<section id="HB58A3AC1F8BE4BC99F18BE16B1FFA13" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe, Efficient, Coordinated, Unified, Revitalized, Enhanced Visa Waiver Act</short-title></quote>.</text></section> 
<section id="H30B9A1D5AB4046CFAFD89FC483C199A9"><enum>2.</enum><header>Electronic Submission of biographical information by visa waiver participants</header> 
<subsection id="H45F720628158418EBFF6AD9C93820988"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall establish, as part of the integrated entry and exit data system required under section 110 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1365a), an electronic system through which an alien seeking to enter the United States without a visa under the visa waiver program described in section 217 of the Immigration and Nationality Act (8 U.S.C. 1187) is required to submit biographical information prior to embarkation.</text></subsection> 
<subsection id="HB3129FC92F6A4E0F8DC44BA47EEF45EC"><enum>(b)</enum><header>Elements</header><text>The electronic system required to be established under subsection (a) shall satisfy the following requirements:</text> 
<paragraph id="HD3CFF0AA29EA4D12BFA330961B4FABE2"><enum>(1)</enum><header>Electronic determination of eligibility</header><text>The system shall include a method for an electronic determination to be made, and an electronic response to be provided, in 30 minutes or less, as to whether or not an alien submitting information as described in subsection (a) is eligible to be admitted to the United States as a nonimmigrant visitor described in section 101(a)(15)(B) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(15)(B)).</text></paragraph> 
<paragraph id="H48AE57DF403240BB81F1C184A0E51466"><enum>(2)</enum><header>Carrier obligations</header><text>The system shall include a method for requiring—</text> 
<subparagraph id="H9C5E6788F8844A24AAEB85AB887C3D64"><enum>(A)</enum><text>carriers and other corporations described in section 217(a)(5) of such Act (8 U.S.C. 1187(a)(5)) to inquire electronically, prior to an alien passenger’s embarkation without a visa, whether the alien has been determined, using the system described in this section, to be eligible for such an admission; and</text></subparagraph> 
<subparagraph id="H143B7317957D433298ADE55176C12E57"><enum>(B)</enum><text>the electronic response to such inquiry to be provided in 90 seconds or less.</text></subparagraph></paragraph> 
<paragraph id="H90AC8647F69A4258AA5E50A3225E223C"><enum>(3)</enum><header>Deployment</header><text display-inline="yes-display-inline">The system shall be deployed as soon as possible after the date of the enactment of this Act.</text></paragraph> 
<paragraph id="H00A4BA09C4EA4626A77CF3D339EF512"><enum>(4)</enum><header>Fee</header><text>The Secretary of Homeland Security shall establish a fee to be charged to aliens described in subsection (a) that is set at a level that will ensure the recovery of the full costs of establishing and operating the system.</text></paragraph></subsection> 
<subsection id="H1CC2B9B912CB488E9863B4F1D401904F"><enum>(c)</enum><header>Consultation</header><text>In developing the system, the Secretary of Homeland Security shall consult with, and allow for the system’s review by, a private sector group consisting of individuals with expertise in travel, tourism, privacy, national security, or computer security issues.</text> </subsection></section> 
<section id="H1A22F1C178BE4443AF26AE2CB8574F88"><enum>3.</enum><header>Change to requirement for readers and scanners at ports of entry</header><text display-inline="no-display-inline">Section 303(b)(2)(A) of the Enhanced Border Security and Visa Entry Reform Act (8 U.S.C. 1732(b)(2)(A)) is amended to read as follows:</text>

<subparagraph id="HD3CC09B90840441AB4C4B852EA8D98D"><enum>(A)</enum><header>In general</header><text>Not later than October 26, 2004, the Secretary of Homeland Security, in consultation with the Secretary of State, shall install at all ports of entry into the United States equipment and software to allow biometric comparison and authentication of all United States visas and other travel and entry documents issued to aliens. Not later than October 26, 2005, the Secretary of Homeland Security, in consultation with the Secretary of State, shall install at all ports of entry into the United States equipment and software to allow biometric comparison and authentication of passports issued pursuant to subsection (c)(1).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H778F71EF2DE744958D26F044D7F21188"><enum>4.</enum><header>Technology standard implementation deadline</header><text display-inline="no-display-inline">Section 303(c) of the Enhanced Border Security and Visa Entry Reform Act (8 U.S.C. 1732(c)) is amended, in each of paragraphs (1) and (2), by striking <quote>2004,</quote> and inserting <quote>2005,</quote>.</text></section> 
<section id="H221115E5F99F4A83ADAC8807D43D018C"><enum>5.</enum><header>Limited good faith waiver</header><text display-inline="no-display-inline">Section 303(c) of the Enhanced Border Security and Visa Entry Reform Act (8 U.S.C. 1732(c)) is amended by adding at the end the following:</text>

<paragraph id="H076A1BD4B0C0497EBB3E36BECDADDBAE"><enum>(3)</enum><header>Limited good faith waiver</header><text></text> 
<subparagraph id="H7C525DFAAEA54AE59FBEEC2C4F9CE13C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security, in consultation with the Secretary of State, may grant not more than 2 extensions for a country, and its nationals, of the deadlines in paragraphs (1) and (2), respectively, upon a determination that the country is making substantial progress towards ensuring that the passports the country issues to its nationals satisfy the requirements of paragraph (1). Each such extension shall be for a period not exceeding 6 months.</text></subparagraph> 
<subparagraph id="H9084D25ED5714FDAAF849774958E78C0"><enum>(B)</enum><header>Factors</header><text>In determining whether a country is making substantial progress under subparagraph (A), the Secretary of Homeland Security shall take into account the following factors, which shall be certified by the Secretary of State:</text>
<clause id="H62A87204B8A748A49E17E6570AFC1DA"><enum>(i)</enum><text display-inline="yes-display-inline">Whether the country has made a good faith effort to satisfy the requirements of paragraph (1) not later than October 26, 2005.</text> </clause>
<clause id="H372A58F1C1AB4D8EA720055928123888"><enum>(ii)</enum><text>Whether the country has a program designed to satisfy the requirements of paragraph (1) not later than October 26, 2006.</text></clause>
<clause id="HAEF97B6E80C341F78EDDCB95CA801F93"><enum>(iii)</enum><text>Whether the country has commenced a pilot program under which some number of passports that satisfy the requirements of paragraph (1) will be issued before March 26, 2006.</text></clause> </subparagraph></paragraph> 
<paragraph id="H9EDC5B10EDAE40A1B4555F976D38B590"><enum>(4)</enum><header>Reports</header><text display-inline="yes-display-inline"></text>
<subparagraph id="H623309E10F124D7EB6968C7EBFB4E9D0"><enum>(A)</enum><header>Initial</header><text>Not later than October 26, 2005, the Secretary of Homeland Security, in consultation with the Secretary of State, shall issue an initial report on the status of countries’ progress in meeting the requirements of paragraph (1).</text></subparagraph>
<subparagraph id="H4C80624E55ED45CB96A2EE4522BB5C1B"><enum>(B)</enum><header>Final</header><text>Not later than April 25, 2006, the Secretary of Homeland Security, in consultation with the Secretary of State, shall issue a final report on the status of countries’ progress in meeting the requirements of paragraph (1).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H405BABF40FAF43FAA56F711C42886254"><enum>6.</enum><header>Technical and conforming amendments</header><text display-inline="no-display-inline">Section 303 of the Enhanced Border Security and Visa Entry Reform Act (8 U.S.C. 1732) is amended by striking <quote>Attorney General</quote> each place that term appears and inserting <quote>Secretary of Homeland Security</quote>.</text></section>
