<section section-type="section-one" id="H790341AA753F4D3F007D895BD7CE8D6C" display-inline="no-display-inline"><enum>1.</enum><header>Mandatory separation age</header> 
<subsection id="H5740E12037C841D8B02FB64900C5F804"><enum>(a)</enum><header>Civil service retirement system</header><text>Section 8335(b) of title 5, United States Code, is amended—</text> 
<paragraph id="HBC06080E052E4D0B9687D9DCB8F96CFB"><enum>(1)</enum><text>by striking <quote>(b)</quote> and inserting <quote>(b)(1)</quote>; and</text></paragraph> 
<paragraph id="H15BC5EAEB805499E8CF864BBC313D001"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H3C2AC48104E64BE0A8639940C471CFD3"> 
<paragraph indent="up1" id="H5A8F96887BFD4BCBAD6C38EC0026FD05"><enum>(2)</enum><text>In the case of employees of the Federal Bureau of Investigation, the second sentence of paragraph (1) shall be applied by substituting <quote>65 years of age</quote> for <quote>60 years of age</quote>. The authority to grant exemptions in accordance with the preceding sentence shall cease to be available after December 31, 2009.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H154F7B23480F493E972EF0DE6CB85572"><enum>(b)</enum><header>Federal employees’ retirement system</header><text>Section 8425(b) of title 5, United States Code, is amended—</text> 
<paragraph id="H00CDB9B789904FCC002059CE75F0AEDE"><enum>(1)</enum><text>by striking <quote>(b)</quote> and inserting <quote>(b)(1)</quote>; and</text></paragraph> 
<paragraph id="HE69E7443ECD94EB48DE66F1B144737F7"><enum>(2)</enum><text>by adding at the end the following:</text>

<paragraph indent="up1" id="HFC91E8B50AF741FE992F7F83F45D264E"><enum>(2)</enum><text>In the case of employees of the Federal Bureau of Investigation, the second sentence of paragraph (1) shall be applied by substituting <quote>65 years of age</quote> for <quote>60 years of age</quote>. <section id="H164C310EA44C4B9988742FF400CE00B3"><enum>2.</enum><header>Retention and relocation bonuses</header> 
<subsection id="H38F9D368D6524DD290CAABF1EDEA129"><enum>(a)</enum><header>In general</header><text>Subchapter IV of chapter 57 of title 5, United States Code, is amended by adding at the end the following:</text>

<section id="H68F0C8BB534E47D8AD25C2053C407915"><enum>5759.</enum><header>Retention and relocation bonuses for the Federal Bureau of Investigation</header> 
<subsection id="HBC511397DC284EB180CC2BD041B2A99F"><enum>(a)</enum><header>Authority</header><text>The Director of the Federal Bureau of Investigation, after consultation with the Director of the Office of Personnel Management, may pay, on a case-by-case basis, a bonus under this section to an employee of the Bureau if—</text> 
<paragraph id="HF333175F4A19468AB09400C9DF66E295"><enum>(1)</enum> 
<subparagraph display-inline="yes-display-inline" id="H15E37DC2ED7B44FE8F68F5FCB3FDF0FE"><enum>(A)</enum><text>the unusually high or unique qualifications of the employee or a special need of the Bureau for the employee’s services makes it essential to retain the employee; and</text></subparagraph> 
<subparagraph indent="up1" id="HC724A06E909B448397C9396356219BA1"><enum>(B)</enum><text>the Director of the Federal Bureau of Investigation determines that, in the absence of such a bonus, the employee would be likely to leave—</text> 
<clause id="H22F4B82F06224B2DBAED248561CEDA17"><enum>(i)</enum><text>the Federal service; or</text></clause> 
<clause id="H3D4080B910BD4283BCE2FE52318FA410"><enum>(ii)</enum><text>for a different position in the Federal service; or</text></clause></subparagraph></paragraph> 
<paragraph id="HCF64D824262E4113A8DC21D120177B08"><enum>(2)</enum><text>the individual is transferred to a different geographic area with a higher cost of living (as determined by the Director of the Federal Bureau of Investigation).</text></paragraph></subsection> 
<subsection id="HAEF3C5E3D40E4A5FB4D8CFD84B0085A7"><enum>(b)</enum><header>Service agreement</header><text>Payment of a bonus under this section is contingent upon the employee entering into a written service agreement with the Bureau to complete a period of service with the Bureau. Such agreement shall include—</text> 
<paragraph id="HA3F32231902742208481AB6D3F6B56C9"><enum>(1)</enum><text>the period of service the individual shall be required to complete in return for the bonus; and</text></paragraph> 
<paragraph id="HEDFD77752BA844BBABCFC8DC9BCA11B8"><enum>(2)</enum><text>the conditions under which the agreement may be terminated before the agreed-upon service period has been completed, and the effect of the termination.</text></paragraph></subsection> 
<subsection id="HC6F555C7174047659926582494D700EA"><enum>(c)</enum><header>Limitation on authority</header><text>A bonus paid under this section may not exceed 50 percent of the employee’s basic pay.</text></subsection> 
<subsection id="H1600E2AFC5AE4CD58F2E7259D6B7C900"><enum>(d)</enum><header>Impact on basic pay</header><text>A retention bonus is not part of the basic pay of an employee for any purpose.</text></subsection> 
<subsection id="HEDB0B5924CBC408F8B2070F53BED424D"><enum>(e)</enum><header>Termination of authority</header><text>The authority to grant bonuses under this section shall cease to be available after December 31, 2009.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<section id="HCE702E456DF64ED999474216A408A5DC"><enum>3.</enum><header>Federal Bureau of Investigation Reserve Service</header> 
<subsection id="HDA97AE78AB5244828E3F00F7301343B6"><enum>(a)</enum><header>In general</header><text>Chapter 35 of title 5, United States Code, is amended by adding at the end the following:</text>

<subchapter id="H9D1737BD393C49CEBD88A6516D4400A8"><enum>VII</enum><header>Retention of retired specialized employees at the Federal Bureau of Investigation</header> 
<section id="HDB517746E9304727B4BE7C477E6760F"><enum>3598.</enum><header>Federal Bureau of Investigation Reserve Service</header> 
<subsection id="H066CA818B0084BD5BFEBEB1C2862B8"><enum>(a)</enum><header>Establishment</header><text>The Director of the Federal Bureau of Investigation may provide for the establishment and training of a Federal Bureau of Investigation Reserve Service (hereinafter in this section referred to as the <quote>FBI Reserve Service</quote>) for temporary reemployment of employees in the Bureau during periods of emergency, as determined by the Director.</text></subsection> 
<subsection id="H35202CC3C91348349DFEC8F58C444471"><enum>(b)</enum><header>Membership</header><text>Membership in the FBI Reserve Service shall be limited to individuals who previously served as full-time employees of the Bureau.</text></subsection> 
<subsection id="H741B1963315A45329300BE007BFE792B"><enum>(c)</enum><header>Annuitants</header><text>If an annuitant receiving an annuity from the Civil Service Retirement and Disability Fund becomes temporarily reemployed pursuant to this section, such annuity shall not be discontinued thereby. An annuitant so reemployed shall not be considered an employee for the purposes of chapter 83 or 84.</text></subsection> 
<subsection id="H06FF123721934FEC9E4BA1FDC8F4A8CA"><enum>(d)</enum><header>No impact on Bureau personnel ceiling</header><text>FBI Reserve Service members reemployed on a temporary basis pursuant to this section shall not count against any personnel ceiling applicable to the Bureau.</text></subsection> 
<subsection id="HEF40C8C2E69A4F9EBDCD5DFFF05FA042"><enum>(e)</enum><header>Expenses</header><text>The Director may provide members of the FBI Reserve Service transportation and per diem in lieu of subsistence, in accordance with applicable provisions of this title, for the purpose of participating in any training that relates to service as a member of the FBI Reserve Service.</text></subsection> 
<subsection id="H3CCE7B59B1AB4B1A91E966040030AC09"><enum>(f)</enum><header>Limitation on membership</header><text>Membership of the FBI Reserve Service is not to exceed 500 members at any given time.</text></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H9A9467D270ED4D5CA0CCFA2B42AA0089"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for chapter 35 of title 5, United States Code, is amended by adding at the end the following:</text>

<section id="H2625917DE6194BEDB58763EF9B14C447"><enum>4.</enum><header>Critical positions in the Federal Bureau of Investigation intelligence directorate</header><text display-inline="no-display-inline">Section 5377(a)(2) of title 5, United States Code, is amended—</text> 
<paragraph id="H9711B6F7DE414E039FC62309E9D1F7C9"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of subparagraph (E);</text></paragraph> 
<paragraph id="H1B53361E3ACF4BA4910044C4E8CB304"><enum>(2)</enum><text>by striking the period at the end of subparagraph (F) and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HDC8A474275584C08A29C3739BBCF7D50"><enum>(3)</enum><text>by inserting after subparagraph (F) the following:</text>
