<official-title>To amend the Robert T. Stafford Disaster Relief and Emergency Assistance Act to provide assistance for areas that experience a disaster that results in major damage to or destruction of 100 homes or fewer.</official-title>

<section id="H7D8DB32D5C3741EDA02BB1C9C1BBA1D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Small Disaster Assistance Act of 2004</quote>.</text></section> 
<section id="H82EB8D26FC4C414CB4B2A5CC68B211AF"><enum>2.</enum><header>Assistance for disasters affecting 100 homes or fewer</header> 
<subsection id="H3E86AA5349284ACF9BFA7B37481E00D0"><enum>(a)</enum><header>In general</header><text>Title IV of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="HE8E3B6F5144F454E0000464CDDE5FF5C"><enum>425.</enum><header>Assistance for disasters affecting 100 homes or fewer</header> 
<subsection id="HBF1C8349DE3C433F81C61C5FBF4DEECA"><enum>(a)</enum><header>In general</header><text>Subject to subsection (c), in the case of an event that results in major damage to or destruction of 100 homes or fewer, the President may grant the request of the Governor of the affected State for a declaration that a major disaster exists under section 401, notwithstanding the limited severity and magnitude of the event, if the President determines that Federal assistance under this title is necessary due to the existence of 1 or more factors listed in subsection (b).</text></subsection> 
<subsection id="H36203C5F3DC54BB4B0295900CDF6FD7"><enum>(b)</enum><header>Factors</header><text>In determining whether to grant the request of the Governor of the affected State under subsection (a), the President shall consider whether the following factors exist in the immediate area of the event:</text> 
<paragraph id="HC444312139B14FA892A0FCC0A7247C00"><enum>(1)</enum><text>A large population of historically and economically disadvantaged individuals.</text></paragraph> 
<paragraph id="HD63C2D5F23FB40CC84E8A866A11EBB4C"><enum>(2)</enum><text>A median family income level below the national, State, or local average.</text></paragraph> 
<paragraph id="H437DC7D342B5412D8884C77420E65FD2"><enum>(3)</enum><text>High unemployment.</text></paragraph> 
<paragraph id="HF8CAF9FFC8974DB3009823BC00ACB008"><enum>(4)</enum><text>A large population of uninsured homeowners or renters.</text></paragraph> 
<paragraph id="H54EA3842EA814195AE15A7C991EA04C8"><enum>(5)</enum><text>A large elderly population.</text></paragraph>
<paragraph id="HCAC19E6997D6496DB999F5B94CF224B0"><enum>(6)</enum><text display-inline="yes-display-inline">A high concentration of damage.</text></paragraph>
<paragraph id="HB112A62A8E8948BFA358EEFD9515524"><enum>(7)</enum><text>A high level of trauma, including injuries, deaths, disruption of community services, and emergency needs.</text></paragraph></subsection> 
<subsection id="H2CBB51455FD04D82BA846425790000E1"><enum>(c)</enum><header>Limitations on relief</header><text></text> 
<paragraph id="HF12A18346CEE4D949709ED89F56E6F19"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), total assistance provided under this title for a major disaster declared under subsection (a) shall not exceed—</text> 
<subparagraph id="HAC045017E07F4E198FF50320FAA4FE3"><enum>(A)</enum><text>$1,000,000 if the disaster results in major damage to or destruction of between 1 and 50 homes; or</text></subparagraph> 
<subparagraph id="H4299D302295B4BACA34B67206BA58452"><enum>(B)</enum><text>$2,000,000 if the disaster results in major damage to or destruction of between 51 and 100 homes.</text></subparagraph></paragraph> 
<paragraph id="H860904D93D20417E87E8DC8BF831057C"><enum>(2)</enum><header>Limitation</header><text>Total assistance provided under this title for a major disaster declared under subsection (a) may exceed the limitation in paragraph (1) if the President determines that—</text> 
<subparagraph id="H7381CAA7E11142FBA93BBFCC702C2839"><enum>(A)</enum><text>continued disaster assistance is immediately required;</text></subparagraph> 
<subparagraph id="H6D72703DDA9145888271B700691372EB"><enum>(B)</enum><text>there is a continuing and immediate risk to lives, property, public health, or safety; or</text></subparagraph> 
<subparagraph id="H80F13CBDF47F408693C372F553B54A3"><enum>(C)</enum><text>necessary assistance will not otherwise be provided on a timely basis.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3D05F00B849847AA93C9005769A2906E"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply to all disasters occurring on or after August 1, 2003.</text> </subsection></section>
