<section id="H171DF3BA8FA849739176F07094A9EDBD" section-type="subsequent-section"><enum>201.</enum><header>Extension of retransmission consent exemption</header><text display-inline="no-display-inline">Section 325(b)(2)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/325">47 U.S.C. 325(b)(2)(C)</external-xref>) is amended by striking <quote>December 31, 2004</quote> and inserting <quote>December 31, 2009</quote>.</text></section> 
<section id="HCAC42041AC5C4AC38DDA2B906D37A1C1"><enum>202.</enum><header>Cable/satellite comparability</header> 
<subsection id="H464430D2594D4D50B05921001CB97FCE"><enum>(a)</enum><header>Amendment</header><text>Part I of title III of the Communications Act of 1934 is amended by inserting after section 339 (<external-xref legal-doc="usc" parsable-cite="usc/47/339">47 U.S.C. 339</external-xref>) the following new section:</text>

<section id="H118C6F8FB0F8425B8FF7E87CCACA6B33"><enum>340.</enum><header>Significantly viewed signals permitted to be carried</header> 
<subsection id="HFE5B5BCF911A41F3A5F774C74883BE7C"><enum>(a)</enum><header>Significantly viewed stations</header><text>In addition to the broadcast signals that subscribers may receive under section 338 and 339, a satellite carrier is also authorized to retransmit to subscribers located in a community the signal of any station that a cable system in the same community is authorized to retransmit pursuant to <external-xref legal-doc="usc" parsable-cite="usc/17/111">section 111</external-xref> of title 17, United States Code, if such station is treated as significantly viewed in the county within which such community is located in accordance with the rules, regulations, and authorizations of the Commission.</text></subsection> 
<subsection id="H6867787A046A4D80B4A2535EC4843BF0"><enum>(b)</enum><header>Limitations</header> 
<paragraph id="HDE3E36BB4DDF4647B6F611D2861D2C00"><enum>(1)</enum><header>Analog service limited to subscribers taking local-into-local service</header><text>With respect to a signal that originates as an analog signal of a television broadcast station, this section shall apply only to retransmissions to subscribers who receive retransmissions from a satellite carrier pursuant to the statutory license under <external-xref legal-doc="usc" parsable-cite="usc/17/122">section 122</external-xref> of title 17, United States Code.</text></paragraph> 
<paragraph id="HF0383C3D00AB4DA2B0906BDFEC6CA020"><enum>(2)</enum><header>Digital service limitations</header><text>With respect to a signal that originates as a digital signal of a network station, this section shall apply only if—</text> 
<subparagraph id="H75F2BA5660134EF5B97DF4B619973FA"><enum>(A)</enum><text>the subscriber receives from the satellite carrier pursuant to the statutory license under <external-xref legal-doc="usc" parsable-cite="usc/17/122">section 122</external-xref> of title 17, United States Code, the retransmission of the digital signal of a network station in the subscriber’s local market that is affiliated with the same television network; and </text></subparagraph> 
<subparagraph id="H33CEF168761846DE9CBA588F10ECE6BD"><enum>(B)</enum><text>either—</text> 
<clause id="H6064664CE9634DFBB244C8815C51F438"><enum>(i)</enum><text>the retransmission of the local network station occupies at least the equivalent bandwidth as the digital signal retransmitted pursuant to this section; or</text></clause> 
<clause id="HC6EF0A51ACE34E369023D493CF41826C"><enum>(ii)</enum><text>the retransmission of the local network station carries the entire bandwidth of the digital signal broadcast by such local network station.</text></clause></subparagraph></paragraph> 
<paragraph id="HBCDC8C0A0ED14F96BB251054D362D0B2"><enum>(3)</enum><header>Limitation not applicable where no network affiliates</header><text>The limitations in paragraphs (1) and (2) shall not prohibit a retransmission under this section to a subscriber located in a local market in which there are no network stations affiliated with the same television network as the station whose signal is being retransmitted pursuant to this section. </text></paragraph> 
<paragraph id="HEDD0CD3366DB4DEF8210671B006821DF"><enum>(4)</enum><header>Authority to grant station-specific waivers</header><text>Notwithstanding paragraphs (1) and (2), a satellite carrier may provide to subscribers the retransmission of a network station that is determined to be significantly viewed under this section, if and to the extent that the network station in the local market in which the subscriber is located, and that is affiliated with the same television network, has granted a waiver from the requirements of paragraph (1) and (2) to such satellite carrier with respect to such significantly viewed station.</text></paragraph></subsection> 
<subsection id="H3A4886C2CCB344468D85F276AFB92566"><enum>(c)</enum><header>Modifications of list</header> 
<paragraph id="H8D4D76A5EE1F44A99EA9548D124FBD6"><enum>(1)</enum><header>Petitions from satellite carriers</header><text>In addition to cable operators and television broadcast station licensees, the Commission shall permit a satellite carrier to petition for decisions and orders—</text> 
<subparagraph id="H139D2517ECAB475896FF84A8E07DEED0"><enum>(A)</enum><text>by which stations and communities may be added to those that are eligible for retransmission under <internal-xref idref="HFE5B5BCF911A41F3A5F774C74883BE7C" legis-path="340.(a)">subsection (a)</internal-xref>; and</text></subparagraph> 
<subparagraph id="H68F550C3754C4BB994BCE5A9FC92A4D7"><enum>(B)</enum><text>by which stations and communities may be determined to be eligible for retransmission under <internal-xref idref="HF0383C3D00AB4DA2B0906BDFEC6CA020" legis-path="340.(b)(2)">paragraph (2) of this subsection</internal-xref>. </text></subparagraph></paragraph> 
<paragraph id="H1C43C9856A294DB3AE92B37FFBBA669F"><enum>(2)</enum><header>Application of criteria to communities without cable service</header><text>In addition to the stations and communities that are eligible for retransmission under <internal-xref idref="HFE5B5BCF911A41F3A5F774C74883BE7C" legis-path="340.(a)">subsection (a)</internal-xref>, in a community that is not served by a cable system, a satellite carrier is also authorized to retransmit to subscribers located in such community the signal of any station that a cable system in that community would be authorized to retransmit pursuant to <external-xref legal-doc="usc" parsable-cite="usc/17/111">section 111</external-xref> of title 17, United States Code, if such signal would be treated as significantly viewed in the county within which such community is located in accordance with the rules, regulations, and authorizations of the Commission.</text></paragraph></subsection> 
<subsection id="H290C4A3178DC458C9B4536D8FDF6960"><enum>(d)</enum><header>Effect on other obligations and rights</header> 
<paragraph id="H46D3FD729F7E43D2965CE79586F714BF"><enum>(1)</enum><header>No effect on carriage obligations</header><text>Carriage of a signal under this section is not mandatory, and any right of a station licensee to have the signal of such station carried under section 338 is not affected by the eligibility of such station to be carried under this section.</text></paragraph> 
<paragraph id="H8DC5CFA48950411997AD3ED73710CE19"><enum>(2)</enum><header>Retransmission consent rights not affected</header><text>The eligibility of the signal of a station to be carried under this section does not affect the right of the licensee of such station to grant (or withhold) retransmission consent under section 325(b)(1).</text></paragraph></subsection> 
<subsection id="H81074EF2B9D04894B710A77C22EB00C7"><enum>(e)</enum><header>Network nonduplication and syndicated exclusivity</header><text/> 
<paragraph id="H378E159B81E04840B56C31E07D2289AD"><enum>(1)</enum><header>Not applicable except as provided by commission regulations</header><text>Signals eligible to be carried under this section are not subject to the Commission’s regulations concerning network nonduplication or syndicated exclusivity unless, pursuant to regulations adopted by the Commission, the Commission determines to permit network nonduplication or syndicated exclusivity to apply within the appropriate zone of protection. </text></paragraph> 
<paragraph id="HDE03E3973CC3411F87B288BFE969EA00"><enum>(2)</enum><header>Limitation</header><text>Nothing in this subsection or Commission regulations shall permit the application of network nonduplication or syndicated exclusivity regulations to the retransmission of distant signals of network stations that are carried by a satellite carrier pursuant to a statutory license under section 119(a)(2)(A) or (B), with respect to persons who reside in unserved households, under 119(a)(4)(A), or under section 119(a)(12).</text></paragraph></subsection> 
<subsection id="HAF8F65F5D4A443629F8FDD4785BFAA"><enum>(f)</enum><header>Enforcement proceedings</header> 
<paragraph id="H520C25890FB64822994C2B4F0057FFBF"><enum>(1)</enum><header>Notice by television broadcast stations</header><text display-inline="yes-display-inline">If a television broadcast station believes that a satellite carrier has retransmitted to any subscriber in the local market of such station the signal of another television broadcast station affiliated with the same television network in violation of this section, the station may provide the satellite carrier with written notice of such violation. Such notice shall be provided via overnight delivery, addressed to the chief executive officer of the satellite carrier at its principal place of business and marked <quote>URGENT LITIGATION MATTER</quote> on the outer packaging. Such notification shall set forth—</text> 
<subparagraph id="HE3A5D428C7004C4EABAACAC863CA3405"><enum>(A)</enum><text>the name, address, and call letters of the station that is claimed to have been unlawfully retransmitted (for purposes of this subsection, the <quote>imported station</quote>);</text></subparagraph> 
<subparagraph id="H51DD7161F5C24099B9E37429D9101900"><enum>(B)</enum><text>the name and address of the satellite carrier;</text></subparagraph> 
<subparagraph id="H5FD17C2E542246CD94ADC0A08BF4CC53"><enum>(C)</enum><text>the dates on which the alleged retransmission occurred;</text></subparagraph> 
<subparagraph id="HF9D0DDFA1C394AFD9B13604DBF71B7B1"><enum>(D)</enum><text>the street address of at least one person to whom the alleged retransmission was made;</text></subparagraph> 
<subparagraph id="HF3A0DAF7F960492197802FB738722482"><enum>(E)</enum><text>a statement that the retransmission was not permitted because—</text> 
<clause id="H7395C8F02D5347CA927766AB5BDEA16E"><enum>(i)</enum><text>the Commission had not determined that the imported station is significantly viewed in the relevant community;</text></clause> 
<clause id="H222909B2B39D45A2BF204C856FBA94CE"><enum>(ii)</enum><text>the subscriber is not eligible for the retransmission of the signal because of the limitation in subsection (b) (1) or (2);</text></clause> 
<clause id="H05D27BA2132A49239653051500CC8432"><enum>(iii)</enum><text>the satellite carrier had not provided the notification required by subsection (h)(3); or</text></clause> 
<clause id="H84336EEDF113402CB1A32F43D162D3A5"><enum>(iv)</enum><text>two or more of the above; and</text></clause></subparagraph> 
<subparagraph id="H600CE87FB953463E00D837EFBFE5C85F"><enum>(F)</enum><text>the name and address of counsel for the station.</text></subparagraph></paragraph> 
<paragraph id="H30434F9E11CA40B6A22E7942D1DB2F54"><enum>(2)</enum><header>Complaints by television broadcast stations</header><text display-inline="yes-display-inline">If, within 30 days of providing to the satellite carrier a notice pursuant to paragraph (1), the satellite carrier has not cured the alleged retransmission in violation of this section, or if the satellite carrier cures the alleged violation after notice and then renews such violation within the next two years, the station may file a complaint with the Commission. Such complaint shall set forth the information provided in a notice under paragraph (1).</text></paragraph> 
<paragraph id="HE53C2511127B4C41B2248663AC0B2FF"><enum>(3)</enum><header>Service of complaints on satellite carriers</header><text display-inline="yes-display-inline">For purposes of any proceeding under this subsection, any satellite carrier that retransmits the signal of any broadcast station shall be deemed to designate the Secretary of the Commission as its agent for service of process. A television broadcast station may serve a satellite carrier with a complaint concerning an alleged violation of this section through retransmission of a station within the local market of such station by filing the original and two copies of the complaint with the Secretary of the Commission and serving a copy of the complaint on the satellite carrier by means of two commonly used overnight delivery services, each addressed to the chief executive officer of the satellite carrier at its principal place of business, and each marked <quote>URGENT LITIGATION MATTER</quote> on the outer packaging. Service shall be deemed complete one business day after a copy of the complaint is provided to the delivery services for overnight delivery. On receipt of a complaint filed by a television broadcast station under this subsection, the Secretary of the Commission shall send the original complaint by United States mail, postage prepaid, receipt requested, addressed to the chief executive officer of the satellite carrier at its principal place of business.</text></paragraph> 
<paragraph id="H0B5FF8F461E74EAD8CF365A981B98D84"><enum>(4)</enum><header>Answers by satellite carriers</header><text>Within 20 business days after the date of service, the satellite carrier shall file an answer with the Commission and shall serve the answer by a commonly used overnight delivery service and by United States mail, on the counsel designated in the complaint at the address listed for such counsel in the complaint. The answer shall include, as a schedule, a complete and accurate list of all subscribers to which the satellite carrier retransmitted the imported station into the community in question pursuant to this section for each month during the relevant time period. Such subscriber information submitted by a satellite carrier may be used only for purposes of determining compliance by the satellite carrier with this section.</text></paragraph> 
<paragraph id="H265A78E75D974B6789CB56167390AAB"><enum>(5)</enum><header>Defenses</header> 
<subparagraph id="H9C6A908E4908433180577001BDF62CC8"><enum>(A)</enum><header>Exclusive defenses</header><text>The defenses under this paragraph are the exclusive defenses available to a satellite carrier against which a complaint under this subsection is filed.</text></subparagraph> 
<subparagraph id="H9FA8C9B37BC34E2494366CFEC4D48800"><enum>(B)</enum><header>Defenses</header><text>The defenses referred to under subparagraph (A) are the defenses—</text> 
<clause id="H262CA424F3134FBE9D3B688CFE2F77D5"><enum>(i)</enum><text>that the satellite carrier did not retransmit the imported station to any person in the complaining station’s local market pursuant to this section during the time period specified in the complaint;</text></clause> 
<clause id="H41EBFCAF66044E219B6CCABA00C3F5DA"><enum>(ii)</enum><text>if the complaining station has alleged that the retransmission was unlawful because the Commission had not determined that the station is significantly viewed in the relevant community, that the Commission had in fact made that determination;</text></clause> 
<clause id="H8856FB74089C4CF6A28155ED311752B8"><enum>(iii)</enum><text>with respect to particular subscribers referenced in the complaint, that those subscribers reside in communities in which the Commission has determined the station to be significantly viewed;</text></clause> 
<clause id="H090C132286B749C082BCCD16D47B89DE"><enum>(iv)</enum><text>if the complaining station has alleged that the retransmission is unlawful because the subscriber is ineligible for the retransmission because of the limitation in subsection (b) (1) or (2), that such limitation is inapplicable; and</text></clause> 
<clause id="H89391C9AA59D40428191D6C1F23EEA52"><enum>(v)</enum><text>if the complaining station has alleged that the retransmission was unlawful because the satellite carrier had not provided the notification required by subsection (h)(3), that the satellite carrier had in fact provided that notification.</text></clause></subparagraph></paragraph> 
<paragraph id="H65DE697F29AC4ABBBABA35E7AC159C07"><enum>(6)</enum><header>Counting of violations</header><text>The unlawful retransmission of a particular television broadcast station on a particular day subsequent to the notice and opportunity to cure described in paragraphs (1) and (2) of this subsection to a single subscriber pursuant to this section shall be considered a separate violation of this section.</text></paragraph> 
<paragraph id="H0E2DDB0964494D9BB010FBF43CC72900"><enum>(7)</enum><header>Procedures</header> 
<subparagraph id="H9DA697795F1142E988CAB9E098BF507"><enum>(A)</enum><header>Regulations</header><text>Within 60 days after the date of enactment, the Commission shall issue procedural regulations implementing this subsection which shall supersede procedures under section 312.</text></subparagraph> 
<subparagraph id="H7E60825BC87843BB84F953DCEAF400E3"><enum>(B)</enum><header>Determinations</header> 
<clause id="HEE8022E963C7468BBF36F7D3C7AEDB40"><enum>(i)</enum><header>In general</header><text>Within 45 days after the filing of a complaint, the Commission shall issue a final determination in any proceeding brought under this subsection, unless the Commission issues an interim determination in writing that there has been a genuine, reasonable, good faith dispute about the applicability of one of the defenses set forth in paragraph (5), in which case the Commission shall have 135 additional days to issue a final determination. The Commission shall hear witnesses only if it clearly appears, based on written filings by the parties, that there is a genuine dispute about material facts. Except as provided in the preceding sentence, the Commission may issue a final ruling based on written filings by the parties.</text></clause> 
<clause id="H1C48D3DD0D40491EAA7C6086B6BA9985"><enum>(ii)</enum><header>Discovery</header><text>The Commission may direct the parties to exchange pertinent documents, and if necessary to take prehearing depositions, on such schedule as the Commission may approve, but only if the Commission first determines that such discovery is necessary to resolve a genuine dispute about material facts, consistent with the obligation to make a final determination within 45 days (or 180 days, as appropriate).</text></clause></subparagraph></paragraph> 
<paragraph id="H73C72CE78004431600CDB29F74ECFDB4"><enum>(8)</enum><header>Relief</header><text>If the Commission determines that a satellite carrier has retransmitted the imported stations to at least one person in the complaining station’s local market based on this section and has failed to meet its burden of proving one of the defenses under paragraph (5) with respect to such retransmission, the Commission shall be required to—</text> 
<subparagraph id="H2D192D54C7DE472DABD1154172FDD8A7"><enum>(A)</enum><text>make a finding that the satellite carrier violated this section with respect to that station; and</text></subparagraph> 
<subparagraph id="H358F1DBECC6C4318A53351C43937B00"><enum>(B)</enum><text>issue an order containing—</text> 
<clause id="H9C8241A97F4943419FC073C2CC89C3E"><enum>(i)</enum><text>a cease-and-desist order directing the satellite carrier immediately to stop making any further retransmissions in violation of this section;</text></clause> 
<clause id="H541707F3959F4F74B4E01F8F8B96866D"><enum>(ii)</enum><text>a monetary penalty of $50 per violation, which may be waived by the Commission only if the Commission determines that there was a genuine, reasonable, good faith dispute about the applicability of one of the defenses set forth in paragraph (5); and</text></clause></subparagraph> 
<subparagraph id="H0072600A39FB4CF89FD1696F04B2F724"><enum>(C)</enum><text>an award to the complainant of the complainant’s costs and reasonable attorney’s fees.</text></subparagraph></paragraph> 
<paragraph id="HEEDC61AD71A24900ABD2AEE7FF3E33A5"><enum>(9)</enum><header>Court proceedings on enforcement of commission order</header> 
<subparagraph id="H0761B63D9DFC435FA7F3871EE357E595"><enum>(A)</enum><header>In general</header><text>On entry by the Commission of a final order granting relief under this subsection—</text> 
<clause id="H467A2DBD3361485A9DEA8FA7BB71333"><enum>(i)</enum><text>a television broadcast station may apply within 30 days after such entry to the United States District Court for the District of Columbia for a final judgment enforcing all relief granted by the Commission; and</text></clause> 
<clause id="HD0B6814BBC1049DA91BC7B9565D001C"><enum>(ii)</enum><text>the satellite carrier may apply within 30 days after such entry to the United States District Court for the District of Columbia for a judgment reversing the Commission’s order.</text></clause></subparagraph> 
<subparagraph id="H8092790287624E2795DF0540CE087123"><enum>(B)</enum><header>Appeal</header> 
<clause id="H48BD24106AC04D8F9BE2A6CE64FDF050"><enum>(i)</enum><text>For cases in which the Commission has not determined that there has been a genuine, reasonable, good faith dispute about the applicability of one of the defenses set forth in paragraph (5), the procedure for an appeal under this subparagraph by the satellite carrier shall supersede any other appeal rights under Federal or State law. The United States District Court for the District of Columbia may find personal jurisdiction based on the satellite carrier’s ownership of licenses issued by the Commission. An application by a television broadcast station for an order enforcing any cease-and-desist relief granted by the Commission shall be resolved on a highly expedited schedule. No discovery may be conducted by the parties in any such proceeding. The district court shall enforce the Commission order unless the Commission record reflects manifest error and an abuse of discretion by the Commission.</text></clause> 
<clause id="H9CDC590FB9C14F2BB0B6F928C6CB88E"><enum>(ii)</enum><text>For cases in which the Commission has determined that there has been genuine, reasonable, good faith dispute about the applicability of one of the defenses set forth in paragraph (5), the appeals process set forth in section 402 shall apply, with the following caveats:</text> 
<subclause id="H607985EFB19F423B9981330887258FA5"><enum>(I)</enum><text>If the Commission has found the retransmissions in question to be in violation of this section, the satellite carrier must cease such retransmissions during the pendency of any appeal. Any such retransmissions after the date of the Commission’s order but prior to any order overturning the Commission on appeal shall be considered violations under paragraph (6).</text></subclause> 
<subclause id="H0589AB360A9F4A5D9004DAE68DA7B18D"><enum>(II)</enum><text>If the Commission has found the retransmissions in question to be not in violation of this section, the satellite carrier may continue such retransmissions during the pendency of the appeal. Any such retransmissions after the date of the Commission’s order but prior to any order overturning the Commission on appeal shall not be considered violations under paragraph (6).</text></subclause></clause></subparagraph></paragraph></subsection> 
<subsection id="HCF5424E119E449AE95037B3D59AAD8D"><enum>(g)</enum><header>Rulemaking</header> 
<paragraph id="HE02D60A24A7346439D50C0E3EE38FB00"><enum>(1)</enum><header>Requirements</header><text>The Commission shall—</text> 
<subparagraph id="HDEAD9A50BD5548EAA4BC1F5502F03C3"><enum>(A)</enum><text>commence a rulemaking proceeding to implement this section by publication of a notice of proposed rulemaking within 180 days after the date of enactment of the <short-title>Satellite Home Viewer Extension and Reauthorization Act of 2004</short-title>;</text></subparagraph> 
<subparagraph id="HC515060241EF4F98A6F211491F95E8C6"><enum>(B)</enum><text>include in such notice a list of the stations or communities eligible for carriage under subsection (a); and</text></subparagraph> 
<subparagraph id="HD61E2D81CA594821B7DBDBA14CBAA29"><enum>(C)</enum><text>adopt rules pursuant to such rulemaking within one year after such date of enactment.</text></subparagraph></paragraph> 
<paragraph id="H42917C93112B4D7DBD192BE3140081F"><enum>(2)</enum><header>Interim eligibility</header><text>Stations and communities listed as eligible for carriage in the notice of proposed rulemaking issued by the Commission under <internal-xref idref="HE02D60A24A7346439D50C0E3EE38FB00" legis-path="340.(g)(1)">paragraph (1)</internal-xref> may be treated as eligible for carriage under this section on an interim basis pending adoption of such rules and publication of the list of eligible stations and communities under such rules.</text></paragraph></subsection> 
<subsection id="H3CB3EEC6C0BA427882932FDD6B56C72C"><enum>(h)</enum><header>Additional corresponding changes in regulations</header><text/> 
<paragraph id="HFE662DD05A3649C083C504DC836B316F"><enum>(1)</enum><header>Community-by-community elections</header><text>The Commission shall, no later than April 30, 2005, revise section 76.66 of its regulations (47 CFR 76.66), concerning satellite broadcast signal carriage, to permit (at the next cycle of elections under section 325) a television broadcast station that is located in a local market into which a satellite carrier retransmits a television broadcast station on the basis of a statutory license under <external-xref legal-doc="usc" parsable-cite="usc/17/122">section 122</external-xref> of title 17, United States Code, to elect, with respect to such satellite carrier, between retransmission consent pursuant to such section 325 and mandatory carriage pursuant to section 338 separately for each county within such station’s local market, if—</text> 
<subparagraph id="H135210D4E5FA48208171B4DDCC00B71E"><enum>(A)</enum><text>the satellite carrier has notified the station, pursuant to paragraph (3), that it intends to carry another affiliate of the same network pursuant to this section during the relevant election period in the station’s local market; or </text></subparagraph> 
<subparagraph id="HDDFB85CDAC2849CFAF6C0342A0D1AEE5"><enum>(B)</enum><text>on the date notification under paragraph (3) was due, the satellite carrier was retransmitting into the station’s local market pursuant to this section an affiliate of the same television network.</text></subparagraph></paragraph> 
<paragraph id="H69E2B5FFE9F04C5BA2D9D3BD7EB01F10"><enum>(2)</enum><header>Single negotiations</header><text>In revising its regulations as required by <internal-xref idref="HFE662DD05A3649C083C504DC836B316F" legis-path="340.(h)(1)">paragraph (1)</internal-xref>, the Commission shall provide that any such station shall conduct a single negotiation for the entire portion of its local market for which retransmission consent is elected.</text></paragraph> 
<paragraph id="HCAB38CB11DF147CF900062019FFE2C32"><enum>(3)</enum><header>Additional provisions</header><text>The Commission shall, no later than April 30, 2005, revise its regulations to provide the following:</text> 
<subparagraph id="HBC204D49D1CC42BC97417224F551F593"><enum>(A)</enum><header>Notifications by satellite carrier</header><text>A satellite carrier’s retransmission of television broadcast stations pursuant to this section shall be subject to the following limitations:</text> 
<clause id="H415840CC78D24D9598FEAF535B4A623"><enum>(i)</enum><text>In any local market in which the satellite carrier provides service on the basis of a statutory license under <external-xref legal-doc="usc" parsable-cite="usc/17/122">section 122</external-xref> of title 17, United States Code, on the date of enactment of the <short-title>Satellite Home Viewer Extension and Reauthorization Act of 2004</short-title>, the carrier may notify a television broadcast station in that market, at least 60 days prior to any date on which the station must thereafter make an election under section 76.66 of the Commission’s regulations (47 CFR 76.66), of—</text> 
<subclause id="H117B5512B53444D3934FE477EAD4F07C"><enum>(I)</enum><text>each affiliate of the same television network that the carrier reserves the right to retransmit into that station’s local market pursuant to this section during the next election cycle under such section of such regulations; and</text></subclause> 
<subclause id="H3188402696164330B8BE58EA55D7CB83"><enum>(II)</enum><text>for each such affiliate, the communities into which the satellite carrier reserves the right to make such retransmissions. </text></subclause></clause> 
<clause id="H79F73B0A4F924059913CB09E65D78FA1"><enum>(ii)</enum><text>In any local market in which the satellite carrier commences service on the basis of a statutory license under <external-xref legal-doc="usc" parsable-cite="usc/17/122">section 122</external-xref> of title 17, United States Code, after the date of enactment of the <short-title>Satellite Home Viewer Extension and Reauthorization Act of 2004</short-title>, the carrier may notify a station in that market, at least 60 days prior to the introduction of such service in that market, and thereafter at least 60 days prior to any date on which the station must thereafter make an election under section 76.66 of the Commission’s regulations (47 CFR 76.66), of each affiliate of the same television network that the carrier reserves the right to retransmit into that station’s local market during the next election cycle under such section of such regulations.</text></clause> 
<clause id="H5934D219BE114F4DA4D6C4CDA79FE6"><enum>(iii)</enum><text>Beginning with the 2005 election cycle, a satellite carrier may only retransmit pursuant to this section during the pertinent election period a signal—</text> 
<subclause id="HABFA9D440DA0483795EE1F08FA3140BA"><enum>(I)</enum><text>as to which it has provided the notifications set forth in clauses (i) and (ii); or</text></subclause> 
<subclause id="H248ED1178F754DC489D256EDFAFD8C6E"><enum>(II)</enum><text>that it was retransmitting into the local market under this section as of the date such notifications were due. </text></subclause></clause></subparagraph> 
<subparagraph id="H13C3819499904301A08C61C1A5D7DAA1"><enum>(B)</enum><header>Harmonization of elections and retransmission consent agreements</header><text>If a satellite carrier notifies a television broadcast station that it reserves the right to retransmit an affiliate of the same television network during the next election cycle pursuant to this section, the station may choose between retransmission consent and mandatory carriage for any portion of the 3-year election cycle that is not covered by an existing retransmission consent agreement.</text></subparagraph></paragraph></subsection> 
<subsection id="HB11E83FD4D734F88AB2D004FA0BE4BFB"><enum>(i)</enum><header>Definitions</header><text>As used in this section:</text> 
<paragraph id="HD195F1DD16E349BB001BC311FE001843"><enum>(1)</enum><header>Local market; satellite carrier; subscriber; television broadcast station</header><text>The terms <term>local market</term>, <term>satellite carrier</term>, <term>subscriber</term>, and <term>television broadcast station</term> have the meanings given such terms in section 338(k).</text></paragraph> 
<paragraph id="H94A60C09084843559F03C1E514CA99F"><enum>(2)</enum><header>Network station; television network</header><text>The terms <term>network station</term> and <term>television network</term> have the meanings given such terms in section 339(d).</text></paragraph> 
<paragraph id="H0A2CCE80422C4385839B6C9F80299500"><enum>(3)</enum><header>Bandwidth</header><text>The terms <term>equivalent bandwidth</term> and <term>entire bandwidth</term> shall be defined by the Commission by regulation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HF135EDFF655441318D52B88CC75D34BD"><enum>203.</enum><header>Carriage of local stations on a single dish</header><text display-inline="no-display-inline">Section 338 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/338">47 U.S.C. 338(d)</external-xref>) is amended—</text> 
<paragraph id="HFC8430518BFF478CA67B8C3DBD7D556C"><enum>(1)</enum><text>by redesignating subsections (g) and (h) as subsections (j) and (k), respectively;</text></paragraph> 
<paragraph id="HBA52FF8977734470B7CFA4CF3FEBDB55"><enum>(2)</enum><text>by inserting after subsection (f) the following new subsection:</text> 
<quoted-block id="HBB3A016085BF4745008486557874FDAB" style="OLC"> 
<subsection id="H9A50D0BAB13047639016410060598C2B"><enum>(g)</enum><header>Carriage of local stations on a single dish</header> 
<paragraph id="H1B67B67DA7304A3FABDEB59D5FD6C916"><enum>(1)</enum><header>Single dish</header><text>Each satellite carrier that retransmits the signals of local television broadcast stations in a local market shall retransmit the signals of all local television broadcast stations retransmitted by that carrier to subscribers in such market by means of a single reception antenna and associated equipment.</text></paragraph> 
<paragraph id="HA171DBDE970D4EC69645D22C8EEDE3C4"><enum>(2)</enum><header>Exception</header><text>Notwithstanding <internal-xref idref="H1B67B67DA7304A3FABDEB59D5FD6C916" legis-path="q:(g)(1)">paragraph (1)</internal-xref>, if the carrier retransmits signals in the digital television service, the carrier shall retransmit the digital television service signals of all the local television broadcast stations retransmitted by that carrier to subscribers in such market by means of a single reception antenna and associated equipment, but such antenna and associated equipment may be separate from the single reception antenna and associated equipment used for signals that are not in the digital television service.</text></paragraph> 
<paragraph id="H958A598FB8C849DE85671BCF00142198"><enum>(3)</enum><header>Effective date</header><text>The requirements of paragraphs (1) and (2) of this subsection shall apply on and after one year after the date of enactment of the <short-title>Satellite Home Viewer Extension and Reauthorization Act of 2004</short-title>.</text></paragraph> 
<paragraph id="H563D8719F61F4C018C4550B59E583F04"><enum>(4)</enum><header>Notice of disruptions</header><text>A carrier that is providing signals of a local television broadcast station in a local market under this section on the date of enactment of the <short-title>Satellite Home Viewer Extension and Reauthorization Act of 2004</short-title> shall, not later than 270 days after such date of enactment, provide to the licensees for such stations and the carrier’s subscribers in such local market a notice that displays prominently and conspicuously a clear statement of—</text> 
<subparagraph id="H176BD6B723524FBE85001D9DAEEEDD9"><enum>(A)</enum><text>any reallocation of signals between different reception antennas and associated equipment that the carrier intends to make in order to comply with the requirements of this subsection;</text></subparagraph> 
<subparagraph id="H02F47291E9E142D2856EA7FF472FD9E8"><enum>(B)</enum><text>the need, if any, for subscribers to obtain an additional reception antenna and associated equipment to receive such signals; and</text></subparagraph> 
<subparagraph id="HB20445C40DA747729F9705D74202CBFB"><enum>(C)</enum><text>any cessation of carriage or other material change in the carriage of signals as a consequence of the requirements of this paragraph.</text></subparagraph></paragraph> 
<paragraph id="H09CB7CB562DC44DBBDB62C3B4F475BB5"><enum>(5)</enum><header>Enforcement</header><text>Notwithstanding any other provision of this section, the Commission may enforce this section and any regulation thereunder in accordance with titles IV and V of this Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H1E16888E84674A918D945119D9B98F30" section-type="subsequent-section"><enum>204.</enum><header>Replacement of distant signals with local signals</header><text display-inline="no-display-inline">Section 339(a) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/339">47 U.S.C. 339(a)</external-xref>) is amended—</text> 
<paragraph id="H6FE2789EF4E646049C9900FB02B7E841"><enum>(1)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></paragraph> 
<paragraph id="HCE9516FEBD644A7CBDC19E243D59D200"><enum>(2)</enum><text>by inserting after paragraph (1) the following new paragraph:</text> 
<quoted-block style="OLC" id="HD0602F16C7864A9B98BF661674D6ACD7" display-inline="no-display-inline"> 
<paragraph id="H58C54A96DD444FF0ACD5EA887700F700"><enum>(2)</enum><header>Replacement of distant signals with local signals</header><text>Notwithstanding any other provision of paragraph (1), the following rules shall apply after the date of enactment of the <short-title>Satellite Home Viewer Extension and Reauthorization Act of 2004</short-title>:</text> 
<subparagraph id="H2555B497428F41649508692E4C85B5B2"><enum>(A)</enum><header>Rules for grandfathered subscribers</header><text>In the case of a subscriber of a satellite carrier who is eligible to receive the signal of a network station solely by reason of <external-xref legal-doc="usc" parsable-cite="usc/17/119">section 119(e)</external-xref> of title 17, United States Code (in this subparagraph referred to as a `distant signal'), the following shall apply:</text> 
<clause id="H175AB7BAE948414FACFAE33D07450F2"><enum>(i)</enum><text>In a case in which the signal of a local network station affiliated with the same television network is made available pursuant to the statutory license under section 122 by that satellite carrier to the subscriber, the carrier may only provide the secondary transmissions of the distant signal of such network station to that subscriber—</text> 
<subclause id="HCDC5D091979F4236A6DC78AC6B43058"><enum>(I)</enum><text>if, within 60 days after receiving the notice of the satellite carrier under section 338(h)(1) of the Communications Act of 1934, the subscriber elects to retain the distant signal; but</text></subclause> 
<subclause id="H698E39E5B597463DB477CDDDCE452706"><enum>(II)</enum><text>only until such time as the subscriber elects to receive such local signal.</text></subclause></clause> 
<clause id="H7CC6574A809F4DE4808CF53D53BAAF87"><enum>(ii)</enum><text>Notwithstanding <internal-xref idref="H175AB7BAE948414FACFAE33D07450F2" legis-path="q:(2)(A)(i)">clause (i)</internal-xref>, the carrier may not retransmit the distant signal to any subscriber who is eligible to receive the signal of a network station solely by reason of <external-xref legal-doc="usc" parsable-cite="usc/17/119">section 119(e)</external-xref> of title 17, United States Code, unless such carrier, within 60 days after the date of the enactment of the <short-title>Satellite Home Viewer Extension and Reauthorization Act of 2004</short-title>, submits to that television network the list and statement required by section 338(h)(2).</text></clause></subparagraph> 
<subparagraph id="HEE87EEA634CF4AA195444FC7CD5677C6"><enum>(B)</enum><header>Rules for other subscribers</header><text>In the case of a subscriber of a satellite carrier who is eligible to receive the signal of a network station under the statutory license under <external-xref legal-doc="usc" parsable-cite="usc/17/119">section 119(a)(2)</external-xref> of title 17, United States Code (in this subparagraph referred to as a <quote>distant signal</quote>), other than subscribers to whom <internal-xref idref="H2555B497428F41649508692E4C85B5B2" legis-path="q:(2)(A)">subparagraph (A)</internal-xref> applies, the following shall apply:</text> 
<clause id="H8717B4563FFD4864926EF895591366B"><enum>(i)</enum><text>In a case in which the signal of a local network station affiliated with the same television network is made available pursuant to the statutory license under section 122 by that satellite carrier to the subscriber on the date of the enactment of the <short-title>Satellite Home Viewer Extension and Reauthorization Act of 2004</short-title>, the carrier may only provide the secondary transmissions of the distant signal of such network station to that subscriber—</text> 
<subclause id="H64A59D21D3C34748ABE122A04FD43C01"><enum>(I)</enum><text/> 
<item id="HF4305FB170BB46D99D26055945D2B005" display-inline="yes-display-inline"><enum>(aa)</enum><text>if, on such date of enactment, the subscriber is receiving such distant signal and is also receiving such local signal, and </text></item> 
<item id="H87CB3954F73A4000A9763D7F4ED81DBF" indent="up1"><enum>(bb)</enum><text>the subscriber's satellite carrier, within 60 days after the date of the enactment of the <short-title>Satellite Home Viewer Extension and Reauthorization Act of 2004</short-title>, submits to that television network the list and statement required by section 338(h)(2); or</text></item></subclause> 
<subclause id="HC6C1826245E84C0FAD6EABD629C6A6EA"><enum>(II)</enum><text/> 
<item id="H57A6C21A8CB0473D8F7E265EDB529F6E" display-inline="yes-display-inline"><enum>(aa)</enum><text>if, on such date of enactment, the subscriber is receiving such distant signal and is not receiving such local signal; but </text></item> 
<item id="HED97FC7C80D548EF9728478B21C623B2" indent="up1"><enum>(bb)</enum><text>only until such time as the subscriber elects to receive such local signal. </text></item></subclause></clause> 
<clause id="HF5E7DA7EF27F4AD995D1BC9805EC3C4"><enum>(ii)</enum><text>In a case in which the signal of a local network station affiliated with the same television network is not made available pursuant to the statutory license under section 122 by that satellite carrier to a subscriber on the date of the enactment of the <short-title>Satellite Home Viewer Extension and Reauthorization Act of 2004</short-title>, the carrier may only provide the secondary transmissions of the distant signal of such network station to that subscriber—</text> 
<subclause id="H2B2F6EFF9252401FAF50A0A73540006C"><enum>(I)</enum><text>who is a subscriber of that satellite carrier on such date of enactment, or </text></subclause> 
<subclause id="H1A64152DE70A44108381F770992599B7"><enum>(II)</enum><text>who becomes a subscriber of that satellite carrier after such date but before the local signal is made available by the carrier, </text></subclause><continuation-text continuation-text-level="clause">but only until such time as the subscriber elects to receive the local signal from that satellite carrier.</continuation-text></clause></subparagraph> 
<subparagraph id="HF59002F8CC874BCD903544DE7F4B9732"><enum>(C)</enum><header>Future applicability</header><text>A satellite carrier may not provide a distant signal (within the meaning of subparagraph (A) or (B)) to any person in a location to which the signal of a local network station affiliated with the same television network was made available by that carrier pursuant to the statutory license under <external-xref legal-doc="usc" parsable-cite="usc/17/122">section 122</external-xref> of title 17, United States Code, before the person becomes a subscriber to that carrier. </text></subparagraph> 
<subparagraph id="HCDB6DD823368451F9710AD588493ACCA"><enum>(D)</enum><header>Authority to grant station-specific waivers</header><text>Notwithstanding the provisions of this paragraph, a satellite carrier may provide the distant signal (within the meaning of subparagraph (A) or (B)) of any distant network station to any person to whom the signal of a local network station is available pursuant to the statutory license under <external-xref legal-doc="usc" parsable-cite="usc/17/122">section 122</external-xref> of title 17, United States Code, if and to the extent that such local network station has granted a waiver from the requirements of this paragraph to such satellite carrier with respect to such distant network station.</text></subparagraph> 
<subparagraph id="H2D385A8386714CF58100E332A88EDB91"><enum>(E)</enum><header>Other provisions not affected</header><text>This paragraph shall not affect the eligibility of a subscriber to receive secondary transmissions under <external-xref legal-doc="usc" parsable-cite="usc/17/119">section 119(a)(3)</external-xref> of title 17, United States Code, or as an unserved household included under section 119(a)(12) of such title.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H289E457F19194718BD12AEF247B1A600"><enum>205.</enum><header>Additional notices to subscribers, networks, and stations concerning signal carriage</header><text display-inline="no-display-inline">Section 338 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/338">47 U.S.C. 338</external-xref>) is further amended by inserting after subsection (g) (as added by <internal-xref idref="HF135EDFF655441318D52B88CC75D34BD" legis-path="203.">section 203</internal-xref>) the following new subsection:</text> 
<quoted-block style="OLC" id="H2B41576943524959898CB9B7DC63402" display-inline="no-display-inline"> 
<subsection id="HF76CBD65E384432BB4D4BEDD8300B13C"><enum>(h)</enum><header>Additional notices to subscribers, networks, and stations concerning signal carriage</header> 
<paragraph id="H81154EE071044998BF0096740866F8E8"><enum>(1)</enum><header>Notices to and elections by subscribers concerning grandfathered signals</header><text>Any carrier that provides a distant signal of a network station to a subscriber pursuant to a statutory license under <external-xref legal-doc="usc" parsable-cite="usc/17/119">section 119(a)(4)(A)</external-xref> of title 17, United States Code, shall—</text> 
<subparagraph id="HDC75D32993894F7C9E977550DFAE2E74"><enum>(A)</enum><text> within 60 days after the local signal of a network station of the same television network is available pursuant to a statutory license under section 122, or within 60 days after the date of enactment of the Satellite Home Viewer Extension and Reauthorization Act of 2004, whichever is later, send a notice to the subscriber—</text> 
<clause id="H5E4628FC2EF34EF1BF1DB97CD5A68B95"><enum>(i)</enum><text>offering to substitute the local network signal for the duplicating distant network signal; and</text></clause> 
<clause id="H36198A811927480A800735EA975C67BC"><enum>(ii)</enum><text>informing the subscriber that, if the subscriber fails to respond in 60 days, the subscriber will lose the distant network signal but will be permitted to subscribe to the local network signal; and</text></clause></subparagraph> 
<subparagraph id="H6EF28AEE8AFF408BB400CEF3E5A3A6D9"><enum>(B)</enum><text>if the subscriber—</text> 
<clause id="H7C427D8019204EB6AB44B2F6EA91BFFB"><enum>(i)</enum><text>elects to substitute such local network signal within such 60 days, switch such subscriber to such local network signal within 10 days after the end of such 60-day period; or</text></clause> 
<clause id="HDA809BA7D75B4A6EBA44CFC3E6BE7D81"><enum>(ii)</enum><text>fails to respond within such 60 days, terminate the distant network signal within 10 days after the end of such 60-day period.</text></clause></subparagraph></paragraph> 
<paragraph id="HCD94A58EB92546ADAAB2F97F3C025C22"><enum>(2)</enum><header>Notices to networks of distant signal subscribers</header><text>Within 60 days after the date of enactment of the <short-title>Satellite Home Viewer Extension and Reauthorization Act of 2004</short-title>, each satellite carrier that provides a distant signal of a network station to a subscriber pursuant to a statutory license under section <external-xref legal-doc="usc" parsable-cite="usc/17/119">119(a)(4)(A)</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/17/119">119(a)(4)(B)(i)</external-xref> of title 17, United States Code, shall submit to each network—</text> 
<subparagraph id="HA7A534ADD05C4D06B685D3AB009EE1E4"><enum>(A)</enum><text>a list, aggregated by designated market area, identifying each subscriber provided such a signal by—</text> 
<clause id="H5E3CE20B14AE4743BD228D28D30027A5"><enum>(i)</enum><text>name;</text></clause> 
<clause id="H8BE3EDA9A81649F28E9E56BFC1BC00E2"><enum>(ii)</enum><text>address (street or RFD number, city, state, and zip code); and</text></clause> 
<clause id="H591DA2E071324C0F006DA46508D00229"><enum>(iii)</enum><text>the distant network signal or signals received; and</text></clause></subparagraph> 
<subparagraph id="HD13EF86E25D84BC7A2E840A83734D6AE"><enum>(B)</enum><text>a statement that, to the best of the carrier’s knowledge and belief after having made diligent and good faith inquiries, the subscriber is qualified under the existing law to receive the distant network signal or signals pursuant to a statutory license under section <external-xref legal-doc="usc" parsable-cite="usc/17/119">119(a)(4)(A)</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/17/119">119(a)(4)(B)(i)</external-xref> of title 17, United States Code.</text></subparagraph></paragraph> 
<paragraph id="H55F7DF7D649B4127A4F976C3DEB1369"><enum>(3)</enum><header>Notice to station licensees of commencement of local-into-local service</header> 
<subparagraph id="HC2797220AD5B4BB5AEB4B200FEA79B62"><enum>(A)</enum><header>Notice required</header><text>Within 180 days after the date of enactment of the <short-title>Satellite Home Viewer Extension and Reauthorization Act of 2004</short-title>, the Commission shall revise the regulations under this section relating to notice to broadcast station licensees to comply with the requirements of this paragraph.</text></subparagraph> 
<subparagraph id="H7FA5611392D34B899DF280C534CB5FC6"><enum>(B)</enum><header>Contents of commencement notice</header><text>The notice required by such regulations shall inform each television broadcast station licensee within any local market in which a satellite carrier proposes to commence carriage of signals of stations from that market, not later than 60 days prior to the commencement of such carriage—</text> 
<clause id="HD0BC12E6E2AA4BF7BE20AB07ED181EB4"><enum>(i)</enum><text>of the carrier’s intention to launch local-into-local service under this section in a local market, the identity of that local market, and the location of the carrier’s proposed local receive facility for that local market;</text></clause> 
<clause id="H2866E0F38CB240BCAFC021C8ACBE0002"><enum>(ii)</enum><text>of the right of such licensee to elect carriage under this section or grant retransmission consent under section 325(b);</text></clause> 
<clause id="H8791EC1D29604323A251D915E3A7B8FF"><enum>(iii)</enum><text>that such licensee has 30 days from the date of the receipt of such notice to make such election; and</text></clause> 
<clause id="HCBC7FDDD2BB64E43BC733C61B2AA61E9"><enum>(iv)</enum><text>that failure to make such election will result in the loss of the right to demand carriage under this section for the remainder of the 3-year cycle of carriage under section 325.</text></clause></subparagraph> 
<subparagraph id="HDA759939C3474064A6F26D21001C7DA9"><enum>(C)</enum><header>Transmission of notices</header><text>Such regulations shall require that each satellite carrier shall transmit the notices required by such regulation via certified mail to the address for such television station licensee listed in the consolidated database system maintained by the Commission.</text></subparagraph></paragraph> 
<paragraph id="HF36990518DB14CAC923068BBA11A1EC"><enum>(4)</enum><header>Notices concerning significantly viewed stations</header><text>Each satellite carrier that proposes to commence the retransmission of a station pursuant to section 340 in any local market shall—</text> 
<subparagraph id="HBA75284E201D45E4A9C8E1FFFD2660C1"><enum>(A)</enum><text>not less than 60 days before commencing such retransmission, provide a written notice to any television broadcast station in such local market of a such proposal; and</text></subparagraph> 
<subparagraph id="H50D1D573B36043D8AD33BACABFC16DE3"><enum>(B)</enum><text>designate on such carrier’s website all significantly viewed signals carried pursuant to section 340 and the communities in which the signals are carried.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HB98E6EFE9EA748DCA2808400F234752B"><enum>206.</enum><header>Privacy rights of satellite subscribers</header> 
<subsection id="H1D62384B48E2433A8175E5522BE254F"><enum>(a)</enum><header>Amendment</header><text>Section 338 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/338">47 U.S.C. 338</external-xref>) is further amended by inserting after subsection (h) (as added by <internal-xref idref="H289E457F19194718BD12AEF247B1A600" legis-path="205.">section 205</internal-xref>) the following new subsection:</text> 
<quoted-block style="OLC" id="HB4D9377076934BFB955577C876E7401C" display-inline="no-display-inline"> 
<subsection id="HBFC7E3528E01421CB6C47554FD2BDC19"><enum>(i)</enum><header>Privacy rights of satellite subscribers</header> 
<paragraph id="H722117709221476BA3BC53C073BF42D3"><enum>(1)</enum><header>Notice</header><text display-inline="yes-display-inline">At the time of entering into an agreement to provide any satellite service or other service to a subscriber and at least once a year thereafter, a satellite carrier shall provide notice in the form of a separate, written statement to such subscriber which clearly and conspicuously informs the subscriber of—</text> 
<subparagraph id="HF573BC0E3D9A4DD4BEE0E93515450C"><enum>(A)</enum><text>the nature of personally identifiable information collected or to be collected with respect to the subscriber and the nature of the use of such information; </text></subparagraph> 
<subparagraph id="HDE9D09F1C05D42E88900F77E259DA1BE"><enum>(B)</enum><text>the nature, frequency, and purpose of any disclosure which may be made of such information, including an identification of the types of persons to whom the disclosure may be made; </text></subparagraph> 
<subparagraph id="H9B0283750CE140E7B6AF75C4E4815D75"><enum>(C)</enum><text>the period during which such information will be maintained by the satellite carrier; </text></subparagraph> 
<subparagraph id="HB117C8DA20AB4F23004F93361215597E"><enum>(D)</enum><text>the times and place at which the subscriber may have access to such information in accordance with paragraph (5); and </text></subparagraph> 
<subparagraph id="HFC6CDDCC23F14610A2BC9F0010F0C4B4"><enum>(E)</enum><text>the limitations provided by this section with respect to the collection and disclosure of information by a satellite carrier and the right of the subscriber under paragraphs (7) and (9) to enforce such limitations.</text></subparagraph><continuation-text continuation-text-level="paragraph">In the case of subscribers who have entered into such an agreement before the effective date of this subsection, such notice shall be provided within 180 days of such date and at least once a year thereafter.</continuation-text></paragraph> 
<paragraph id="H57DD6BA243D44F0584F6198B868DC93F"><enum>(2)</enum><header>Definitions</header><text>For purposes of this subsection, other than paragraph (9)—</text> 
<subparagraph id="H4D858982C8C049E68D658567D97923B4"><enum>(A)</enum><text>the term <term>personally identifiable information</term> does not include any record of aggregate data which does not identify particular persons; </text></subparagraph> 
<subparagraph id="HBB818FB65C3E4043A4C1795351A3B9D"><enum>(B)</enum><text>the term <term>other service</term> includes any wire or radio communications service provided using any of the facilities of a satellite carrier that are used in the provision of satellite service; and </text></subparagraph> 
<subparagraph id="H98676ACAB0EA43FD960656C6A67B2D89"><enum>(C)</enum><text>the term <term>satellite carrier</term> includes, in addition to persons within the definition of satellite carrier, any person who—</text> 
<clause id="HCD09846D43954D95B419218ED63C46C3"><enum>(i)</enum><text>is owned or controlled by, or under common ownership or control with, a satellite carrier; and</text></clause> 
<clause id="H34ADCDAA40404B2286318700002C17F3"><enum>(ii)</enum><text>provides any wire or radio communications service. </text></clause></subparagraph></paragraph> 
<paragraph id="HFD5270A4BE8345C48EB47DED251C710"><enum>(3)</enum><header>Prohibitions</header> 
<subparagraph id="H0E99C2FE72EA47269BC2AE6809ECD203"><enum>(A)</enum><header>Consent to collection</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), a satellite carrier shall not use any facilities used by the satellite carrier to collect programming selection or subscription information from such a subscriber to collect personally identifiable information concerning any subscriber without the prior written or electronic consent of the subscriber concerned. </text></subparagraph> 
<subparagraph id="H94A2F0FAB2124D8980F75F99C31FED12"><enum>(B)</enum><header>Exceptions</header><text>A satellite carrier may use such facilities to collect such information in order to—</text> 
<clause id="H3017898C9E0349F79995CDFFEB0030E"><enum>(i)</enum><text>obtain information necessary to render a satellite service or other service provided by the satellite carrier to the subscriber; or </text></clause> 
<clause id="HAB8D017A0EC14D5B007458EEE95FCCE8"><enum>(ii)</enum><text>detect unauthorized reception of satellite communications. </text></clause></subparagraph></paragraph> 
<paragraph id="H7C5E72785B9D4715B81111F6BBFC6121"><enum>(4)</enum><header>Disclosure</header><text/> 
<subparagraph id="HBA276C048FAB402B963BD68C6CBEA5F3"><enum>(A)</enum><header>Consent to disclosure</header><text>Except as provided in subparagraph (B), a satellite carrier shall not disclose personally identifiable information concerning any subscriber without the prior written or electronic consent of the subscriber concerned and shall take such actions as are necessary to prevent unauthorized access to such information by a person other than the subscriber or satellite carrier. </text></subparagraph> 
<subparagraph id="H70259DAB11344E8CA003002F08FD0084"><enum>(B)</enum><header>Exceptions</header><text>A satellite carrier may disclose such information if the disclosure is—</text> 
<clause id="H70351411989A4E6D9FF1A813DA726D94"><enum>(i)</enum><text>necessary to render, or conduct a legitimate business activity related to, a satellite service or other service provided by the satellite carrier to the subscriber; </text></clause> 
<clause id="H30895D8A37F7484EA9632D94DC7D8125"><enum>(ii)</enum><text>subject to paragraph (9), made pursuant to a court order authorizing such disclosure, if the subscriber is notified of such order by the person to whom the order is directed; </text></clause> 
<clause id="H65631BF98D894CAFB1733304D32846AA"><enum>(iii)</enum><text>a disclosure of the names and addresses of subscribers to any satellite service or other service, if—</text> 
<subclause id="H81F0760228984D299B14F9008E94751F"><enum>(I)</enum><text>the satellite carrier has provided the subscriber the opportunity to prohibit or limit such disclosure; and </text></subclause> 
<subclause id="H0AB0E32AC0414E6D8EE6019010D06D82"><enum>(II)</enum><text>the disclosure does not reveal, directly or indirectly, the—</text> 
<item id="H4427BF152ACF47CCBB3E45431E90C63D"><enum>(aa)</enum><text>extent of any viewing or other use by the subscriber of a satellite service or other service provided by the satellite carrier; or </text></item> 
<item id="HAE2BDAE251024147964D75B4E124469"><enum>(bb)</enum><text display-inline="yes-display-inline">the nature of any transaction made by the subscriber over any facilities used by the satellite carrier to collect programming selection or subscription information from such a subscriber; or</text></item></subclause></clause> 
<clause id="H024866FD9E764E0AA7646DFDF483AE67"><enum>(iv)</enum><text>to a government entity as authorized under chapters 119, 121, or 206 of title 18, United States Code, except that such disclosure shall not include records revealing satellite subscriber selection of video programming from a satellite carrier. </text></clause></subparagraph></paragraph> 
<paragraph id="HD50513A11EFF48E793A100F9A1DBEC00"><enum>(5)</enum><header>Access by subscriber</header><text>A satellite subscriber shall be provided access to all personally identifiable information regarding that subscriber which is collected and maintained by a satellite carrier. Such information shall be made available to the subscriber at reasonable times and at a convenient place designated by such satellite carrier. A satellite subscriber shall be provided reasonable opportunity to correct any error in such information. </text></paragraph> 
<paragraph id="H0C27115BF87145668FE19472E7FCA13E"><enum>(6)</enum><header>Destruction of information</header><text>A satellite carrier shall destroy personally identifiable information if the information is no longer necessary for the purpose for which it was collected and there are no pending requests or orders for access to such information under paragraph (5) or pursuant to a court order. </text></paragraph> 
<paragraph id="H57E03140F584405FBE8D4EAF83C2A039"><enum>(7)</enum><header>Penalties</header><text>Any person aggrieved by any act of a satellite carrier in violation of this section may bring a civil action in a United States district court. The court may award—</text> 
<subparagraph id="H6D9EE2F6598F4DD1A66B641C0017ED68"><enum>(A)</enum><text>actual damages but not less than liquidated damages computed at the rate of $100 a day for each day of violation or $1,000, whichever is higher; </text></subparagraph> 
<subparagraph id="H694BABE232C44980A4E4EF52E361B747"><enum>(B)</enum><text>punitive damages; and </text></subparagraph> 
<subparagraph id="HB6B6BD8064184071B56C32DA208760AB"><enum>(C)</enum><text>reasonable attorneys' fees and other litigation costs reasonably incurred.</text></subparagraph><continuation-text continuation-text-level="paragraph">The remedy provided by this subsection shall be in addition to any other lawful remedy available to a satellite subscriber.</continuation-text></paragraph> 
<paragraph id="HC08E2687993E427593DE375C4300A365"><enum>(8)</enum><header>Rule of construction</header><text>Nothing in this title shall be construed to prohibit any State from enacting or enforcing laws consistent with this section for the protection of subscriber privacy. </text></paragraph> 
<paragraph id="H1682B12A2166443B8165597460203277"><enum>(9)</enum><header>Court orders</header><text>Except as provided in <internal-xref idref="H024866FD9E764E0AA7646DFDF483AE67" legis-path="q:(i)(4)(B)(iv)">paragraph (4)(B)(iv)</internal-xref>, a governmental entity may obtain personally identifiable information concerning a satellite subscriber pursuant to a court order only if, in the court proceeding relevant to such court order—</text> 
<subparagraph id="H7206CB279E814054B62636DCD4FA56F5"><enum>(A)</enum><text>such entity offers clear and convincing evidence that the subject of the information is reasonably suspected of engaging in criminal activity and that the information sought would be material evidence in the case; and </text></subparagraph> 
<subparagraph id="HE9BC6EB86B17404C9969CB47F2D5F2C"><enum>(B)</enum><text>the subject of the information is afforded the opportunity to appear and contest such entity's claim.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H199E71C9ADA24456ACCEEB9E010AE5E"><enum>(b)</enum><header>Effective date</header><text>Section 338(i) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/338">47 U.S.C. 338(i)</external-xref>) as amended by subsection (a) of this section shall be effective 60 days after the date of enactment of this Act.</text></subsection></section> 
<section id="HEF253997687748E6B10678104839D413"><enum>207.</enum><header>Reciprocal bargaining obligations</header> 
<subsection id="HB9F428B040184A5B99A3B2E665BB1538"><enum>(a)</enum><header>Amendments</header><text>Section 325(b)(3)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/325">47 U.S.C. 325(b)(3)(C)</external-xref>) is amended—</text> 
<paragraph id="HBBF5DB04C13544519BEDD3D95C1CC5A"><enum>(1)</enum><text>by striking <quote>Within 45 days</quote> and all that follows through <quote>1999, the</quote> and inserting <quote>The</quote>;</text></paragraph> 
<paragraph id="H25939C85CDF64109BB30FB5ECE11EFDC"><enum>(2)</enum><text>by striking the second sentence;</text></paragraph> 
<paragraph id="HA0EB662E6FED48DAB25F9E5EF104789B"><enum>(3)</enum><text>by striking <quote>and</quote> at the end of clause (i);</text></paragraph> 
<paragraph id="H4401DE0CE2204C508839D730C5C97BC9"><enum>(4)</enum><text>in clause (ii)—</text> 
<subparagraph id="H6B5A8E22AED94CFEB2B01DA27E6AF9F"><enum>(A)</enum><text>by striking <quote>January 1, 2006</quote> and inserting <quote>January 1, 2010</quote>; and</text></subparagraph> 
<subparagraph id="H6834D566FFC745EB978976F580F00968"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HFE84643F561E498B88E613B120EFC483"><enum>(5)</enum><text>by adding at the end the following new clauses:</text> 
<quoted-block style="OLC" id="HE655C964C0654F588BDFAD4E003B6D32" display-inline="no-display-inline"> 
<clause id="H6C97A4DB51804A558C10243077B60594"><enum>(iii) </enum><text>until January 1, 2010, prohibit a multichannel video programming distributor from failing to negotiate in good faith for retransmission consent under this section, and it shall not be a failure to negotiate in good faith if the distributor enters into retransmission consent agreements containing different terms and conditions, including price terms, with different broadcast stations if such different terms and conditions are based on competitive marketplace considerations.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H19F301DF626A439687500768943566B2"><enum>(b)</enum><header>Deadline</header><text>The Federal Communications Commission shall prescribe regulations to implement the amendments made by <internal-xref idref="HFE84643F561E498B88E613B120EFC483" legis-path="207.(a)(5)">subsection (a)(5)</internal-xref> within 180 days after the date of enactment of this Act.</text></subsection></section> 
<section id="H0684F09C944A4108B3BA88791DA19F5" section-type="subsequent-section"><enum>208.</enum><header>Unserved digital customers</header> 
<subsection id="H97CFEFBF27A54520A1E427AA7F1BD9CE"><enum>(a)</enum><header>Inquiry required</header><text>Consistent with the digital television service rules of Federal Communications Commission in effect on the date of enactment of this Act, and the propagation prediction models derived from Bulletin No. 69 of the Commission’s Office of Engineering and Technology, the Commission shall initiate an inquiry to recommend the appropriate methodologies for determining which consumers are in locations where the consumer will be unable, on and after the date on which analog television services are discontinued pursuant to the provisions of section 309(j)(14) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)(14)</external-xref>), to receive broadcast digital television service signals that are transmitted from a station’s permanent digital television channel that are of sufficient intensity to be able to receive and display digital television service using receiving terrestrial outdoor antennas of reasonable cost and ease of installation. Such methodologies shall be based on the current field strength requirements for digital television stations in section 73.622(e)(1) of the Commission’s regulations (47 CFR 622(e)(1)).</text></subsection> 
<subsection id="H71C5DD91D57D4BD69EB45D9AC226D6B"><enum>(b)</enum><header>Report required</header><text>The Federal Communications Commission shall submit a report on the results of the inquiry required by subsection (a) to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate not later than December 31, 2005. Such report shall include—</text> 
<paragraph id="HDA1E23CE660E4454B54B02502EC669A2"><enum>(1)</enum><text>a proposal, using the best engineering practices for the broadcast television industry, for a predictive methodology for determining both which consumers—</text> 
<subparagraph id="HA2A90B63E4334CFEA5FE4CEBD6037C00"><enum>(A)</enum><text display-inline="yes-display-inline">receive a digital signal of sufficient intensity to be able to receive and display digital television service using receiving terrestrial outdoor antennas of reasonable cost and ease of installation; or</text></subparagraph> 
<subparagraph id="H9D1EAC29D85B43D2BA8D829269BE82AC"><enum>(B)</enum><text>will receive such a signal after a local station begins transmitting on its permanent digital television channel;</text></subparagraph></paragraph> 
<paragraph id="H68E41FD38AC8483AB353007DEC03C062"><enum>(2)</enum><text display-inline="yes-display-inline">an analysis of whether it is possible to identify the areas of the country within which consumers will not, on and after the date on which analog television services are discontinued pursuant to the provisions of section 309(j)(14) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)(14)</external-xref>), be able to receive a digital television signal of sufficient intensity to be able to receive and display digital television service using receiving terrestrial outdoor antennas of reasonable cost and ease of installation; and</text></paragraph> 
<paragraph id="HC9140BF946E140FEA9BC67ADEB4DBAA2"><enum>(3)</enum><text>if possible, an identification, on a county-by-county or more localized basis, of such areas for each television network.</text></paragraph></subsection></section> 
<section id="H6691B8369516467183DFCF06EE51383E"><enum>209.</enum><header>Reduction of required tests</header><text display-inline="no-display-inline">Section 339(c)(4) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/339">47 U.S.C. 339(c)(4)</external-xref>) is amended by inserting after subparagraph (C) the following new subparagraphs:</text> 
<quoted-block style="OLC" id="H57FE52A030EC4275861E04D516BBA1C8" display-inline="no-display-inline"> 
<subparagraph id="HE7111AECB1A4440BB9E5C1DAF6CD45DE"><enum>(D)</enum><header>Reduction of verification burdens</header><text>Within one year after the date of enactment of the <short-title>Satellite Home Viewer Extension and Reauthorization Act of 2004</short-title>, the Commission shall by rule exempt from the verification requirements of subparagraph (A) any request for a test made by a subscriber to a satellite carrier—</text> 
<clause id="H4D0FBAB15FF9452A9FF8AE7C03BC7E80"><enum>(i)</enum><text>to whom the retransmission of the signals of local broadcast stations is available under <external-xref legal-doc="usc" parsable-cite="usc/17/122">section 122</external-xref> of title 17, United States Code, from such carrier; or</text></clause> 
<clause id="HE5B0C27C269C4EA694940045A0C2BFA6"><enum>(ii)</enum><text>for whom the predictive model required by paragraph (3) predicts a signal intensity that exceeds the signal intensity standard in effect under section 119(d)(11)(A) of such title by such number of decibels as the Commission specifies in such rule.</text></clause></subparagraph> 
<subparagraph id="H3640A017FFE74E8E80A37B4561DEA80" display-inline="no-display-inline"><enum>(E)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding any provision of this Act, this section does not prohibit a subscriber who is predicted to receive a signal that meets or exceeds such signal intensity standard from conducting a signal strength test at the subscriber’s own expense for the purpose of determining their eligibility for distant signals under this section.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H467B2F7CCCCB46FDA6411F61C7FA3D1"><enum>210.</enum><header>Carriage of certain additional stations</header><text display-inline="no-display-inline">Section 340 of the Communications Act of 1934, as added by section 202(a) of this Act, is amended by inserting at the end of subsection (c) the following new paragraph:</text> 
<quoted-block style="OLC" id="H3ED3C345E6B5404E879EBDD52E4C00F2" display-inline="no-display-inline"> 
<paragraph id="H5A2768D32C0F4891AF8B4F03D700A9B9"><enum>(3)</enum><header>Carriage of certain additional stations</header><text display-inline="yes-display-inline"/> 
<subparagraph id="H92C4E0A300104E7FAB60D9395C28E1D6"><enum>(A)</enum><header>Additional stations authorized</header><text>In addition to the signals that are eligible to be carried under subsection (a) and paragraph (2) of this subsection, a satellite carrier is also authorized to retransmit to subscribers in no more than two counties in a State that are in a local market principally comprised of counties in another State, the signals of any television station located in the capital city of the State in which such counties are located, if the total number of television households in the two counties combined did not exceed 10,000 for the year 2003 according to Nielson Media Research.</text></subparagraph> 
<subparagraph id="H27BE050C4342494CB9B4FDEDD3ABFD01"><enum>(B)</enum><header>Treatment as significantly viewed; limitations</header><text>Such signals shall be deemed, solely for purposes of this section, to be significantly viewed in such two counties. In total, a satellite carrier that carries one or more additional signals under this paragraph may retransmit no more than four television broadcast stations in such counties pursuant to this paragraph. All rules applicable to carriage of stations pursuant to subsection (a) or paragraph (2) of this subsection shall apply to carriage of stations pursuant to this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></title>
