<official-title>To amend the National Voter Registration Act of 1993 to require any individual who desires to register or re-register to vote in an election for Federal office to provide the appropriate State election official with proof that the individual is a citizen of the United States to prevent fraud in Federal elections, and for other purposes.</official-title>

<section id="H3B057B6743624E13AF057E0076C5281" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Federal Election Integrity Act of 2004</quote> .</text></section> 
<section id="HD7750E72FF0448C0A548E9B168D4F742"><enum>2.</enum><header>Requiring Proof of Citizenship to Accompany Application For Voter Registration</header> 
<subsection id="H37817F4E9E5748FDAC618B69A7885F63"><enum>(a)</enum><header>Application Provided With Motor Vehicle License Application</header><text>Section 5(c)(2) of the National Voter Registration Act of 1993 (42 U.S.C. 1973gg—3(c)(2)) is amended—</text> 
<paragraph id="H56E2EA30F0F3423680C979246760B29C"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>may require</quote> and inserting <quote>in addition to the information required under subparagraph (E), may require</quote>;</text></paragraph> 
<paragraph id="H11A027D26A4845B6BD931763FBD385C7"><enum>(2)</enum><text>by striking <quote>and</quote> at the end of subparagraph (D);</text></paragraph> 
<paragraph id="HC849611FC00E4F74B0B14D59DE56507F"><enum>(3)</enum><text>by redesignating subparagraph (E) as subparagraph (F); and</text></paragraph> 
<paragraph id="HCC97FA928FB1453B976878C621E114E8"><enum>(4)</enum><text>by inserting after subparagraph (D) the following new subparagraph:</text> 
<quoted-block style="OLC" id="H1E9D6858D35C4824ABE405F1FEC7DE" display-inline="no-display-inline"> 
<paragraph id="H6F95D24E12D5467280AF05FA13FBE6AE"><enum>(E)</enum><text>shall require the applicant to provide a photographic copy of any document which provides proof that the applicant is a citizen of the United States, in accordance with guidelines established by the Election Administration Commission in consultation with the Secretary of Homeland Security and the Secretary of State.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H81945288A2BB491DBF0186443844FF18"><enum>(b)</enum><header>Mail-in Form</header><text>Section 9(b) of such Act (42 U.S.C. 1973gg—7(b)) is amended—</text> 
<paragraph display-inline="no-display-inline" id="H3DD071DA7AC84970BD2322E1B7B8484E"><enum>(1)</enum><text>in paragraph (1), by striking <quote>may require</quote> and inserting <quote>consistent with paragraph (5), may require</quote>;</text></paragraph> 
<paragraph id="H40367FE5D4EF44FC94A81B25F22B40AF"><enum>(2)</enum><text>by striking <quote>and</quote> at the end of paragraph (3);</text></paragraph> 
<paragraph id="H5AA9D49C36864EE5A686109F56D24632"><enum>(3)</enum><text>by striking the period at the end of paragraph (4) and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HBF00699D4438429BBFF9B356D39E2400"><enum>(4)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="H3F38477D241142E9B5C1FE0231D89CE4" display-inline="no-display-inline"> 
<paragraph id="H541E59F88FBB4237ABF605009C3CD3C"><enum>(5)</enum><text>shall require the applicant to provide a photographic copy of any document which provides proof that the applicant is a citizen of the United States, in accordance with guidelines established by the Election Administration Commission in consultation with the Secretary of Homeland Security and the Secretary of State.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HFDA7584FEF8D4384ACF47378E1B4DF87"><enum>(c)</enum><header>Special Rules For States Without Registration Requirement and States Permitting Same-Day Registration</header> 
<paragraph id="H8E2AE4718A9F439A9F54789732A588BD"><enum>(1)</enum><header>In general</header><text>Section 8 of such Act (42 U.S.C. 1973gg—6) is amended—</text> 
<subparagraph id="HDE70EE1B3D35433800BBE7A341792C55"><enum>(A)</enum><text>by redesignating subsection (j) as subsection (k); and</text></subparagraph> 
<subparagraph id="H50274A7EA9A0481592D7ECB9FDB20062"><enum>(B)</enum><text>by inserting after subsection (i) the following new subsection:</text>

<subsection id="H67C0CFA7B90C420893EADA4457560010"><enum>(j)</enum><header>Requirement for Proof of Citizenship in States Without Registration Requirement and States Permitting Same-Day Registration</header> 
<paragraph id="H7EE66EE0DBE546B4A4CD7E5C0323F2E9"><enum>(1)</enum><header>States without registration requirement</header><text display-inline="yes-display-inline">In the case of a State described in section 4(b)(1), the appropriate State or local election official may not provide any individual with a ballot for an election for Federal office (including an absentee ballot) unless the individual provides the official with a photographic copy of any document which provides proof that the individual is a citizen of the United States, in accordance with guidelines established by the Election Administration Commission in consultation with the Secretary of Homeland Security and the Secretary of State.</text></paragraph> 
<paragraph id="H3E9438AC53F647C492EB16D72D651B3E"><enum>(2)</enum><header>States permitting same-day registration</header><text display-inline="yes-display-inline">In the case of a State described in section 4(b)(2), the appropriate State or local election official may not permit any individual to register to vote in an election for Federal office (including an individual who desires to register to vote at the polling place at the time of voting in the election) unless the individual provides the official with a photographic copy of any document which provides proof that the individual is a citizen of the United States, in accordance with guidelines established by the Election Administration Commission in consultation with the Secretary of Homeland Security and the Secretary of State.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H08611A1C56294E35A909B99EDD458341"><enum>(2)</enum><header>Conforming amendment</header><text>Section 4(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1973gg-2">42 U.S.C. 1973gg–2(b)</external-xref>) is amended by striking <quote>This Act</quote> and inserting <quote>Except as provided in section 8(j), this Act</quote>. </text></paragraph></subsection></section> 
<section id="H7F95AAD224E04F348B43EAC43CCBB3C0"><enum>3.</enum><header>Requiring Voters to Provide Photo Identification</header> 
<subsection id="HD4F7393666614BD7821542AD1C568863"><enum>(a)</enum><header>In General</header><text>Section 303(b) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(b)</external-xref>) is amended—</text> 
<paragraph id="H85F2D56F93C840E9A73657711F20C9A0"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="subsection">for Voters Who Register by Mail</header-in-text></quote> and inserting <quote><header-in-text level="subsection">for Providing Photo Identification</header-in-text></quote>; and</text></paragraph> 
<paragraph id="H62D2A709B0D149BDA76E2CFA809908E3"><enum>(2)</enum><text>by striking paragraphs (1) through (3) and inserting the following:</text> 
<quoted-block style="OLC" id="H8605947A47D340CA950746E12B472095" display-inline="no-display-inline"> 
<paragraph id="H3AE3B7300F8042970058002168A6DC66"><enum>(1)</enum><header>Individuals voting in person</header><text>Notwithstanding any other provision of law, the appropriate State or local election official may not provide a ballot for an election for Federal office (including a provisional ballot under section 302(a)) to an individual who desires to vote in person unless the individual presents to the official a current and valid photo identification.</text> </paragraph> 
<paragraph id="H0193B83E5B094DAE92E4C2820367F2F3"><enum>(2)</enum><header>Individuals voting by mail</header><text>Notwithstanding any other provision of law, the appropriate State or local election official may not accept any ballot for an election for Federal office provided by an individual who votes by mail unless the individual submits with the ballot a copy of a current and valid photo identification.</text> </paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph> </subsection> 
<subsection id="HD4D32418DDFF41DE00483FC327361714"><enum>(b)</enum><header>Conforming Amendments</header><text>Section 303 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483</external-xref>) is amended—</text> 
<paragraph id="HC942F1262A8C4290AF2FD11E01FEAF18"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="section">for voters who register by mail</header-in-text></quote> and inserting <quote><header-in-text level="section">for Providing Photo Identification</header-in-text></quote>; and</text></paragraph> 
<paragraph id="H7AB6F3C5E4294D748BC925D22577E5E0"><enum>(2)</enum><text>in subsection (c), by striking <quote>subsections (a)(5)(A)(i)(II) and (b)(3)(B)(i)(II)</quote> and inserting <quote>subsection (a)(5)(A)(i)(II)</quote>.</text></paragraph> </subsection> 
<subsection id="H0236AE559AC1441B00857005F015686B"><enum>(c)</enum><header>Clerical Amendment</header><text>The table of contents of such Act is amended by amending the item relating to section 303 to read as follows:</text>

<subsection id="HE8FEEDFE457F4DE5AD04EEFC8F72364D"><enum>(d)</enum><header>Effective Date</header><text>Section 303(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(d)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="HBF0CC6EF461F460EA9969201A7CEEC9" display-inline="no-display-inline"> 
<subsection id="HDD18EB8370754D2D817602DC44CE19D4"><enum>(d)</enum><header>Requirement to provide photo identification</header><text>Subsection (b) shall apply with respect to the regularly scheduled general election for Federal office held in November 2004 and each succeeding election for Federal office.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HEDC626F3881C4AB5BF5B4F59BB43B333"><enum>4.</enum><header>Effective Date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall apply with respect to the regularly scheduled general election for Federal office held in November 2004 and each succeeding election for Federal office.</text> </section>
