<official-title>To amend the Immigration and Nationality Act to modify the treatment of adopted children.</official-title>

<section id="H0433071D092848CE88E5EFA2299FFD6C" section-type="section-one"><enum>1.</enum><header>Modification of treatment of adopted children</header> 
<subsection id="HAFB6910A01D645F7828C2D7812BD67A2"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="act" parsable-cite="INA/101(b)(1">Section 101(b)(1</external-xref>) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101(b)(1)">8 U.S.C. 1101(b)(1)</external-xref>) is amended—</text> 
<paragraph id="HEC0B2707FC0A48FCA8C7D95EA996C768"><enum>(1)</enum><text>in subparagraph (E)(i), by striking <quote>a child adopted while under the age of sixteen years if the child has been in the legal custody of, and has resided with, the adopting parent or parents for at least two years:</quote> and inserting <quote>a child adopted while under the age of 18 years if the child has been in the legal custody of, and has resided with, the adopting parent or parents for at least two years and the adoption was officially initiated while the child was under the age of 16 years:</quote>; and</text></paragraph> 
<paragraph id="H4E0A53A60EE34E568D7F5B694D9DB400"><enum>(2)</enum><text>in subparagraph (F)—</text> 
<subparagraph id="HC718959172C545DAB83200EC219ED7B1"><enum>(A)</enum><text>in clause (i)—</text> 
<clause id="H363BDAA9780F4D2A99009300ADFBD119"><enum>(i)</enum><text>by striking <quote>child, under the age of sixteen at the time a petition is filed in his behalf to accord a classification as an immediate relative under section 201(b), who</quote> and inserting <quote>child who</quote>;</text></clause> 
<clause id="H307F4FBE5C3249BFA623D9E66C6EFD28"><enum>(ii)</enum><text>by inserting <quote>while under the age of 18 years</quote> after <quote>who has been adopted abroad</quote>; and</text></clause> 
<clause id="H02C1B124F1CA4F7485326B6244542466"><enum>(iii)</enum><text>by striking <quote>the Attorney General is satisfied that proper care will be furnished the child if admitted to the United States:</quote> and inserting <quote>the Secretary of Homeland Security is satisfied that proper care will be furnished the child if admitted to the United States and that the adoption abroad, or the compliance with domestic preadoption requirements, was officially initiated while the child was under the age of 16 years:</quote>; and</text></clause></subparagraph> 
<subparagraph id="H1F7D833AC8604624A80314F6C036D592"><enum>(B)</enum><text>in clause (ii), by striking <quote>except that the child is under the age of 18 at the time a petition is filed in his or her behalf to accord a classification as an immediate relative under section 201(b).</quote> and inserting <quote>except that the Secretary of Homeland Security shall be satisfied that the adoption abroad, or the compliance with domestic preadoption requirements, was officially initiated while the child was under the age of 18 years.</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H6E939C04CA6C426D94024D5DA66DDA39"><enum>(b)</enum><header>Provisions effective upon entry into force of convention</header> 
<paragraph id="H5680B0A807C14C1093BCC918F02100C3"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="act" parsable-cite="INA/101(b)(1)(G">Section 101(b)(1)(G</external-xref>) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101(b)(1)(G)">8 U.S.C. 1101(b)(1)(G)</external-xref>) is amended—</text> 
<subparagraph id="HCF480B1F39474CA6AC4712FFA269D455"><enum>(A)</enum><text>in the matter preceding clause (i)—</text> 
<clause id="H4652CCCBB0D248A7A463C2BB53CC18BE"><enum>(i)</enum><text>by striking <quote>child, under the age of sixteen at the time a petition is filed on the child’s behalf to accord a classification as an immediate relative under section 201(b), who</quote> and inserting <quote>child who</quote>; and</text></clause> 
<clause id="HF1F9C4C1C65E485B97D9F360DF2BCCA8"><enum>(ii)</enum><text>by inserting <quote>while under the age of 18 years</quote> after <quote>who has been adopted</quote>; and</text></clause></subparagraph> 
<subparagraph id="HCF816A6DC9A84359B31C014F7012B1A7"><enum>(B)</enum><text>in clause (i)—</text> 
<clause id="H99ACF726034C4FEF941BB661A9005476"><enum>(i)</enum><text>in subclause (IV), by striking <quote>and</quote> at the end; and</text></clause> 
<clause id="HE1C94B65507444E8A529AFCF0187CA0"><enum>(ii)</enum><text>by adding at the end the following:</text>

<subclause id="H07CEBA9A51954E15902388B4E739A7BF" indent="up1"><enum>(VI)</enum><text>in the case of a child who—</text> 
<item id="H0F61569F5FF048999C68DB9DFB9D4C8F"><enum>(aa)</enum><text>has been adopted, the adoption was officially initiated while the child was under the age of 16 years; or</text></item> 
<item id="H1C1176555380439AA42DB5CF934DC3EA"><enum>(bb)</enum><text>has not been adopted, the approval described in subparagraph (V)(aa) was officially sought while the child was under the age of 16 years; and</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph> 
<paragraph id="H6716312F0E044EEBA26977297ED02CE3"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall take effect as if included in the enactment of section 302(a) of the Intercountry Adoption Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106–279">Public Law 106–279</external-xref>).</text></paragraph></subsection> 
<subsection id="H84CE803DF45B41889393D8A5276ECF97"><enum>(c)</enum><header>Naturalization purposes</header><text><external-xref legal-doc="act" parsable-cite="INA/101(c)(1">Section 101(c)(1</external-xref>) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101(c)(1)">8 U.S.C. 1101(c)(1)</external-xref>) is amended to read as follows:</text> 
<quoted-block act-name="Immigration and Nationality Act" id="H90CB2963E26D4596944DCDAE2B996D00" style="traditional"> 
<paragraph indent="up1" id="H37A225F501084361872E7F36ACECDDD1"><enum>(1)</enum><text>The term <term>child</term> means an unmarried person under 21 years of age and includes—</text> 
<subparagraph id="H981C5437BB584825AF1DDCCB5C7BC558"><enum>(A)</enum><text>a child legitimated under the law of the child’s residence or domicile, or under the law of the father’s residence or domicile, whether in the United States or elsewhere, if such legitimation takes place before the child reaches the age of 16 years and the child is in the legal custody of the legitimating parent or parents at the time of such legitimation; and</text></subparagraph> 
<subparagraph id="H5A987E4BE8A9479A8DA357DC82E51B8E"><enum>(B)</enum><text>except as otherwise provided in sections 320 and 321, a child adopted in the United States, if such adoption is officially initiated before the child reaches the age of 16 years and the child is in the legal custody of the adopting parent or parents at the time of such adoption.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
