<official-title>To amend the Child Nutrition Act of 1966 to promote better nutrition among school children participating in the school breakfast and lunch programs.</official-title>

<section section-type="section-one" id="HF85BFB9CE1744BF6AE10467F65DE3E67" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Better Nutrition for School Children Act of 2004</short-title></quote>.</text></section> 
<section id="HBCAAEC1C9E0146B682C7EB3588C1EDF"><enum>2.</enum><header>Foods of minimal nutritional value</header> 
<subsection id="HCFCCCC4FE0F14C11B04CDD781B73241C"><enum>(a)</enum><header>In general</header><text>Section 10 of the <act-name parsable-cite="CNA66">Child Nutrition Act of 1966</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1779">42 U.S.C. 1779</external-xref>) is amended—</text> 
<paragraph id="H0AD7BCFE7D9549ADB481E99C9C9F2CDD"><enum>(1)</enum><text>in subsection (a), by inserting <quote>(throughout the entire school, including the school grounds, until the end of the time of service of food under the school lunch program under the Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>))</quote> after <quote>participating schools</quote>;</text></paragraph> 
<paragraph id="H5E24932779EB43DE85029028965FA288"><enum>(2)</enum><text>by striking subsection (b);</text></paragraph> 
<paragraph id="H0C9B1C29BB01478AA14BDDFECB7EBE2"><enum>(3)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph> 
<paragraph id="HDF797DEFF82149D786D9C4E815838965"><enum>(4)</enum><text>by inserting after subsection (a) the following:</text>

<subsection id="H9432148A59914AF681E3CB2BBD30D37F"><enum>(b)</enum><header>Basis</header><text>The Secretary shall promulgate the regulations required under subsection (a) based on sound nutritional science, as determined by the Secretary.</text></subsection> 
<subsection id="HF9CC5B73A2AD4FBF927BD8D216DE3FBD"><enum>(c)</enum><header>Factors</header><text>In promulgating the regulations required under subsection (a), the Secretary shall consider—</text> 
<paragraph id="H80F9E5FC072A470EBE595788E300B0AD"><enum>(1)</enum><text>the nutritional needs of students in various grade levels;</text></paragraph> 
<paragraph id="H330972B6827047E79DC56D5D987CA462"><enum>(2)</enum><text>the proximity of any area where foods of minimal nutritional value may be sold, donated, or served without charge to the food service facilities or areas;</text></paragraph> 
<paragraph id="H0D28EBC55D6240C10074F86C8C19F8CF"><enum>(3)</enum><text>the extent to which students will likely substitute consumption of foods of minimal nutritional value for other food served in participating schools under this Act and the Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>); and</text></paragraph> 
<paragraph id="H7C718DB0F27F497B93D829E1AFDB62E0"><enum>(4)</enum><text>the benefits to a school of permitting the sale, donation, or service without charge of foods of minimal nutritional value, including the extent to which the proceeds of such sales inure to the benefit of a school or an organization of students approved by a school.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HE96D84F6A0064008B48781C6E8C0BCE9"><enum>(b)</enum><header>Regulations</header> 
<paragraph id="H66B2E62D1F3D4F648F4E291C6DE2F4F"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Agriculture shall promulgate such regulations as are necessary to implement the amendments made by this section.</text></paragraph> 
<paragraph id="H09045219C2F34BC3A3CBD14BD6006EBD"><enum>(2)</enum><header>Foods of minimal nutritional value</header><text>In promulgating the regulations, the Secretary shall review and (as necessary) revise the definition of <quote>foods of minimal nutritional value</quote> that is used to carry out the <act-name parsable-cite="CNA66">Child Nutrition Act of 1966</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>) and the Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>).</text></paragraph> 
<paragraph id="HDF31738A98CB4DA581008800997C6100"><enum>(3)</enum><header>Procedure</header><text>The promulgation of the regulations and the administration of the amendments made by this section shall be made without regard to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>).</text></paragraph> 
<paragraph id="HE87AE6BB5E6A487D954F17001860BFDB"><enum>(4)</enum><header>Congressional review of agency rulemaking</header><text>In carrying out this subsection, the Secretary shall use the authority provided under <external-xref legal-doc="usc" parsable-cite="usc/5/808">section 808(2)</external-xref> of title 5, United States Code.</text></paragraph></subsection></section>
