<section id="H33AE0E99500C4C28ACBD00CB333C014F" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vocational and Technical Education for the Future Act</short-title></quote>.</text></section> 
<section id="H7463C408E1A04853969D04D24E978D98"><enum>2.</enum><header>References</header><text display-inline="no-display-inline">Wherever in this Act an amendment is expressed in terms of an amendment to or repeal of a section or other provision, the amendment or repeal shall be considered to be made to a section or other provision of the Carl D. Perkins Vocational and Technical Education Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301 et seq.</external-xref>)</text></section> 
<section id="H17837C0D9F374272A972D8229927BA94"><enum>3.</enum><header>Purposes and Definitions</header> 
<subsection id="H6CD23F3D88F2434486D85814EE49004D"><enum>(a)</enum><header>Purposes</header><text>Section 2(2) (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301(2)</external-xref>) is amended by inserting <quote>rigorous and challenging</quote> after <quote>integrate</quote>.</text></subsection> 
<subsection id="H96D6D8A07493436C00C1FAAF347B1F40"><enum>(b)</enum><header>Definitions</header><text>Section 3 of the Carl D. Perkins Vocational and Technical Education Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>) is amended—</text> 
<paragraph id="HD09D5C606A7E4BED9B178433CCD42BFF"><enum>(1)</enum><text>by redesignating paragraphs (4) through (20) as paragraphs (5) through (21) and paragraphs (21) through (30) as paragraphs (23) through (31), respectively;</text></paragraph> 
<paragraph id="H7B4DBA61F9054B9BB9E30014A2D1E51"><enum>(2)</enum><text>by inserting after paragraph (3) the following:</text>

<paragraph id="HBC63A7FA6B8F405CA0B927FFA002E7A"><enum>(4)</enum><header>Articulation agreement</header><text display-inline="yes-display-inline">The term <term>articulation agreement</term> means a written commitment to a program designed to provide students with a nonduplicative sequence of progressive achievements leading to degrees or certificates in a tech-prep education program provided by secondary schools and postsecondary educational institutions linked through credit transfer agreements. </text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HA2F1D403E0FA491689ECD5F7379DEEF9"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (5) (as so redesignated), by inserting <quote>to students (and parents, as appropriate)</quote> after <quote>providing access</quote>; </text></paragraph>

<section id="H96B3700CA1924CA2A5A2F9865DED9F87"><enum>4.</enum><header>Transition provisions</header><text display-inline="no-display-inline">Section 4 (<external-xref legal-doc="usc" parsable-cite="usc/20/2303">20 U.S.C. 2303</external-xref>) is amended—</text> 
<paragraph id="H813987AA8FAC4FD485819865C54844C3"><enum>(1)</enum><text>by striking <quote>Applied Technology</quote> and inserting <quote>Technical</quote>; and</text></paragraph> 
<paragraph id="H212ADACD29FA4F7697308EE90300ECC"><enum>(2)</enum><text>by striking <quote>the Carl D. Perkins Vocational and Applied Technology Education Amendments of 1998</quote> and inserting <quote>the Vocational and Technical Education for the Future Act</quote>. </text></paragraph></section> 
<section id="HA777658D3E6F4C2A831F640086FF6B54"><enum>5.</enum><header>Authorization of Appropriations</header><text display-inline="no-display-inline">Section 8 (<external-xref legal-doc="usc" parsable-cite="usc/20/2307">20 U.S.C. 2307</external-xref>) is amended by striking <quote>, and title II) such sums</quote> and all that follows and inserting <quote>) $1,307,000,000 for fiscal year 2005 and such sums as may be necessary for each of fiscal years 2006 through 2010.</quote>.</text></section> 
<section id="H08E6AB97B99446C588A04BF068C8DBF1"><enum>6.</enum><header>Prohibitions</header><text display-inline="no-display-inline">The Carl D. Perkins Vocational and Technical Education Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301 et seq.</external-xref>) is amended by adding after section 8 the following new section:</text> 
<quoted-block style="OLC" id="HD3666708425444988C73599CB5C8E209" display-inline="no-display-inline"> 
<section id="H593F921721134956A9A46EE41FF4982B"><enum>9.</enum><header>Prohibitions</header> 
<subsection id="H381C87C4C7654C8EB73ED7187DB96B9"><enum>(a)</enum><header>Local Control</header><text>Nothing in this Act shall be construed to authorize an officer or employee of the Federal government to mandate, direct, or control a State, local educational agency, or school’s curriculum, program of instruction, or allocation of State or local resources, or mandate a State or any subdivision thereof to spend any funds or incur any costs not paid for under this Act.</text></subsection> 
<subsection id="H811648FB230E4209B1005CA0AFA69749"><enum>(b)</enum><header>No preclusion of other assistance</header><text>Any State that declines to submit an application to the Secretary for assistance under this Act shall not be precluded from applying for assistance under any other program administered by the Secretary.</text> </subsection> 
<subsection id="HA894CD84A96D464BB7956E58F51D3F63"><enum>(c)</enum><header>Prohibition on Requiring Federal Approval or Certification of Standards</header><text></text> 
<paragraph id="H5C372D51E0F24F389EE74BE69D290387"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of Federal law, no State shall be required to have academic content or student academic achievement standards approved or certified by the Federal government, in order to receive assistance under this Act. </text></paragraph> 
<paragraph id="H3F217A38CA304BE5B976593408898523"><enum>(2)</enum><header>Rule of Construction</header><text>Nothing in this subsection shall be construed to affect requirements under section 113.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H449BCCC0D5E24FBCBC4E94F127C5B1FF"><enum>7.</enum><header>Allotment and Allocation to States</header> 
<subsection id="H5FFF9FD36FF4474690DDC5D303623174"><enum>(a)</enum><header>Allotment for national activities for 2005</header><text>Section 111(a)(C) is amended to read as follows:</text> 
<quoted-block style="OLC" id="H72D4475079704478AFD900B4F987C49E" display-inline="no-display-inline"> 
<subparagraph id="H10CC18FAA2F14862AF797501CFE07EDA"><enum>(C)</enum><text>0.54 percent to carry out section 114(d).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF1C0525AF81C4A8E96D220B4490031D7"><enum>(b)</enum><header>Technical amendments</header><text>Section 111(a)(3) (<external-xref legal-doc="usc" parsable-cite="usc/20/2321">20 U.S.C. 2321(a)(3)</external-xref>) is amended by striking <quote>(or in the case of fiscal year 1999</quote> and all that follows through <quote>Applied Amendments of 1998)</quote> each place it appears.</text></subsection> 
<subsection id="H3AE415F033EF41CA99949D56727D49AF"><enum>(c)</enum><header>Within State Allocation</header><text>Section 112 (<external-xref legal-doc="usc" parsable-cite="usc/20/2322">20 U.S.C. 2322</external-xref>) is amended—</text>

<paragraph id="HD6A8F4543B9F44FABDAB66BCD3CAAF3"><enum>(2)</enum><header>Special rule</header><text display-inline="yes-display-inline">Each eligible agency shall distribute grant funds described in paragraph (1) to eligible recipients for activities described in subparagraph (D) of such paragraph in an amount at least equal to the amount allotted to the eligible agency for fiscal year 2004 under section 203 of this Act as such section was in effect on the day before the date of enactment of the Vocational and Technical Education for the Future Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>

<subsection id="H0A502DA9E71A4CB0BF2F16A9B80663E"><enum>(a)</enum><header>Purpose</header><text>Section 113(a) (<external-xref legal-doc="usc" parsable-cite="usc/20/2323">20 U.S.C. 2323(a)</external-xref>) is amended—</text> 
<paragraph id="HE3647A106E1045749FCE4936181028A9"> <enum>(1)</enum><text>by striking <quote>establish a State</quote> and inserting <quote>support a State and local</quote>; and</text></paragraph> 
<paragraph id="H83EA35F08A544DFAA351B1573EDA97D6"><enum>(2)</enum><text>by inserting <quote>and its eligible recipients</quote> after <quote>effectiveness of the State</quote>.</text></paragraph> </subsection> 
<subsection id="H31F1CF82279545B2B16F71A4B88E4269"><enum>(b)</enum><header>State performance measures</header><text display-inline="yes-display-inline">Section 113(b) (<external-xref legal-doc="usc" parsable-cite="usc/20/2323">20 U.S.C. 2323(b)</external-xref>) is amended—</text>

<subparagraph id="H2A1DF4C6016E4539B500F66405D61DBF"><enum>(B)</enum><header>Core indicators of performance for postsecondary students</header><text display-inline="yes-display-inline">Each eligible agency shall identify in the State plan core indicators of performance of postsecondary students that include, at a minimum, measures of each of the following:</text> 
<clause id="HD48F6980ABAA4A3796004E9DBB59F618"><enum>(i)</enum><text>Student attainment of challenging academic and vocational and technical skill proficiencies.</text></clause> 
<clause id="HD07F97F40CC24F619DE28182866DAF4C"><enum>(ii)</enum><text>Student attainment of a postsecondary degree or credential. </text></clause> 
<clause id="H65519899B5D449FD8075008B1B8182D4"><enum>(iii)</enum><text>Placement in, retention in, and completion of, postsecondary education or advanced training, placement in military service, or placement or retention in employment. </text></clause> 
<clause id="H39636F116F4B48549EDE15B08E308273"><enum>(iv)</enum><text>Student participation in and completion of vocational and technical education programs in nontraditional fields.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H71991E03F1754ED0874DD655FE06E7C"><enum>(D)</enum><text>in subparagraph (D) (as so redesignated) by inserting <quote>vocational and technical education</quote> after <quote>has developed State</quote>; and </text></subparagraph></paragraph> 
<paragraph id="HADA8784155E84046BCD94C30772BA63D"><enum>(2)</enum><text>in paragraph (3)—</text>

<clause id="H05FF843951994B5B97A6E92FE0738883"><enum>(i)</enum><header>In general</header><text>Each eligible recipient shall establish in the local plan submitted under section 134, levels of performance for each of the core indicators of performance described in paragraphs (2)(A) and (B) for vocational and technical education activities authorized under this title. The levels of performance established under this subparagraph shall, at a minimum—</text> 
<subclause id="H95289833AB5E4A1DB7E7BF359C6C2832"><enum>(I)</enum><text>be expressed in a percentage or numerical form, so as to be objective, quantifiable, and measurable; and</text></subclause> 
<subclause id="HDA80DACAB9EF40F6812F737029F7CB54"><enum>(II)</enum><text>require the eligible recipient to make continuous and substantial improvement in the academic and vocational and technical achievement of vocational and technical education students.</text></subclause></clause> 
<clause id="HC0B7B3A74A234CE0ADFB8BF33FBBE200"><enum>(ii)</enum><header>Identification in the local plan</header><text>Each eligible recipient shall identify, in the local plan submitted under section 134, levels of performance for each of the core indicators of performance for the first 2 program years covered by the local plan.</text></clause> 
<clause id="H5A5D2E1451574DB38DE432006C9D78C7"><enum>(iii)</enum><header>Agreement on local adjusted levels of performance for the first 2 years</header><text>The eligible agency and each eligible recipient shall reach agreement on the levels of performance for each of the core indicators of performance, for the first 2 program years covered by the local plan, taking into account the levels identified in the local plan under clause (ii) and the factors described in clause (v). The levels of performance agreed to under this clause shall be considered to be the local adjusted level of performance for the eligible recipient for such years and shall be incorporated into the local plan prior to the approval of such plan.</text></clause> 
<clause id="H789C57594647400194FE443C004467F"><enum>(iv)</enum><header>Agreement on local adjusted levels of performance for 3rd, 4th, 5th, and 6th years</header><text>Prior to the third program year covered by the local plan, the eligible agency and each eligible recipient shall reach agreement on the local adjusted levels of performance for each of the core indicators of performance for the third, fourth, fifth, and sixth program years covered by the local plan, taking into account the factors described in clause (v). The local adjusted levels of performance agreed to under this clause shall be considered to be the local adjusted levels of performance for the eligible recipient for such years and shall be incorporated into the local plan.</text></clause> 
<clause id="H779237E851F842D796DE295D5BA053E5"><enum>(v)</enum><header>Factors</header><text>The agreement described in clause (iii) or (iv) shall take into account—</text> 
<subclause id="HF31A1598D4ED4FA393FDC1C108F3C0A7"><enum>(I)</enum><text>how the levels of performance involved compare with the local adjusted levels of performance established for other eligible recipients taking into account factors including the characteristics of participants when the participants entered the program and the services or instruction to be provided; and</text></subclause> 
<subclause id="HED4F7A8D8C0044FCB8A4DED42E8DDB58"><enum>(II)</enum><text>the extent to which such levels of performance promote continuous improvement on the indicators of performance by such eligible recipient.</text></subclause></clause> 
<clause id="H314F48F3FF7C4CE8966C9402D1D6EEA7"><enum>(vi)</enum><header>Revisions</header><text>If unanticipated circumstances arise with respect to an eligible recipient resulting in a significant change in the factors described in clause (v)(II), the eligible recipient may request that the local adjusted levels of performance agreed to under clause (iii) or (iv) be revised. The eligible agency shall issue objective criteria and methods for making such revisions.</text></clause></subparagraph> 
<subparagraph id="HFA75ED51FDB44073B6A229F6DF011239"><enum>(B)</enum><header>Levels of performance for additional indicators</header><text>Each eligible recipient may identify in the local plan, local levels of performance for any additional indicators of performance. Such levels shall be considered to be the local levels of performance for purposes of this title.</text></subparagraph> 
<subparagraph id="H32C6F99199214E54AC27B200F818BAF4"><enum>(C)</enum><header>Report</header><text>Each eligible recipient shall publicly report, on an annual basis, its progress in achieving its levels of performance on the core indicators of performance.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HF4C868C64C924DCD8100DACB157E4BE5"><enum>9.</enum><header>National Activities</header> 
<subsection id="HBF9F3898312D4D43BC68F41541B8E103"><enum>(a)</enum><header>Program performance information</header><text display-inline="yes-display-inline">Section 114(a)(3) (<external-xref legal-doc="usc" parsable-cite="usc/20/2324">20 U.S.C. 2324(a)(3)</external-xref>) is amended by inserting <quote>in the aggregate</quote> after <quote>international comparisons</quote>. </text></subsection> 
<subsection id="H840FF40893304A808B1BE30561CB738F"><enum>(b)</enum><header>Evaluation and assessment</header><text>Section 114(c) (<external-xref legal-doc="usc" parsable-cite="usc/20/2324">20 U.S.C. 2324(c)</external-xref>) is amended—</text>

The advisory panel shall transmit to the Secretary and to Congress an independent analysis of the findings and recommendations resulting from such assessment. The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the panel established under this subsection.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<paragraph id="H4DAFB44136BC4B1EA33B1738A1F7004D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">From funds reserved under section 111(a)(1)(C), the Secretary may award grants to eligible agencies for exemplary performance in carrying out programs under this Act. Such awards shall be based on an eligible agency exceeding challenging performance measures established under section 113(b) that reflect sustained or significant improvement.</text></paragraph> 
<paragraph id="H8E5D7D5A180046F08D784DE9CF6D04A4"><enum>(2)</enum><header>Special consideration</header><text>In awarding these grants, the Secretary may consider—</text> 
<subparagraph id="H057333D7B8BC47598B90CC309471E252"><enum>(A)</enum><text>an eligible agency effectively developing connections between secondary education and postsecondary education and training; and</text></subparagraph> 
<subparagraph id="HF11B20D4C53F485FB7EBB7D001F60C7"><enum>(B)</enum><text>an agency’s adoption and integration of rigorous and challenging academic and technical coursework.</text></subparagraph></paragraph> 
<paragraph id="H1C9DB957E24942008654A22CB26F86A4"><enum>(3)</enum><header>Use of funds</header><text>The funds awarded to an eligible agency under this subsection may be used to carry out any activities authorized under section 124, including demonstrations of innovative programs.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<paragraph id="HC594CB6976CA497DAA73D6401D230000"><enum>(2)</enum><text>consultation with the Governor and appropriate agencies, groups, and individuals including parents, students, teachers, representatives of businesses, labor organizations, eligible recipients, State and local officials, and local program administrators, involved in the planning, administration, evaluation, and coordination of programs funded under this title; </text></paragraph> 
<paragraph id="H79F412C2E27B404E9680F94715E4F9C"><enum>(3)</enum><text>convening and meeting as an eligible agency (consistent with State law and procedure for the conduct of such meetings) at such time as the eligible agency determines necessary to carry out the eligible agency’s responsibilities under this title, but not less than four times annually; and </text></paragraph> 
<paragraph id="H9DBC94D4E9C84400AE8D5C459D11DA3"><enum>(4)</enum><text>the adoption of such procedures as the eligible agency considers necessary to—</text>

<subparagraph id="HE2C6597AA73A417EB104079C98DB20E9"><enum>(B)</enum><text>make available to the service delivery system under section 121 of <external-xref legal-doc="public-law" parsable-cite="pl/105/220">Public Law 105–220</external-xref> within the State a listing of all school dropout, postsecondary, and adult programs assisted under this title.</text></subparagraph></paragraph></subsection> 
<subsection id="H5954BE377CF74B54BF72938703BE0797"><enum>(b)</enum><header>Exception</header><text>Except with respect to the responsibilities set forth in subsection (a), the eligible agency may delegate any of the other responsibilities of the eligible agency that involve the administration, operation, supervision of activities assisted under this title, in whole or in part, to one or more appropriate State agencies.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>

<subparagraph id="HEA1E13BC5CD14B72A9F240635B66FF86"><enum>(H)</enum><text>how funds will be used effectively to link secondary and postsecondary academic and vocational and technical education in a manner that increases student academic and vocational and technical achievement.</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="H421F0CD9BA95456A83FF45D2D9DC38C2"><enum>(B)</enum><text>by amending paragraph (2) to read as follows:</text>

<paragraph id="HFE9476B346F44D7DB1A09796A0092340"><enum>(1)</enum><header>Plan</header><text>If a State fails to meet the State adjusted levels of performance described in the report submitted under section 113(c), the eligible agency shall develop and implement a program improvement plan in consultation with the appropriate agencies, individuals, and organizations for the first program year succeeding the program year in which the eligible agency failed to meet the State adjusted levels of performance, in order to avoid a sanction under paragraph (3). </text></paragraph> 
<paragraph id="H005145E90B14460280C1CE0F8EB0764"><enum>(2)</enum><header>Technical Assistance</header><text>If the Secretary determines that an eligible agency is not properly implementing the eligible agency’s responsibilities under section 122, or is not making substantial progress in meeting the purpose of this Act, based on the State’s adjusted levels of performance, the Secretary shall work with the eligible agency to implement improvement activities consistent with the requirements of this Act. </text></paragraph> 
<paragraph id="H92CB0CEFDAC5401CA6D8626C4067A3CB"><enum>(3)</enum><header>Failure</header> 
<subparagraph id="HF88C01B296D345E086C34017A469AD19"><enum>(A)</enum><header>In general</header><text>If an eligible agency fails to meet the State adjusted levels of performance, has not implemented an improvement plan as described in paragraph (1), has shown no improvement within 1 year after implementing an improvement plan as described in paragraph (1), or has failed to meet the State adjusted levels of performance for 2 or more consecutive years, the Secretary may, after notice and opportunity for a hearing, withhold from the eligible agency all, or a portion of, the eligible agency’s allotment under this title. </text></subparagraph> 
<subparagraph id="H8F4A5250DE754A32B0DAFF52C9CF7D4E"><enum>(B)</enum><header>Waiver for exceptional circumstances</header><text>The Secretary may waive the sanction in subparagraph (A) due to exceptional or uncontrollable circumstances such as a natural disaster or a precipitous and unforeseen decline in the financial resources of the State. </text></subparagraph></paragraph> 
<paragraph id="HC3C7C31D95884C3C003C30DEB88199C1"><enum>(4)</enum><header>Funds Resulting from Reduced Allotments</header> 
<subparagraph id="H1D2B846D2AA74390B2B7C71D9CBB09A3"><enum>(A)</enum><header>In general</header><text>The Secretary shall use funds withheld under paragraph (3) for a State served by an eligible agency, to provide (through alternative arrangements) services and activities within the State to meet the purposes of this Act. </text></subparagraph> 
<subparagraph id="H4AE5E0C2214D4A64A600F8FC34D22300"><enum>(B)</enum><header>Redistribution</header><text>If the Secretary cannot satisfactorily use funds withheld under paragraph (3), then the amount of funds retained by the Secretary as a result of a reduction in an allotment made under paragraph (3) shall be redistributed to other eligible agencies in accordance with section 111. </text></subparagraph></paragraph></subsection> 
<subsection id="HCFCA2F4BF3DD4924A13D001CC63263EA"><enum>(b)</enum><header>Local Program Improvement</header> 
<paragraph id="HF4627F2908874803A0EFDA2441E41248"><enum>(1)</enum><header>Local Evaluation</header><text>Each eligible agency shall evaluate annually, using the local adjusted levels of performance described in section 113(b)(4), the vocational and technical education activities of each eligible recipient receiving funds under this title. </text></paragraph> 
<paragraph id="H0DFF10C9A50643B6A08F6F4844C3FFA"><enum>(2)</enum><header>Plan</header> 
<subparagraph id="HD8C2376B8A8A45F68453335886EB2802"><enum>(A)</enum><header>In general</header><text>If, after reviewing the evaluation, the eligible agency determines that an eligible recipient is not making substantial progress in achieving the local adjusted levels of performance, the eligible agency shall—</text> 
<clause id="HE973320425454327ABE500AD718C269"><enum>(i)</enum><text>conduct an assessment of the educational needs that the eligible recipient shall address to overcome local performance deficiencies; </text></clause> 
<clause id="H9437F94FE5C7483DA84200F28B62A1B1"><enum>(ii)</enum><text>enter into an improvement plan agreement with an eligible recipient based on the results of the assessment, for the first program year succeeding the program year in which the eligible recipient failed to meet the local adjusted levels of performance, which plan shall demonstrate how the local performance deficiencies will be corrected and include instructional and other programmatic innovations of demonstrated effectiveness, and where necessary, strategies for appropriate staffing and professional development; and </text></clause> 
<clause id="HA5FE91BF64934E6FA371DF14FE59A22B"><enum>(iii)</enum><text>conduct regular evaluations of the progress being made toward reaching the local adjusted levels of performance as described in section 113(b)(4) and progress on the improvement plan itself. </text></clause></subparagraph> 
<subparagraph id="H6EF84164D1AA4E5EB53FE3C146FBA0FC"><enum>(B)</enum><header>Consultation</header><text>The eligible agency shall conduct the activities described in paragraph (2) in consultation with teachers, parents, other school staff, appropriate agencies, and other appropriate individuals and organizations. </text></subparagraph></paragraph> 
<paragraph id="H4D7F6F1EEB3C4B2590857642865983C1"><enum>(3)</enum><header>Technical Assistance</header><text>If the eligible agency determines that an eligible recipient is not properly implementing the eligible recipient’s responsibilities under section 134, or is not making substantial progress in meeting the purpose of this Act, based on the local adjusted levels of performance, the eligible agency shall provide technical assistance to the eligible recipient to assist such recipient in carrying out the improvement activities consistent with the requirements of this Act. </text></paragraph> 
<paragraph id="HF3508E212EE34E2700BE9B15D7C51665"><enum>(4)</enum><header>Failure</header> 
<subparagraph id="H84B7913B3BDD4DCEBDBD9B631F18FD2"><enum>(A)</enum><header>In general</header><text>If an eligible recipient fails to meet the local adjusted levels of performance as described in section 113(b)(4), has not implemented an improvement plan as described in paragraph (2), has shown no improvement within 1 year after implementing an improvement plan as described in paragraph (2), or has failed to meet the local adjusted levels of performance for 2 or more consecutive years, the eligible agency may, after notice and opportunity for a hearing, withhold from the eligible recipient all, or a portion of, the eligible recipient’s allotment under this title. </text></subparagraph>

<subclause id="HC4DEB0E1575B4150AAE4ACDC9FE5BD00" display-inline="yes-display-inline"><enum>(I)</enum><text>a nonprofit institution of higher education that offers—</text> 
<item id="H540335587D24461CAAB635E7E7B7EE64" indent="up1"><enum>(aa)</enum><text display-inline="yes-display-inline">a 2 or 4-year degree program, or a 2-year certificate program, and is qualified as institutions of higher education pursuant to section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>) (except those institutions described in section 102(a)(1)(C) of such Act), including an institution receiving assistance under the Tribally Controlled College or University Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/25/1801">25 U.S.C. 1801 et seq.</external-xref>) and a tribally controlled postsecondary vocational and technical institution; or </text></item> 
<item id="H6C3D24E47DAB4EEA81B975E4665577B5" indent="up1"><enum>(bb)</enum><text>a 2-year apprenticeship program that follows secondary instruction, if such nonprofit institution of higher education is not prohibited from receiving assistance under part B of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1071">20 U.S.C. 1071 et seq.</external-xref>) pursuant to the provisions of section 435(a)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1083">20 U.S.C. 1083(a)</external-xref>); or </text></item></subclause> 
<subclause id="HD6D922C1CE584427BB897C2C70A7AD9E"><enum>(II)</enum><text>a proprietary institution of higher education that offers a 2-year associate degree program and is qualified as an institution of higher education pursuant to section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>), if such proprietary institution of higher education is not subject to a default management plan required by the Secretary,<italic></italic></text></subclause><continuation-text continuation-text-level="clause">and may include employers and labor organizations;</continuation-text></clause> </subparagraph> 
<subparagraph id="H06674E9D78F64FE1A9BA53B61B34FAC3"><enum>(B)</enum><text>consist of a minimum of 2 years of secondary school preceding graduation and a minimum of 2 years of higher education, or an apprenticeship program of at least 2 years following secondary instruction; </text></subparagraph> 
<subparagraph id="H004EB126BD6E4286A160D021712C6532"><enum>(C)</enum><text>meet academic standards developed by the State, including standards developed under section 1111 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311</external-xref>) for secondary students, and support proficiency in mathematics, science, reading, writing, communications, and technologies;</text></subparagraph> 
<subparagraph id="HBA130D6F9DD74358918B787FC588273C"><enum>(D)</enum><text>are comprised of model sequences of courses that integrate rigorous and challenging academics and vocational and technical education;</text></subparagraph> 
<subparagraph id="HF0B23A4271334450B7A8AB00D39FA200"><enum>(E)</enum><text>provide technical preparation in a career field such as engineering technology, applied science, a mechanical, industrial, or practical art or trade, agriculture, health occupations, business, or applied economics;</text></subparagraph> 
<subparagraph id="H735E65D013D84A618547174EE520D1E9"><enum>(F)</enum><text>that use, if appropriate and available, work-based or worksite learning in conjunction with academic and vocational and technical education;</text></subparagraph> 
<subparagraph id="H98B2C177ED1644C9B5652F0013D9D6F7"><enum>(G)</enum><text>that use educational technology and distance learning, as appropriate, to involve all the consortium partners more fully in the development and operation of programs; and</text></subparagraph> 
<subparagraph id="HEEE158B5B9784FA7A1D05D68BF773D42"><enum>(H)</enum><text>that facilitate and promote close working relationships among eligible recipients to ensure that programs within a geographic area are closely integrated with Tech-Prep program activities.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H634BDACB74CE4EEBA0673C4FC576E3AD"><enum>(D)</enum><text>in paragraph (5) (as so redesignated)—</text> 
<clause id="H5445ED68C492404E93E3E4891751B3E3"><enum>(i)</enum><text>by inserting <quote>, and the related math and science education,</quote> after <quote>use of technology in vocational and technical education</quote>;</text></clause>

<subsection id="HC5A827259C324BC6A919EBC4BE1EC100"><enum>(a)</enum><header>Fiscal Requirements</header><text>Section 311(b) (<external-xref legal-doc="usc" parsable-cite="usc/20/2391">20 U.S.C. 2391(b)</external-xref>) is amended—</text> 
<paragraph id="H3C2A53B36DFE4181B67C7BE7D6AC9819"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="H79808EF5105F44E3A9F9E1FF12B24D86"><enum>(A)</enum><text>by amending subparagraph (A) to read as follows:</text>
