<section id="H9CA96876C5024838007B19A71ED3E1F5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote>Enhanced Protection of Our Cultural Heritage Act</quote>.</text></section> 
<section id="HF7C6AADD6F7B45058411C98B4282B514"><enum>2.</enum><header>Enhanced penalties for cultural heritage crimes</header> 
<subsection id="H6171940633244931AB9F4EBC55D21F00"><enum>(a)</enum><header>Enhanced Penalty for Illegal Trafficking in Archaeological Resources</header><text>Section 6(d) of the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470ee">16 U.S.C. 470ee(d)</external-xref>) is amended by striking <quote>not more than $10,000</quote> and all that follows through the end of the subsection, and inserting <quote>not more than $100,000, imprisoned not more than 10 years, or both.</quote>.</text></subsection> 
<subsection id="HC61BFF38D8AD475ABF3CA95100D7F194"><enum>(b)</enum><header>Enhanced Penalty for Embezzlement and Theft From Indian Tribal Organizations</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1163">Section 1163</external-xref> of title 18, United States Code, is amended by striking <quote>five years</quote> and inserting <quote>10 years</quote>.</text></subsection> 
<subsection id="H6B53992EB67D4D3781B6BCD7004DA929"><enum>(c)</enum><header>Enhanced Penalty for Illegal Trafficking in Native American Human Remains and Cultural Items</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1170">Section 1170</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="HDFE03B4E4F1A4E208D223C39C205FE14"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="HF617D3D769BE4569A63E6376C0B10926"><enum>(A)</enum><text>by inserting <quote>or attempts to sell, purchase, use for profit, or transport for sale or profit,</quote> before <quote>human remains</quote>; and</text></subparagraph> 
<subparagraph id="HF0CE29492A2C4A9E00CFDC13AA871D00"><enum>(B)</enum><text>by striking <quote>or imprisoned not more than 12 months, or both, and in the case of a second or subsequent violation, be fined in accordance with this title, or imprisoned not more than 5 years</quote> and inserting <quote>imprisoned not more than 10 years</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H40339BCC27184F4AA120A996E14F7B57"><enum>(2)</enum><text>in subsection (b), by striking <quote>imprisoned not more than one year, or both, and in the case of a second or subsequent violation, be fined in accordance with this title, imprisoned not more than 5 years</quote> and inserting <quote>imprisoned not more than 10 years</quote>.</text></paragraph></subsection></section>
