Bureau of Land Management to the United States Fish and Wildlife Service for inclusion in the Desert National Wildlife Range and the administrative jurisdiction over the land described in subsection (c) is transferred from the United States Fish and Wildlife Service to the United States Bureau of Land Management.</text></subsection> 
<subsection id="H2D523D207445482CA092C6839EB87300"><enum>(b)</enum><header>Description of land</header><text>The parcel of land referred to in subsection (a) is the approximately 8,503 acres of land administered by the United States Bureau of Land Management as generally depicted on the map entitled <quote>Lincoln County Conservation, Recreation, and Development Act Map</quote> and identified as <quote>Lands to be transferred to the Fish and Wildlife Service</quote> and dated June 14, 2004.</text></subsection> 
<subsection id="HD9CD72B7C5714C94AF86698190FFEB2"><enum>(c)</enum><header>Description of land</header><text>The parcel of land referred to in subsection (a) is the approximately 8,382 acres of land administered by the United States Fish and Wildlife Service as generally depicted on the map entitled <quote>Lincoln County Conservation, Recreation, and Development Act Map</quote> and identified as <quote>Lands to be transferred to the Bureau of Land Management</quote> and dated June 14, 2004.</text></subsection>
