<official-title>To improve protections for children and to hold States accountable for the orderly and timely placement of children across State lines, and for other purposes.</official-title>

<section id="HA0C9D93121004CB69BB910AC7FE29F1C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Orderly and Timely Interstate Placement of Foster Children Act of 2004</short-title></quote>.</text></section> 
<section id="HF14A71790011462BA27766D380B36579"><enum>2.</enum><header>Sense of the Congress</header> 
<subsection id="HE4949AEE66384925BE7CCA1748D4B21E"><enum>(a)</enum><header>Finding</header><text>The Congress finds that the Interstate Compact on the Placement of Children (ICPC) was drafted more than 40 years ago, is outdated, and is a barrier to the timely placement of children across State lines.</text></subsection> 
<subsection id="HAC8ED70F0C2B4D7B95367E45D218F748"><enum>(b)</enum><header>Sense of the Congress</header><text>It is the sense of the Congress that the States should expeditiously revise the ICPC to better serve the interests of children and reduce unnecessary work, and that the revision should include—</text> 
<paragraph id="HDB5F4805516741DFB8CAB9E0ABCCC89"><enum>(1)</enum><text>limiting its applicability to children in foster care under the responsibility of a State, except those seeking placement in a residential facility primarily to access clinical mental health services; and</text></paragraph> 
<paragraph id="H0084D728FD0240318F09003CBFDF83A6"><enum>(2) </enum><text>providing for deadlines for the completion and approval of home studies as set forth in section 4.</text></paragraph></subsection></section> 
<section id="HB902DA0217DB4223AA464D9D5EDFD9DC"><enum>3.</enum><header>Orderly and timely process for interstate placement of children</header><text display-inline="no-display-inline">Section 471(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)</external-xref>) is amended—</text> 
<paragraph display-inline="no-display-inline" id="HB2768C02C6EA40D3999E30532D4173CF"><enum>(1)</enum><text>by striking “and” at the end of paragraph (23);</text></paragraph> 
<paragraph id="H235308BF2DBF482E877EA3ADBB9BF744"><enum>(2)</enum><text>by striking the period at the end of paragraph (24) and inserting “; and”; and</text></paragraph> 
<paragraph id="H776EE2B65829423C8307517D8E949CD0"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="HE443C40A59CB493D99208F9F41D6232" display-inline="no-display-inline"> 
<paragraph id="H2FA9EA1E279D4B20A637E1CCF3A8806"><enum>(25)</enum><text>provide that the State shall have in effect procedures for the orderly and timely interstate placement of children; and procedures implemented in accordance with an interstate compact approved by the Secretary, if incorporating with the procedures prescribed by paragraph (26), shall be considered to satisfy the requirement of this paragraph.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HC696DE45BBB842C79C09509EF7C3D46"><enum>4.</enum><header>Home studies</header> 
<subsection id="HFF39A348BD83439E8EB73B9BCACAA22D"><enum>(a)</enum><header>Orderly process</header><text></text> 
<paragraph id="HF2F9F9C92762401C0090E75005C7792D"><enum>(1)</enum><header>In general</header><text>Section 471(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)</external-xref>) is further amended—</text> 
<subparagraph id="HC65413D3F62E4944A3220844A01850B6"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (24);</text></subparagraph> 
<subparagraph id="HDB9539913CAD4176001E3E0006CAADFB"><enum>(B)</enum><text>by striking the period at the end of paragraph (25) and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="H324BBFA9E0DF47D2ACD62D41BC5FAF46"><enum>(C)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H1726CD87316C401E8E9268C8366B54FD" display-inline="no-display-inline"> 
<paragraph id="HB81CBE61FCFF4BE5B957A5F6CEC27D6C"><enum>(26)</enum><text>provides that—</text> 
<subparagraph id="H9E1EC392FE744BE793E1ED746F72441C"><enum>(A)</enum><text>within 60 days after the State receives from another State a request to conduct a study of a home environment for purposes of assessing the appropriateness of placing a child in the home, the State shall, directly or by contract—</text> 
<clause id="HF52E09628C7D4C8DA9D500E9BF002E27"><enum>(i)</enum><text>conduct and complete the study; and</text></clause> 
<clause id="HD9F3D7CFFA3C4E8389F66D991D518688"><enum>(ii)</enum><text>return to the other State a report on the results of the study, which shall address the extent to which placement in the home would meet the needs of the child;</text></clause></subparagraph> 
<subparagraph id="H3E0603DCAB604B08A4C4425DAB81F12"><enum>(B)</enum><text>the State shall treat any report described in subparagraph (A) that is received from another State (or from a private agency under contract with another State) as meeting any requirements imposed by the State for the completion of a home study before placing a child in the home, unless, within 7 days after receipt of the report, the State determines, based on grounds that are specific to the content of the report, that making a decision in reliance on the report would be contrary to the welfare of the child; and</text></subparagraph> 
<subparagraph id="HEF7634FCE28A40E29004217DF9266FD"><enum>(C)</enum><text>the State shall not impose any restriction on the ability of a State agency administering, or supervising the administration of, a State program operated under a State plan approved under this part to contract with a private agency for the conduct of a home study described in subparagraph (A). </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HF590E312701D485DB91732C431D8DEC7"><enum>(2)</enum><header>Sense of the Congress</header><text>It is the sense of the Congress that each State should—</text> 
<subparagraph id="H2A59CEA741114D42B0F585CE23BBC28B"><enum>(A)</enum><text>use private agencies to conduct home studies when doing so is necessary to meet the requirements of section 471(a)(26) of the Social Security Act; and</text></subparagraph> 
<subparagraph id="H7494427380AC4B6FB906C9C329BB2B8F"><enum>(B)</enum><text>give full faith and credit to any home study report completed by any other State with respect to the placement of a child in foster care or for adoption.</text></subparagraph></paragraph></subsection> 
<subsection id="HD109B15E5D3741058FA16100A4B74396"><enum>(b)</enum><header>Timely interstate home study incentive payments</header><text>Part E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/670">42 U.S.C. 670–679b</external-xref>) is amended by inserting after section 473A the following:</text> 
<quoted-block style="OLC" id="H4E01EA76A4454BDEB1DB8B86798E279" display-inline="no-display-inline"> 
<section id="HBBFC85083C244C869E5CDAAFC6A07B85"><enum>473B.</enum><header>Timely interstate home study incentive payments</header> 
<subsection id="H22531223B3BD4D1E93A9124BF71FB84E"><enum>(a)</enum><header>Grant authority</header><text>The Secretary shall make a grant to each State that is a home study incentive-eligible State for a fiscal year in an amount equal to the timely interstate home study incentive payment payable to the State under this section for the fiscal year, which shall be payable in the immediately succeeding fiscal year.</text></subsection> 
<subsection id="HAD8A6F88C21A4EAEA384003039D3FE35"><enum>(b)</enum><header>Home study incentive-eligible State</header><text>A State is a home study incentive-eligible State for a fiscal year if—</text> 
<paragraph id="H6777F1886AEF4AF4AF23CB3148D9DFA"><enum>(1)</enum><text>the State has a plan approved under this part for the fiscal year;</text></paragraph> 
<paragraph id="H5443ADFEBD364D83B3D740B7E01F7FBE"><enum>(2)</enum><text>the State is in compliance with subsection (c) for the fiscal year; and</text></paragraph> 
<paragraph id="H8EC9A449537A40CA9FCE8481499FDA7D"><enum>(3)</enum><text>based on data submitted and verified pursuant to subsection (c), the State has completed a timely interstate home study during the fiscal year.</text></paragraph></subsection> 
<subsection id="H2575F1772F034CA789463714F6BAD9F0"><enum>(c)</enum><header>Data requirements</header> 
<paragraph id="H9FBB3A837B4E44DF8DB73F8EE93C0384"><enum>(1)</enum><header>In general</header><text>A State is in compliance with this subsection for a fiscal year if the State has provided to the Secretary a written report, covering the preceding fiscal year, that specifies—</text> 
<subparagraph id="H50A36D41847742FA837D85DE67E674BD"><enum>(A)</enum><text>the total number of interstate home studies requested by the State with respect to children in foster care under the responsibility of the State, and with respect to each such study, the identity of the other State involved; and</text> </subparagraph> 
<subparagraph id="HE5955E6933F74BEBBEF67CAF7879C85E"><enum>(B)</enum><text>the total number of timely interstate home studies completed by the State with respect to children in foster care under the responsibility of other States, and with respect to each such study, the identity of the other State involved.</text> </subparagraph></paragraph> 
<paragraph id="HF475CBA8E579472F00EBF3DA4CB78311"><enum>(2)</enum><header>Verification of data</header><text>In determining the number of timely interstate home studies to be attributed to a State under this section, the Secretary shall check the data provided by the State under paragraph (1) against complementary data so provided by other States.</text> </paragraph></subsection> 
<subsection id="HD07BED4D23B740B182B22FE47AF2912"><enum>(d)</enum><header>Timely interstate home study incentive payments</header><text></text> 
<paragraph id="H062AD18BE2C54257AC6500E134973CBD"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2) of this subsection, the timely interstate home study incentive payment payable to a State for a fiscal year shall be $1,000, multiplied by the number of timely interstate home studies attributed to the State under this section during the fiscal year.</text> </paragraph> 
<paragraph id="HAAA03DF008D0498AA740B289184B00DA"><enum>(2)</enum><header>Pro rata adjustment if insufficient funds available</header><text>If the total amount of timely interstate home study incentive payments otherwise payable under this section for a fiscal year exceeds the total of the amounts made available pursuant to subsection (h) for the fiscal year, the amount of each such otherwise payable incentive payment shall be reduced by a percentage equal to—</text> 
<subparagraph id="H5A8DDE5149874878989DB649A0DCD4F2"><enum>(A)</enum><text>the total of the amounts so made available; divided by</text></subparagraph> 
<subparagraph id="HCE62CDA204BB4235887D68CDCC4B2314"><enum>(B)</enum><text>the total of such otherwise payable incentive payments.</text> </subparagraph></paragraph></subsection> 
<subsection id="HDB12A721AD4C4ADE84A32DA4EF6EAD"><enum>(e)</enum><header>2-year availability of incentive payments</header><text>Payments to a State under this section in a fiscal year shall remain available for use by the State through the end of the next fiscal year.</text></subsection> 
<subsection id="H6E363554FF384F1195CADEB499BABD9E"><enum>(f)</enum><header>Limitations on use of incentive payments</header><text>A State shall not expend an amount paid to the State under this section except to provide to children or families any service (including post-adoption services) that may be provided under part B or E. Amounts expended by a State in accordance with the preceding sentence shall be disregarded in determining State expenditures for purposes of Federal matching payments under sections 423, 434, and 474.</text></subsection> 
<subsection id="H9CDB6BC54DD541749FEA334DC6FEB77D"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H8C7B5D733E154C0997F691301B73C422"><enum>(1)</enum><header>Home study</header><text>The term <quote>home study</quote> means a study of a home environment, conducted in accordance with applicable requirements of the State in which the home is located, for the purpose of assessing whether placement of a child in the home would be appropriate for the child.</text></paragraph> 
<paragraph id="H679361FA9831477A9E5B2D58BFF94510"><enum>(2)</enum><header>Interstate home study</header><text>The term <quote>interstate home study</quote> means a home study conducted by a State at the request of another State, to facilitate an adoptive or relative placement in the State. </text></paragraph> 
<paragraph id="HBC625E37541D488D001E32A66F00A711"><enum>(3)</enum><header>Timely interstate home study</header><text>The term <quote>timely interstate home study</quote> means an interstate home study completed by a State if the State provides to the State that requested the study, within 30 days after receipt of the request, a report on the results of the study. </text></paragraph></subsection> 
<subsection id="H40C1CB149C8248428FF2F2FF44D1D8A1"><enum>(h)</enum><header>Limitations on authorization of appropriations</header><text></text> 
<paragraph id="H35FED1AA3AC74F38B9FA61011DDED4B"><enum>(1)</enum><header>In general</header><text>For grants under subsection (a), there are authorized to be appropriated to the Secretary $10,000,000 for fiscal year 2005.</text></paragraph> 
<paragraph id="H42213E7746DF496AAEA004EFC3CD0236"><enum>(2)</enum><header>Availability</header><text>Amounts appropriated under paragraph (1) are authorized to remain available until expended.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2EC7617266BE4D4A9E63C496E1A2A7D1"><enum>(c)</enum><header>Repealer</header><text>Effective October 1, 2008, section 473B of the Social Security Act is repealed.</text></subsection> </section> 
<section id="HB6B73D147CA849CAA1A6955661897D7"><enum>5.</enum><header>Requirement to check child abuse registries; opt-out eliminated</header><text display-inline="no-display-inline">Section 471(a)(20) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(20)</external-xref>) is amended—</text> 
<paragraph id="H9CE6181FC1FA47739DB377F4F5DDAD00"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>unless an election provided for in subparagraph (B) is made with respect to the State,</quote>; and</text></paragraph> 
<paragraph id="H7CCEFAB047494FCA8D1173B9F1D8B2B"><enum>(2)</enum><text>by striking subparagraph (B) and inserting the following:</text> 
<quoted-block id="HFEF8D6C71830472695ABE05839F81B4D"> 
<subparagraph id="H3966E1997EAD4F7F9BFA3E21349BF96"><enum>(B)</enum><text>provides that the State shall—</text> 
<clause id="HC31759E3362E4C19AE889F003C78894E"><enum>(i)</enum><text>check any child abuse and neglect registry maintained by the State for information on any prospective foster or adoptive parent and on any other adult living in the home of such a prospective parent, and request any other State in which any such prospective parent or other adult has resided in the preceding 5 years, to enable the State to check any child abuse and neglect registry maintained by such other State for such information, before the prospective foster or adoptive parent may be finally approved for placement of a child, regardless of whether foster care maintenance payments or adoption assistance payments are to be made on behalf of the child under the State plan under this part;</text></clause> 
<clause id="H7DCAEBEF4C3A41928017C1647031F5C2"><enum>(ii)</enum><text>comply with any request described in clause (i) that is received from another State; and</text></clause> 
<clause id="H14AFEBF54F50408CA69211D966AEF20"><enum>(iii)</enum><text>have in place safeguards to prevent the unauthorized disclosure of information in any child abuse and neglect registry maintained by the State, and to prevent any such information obtained pursuant to this subparagraph from being used for a purpose other than the conducting of background checks in foster or adoptive placement cases;</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H5E002B7A88B6444F987893D45CF554CC"><enum>6.</enum><header>Courts allowed access to the Federal Parent Locator Service to locate parents in foster care or adoptive placement cases</header><text display-inline="no-display-inline">Section 453(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653(c)</external-xref>) is amended—</text> 
<paragraph id="H052F117136574E1C8BEA55F77DA26DBE"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (3);</text></paragraph> 
<paragraph id="H7E71F392BACA49C7B9CE986BA49F3525"><enum>(2)</enum><text>by striking the period and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H6919FA5F6636466DA023AD6C415E3BA4"><enum>(3)</enum><text>by adding at the end the following:</text>

<paragraph id="HF65C4F71C2584FC7BFFFD8208BCEF1D3"><enum>(5)</enum><text>any court which has authority with respect to the placement of a child in foster care or for adoption, but only for the purpose of locating a parent of the child.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H19C8B82F1A314464B2B2C852286E82E1"><enum>7.</enum><header>Caseworker visits</header> 
<subsection id="HF8F5F4ED4854466A85BB4B9E26DC53D"><enum>(a)</enum><header>Purchase of services in interstate placement cases</header><text>Section 475(5)(A)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(5)(A)(ii)</external-xref>) is amended by striking <quote>or of the State in which the child has been placed</quote> and inserting <quote>of the State in which the child has been placed, or of a private agency under contract with either such State</quote>.</text></subsection> 
<subsection id="H0366D565F854450F8C41AAC600CCDC8C"><enum>(b)</enum><header>Increased visits</header><text>Section 475(5)(A)(ii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(5)(A)(ii)</external-xref>) is amended by striking <quote>12</quote> and inserting <quote>6</quote>.</text></subsection></section> 
<section id="H70FAC877698C42B08F67CD6EA6008D1F"><enum>8.</enum><header>Health and education records</header><text display-inline="no-display-inline">Section 475 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>) is amended—</text> 
<paragraph id="H596310A304BE4B12903EC9E3445BFF48"><enum>(1)</enum><text>in paragraph (1)(C)—</text> 
<subparagraph id="H2F99D50A8ABC42EB00182C92AFE2FD2C"><enum>(A)</enum><text>by striking <quote>To the extent available and accessible, the</quote> and inserting <quote>The</quote>; and</text></subparagraph> 
<subparagraph id="H6CA77EBDD5334070894F6824C1E6F599"><enum>(B)</enum><text>by inserting <quote>the most recent information available regarding</quote> after <quote>including</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HAC167BF3AECF49E1862DA88F6784DFE5"><enum>(2)</enum><text>in paragraph (5)(D)—</text> 
<subparagraph id="H6FCF3AC79A2E4F6F9D2DA939AD2FAB67"><enum>(A)</enum><text>by inserting <quote>a copy of the record is</quote> before <quote>supplied</quote>; and</text></subparagraph> 
<subparagraph id="H0A85EA355E754732AB3738E855A14B60"><enum>(B)</enum><text>by inserting <quote>, and is supplied to the child at the time the child leaves foster care if the child is leaving foster care by reason of having attained the age of majority under State law</quote> before the semicolon.</text></subparagraph></paragraph></section> 
<section id="H0622DF8EDEB3406D973FB546DB20D2A0"><enum>9.</enum><header>Right to be heard in foster care proceedings</header> 
<subsection id="H14B69038D2F74624967204E81461239D"><enum>(a)</enum><header>In general</header><text>Section 475(5)(G) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(5)(G)</external-xref>) is amended—</text> 
<paragraph id="H7064DBEBEFCF4F7A87D042772358D31"><enum>(1)</enum><text>by striking <quote>an opportunity</quote> and inserting <quote>a right</quote>;</text></paragraph> 
<paragraph id="HA9FD165029BB420D8620BBEA48953BFB"><enum>(2)</enum><text>by striking <quote>and opportunity</quote> and inserting <quote>and right</quote>; and </text></paragraph> 
<paragraph id="HF96CC430540546B884A3EEC9A8FD7E45"><enum>(3)</enum><text>by striking <quote>review or hearing</quote> each place it appears and inserting <quote>proceeding</quote>.</text></paragraph></subsection> 
<subsection id="H1EE41EFF32E6449D9F469D57184900AB"><enum>(b)</enum><header>Notice of proceeding</header><text>Section 438(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/638">42 U.S.C. 638(b)</external-xref>) is amended by inserting <quote>shall have in effect a rule requiring State courts to notify foster parents, pre-adoptive parents, and relative caregivers of a child in foster care under the responsibility of the State of any proceeding to be held with respect to the child, and</quote> after <quote>highest State court</quote>.</text></subsection></section> 
<section id="H4E0A0A6D3D5E460CA5135E46A41CAA63"><enum>10.</enum><header>Reasonable efforts</header> 
<subsection id="H9302D80A9B724F2F8C00BB7EC4E5744D"><enum>(a)</enum><header>In general</header><text>Section 471(a)(15)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(15)(C)</external-xref>) is amended by inserting <quote>(including, if appropriate, through an interstate placement)</quote> after <quote>accordance with the permanency plan</quote>.</text></subsection> 
<subsection id="H886DC97E5F7A481E98CCB700AFB57373"><enum>(b)</enum><header>Permanency hearing</header><text>Section 471(a)(15)(E)(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(15)(E)(i)</external-xref>) is amended by inserting <quote>, which considers in-State and out-of-State permanent placement options for the child,</quote> before <quote>shall</quote>. </text></subsection> 
<subsection id="HB861EB6AE6EA4994B4169D6F3F48F064"><enum>(c)</enum><header>Concurrent planning</header><text>Section 471(a)(15)(F) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(15)(F)</external-xref>) is amended by inserting <quote>, including identifying appropriate out-of-State relatives and placements</quote> before <quote>may</quote>.</text></subsection></section> 
<section id="H171EA93F6CF24C069ED0ACA47F6066E5"><enum>11.</enum><header>Case plans</header><text display-inline="no-display-inline">Section 475(1)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(1)(E)</external-xref>) is amended by inserting <quote>to facilitate orderly and timely interstate placements</quote> before the period.</text></section> 
<section id="H520182C0B2DB4328A12FAA6B7945944B"><enum>12.</enum><header>Case review system</header><text display-inline="no-display-inline">Section 475(5)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(5)(C)</external-xref> is amended— </text> 
<paragraph display-inline="no-display-inline" id="H45DB1A94A32447E795C33B22DF225977"><enum>(1)</enum><text>by inserting <quote>, in the case of a child who will not be returned to the parent, the hearing shall consider in-State and out-of-State placement options,</quote> after <quote>living arrangement</quote>; and</text></paragraph> 
<paragraph id="HB06262386B274E269B00116D1EB9FC72"><enum>(2)</enum><text>by inserting <quote>the hearing shall determine</quote> before <quote>whether the</quote>. </text></paragraph></section> 
<section id="HFDEA8F0AAEDD43A6A9FFACAB6400DF7F"><enum>13.</enum><header>Use of interjurisdictional resources</header><text display-inline="no-display-inline">Section 422(b)(12) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/622">42 U.S.C. 622(b)(12)</external-xref>) is amended—</text> 
<paragraph id="HA7D77DC5C71D4DAA98D894CEF1F2303"><enum>(1)</enum><text>by striking <quote>develop plans for the</quote> and inserting <quote>make</quote>;</text></paragraph> 
<paragraph id="HBAD97755EB584E4794DE1CBEEBCF6E69"><enum>(2)</enum><text>by inserting <quote>(including through contracts for the purchase of services)</quote> after <quote>resources</quote>; and</text></paragraph> 
<paragraph id="H43D5F3AED635483A9E0038DE3000A835"><enum>(3)</enum><text>by inserting <quote>, and shall eliminate legal barriers,</quote> before <quote>to facilitate</quote>.</text></paragraph></section> 
<section id="HB2D086BE18CD484088506D98C1B18508"><enum>14.</enum><header>GAO study on child welfare background checks</header> 
<subsection id="H582B4B9517B14A328297D9607EF0CBA8"><enum>(a)</enum><header>Study</header><text>The Comptroller General of the United States shall conduct a study of background checks that are performed for the purpose of determining the appropriateness of placing in a foster or adoptive home a child who is under the custody of a State. The study shall review the policies and practices of States in order to—</text> 
<paragraph id="HA78219D76DF44FA380995EB6226891C4"><enum>(1)</enum><text>identify the most common delays in the background clearance process and where in the process the delays occur;</text></paragraph> 
<paragraph id="HE3B33D4E8C6A4EEFB5E195082CFA47ED"><enum>(2)</enum><text>describe when background checks are initiated;</text></paragraph> 
<paragraph id="H4FC5BAE3453A41229D3386CE93427E63"><enum>(3)</enum><text>determine which of local, State, or Federal (such as FBI) background checks are used, how long it takes, on average, for each kind of check to be processed, which crimes or other events are included in each kind of check, how the States differ in classifying the crimes and other events checked, and how the information revealed by the checks is used in determining eligibility to act as a foster or adoptive parent;</text></paragraph> 
<paragraph id="H74EE0DF7BC21494790BDCE16E9797BEE"><enum>(4)</enum><text>examine the barriers child welfare agencies face in accessing criminal background check information;</text></paragraph> 
<paragraph id="HB3B84ECA3007476400D0227D3C5E7E6"><enum>(5)</enum><text>examine the use of the latest information-sharing technology, including electronic fingerprinting and participation in the Integrated Automated Fingerprinting Information System;</text></paragraph> 
<paragraph id="H63C6B3A783EF4379AAD509F04B882D00"><enum>(6)</enum><text>identify the varied uses of such technology for child welfare purposes as opposed to criminal justice purposes; and</text></paragraph> 
<paragraph id="H286753B9B5244F4FB39DECA86E8367D9"><enum>(7)</enum><text>recommend best practices that can increase the speed, efficiency, and accuracy of child welfare background checks at all levels of government.</text></paragraph></subsection> 
<subsection id="H70D53C7072A44CC28BBE8BF97B80CF4F"><enum>(b)</enum><header>Report to the Congress</header><text>Within 12 months after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the Committees on Ways and Means and on Education and the Workforce of the House of Representatives and the Committees on Finance and on Health, Education, Labor, and Pensions of the Senate a report which contains the results of the study required by subsection (a).</text></subsection></section> 
<section id="H8708D03703B6499B865C1D006E28A5B2"><enum>15.</enum><header>Effective date</header> 
<subsection id="HD389090DC5F1423A93FB22F604C56472"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), the amendments made by this Act shall take effect on October 1, 2004, and shall apply to payments under parts B and E of title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name> for calendar quarters beginning on or after such date, without regard to whether regulations to implement the amendments are promulgated by such date.</text></subsection> 
<subsection id="HF0BF77161A604AD3A600A8D818F2E9B2"><enum>(b)</enum><header>Delay permitted if State legislation required</header><text>If the Secretary of Health and Human Services determines that State legislation (other than legislation appropriating funds) is required in order for a State plan under part B or E of title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name> to meet the additional requirements imposed by the amendments made by this Act, the plan shall not be regarded as failing to meet any of the additional requirements before the 1st day of the 1st calendar quarter beginning after the first regular session of the State legislature that begins after the date of the enactment of this Act. If the State has a 2-year legislative session, each year of the session is deemed to be a separate regular session of the State legislature.</text></subsection></section>
